We will look at reforming and overhauling the Human Rights Act, and I think my hon. Friend raises a reasonable point. I support continued membership of the European convention on human rights, but a fair challenge has been raised by lawyers and judges past and present about the elasticity of rights and whether, when they are expanded, that decision ought to be taken by elected Members of this House and not by courts and lawyers. That is a fair challenge, and if hon. Members look fairly at the data from successful challenges on seeking the deportation of foreign national offenders, they will see that there is a good argument that there are too many cases of criminals being able to flout the system because of that elastic interpretation of rights.

The victims of the most horrendous crimes wait years for justice in this country, the courts backlog might not be sorted for eight years, rape convictions are at shamefully low levels, and even with strict lockdown conditions, violence, self-harm and drug abuse are still rife across the prison estate, yet the Secretary of State is investing his time and energy in his personal obsession with dismantling the Human Rights Act. What message does he think this sends to victims about the priorities of his Government?

I have visited three prisons in my time as Justice Secretary. We have secured an important settlement for the courts backlog in this spending review, but on top of that, a lot of victims and their families say that it is galling to see foreign national offenders who cannot be deported and who are claiming their right to a family life. I think the hon. Gentleman needs to instil a little bit of balance and perspective, and we are going to reintroduce some common sense to the system.

There have never been sufficient nursery places to meet the extra demand created by the Childcare Act 2016, and now things are set to get worse. I have received a huge number of emails from local nursery managers and workers angry at the Government for failing to take action to protect early years workers during the coronavirus, because they are not entitled to access the furlough scheme. What will the right hon. Gentleman do to sort this out and ensure that these nurseries still exist once the crisis is over?

This is a hugely challenging time for nurseries, as it is for schools and other small businesses. The Chancellor has set out the range of support available. It is widespread, covering all sorts of different areas, but of course in relation to nurseries or any other sector that is finding the challenges too much to bear as we go through this crisis, we will make sure we look at them afresh to see what further can be done.

I pay tribute to all my hon. Friend’s tireless efforts and work. The Asia-Pacific region covered by the trans-Pacific trade agreement and ASEAN is a hugely important relationship for us. They are growth markets of the future, and we have perhaps not invested in partners there as much as we could have. While ensuring that we remain strong trading partners and allies with our European partners, leaving the EU allows us to invest more and with renewed vigour and enthusiasm in that critical region. That will bring dividends in jobs, free trade and advantages for consumers at home, and it also allows us to project our influence and soft power, as we have been discussing in this House.

T7. Teesside also celebrates your election to the Chair, Mr Speaker. This morning, Israel’s Supreme Court confirmed its Government’s decision to deport Human Rights Watch’s director for Israel and Palestine, Omar Shakir. That decision comes amid the worrying closing of civil society space for those advocating human rights in that country. Will the Government urge Israel to reverse its decision and allow Human Rights Watch to continue its vital work?

I know at first hand from my time working on human rights in war crimes and for human rights NGO Liberty how important the work of Human Rights Watch is. We want to see that continue, and of course we support it in general terms. We discuss a whole range of issues with our Israeli partners. The Israeli Supreme Court has a strong record of independence and has held the Executive to account on many occasions. It is important that we respect the separation of powers there as well.

I am not sure where the hon. Gentleman was, but I set them out in my statement. They include regulatory control and border control, and of course we would be able to move more swiftly not just to negotiate but to bring free trade deals into effect.

Ministers have implied in the past that the chemical industry can take comfort that good progress has been made on the future of the EU regulation concerning the registration, evaluation, authorisation and restriction of chemicals, which governs, among other things, the production and quality standards for chemicals. Can the Secretary of State give chemical companies on Teesside the assurance that REACH will apply and that there will be no other impediments to their business if we get a no deal Brexit?

As the hon. Gentleman will know, our White Paper includes proposals for continued co-operation and stability in this area. There is no deal until there is a whole deal, and although my thoughts and ambitions are with him and with his constituents on this point, I am afraid that I will not give out snippets from the negotiation room. The reality is that we need to present the package as a whole when we have negotiated it, so that people can see it in a balanced and rounded way.

My hon. Friend makes his point in his usual powerful and eloquent way. Of course, when the referendum legislation was passed it was agreed by all parties that we would respect the verdict of the referendum. That was how we entered into the legislation, that was how the legislation was passed by the House and that was how we campaigned. It would be a shifting of the democratic goalposts and a breach of democratic trust to suggest otherwise.

T2. My Stockton North constituency is home to some of the country’s most energy-intensive industries, and the future nature of the greenhouse gas scheme is a key business issue for them. The Chequers agreement suggests that we might remain in the EU emissions trading scheme. When will we know?

Having sat on various Select Committees with the hon. Gentleman, I know that he takes these issues very seriously. We detailed it in the White Paper, and he has the reassurance of the detail in that extensive document. I will be going out to talk to Michel Barnier and our European friends about all these issues to make sure we can take it further forward.

My hon. Friend is right to raise this issue. The community housing fund was worth £60 million in its first year. In the context of the Budget in November, we announced that it would be continuing for a further three years. That includes capital and revenue funding, and it is part of the Government’s drive to support community groups bringing forward home-build projects.
