We have increased the overall spending on early years and children’s services to £12.7 billion.

My local council, Rochdale Borough, predicts an overspend of £4.5 million this year on children’s services, with a predicted total overspend in England of £840 million, so will the Chief Secretary now admit that £84 million—just one tenth of the total overspend—goes nowhere near addressing this local and national crisis?

The £84 million is specifically to roll out pilots and projects that we know have worked to reduce demand on children’s services and make sure children get a better outcome, but at the Budget we also put in an extra £410 million, which councils can spend on either adult social care or children’s social care.

The Labour Government brought in Agenda for Change for NHS staff, which finally put us—I was one of those NHS staff—on a fair rate of pay with an independent pay review body, but since 2010 the coalition Government and the Tory Government have systematically undermined Agenda for Change pay rates by capping and freezing wages. The Government are all too ready to describe NHS workers as fantastic, but giving them a fair pay award is just that—fantasy. Is it not time that the Government put their money where their mouth is?

The hon. Lady is not acknowledging the fact that more than half of those people on Agenda for Change are receiving average incremental pay of 3.3%.

I congratulate the hon. Gentleman on his assiduousness in asking parliamentary questions, which have elicited an answer. If he reads the “Prison safety and reform” White Paper, he will see there is a whole section on how we deal with the issue of drugs: testing offenders on entry and exit, and making sure that governors are held accountable for getting people off drugs. That is the way we are going to crack this problem.

As my hon. Friend the Member for Leeds East (Richard Burgon), the shadow Secretary of State, has pointed out, this is the worst prison disturbance since the Strangeways riot of 1990. The Woolf report on that riot recommended that

“no establishment should hold more prisoners than is provided for in its certified normal level of accommodation”,

but it is reported that HMP Birmingham was overcrowded by almost a third last year. Have this Government learnt no lessons at all from the riots of 26 years ago?

I have discussed the issue the hon. Lady mentions with Lord Woolf. She is right that the disturbance at HMP Birmingham was very serious; that is why we are investing £1.3 billion in our prison build programme to create extra capacity and eliminate overcrowding in the prison estate.

12. What steps she is taking to protect judicial independence.

The independence of the judiciary is the cornerstone of the rule of law, vital to our constitution and freedoms. As Lord Chancellor I frequently make this clear, both in private and in public.

After the press attacks on the judiciary, it took the Justice Secretary nearly 48 hours to release a statement. The former Lord Chief Justice Lord Judge said of that statement that he thought it was

“a little too late—and quite a lot too little”.

Does she agree with Lord Judge, and if so will she take the opportunity to apologise?

It is not the job of the Government or the Lord Chancellor to police headlines. The process is working absolutely as it should. People have a right to bring a case to court. The Government have the right to defend our position in the court. The judiciary is independent and impartial, and the press can scrutinise the process within the law.

What we know is that no country that is not a full member of the EU has full access to the agricultural market. Whether it is Norway, Canada or any other of the countries whose models the out campaign have talked about, none of them has full access without quotas or tariffs. I have given the example of beef, with a cost of £240 million a year. The sheep industry would be even harder hit because 40% of all the sheep that we produce here in the UK are exported to the EU.

The Government are taking action to help farmers to manage low prices and market volatility, which is why we have ensured that all eligible farmers have now been paid their full basic payment or a bridging payment for 2015. To help farmers in the future, we have extended the period of tax-averaging from two to five years, and this month I am convening farmers, food producers and the European Investment Bank to seek further investment in improved productivity and processing capacity.

I thank the Secretary of State for her response. Can she confirm that any grant money from the EU solidarity fund will be additional money to be spent in the communities that have been affected by floods, and that it will not be swallowed up by the Treasury as payback for money already spent?

I can confirm that that is additional money that is being applied for through my colleague, the Secretary of State for Communities and Local Government.

I was pleased to meet my hon. Friend and representatives of the local internal drainage boards to discuss flooding in his constituency, and I am pleased to hear that the Environment Agency has found a solution to this issue. I note that 100,000 acres of agricultural land in his constituency will be protected as part of our six-year programme.

While the Government are prevaricating, farms and businesses in the north of England and in Scotland are struggling to cope with the aftermath of the December floods. Can the Secretary of State explain why she needs to find out the total cost before applying to the EU solidarity fund, and will she be able to do this in time to meet the deadline?

The hon. Lady should be aware that we have made a farming recovery fund available, and that we have already paid out money to farmers worth up to £20,000 for each farmer. As soon as the floods took place, we looked on satellite mapping, identified the affected farmers and got on with paying them and sorting the issue out.

That is a devolved matter on which local government must decide.

During the floods I have visited Heywood fire station, which is one of only two stations in Greater Manchester with water rescue units, and which has done sterling work in rescuing people from the floods. However, not only does it face significant further cuts, but, as was pointed out earlier by my hon. Friend the Member for Lancaster and Fleetwood (Cat Smith), it does not even have a statutory duty to attend incidents of this type. Does the Secretary of State agree that we now need a serious debate about future co-ordination of flood responses, and about long-term funding for our fire and rescue services?

We saw a very effective emergency response from the fire service and other emergency services, the Environment Agency and the Army, all working together. That lesson has been learnt from previous flooding incidents, as we have brought in all those services as soon as possible to ensure that we protect lives and property.

Like everybody in the House, I pay tribute to all our emergency services for the magnificent work they have done and continue to do. At present, however, there is no formal expectation that fire and rescue services will actually attend floods in England and Wales. Does the Secretary of State agree that, to ensure an effective, safe and robust response to flooding, we should follow the example of Scotland and Northern Ireland and make it a statutory duty for firefighters in England and Wales to respond to flooding?

My view is that our procedures are working, with the gathering of Departments on Saturday to make sure that we had the right preparations in place for the emergency services, the Environment Agency and the Army. The Cobra system that we have to co-ordinate them when we have an emergency, as we have had for the past few days, has worked very effectively, and we have been able to mobilise people on the ground. I am interested in what works, in what is effective and in how we protect the maximum number of people and the maximum number of homes from this extreme event.
