Will the Minister meet me to discuss the case of my constituent Mohammed Al-Maily, a Saudi national with indefinite leave to remain who has been told that he is liable for removal from the UK despite living in the UK for 28 years with his wife? The reason the Home Office has stated is that it shredded the archives detailing whom it had granted indefinite leave to remain to, and the Saudi embassy claims to have lost his passport evidencing his right to leave to remain in the UK.

That is what I would describe as illegitimate shoehorning. It is quite common for colleagues to seek to shoehorn into another question their own preoccupation. To do so so nakedly by advertising another case is a trifle cheeky on the part of the hon. Gentleman, but in observation of and tribute to his ingenuity, as well as to his cheek, perhaps the Secretary of State can be allowed to answer.

Under this Government, children with special needs are six times more likely to be excluded than their peers. In Norwich, headteachers have described provision for special educational needs as a complete mess because of a funding shortfall. Will Ministers commit to increasing funding support for these children to ensure that they get the education they do not just deserve, but is their right?

I am grateful to the hon. Gentleman, whom I indulged fully as he developed his point of order. I say with respect to the latter part of his observations, in respect of an alleged breach of the ministerial code, that I am not its arbiter. It is not for the Chair to adjudicate upon whether a Minister has breached the ministerial code. Whether the hon. Gentleman likes it or not, that is in the hands of the Prime Minister. The Prime Minister looks at such matters, or can ask others to look at them on her behalf, but it is not a matter for the Chair.

I thank the hon. Gentleman for raising the matter, and although it is not—simply as a matter of constitutional fact—a point of order for the Chair, he has none the less taken the opportunity to put his concerns on the record. It is up to the Government if they wish to respond to the matter he raises, because there is absolutely no doubt that Ministers will have heard what he had to say—it will have been heard on the Treasury Bench, and it either will have been heard, or will very soon be heard, by the particular Minister at whom his remarks were directed.

On a point of order, Mr Speaker. I seek your advice pertaining to the powers and privileges of the House. You will recall the recent debate I led on the treatment of small and medium-sized businesses by the state owned bank the Royal Bank of Scotland, after which this House voted unanimously for a full inquiry. Since that debate, I have received a full and unredacted copy of the Financial Conduct Authority investigation into RBS, which the FCA has so far refused to release, including to the Treasury Committee. Having read the document, I believe it shows that RBS executives misled the Select Committee in their evidence and have a stated policy of misleading Members of this House. Far from being isolated incidents of poor governance, as they claimed to the Committee, the report explicitly states that their behaviour was “systemic and widespread”. In one shocking passage of the report, out of hundreds, the bank boasted that one family business was set to “lose their shirts” so that RBS could get a “chunky equity deal.” Furthermore, it is clear that the summary of the report the FCA has published is what I would politely describe as a sanitised version.

The chair of the FCA, Andrew Bailey, is giving evidence to the Select Committee tomorrow. First, in light of that, Mr Speaker, may I ask your permission to hand over the full unredacted report to both you and the right hon. Member for Loughborough (Nicky Morgan), the Chair of the Treasury Committee, whom I note is unable to be in the Chamber at the moment?

Secondly, Mr Speaker, may I ask you to confirm that parliamentary privilege will apply to any Member or the Select Committee should they choose to refer to the report in the House? Finally, might I ask your guidance on whether deliberately misleading a Select Committee of this House would constitute contempt of Parliament, and what recourse this House has when that occurs?

I am most grateful to the hon. Gentleman for his point of order and his courtesy in giving me advance notice of it. It is not for me either to give or to deny the hon. Gentleman permission to hand over the report to the Chair of the Select Committee; the hon. Gentleman must, and I am sure will, take responsibility for his own actions. For my part, I must say to the House, as well as to the hon. Gentleman, that I do not wish to receive a copy. That is for two very good reasons. First, I have a very full reading list, in so far as the hon. Gentleman has the remotest interest in my personal habits. Secondly, and more importantly, I do not wish to receive a copy of the report because however important its contents and however they may be a source of perturbation to many people, they are not a matter for the Chair. Should the Treasury Committee wish to procure this document, I am sure that it could take steps to do so. The hon. Gentleman would also be well advised to take legal advice if he plans wider disclosure of the document he has received.

I can confirm that the hon. Gentleman’s comments in this House are covered by privilege. That is, it has to be said, perhaps just as well, since he has already uttered them. Deliberately misleading a Select Committee of the House would constitute a contempt. The proper course of action for a Member wishing to complain of a breach of privilege is to write to me. There have been a number of examples of this, so I can authoritatively tell the hon. Gentleman that that is the proper course open to him. I hope that that is helpful to the hon. Gentleman and that he will go about his business at least moderately satisfied.

On a point of order, Mr Speaker. I hope to get your advice on an exceptionally serious issue, which has been brought to me by a whistleblower in my constituency, relating to the East of England Ambulance Service. It has been put to me that the service became critically overstretched as a result of high demand on 19 December. At that point, senior operational managers wanted to move to REAP4, which is the highest state of emergency, and seek mutual aid, most likely from the armed forces. However, that decision was not taken until 31 December, some 12 days later. Even then, aid was not requested by senior management.

I have been informed that, during that period, 20 people died in incidents when ambulances arrived late. If that is true, it raises serious questions for the trust and the Government as to why REAP4 was not declared and no aid was sought; what potentially avoidable deaths resulted from those decisions; and, above all, how we can avoid that ever happening again. Given that this is, quite literally, a matter of life and death, can you advise me, Mr Speaker, on how I may urgently seek answers to those questions from the Secretary of State for Health and Social Care?

I am grateful to the hon. Gentleman for his point of order and for his characteristic courtesy in giving me advance notice of his intention to raise it. The answer is twofold. First, he should undertake the short journey from the Chamber to the Table Office in order to table such questions—there may be many—to which he seeks answers from the Secretary of State for Health and Social Care. The hon. Gentleman may already be working on these matters now; if not, I am sure he will apply hot, wet towels over his head as he prepares his line of questioning.

Secondly, the hon. Gentleman may seek to consult his colleagues on the Opposition Front Bench if he wishes a party view to be taken on this matter and the issue to be pursued not only from the Back Bench, but by his fellow Members of the Front Bench. Meanwhile, he has aired his concern, and it will have been heard on the Treasury Bench.

On a point of order, Mr Speaker. I hope you might be able to advise me on how I can ascertain Government policy and action on an urgent matter that affects my constituency in Norwich. As you will know, hundreds of jobs could be lost with the closure of the Colman’s mustard factory and the Britvic factory in my constituency. I have repeatedly asked the Business Secretary to come to Norwich to meet the highly productive workers there and see the highly profitable factories. So far, he has not got back to me. Although I understand that he is still in his place at the Department, there are several new junior Ministers whose positions and responsibilities we do not know. May I ask for your guidance on how we might get clarification on that point and answers from the responsible Ministers very urgently, given the hundreds of my constituents who face losing their jobs?

I can and will respond to the hon. Gentleman. I preface my response by thanking him for his courtesy in giving me advance notice of his point of order. I say with great seriousness that I appreciate the importance of this matter to him and his constituents. I have two points to make. First, on the specific question that he raised—which member of the new ministerial team has responsibility for the matter—it is customary for the Government to publish from time to time a list of ministerial responsibilities. It would certainly be helpful to Members on both sides of the House if the division of ministerial responsibilities within Departments could be publicly clarified as soon as possible. Meanwhile, the hon. Gentleman has put his concern on the record and I am sure that it will have been noted on the Treasury Bench.

Secondly, on the back of my experience as a Member before I became Speaker, my advice to him about seeking a visit is: persist, man, persist. Make what I would call a polite nuisance of yourself. Keep going, keep asking, keep requesting, keep putting the matter in the minds of Ministers. On the whole, I tended to find when I was a Back Bencher that by making a nuisance of myself in that way, more often than not, I got at least a significant share of what I was seeking for my constituents.

Order. We cannot and will not have a debate on the matter. The hon. Lady was courteous enough to give me advance notice of her intention to raise this point of order, for which I thank her, and I have attended both to the substance of what she has said and to the remarks of the Minister.

I must say to the hon. Lady that, disquieting though the experience might have been, and relatively irregularly though it might occur, it is not clear to me that the hon. Member for Copeland (Trudy Harrison) has broken any convention. It is certainly a convention to notify another Member of an intention to visit his or her constituency in a political public capacity. It is also a very well established convention that a Member of Parliament should not purport to represent or offer to represent people who are not her or his constituents. [Interruption.] Order. Writing, however, in a campaigning context on party notepaper, though it might not happen very frequently, is not—and I have some experience of these matters—a demonstrable breach of a long-standing convention.

I say to the hon. Lady, whose concern I treat very seriously, that I appreciate that concern, but it seems to me that courtesies between Members of the House, which are important, are best arrived at and adhered to by informal discussions between colleagues. It is not desirable that they should ritually be attempted to be resolved by being raised on the Floor of the House with the Chair. That is to say, to be clear, that they are not matters of order but matters of informal agreement and understanding. It is much better if such understandings can be reached between neighbouring colleagues.

On a point of order, Mr Speaker. You have often stated from the Chair that answers to written parliamentary questions from Back-Bench Members from all parts of the House should be answered in both a timely and a substantive manner by Ministers. On 24 March, I tabled a named day question to the Parliamentary Secretary, Cabinet Office, the hon. Member for Kingswood (Chris Skidmore), asking, very simply, how much the Government had spent on advertising in the Evening Standard in the last financial year. Three days later, I received a holding answer. Now, over a month later, I still have not received a substantive answer. I am concerned that the Government might now simply be winding down the clock, with the intention of not providing an answer before we prorogue. The public might also draw the conclusion that they have something embarrassing to hide that they do not want to reveal during an election campaign. Is there anything you can do from the Chair, Mr Speaker, to encourage Ministers to answer such questions substantively this week, so that both Members of the House and the public can know the truth?

I am grateful to the hon. Gentleman for giving me notice of his point of order. I do appreciate his concern. The content of Ministers’ answers is, of course, not a matter for the Chair. That is a matter exclusively for the Minister giving the response. However, the hon. Gentleman references my repeated exhortation to Ministers to provide timely and substantive responses, an exhortation in which I am regularly joined by the Leader of the House. Many Ministers attach a premium to adhering to that principle and expectation. I agree that it is unsatisfactory if the Government are unable to give a substantive answer to a named day question tabled well before Prorogation. No doubt the concern articulated by the hon. Gentleman has been heard on the Treasury Bench. In so far as he further seeks my advice, it is encapsulated in one sentence: the hon. Gentleman should seek to speak to the Leader of the House, sooner rather than later.

It is always a pleasure to follow my hon. Friend the Member for Stockton North (Alex Cunningham), as well as, of course, the Toblerone tour de force that came from the Foreign Secretary earlier.

It is strange to be debating Britain’s place in the world in the context of a Budget statement that refused to address the single issue that will completely dominate our place in the world for an entire generation: Brexit—a word the Chancellor managed to avoid using even once in his speech. His announcement that he will spend £500 million of new money on technology such as artificial intelligence sounds wonderful, but when we look at what is happening in the real economy, we see that our high-tech businesses are actively considering whether they can afford to remain in the UK at all if we leave the single market.

Only last week, UKIE—the Association for United Kingdom Interactive Entertainment—which represents the UK’s dramatically successful gaming industry and has several members in my constituency, reported that 40% of its members are considering relocating all or part of their businesses abroad because of Brexit. Of course, the same figure, or higher, will be found in many other parts of the UK economy. The Chancellor knows that, and that it was always likely to be the case, which is why he—along with the Prime Minister, of course—opposed Brexit in the referendum.

Has the Chancellor, then, made any allowance in his forecasts for future losses in tax revenue yielded by the taxes of EU citizens working in the UK, who may be given no choice but to leave rather than be forced through the humiliation of expulsion? Some 7% of the UK workforce are EU citizens, and the Office for National Statistics estimates that they have been net contributors of more than £20 billion in the past decade. Why did he make no mention of the tens of billions of pounds the UK will be asked to pay in exit-related costs? The OBR is clear that he has made no contingency for this huge cost, which may be more than £50 billion—why?

As time passes it becomes clearer that the Government have been hijacked by a small gang of ideological fanatics who want the hardest of hard Brexits, and against whom the Prime Minister and her Chancellor appear powerless. This hard Tory Brexit rests on nothing more than wishful thinking—on the fantasy that the UK will be able simply to stroll up to negotiating tables around the world and come away with deals that favour us and our industries, as if the likes of China, India and a Trump-led USA are unaware of how isolated and desperate our position will be.

Last June, the British people did not vote to apparently reclaim their sovereignty, laws and rights from Brussels only to see the Government auction them off to the highest bidder, behind closed doors. We are talking about our NHS, our Climate Change Act, and our employee rights. Nor did the British people vote to divide the Union, yet the Government’s hard Brexit is the key reason Nicola Sturgeon has given for requesting a second referendum. The First Minister wants the people of Scotland to have a choice, just as the Government now have a choice: do they want hard Brexit or do they want to retain the Union?

We must be on our guard. We stand to lose much more than the economy and the Union if we continue down this path. The world that the Donald Trumps, Geert Wilders and Marine Le Pens want to build is a genuinely dangerous one. It is a world of protectionism, bragging nationalism and domestic politics dominated by the empty, angry rhetoric of scapegoating. As any student of 20th-century history will tell us, these are ominous tidings indeed. The world around us is rapidly changing, and not always for the better. Out there, there is a sense that things are out of control. The term “going to hell in a handcart” is one we hear frequently. In this climate of uncertainty and instability—

I will be very brief, Mr Speaker.

Some newspapers have exposed shocking examples of what I can only describe as crony capitalism in some of our LEPs. For example, the former elected mayor of Bristol, George Ferguson, received more than £50,000 for his own brewing firms while on the LEP board, which kept no minutes; perhaps the Minister is impressed to find right-wing politicians who can organise a booze-up in a brewery. Given that the Government are putting nearly £2 billion into LEPs through the autumn statement, can he tell us what they are doing to enforce basic standards of accountability?

It is a shame that the Secretary of State did not share the statement with us in advance; presumably we are now expected to get first sight of Government policy through a long lens on Whitehall. But after weeks of press briefings, at least they have finally decided to come to this Chamber, because we have heard a lot about the Prime Minister’s policy on corporate governance, but the more they said, the less we have actually known.

When the Prime Minister launched her leadership, she said she wanted a change in the way big business is governed. She said:

“later this year we will publish our plans to have not just consumers represented on company boards, but workers as well. Because we are the party of workers.”

But it seems there has been a change of mind because just weeks ago we heard it was not about putting workers on boards but about finding a model that works for everyone. Perhaps it is the same model as for Brexit: to have their cake and eat it.

When we debated in the Chamber last month the fate of Sir Philip Green, I said that the most shocking thing about the whole affair is that everything he did was legal. A key question today is whether anything that has been proposed would change that: do these proposals pass the BHS test?

Bringing private companies into the plc rule book is a move so targeted at a particular series of events that I expect it will come to be known as the BHS law, but had the proposals outlined today by the Secretary of State been in place six months ago, I am not wholly convinced we would have avoided the corporate governance scandals that have plagued the last summer. To force private companies to abide by the corporate governance code will do little unless the code is tightened. BHS may have been a private company, but Sports Direct is not, and we all know what has gone on there.

Similarly, to strengthen the power of boards to give oversight on how companies are run or their remuneration structures will change little unless the make-up of those boards is also shaken up, yet we all know what has happened to the Government’s commitment to put a diversity of voices on boards. It is a weakness of too many discussions of corporate governance, and a weakness reflected in this Green Paper, that they are dominated by high-profile scandals.

For too long our economy has suffered from an inherent short-termism—a short-termism that sees the long-term health of a company being sacrificed for a quick buck, and that all too often obscures the link between rewards and long-term performance. In 1970, £10 in every £100 went on dividends; now, it is between £60 and £70. It is employees and investment that have lost out from this shift. We see that in our pitiful investment and productivity rates. Britain now languishes 33rd out of the 35 OECD countries on investment rates. Seen in this light, it is no surprise that it takes British workers five days to produce what German workers produce in four—and we see this in the yawning gap between top pay and average pay: in the 10% increase in executive pay when workers are suffering 10 years of stagnant wages.

Our damaging short-termism is also seen in corporate takeovers that occur against the public interest and the company’s interest—takeovers that have instead served as a means to asset-strip, as when Kraft took over Cadbury with hedge funds buying up 31% of the shares and selling Cadbury short.

When the unacceptable face of capitalism surfaces, as it has in the last few months with the scandals in BHS and Sports Direct, what we are witnessing is the extreme manifestation of these broader problems, and that is what makes today so particularly disappointing. Corporate governance reform is not just about improving the image of our corporate sector or placating our innate sense of injustice at the lack of proportionality between the salaries of directors and their employees; nor is it just about fulfilling the wishes of the six out of 10 members of the public who, as TUC figures show, want to see workers on boards. These things matter, of course, but corporate governance reform is also about changing the way our companies, and therefore our economy, work.

The recasting of how our economy works is key to Britain’s success. Without more long-termism in our corporate practices, we will not be able to address the problems—

Order. The hon. Gentleman has had his five minutes. I do not know whether he was then proposing to put questions, but I gently say to Members that in these matters there is a form to be followed—a procedure to be adhered to—and although I have listened to the hon. Gentleman with great care and attention, he has contributed in the manner of a debate rather than a response to a statement. Ordinarily, I would be very happy to hear his questions, but Members cannot make a long preamble and exceed their time, and then almost as an afterthought get around to some questioning. So I think we will for now have to conclude that the hon. Gentleman has concluded his contribution. But I am sure the Secretary of State will find in the commentary some implied questions, using the great intellectual dexterity for which he is renowned in all parts of the House.

I would like to follow up on that. It is just two days since the Government accepted the amendment that I and my hon. Friends the Members for Wigan (Lisa Nandy) and for Salford and Eccles (Rebecca Long Bailey) tabled to the Budget resolution. The Chancellor was the first in history who had to accept an Opposition amendment to his own Budget, and that was within a week of its delivery. Now we discover that the Finance Bill makes no provision whatsoever regarding VAT on energy-saving products. In fact, it is worse than that, because my hon. Friend the Member for Salford and Eccles has just received a written answer from the Financial Secretary stating that the Government are “still considering” their policy, and that the lower rate of VAT will continue only “in the meantime”. Will the Secretary of State tell us whether there is a now a U-turn on the U-turn?

The report, which I have seen, raises serious questions about patient safety and care owing to cuts to services. Does the Prime Minister agree with me that the duty of candour should apply to NHS management as it does to NHS front-line staff? If so, will he join me in the call for the report’s publication?
