Commons ChamberThe objection seems to be that we may have to act in this way, but we do not want to break international law. Has my hon. Friend noted my amendment 45, which shows a way through? Under the Vienna convention, which is already mentioned through the conditional interpretative declaration, if another party is acting in bad faith, we can use the declaration to escape from an impossible situation. Will the Minister at least look at that amendment?
I will look at my hon. Friend’s amendment. I will come to amendments shortly—I realise that I need to make some more progress in addressing the many amendments we face. We do not consider necessarily that a unilateral interpretative declaration would be required, although as I said, we will use all the tools at our disposal to resolve the issue within the terms of the protocol before using the powers in the Bill. If that is one that we considered would help, we would not hesitate to use it, but we do not see the need for the amendment in that respect.
For the avoidance of doubt, let me confirm again that we are of course committed to implementing the withdrawal agreement and the Northern Ireland protocol, and have already taken many practical steps to do that. However, as a responsible Government, we cannot allow the gains of the peace process or the economic integrity of the UK’s internal market to be compromised inadvertently by unintended consequences and harmful legal defaults suggested by some interpretations of the protocol.
Finally, clause 50 disapplies certain provisions of the UK Internal Market Bill in the scenario that Northern Ireland’s representatives resolve, under the protocol’s consent mechanism, that articles 5 to 10 of the protocol should cease to apply. This is a practical step to account for and respect the principle of consent enshrined in the protocol. The protocol itself is not codified as a permanent solution for Northern Ireland, and neither should it be in the domestic legislation that implements it. Taken together, these clauses deliver on our commitments to Northern Ireland.
I want to address the amendments as briefly as I can, so I will have to be limited in the number of interventions I will take.

Commons ChamberWhat would be the effect if the House rejected the SI tonight? We are constantly told that international law always trumps domestic law, so what would be the effect? Is there any point in voting for or against the motion, because it really has no effect at all? International law will always trump what we do, and in that sense parliamentary democracy is inferior to international law. Is that correct?
My right hon. Friend makes an important point, but there would be a profound effect as a result of the rejection of this SI, and I shall come to that later in my speech. It is important to state that, were we to reject this SI, it would leave the UK statute book in a mess, so I do not think that is a good course of action.

I do not agree with the hon. Gentleman and do not share his pessimism. We start the trade negotiations from the unique position of our having a high degree of convergence with countries and territories that have followed the same rules for a long time. We can therefore be very ambitious about the future trade agreement that we can reach with the EU.
Until recently, I had thought that The Beano was a rather silly boys’ magazine; I now understand that it refers to “Brexit in name only”. Will the Minister confirm that abiding by Brexit in name only is not Government policy, that we will not move modestly apart from Europe, that we are leaving the customs union, the single market and the European Union and that we will have control of our borders?

Commons ChamberMy hon. Friend is absolutely right to draw attention to the opportunities for wider trade deals around the world. As the Prime Minister has said, we will not make the same huge payments to the EU that we have to date. That will mean more money for public services in the UK.
The Government have agreed a number of important principles with the EU that will apply to how we arrive at valuations in due course. This includes taking account of all relevant assets.
The European Union is estimated to have a wine cellar of more than 42,000 bottles and art work worth more than £13 million, some, one might say, metaphorically looted from the capitals of Europe. After we leave the party, will the Minister promise to take back control of our fair share of this art and wine and not leave it to Mr Juncker to enjoy?

Commons ChamberWe are of one mind anyway—it does not really matter very much.
In the interests of good government, will the Minister instruct the permanent secretary to ensure that there are worthwhile discussions with a possible future Government on how we square the circle of staying in the single market but controlling immigration and of being inside the customs union, or outside it—I do not know what they are going to do—and trying to make new trade agreements? I am sure that the permanent secretary is a very clever man and that he can do all this work.
I congratulate my hon. Friend on his demonstration of the single transferable question and on the point he makes. The speech from the shadow Secretary of State has been widely picked up as setting out a confused position and one that is irresolvable, but I have no doubt that our permanent secretary is brilliant enough to be able to work his way through it.
