In our 2016-17 inquiry, we approached this question from the point of view that serving and ex-service personnel were being dragged into court—because we were worried not that guilty service personnel might be found guilty, but that innocent service personnel would be found innocent only after they had gone through a horrendous process of trial, investigation, reinvestigation, and on and on. There are numerous cases of perfectly blameless personnel who, as a result of vexatious litigation, have found themselves being investigated over and over again. We have heard much about the trauma of the victim’s family, and I empathise with that totally—not least because of what I said about my family history—but we have not heard enough about the trauma of innocent service personnel and security forces who were being investigated over and over again. [Interruption.] I am delighted to hear murmurings of support from my hon. Friend the Member for Plymouth, Moor View (Johnny Mercer), who knows more about this than most.
It is not just about those who were dragged through the courts; it is about those who have been at home for years and years afterwards—I first served in 1976—worrying about whether a letter would come through the box. It is about the fear felt by innocent people as well as those who are being dragged through.
That is absolutely right. It is all about protecting innocent service personnel from the vexatious use of the legal process. As I said in my intervention on the Secretary of State, it is not the punishment, but the process; indeed, the process is the punishment.
In the Defence Committee’s inquiry, we were fortunate to discuss with four eminent professors the applicability of the statute of limitations. Of course, I do not attribute my views to any of them, but I record the then Committee’s gratitude to Professor Sands, Professor Rowe, Professor McEvoy and Professor Ekins. They made it very clear that any statute of limitations had to apply to everybody or to nobody; there could be no legislating for state impunity.
The professors also made it clear that international law required not a prosecution, but an adequate investigation, and that that requirement could be met by a truth recovery process. The one concession that I make to those who have been criticising the Bill is that the Government need to be absolutely sure that the truth recovery process that they propose will stand up to that test in international law.

Commons ChamberI cannot comment on that particular case since it is now sub judice, but cases of that sort fall squarely within the situation that I am describing. As my right hon. and gallant Friend the Member for East Devon (Sir Hugo Swire) said, it is the process of pursuit, proceedings and trial, rather than the actual derisory sentence at the end of it, that amounts to cruel, unusual and almost certainly unjustified punishment that is inflicted so long after the event.
Nobody is suggesting that crimes that would be called war crimes, if this were an international rather than a civil conflict, should be excused and that people should be put above the law; but the provisions of international law can be met by combining a truth recovery process with a statute of limitations. If people who had committed heinous crimes years and years ago were, at the end of the process, going to serve a proportionate sentence, one could perhaps make out an argument that the matter should be allowed to proceed to the end of time. However, given the way in which terrorists, on the one hand, and armed forces personnel and security forces, on the other, have all been swept up into the concept of the Northern Ireland (Sentences) Act, meaning that they will serve, at most, a derisory sentence if eventually convicted—which most of them will not be—the way to proceed is the Nelson Mandela solution.
As my right hon. Friend the Member for Sevenoaks (Sir Michael Fallon) said, his amendments are not perfect, and there will be concerns, but when is the right time for us to defend our veterans? When is the right time for those in this House to speak out and say, “Enough is enough”?
I have to declare an interest. It was not 30 or 40 years ago that I got on the troop ship from Liverpool across to Belfast docks. It was 42 years ago that I and the 1st Battalion Grenadier Guards went across to Northern Ireland. I was petrified, like most young people were when they went into the armed forces and into combat. I was not going abroad—we were not going to Afghanistan, Iraq, Aden, Borneo or Malaya. I was going to another part of the United Kingdom to protect a community from terrorism. It was a policing role. I have never quite understood why we issued the general service medal for those who went to Northern Ireland, because it was part of the United Kingdom. It was not an operation, as we have heard. We were not on ops; we were assisting the RUC to protect the community. Sometimes that community turned on us, and we lost a lot of good friends and soldiers. Some we have never found. I have spoken in the House before about my captain, Captain Robert Nairac, whose bravery everybody should understand.
We are not here this evening to just accept what the Secretary of State has said and give it carte blanche. The Secretary of State has no idea what I am going to say, and other colleagues are waiting to argue for these amendments as well, but the Secretary of State and the Opposition Front Benchers have already made their mind up, before hearing from gallant colleagues who have served and colleagues who have never served but have constituents who are under threat day in, day out of a knock at the door or a letter. Perhaps that letter will come to me; perhaps I am one of those people. I am probably one of the older ones who served back then. I went in 1976, and the forces that were out there—some were volunteers for the Ulster Defence Regiment, which my hon. and gallant Friend the Member for Strangford (Jim Shannon) was serving in—were doing a fantastic job. The RUC was doing a fantastic job. At one stage, we had 10,000 soldiers putting their lives on the line in the Province to keep people safe.

Commons ChamberNaturally, there is an ongoing police inquiry, but I am sure that Members across the whole House will want to register that their thoughts are with Corrie’s family, loved ones and his service colleagues from the RAF Regiment who I had the honour of meeting at RAF Honington just after he went missing. On a daily basis, I have ensured that all available military kit, personnel and surveillance equipment are available should the police request them, and they have requested them on several occasions. I thank the hon. Gentleman for paying tribute to my Parliamentary Private Secretary, who has done diligent work in Bury St Edmunds to ensure that the local community knows what is going on. We all want Corrie to come home safely, and the MOD will do all we possibly can.
Following the revelation of a very rare failure of a Trident missile test, will the Secretary of State confirm that our nuclear deterrent still meets what might be termed the Federer criterion of being able to deliver lethal projectiles at high velocity, in rapid succession and with total accuracy over a very long period of years?

Commons ChamberThe strategic defence and security review 2015 committed us to a more adaptive force to meet the range of future threats. This means having the best mix of Challenger 2 tanks and the new Ajax multi-purpose armoured vehicles to deliver the Army’s contribution to future threats. We are planning to spend £700 million to extend the Challenger 2 capability out to 2035.
I thank the Minister for that answer. While we should warmly welcome the very large order for Ajax fighting vehicles, does he accept that these will be no match for the armour and the armament of enemy main battle tanks? Will he therefore confirm how many of our existing 227 tanks will go forward to the Challenger 2 life extension programme, bearing in mind the need to have capacity for regeneration in the event of a crisis?
My right hon. Friend is the Chair of the Defence Committee and has taken a keen interest in defence matters for so many years. He knows very well that it is for the military to decide exactly what the capabilities are, but having £700 million available for Challenger 2 going forward to 2035 shows a clear commitment to Challenger.

Commons ChamberI completely agree with my hon. Friend, and I know lots of colleagues from across the House will be standing up today and asking whether, as part of the review, there could be extra money for their constituencies. I fully understand that, but I also need the House to understand that policing in many parts of the country has fundamentally changed over the years. The demands and needs are now completely different from before, particularly in rural forces. As I suggested in response to the intervention from my right hon. Friend the Member for North West Hampshire (Sir George Young), we must put the arguments together into the consultation, which will be taking place across the summer, so that, although I am not sure everybody will be happy, the 2016-17 formula will be much fairer than the current system.
It is encouraging that the review of the formula will bear in mind the need to ensure that more efficient police forces, such as those in Hampshire, are not penalised for their efficiency. What does my right hon. Friend think about the recent survey carried out in Hampshire which showed that more than 70% of respondents would be willing to pay more and see an increase in the council tax precept to 1.99% because they value the services they get from the constabulary?
When we introduced PCCs, who are elected by the local people, we gave them the ability to make local decisions. Where PCCs have decided to raise the precept to a level below the need for a referendum, I fully understand and respect that. There is at least one force area at the moment—Bedfordshire—where the PCC is looking to go beyond that, so there will be a referendum there. If it goes ahead, it will be held on the general election date.
I do not want to talk only about Hampshire—although a couple of colleagues from Hampshire have intervened so far, and it was a pleasure to be in Hampshire only the other day—as I want now to touch a little more on the changes that have been taking place within the police in England and Wales.

Commons ChamberIt is an honour and a privilege to respond on behalf of the Government this evening to this very important Adjournment debate. I congratulate my hon. Friend the Member for Dover (Charlie Elphicke) not only on securing the debate but on getting colleagues to come in on a Thursday evening and support him.
I apologise because I am probably not the lead Minister who would normally deal with this debate, but it is important that my Department—I sit in two Departments—which has responsibility for part of the work that needs to be done to address this important issue is represented at the Dispatch Box. The cross-governmental responsibilities here include the Department for Education, the Ministry of Justice, the Department for Culture, Media and Sport, the Home Office and the Cabinet Office to name a few. There are probably other Departments that feel they have responsibilities, not least given the Prime Minister’s interest in recent years.
An Adjournment debate this evening will not allow the issue to have the time it deserves. Far be it from me to suggest what the Backbench Business Committee should and should not do, but this is a very important debate that needs more air time than an Adjournment debate in the House can give.
It is also my belief, and that of the Government, that there is no difference in law between what one does online and what one does in public: what one does face to face is identical within law to what is done online. My hon. Friend quoted at least three Acts. My officials think that five Acts may be in place to help with the issue: the Protection from Harassment Act 1997, the Criminal Justice and Public Order Act 1994, the Malicious Communications Act 1998, the Communications Act 2003 and the Defamation Act 2013. They all apply to online trolls.
Perhaps I can address early on some of the specific points that my hon. Friend raised, particularly education. Education is very important. Since September 2014, not so long ago, e-safety has to be taught at all four key stages within the curriculum at our schools. It is massively important that young people have the education and knowledge that they need reinforced at every key stage going forward so that while they use the wonderful new media as much as possible, they understand the problems and dangers of internet bullying.
As my hon. Friend suggested, there are no boundaries or borders in this type of abhorrent behaviour. The internet is a wonderful thing, but I know as Minister responsible for child protection how dangerous the internet is in particular to young, vulnerable people.
I was in Washington at the beginning of the week before last, where I attended the global alliance conference on child online protection, and it was very obvious where the problems occur. It is an international problem; that is the case not only with trolling, but also with some of the other abhorrent things we see on the internet these days. People are earning huge amounts of money out of other people’s grief and poverty, and just getting a kick, frankly, out of abusing people online.
May I therefore reiterate again that in law there is no difference between standing in front of someone and abusing them and doing it online? That is very important, and we have seen some significant cases coming before the courts recently to make sure everybody understands that.
Let me touch briefly on three points, and in particular the anonymous nature of trolls. It is an obvious thing to say that someone should have their anonymity removed—or should they not have it in the first place? In the international spectrum, however, I do not want people living in Syria to have their anonymity taken away. I want people around the world who are living under repression to have the ability to tell the rest of the world what is going on in their countries—what is happening to them, to their families, to their political parties—without fear that their identity will be known.
In saying that, the police do have a way of finding out very quickly where such a communication came from. I know that myself as, sadly, my bank account was hacked fairly recently, but the IP addresses were made available enormously quickly by my internet bank to the police and subsequently arrests have been made. They cannot hide, therefore: “If you abuse someone using the internet, no matter what technology you use, invariably you will be discovered, and if you break the law, you will be prosecuted.” What we must do, however, is ensure people have the confidence to come forward, not necessarily directly to the police every time because it can be very difficult for young people to do that, but to someone they trust within their school or family or community, to tell them what is going on so we can prosecute.
Is not the problem that this would be regarded by the police as a pretty low priority unless it had reached a level of great seriousness, and therefore is not the solution, as I suggested before, that the main companies must have easy ways of reporting abuse before it gets to that level and that they should be likely to block it irrespective of whether or not the person’s identity is known?
I thank my hon. Friend for his intervention, and he has touched on a point I was coming to in the next few minutes. On his first point, this sort of offence can now be heard in the High Court and it does carry a penalty of up to two years. That is relatively new, but that actually happens. Standing here not as a Justice Minister but as the police Minister from the Home Office, I can say that the police should, and will, deal with this in the same way as they would deal with an offence offline. That is vitally important, and perhaps a message from the Dispatch Box from the police Minister to the police on that point this evening will not go amiss.
This country leads the way in working with these big companies. While I was in Washington the American Administration said to me that we have a rapport and a relationship and get things done with the big companies in a way that they do not. We need to use that relationship, and of course in early December there will be a global conference here in London, headed by the Prime Minister, on online protection of children and these sorts of issues will be discussed.
Trolls need to know that they will be prosecuted and that the action that will be taken is international. I can assure my hon. Friend that I will have international meetings in this difficult area. I will also let the Ministers in all the different Government Departments know what I have said at the Dispatch Box today, and tell them that we are coming together as a Government to ensure that we do this in a departmental way and that the lead Department leads the process. I can assure my hon. Friend that we are doing something about this.

Commons ChamberWhen I woke this morning, I did not expect to be responding to such an excellent Adjournment debate on such an important subject as the Minister responsible for policing in the United Kingdom and with responsibilities in the Ministry of Justice for child protection—among other things, I believe, which we will see once the final list comes out.
I congratulate the hon. Member for Bridgend (Mrs Moon); may I call her my hon. Friend? We have dealt with many things together in the past and this is an appropriate opening debate for me, not least because of my previous ministerial duties at the Department for Work and Pensions as the Minister responsible for disabled people and, as she mentioned, my time on one blue-light facility as a fireman in the Essex county fire and rescue service. I was also a paramedic, when I was in the military, and a battlefield medic. When we are not on operations, the military look after the communities where they are and, sadly, I remember responding to all too many suicide attempts when I was in both the military and the fire service.
Sadly, as the police are on the front line, they often bear the brunt of what is going on, emotionally as well as in terms of their physical time. It is right and proper that as this is my first speech in this role, I should pay tribute to the work that all police do in this country. The hon. Lady has mentioned the British Transport police and the police in the devolved Administrations. I worked closely with the police in Northern Ireland when I was a Northern Ireland Minister, and there are also myriad other police services, such as the ports police, and the nature of ports means that they often sadly see a lot of suicides and attempted suicides.
When I was the Minister responsible for disabled people, one thing I did with the permission of the Prime Minister was start a joint ministerial forum for Ministers from all Departments. I nearly said that they were required to attend, but actually I cajoled them into doing so. For the first time in 40 years, since we first had a Minister responsible for disabled people, Ministers from all Departments came together not to pat ourselves on the back for what we had done for the disabled community but to see how we could improve things in the short and long term. It is spooky that one thing we were talking about at that forum was the whole question of mental health. The previous policing Minister, my right hon. Friend the Member for Ashford (Damian Green), discussed this very subject with me. We started to work very closely with the Health Minister with responsibilities in this particular area, who has been enormously helpful.
One thing we discussed extensively was not just what to do at the time of the incident, but how we could prevent people from getting to that position in the first place. My hon. Friend the Member for New Forest East (Dr Lewis) alluded to mental health issues in his constituency and I hope that we have all been to mental health facilities in our constituencies to see the excellent work they do. One of the biggest problems we have is ensuring that when someone is presenting, not to a police officer but to a health professional, the knowledge and skills are there to recognise that there is a mental health issue, not least at accident and emergency. I know from my own experience that people were presenting at A and E or being presented by the police, but there were not staff on hand with the skills to diagnose and understand those people’s conditions, which would involve either mental health or learning difficulties—another issue that often comes into play.
In my intervention, I did not make it clear enough that what happened in Hampshire appears to be happening in other parts of the country as well. We are going through one of those fashionable phases in which there has been a swing away from in-patient acute mental health beds, which is having an effect as the facilities are not available for the people in acute distress whom the police are discovering or with whom they have to deal.

It is a pleasure to be here, Mrs Brooke. I should like to get some facts on the record, not only for my hon. Friend the Member for Romsey and Southampton North (Caroline Nokes), but to give the Government’s side.
Like my hon. Friend, I am keen on competition, because I am a free marketeer as well. I am also keen, as a Minister, to consider in detail a request made by anybody anywhere in the United Kingdom. That is not what happened in 2008. The right hon. Member for South Shields (David Miliband) knows full well that when a request was submitted in 2008, it was dismissed quickly. I have not seen any legal advice instructing the Government that it would be illegal for them to look at the matter. Certainly, my legal advice, when Liverpool city council said that it would like to start turnaround, was not that I could not look at that. As a free marketeer, the Minister for the whole United Kingdom, and a Tory MP, here I am defending Liverpool. That is an interesting anomaly. Lord Heseltine would be proud of me.
It is clear that we were open and transparent all the way through; I will come back to how we achieved that. I met the operators of Southampton port—and Members from across the House—on more than one occasion to explain things exactly. In a democratic society that believes in a free market, any request should be looked at fairly by a Minister of the Crown. I looked at the request made by Liverpool city council, and I asked my officials what the procedures would be, what powers I had, and what powers were not in my hands. It was obvious that I had the power to look at the request, so we consulted widely, and got submissions from all parts of the House and across the country on what should happen. The key thing that I got back from the submissions was the point about fairness; that needs to be in whatever we do.
I looked at what I could do about the two separate payments made to Liverpool when it got the grants. First, I asked whether I or anyone in the UK had the power to ask for the regional development grant to be repaid. The answer was no; it is a Commission issue, for the Commission alone to deal with.
I will continue for the moment, because I am conscious of the time, and I want to cover many of the points made. If I have time at the end, I shall come back to my hon. Friend.
The issue is being looked at by the Commission, and it is for it to decide. What was in my power was the ability look at whether Liverpool had to pay back the full UK part of the grant, whether there was any depreciation because of the length of time, and whether interest would be added. My Department made an evaluation, and Liverpool asked to pay £5.3 million as a lump sum, which I rejected. The assumptions of my officials were that the amount should be about £8 million —we ended up with a figure of £8.8 million. To ensure that I was seen to be impartial, I asked for some independent advice on how much money should be repaid. My hon. Friend the Member for Romsey and Southampton North came up with the right amount, which was £8.8 million, or £12.6 million if phased. That is almost identical to the figures that the modelling came up with, after consideration of how other repayments were made.
I made that decision, and put it to Liverpool that it would have to pay those moneys back. As yet, Liverpool has not indicated how it will pay that—in stages, or in one lump sum. The assumption—that is all it is—is that it will be a one-stage payment. As yet, Liverpool has not indicated to the Department for Communities and Local Government how it will pay the money, or when it intends to do so. My officials have been in touch with DCLG officials, who have been in touch with the city council to push it on the need for a decision.
It is absolutely the case that state aid has not been cleared yet, but I do not have any power to stop Liverpool while we wait for the Commission to act. The key to the situation is that my officials and I as the Minister, independently and with no vested interests, have looked at what can be done. I believe that competition is good, and that competition around the country will drive up the excellent cruise market. I was at the European Cruise Council conference in Brussels only last week, and even after the terrible Costa Concordia disaster, the market has picked itself up and is moving forward again.
Will the hon. Lady bear with me for a second, because two other colleagues have tried to intervene as well? I have been given only 10 minutes to sum up the debate and, with so many people present, we could have done with a little longer.
The key for me is whether the effect on other ports and other incomes around the country will be dramatic. I have seen no evidence for that yet. At the European cruise conference, I spoke to the representative of a cruise operator that does not operate here at the moment, but will put 22 cruises in next year. I asked, “Would you be doing this at any other port in the UK?” The answer was no. I had to take that at face value. Will there be such a dramatic effect? I do not honestly think so. The Government have been genuine and honest about how much pain there should be, and Liverpool city council will have to step up to that and be as honest and open with us, and with its own electorate, as we were with it on what will have to be paid back and when. Also, should it have gone ahead without state aid approval? No, it should not have done.
With regard to the European money, are the Government in a position to make representations to the European Commission on the matter? If the Government think that the Commission is unlikely to ask for the money back, does that not suggest that the Commission acted in a distorting and anti-competitive way when making the money available in the first place?
My hon. Friend is leading me down a path that I am probably quite happy to be led down. I understand from my legal advice that the Commission has never asked for any such funding back in other, similar cases. Looking around Europe at subsidies, the Commission would probably rather not open such a Pandora’s box.
