I congratulate the hon. Lady most sincerely on securing this important debate. Part of the problem in my constituency is that over the past year we have had temporary closures in Ogmore Vale, Aberkenfig and the community of Bettws. Those temporary closures are ongoing, with one of them nearing a year. Post offices provide banking services as well as the postal service, and they are often linked to local shops. Those services are important, given all the bank closures in my constituency. I have only one bank left for 58,000 constituents. Temporary closures are as much of a problem in my constituency as permanent closures. Does the hon. Lady agree that the Post Office needs to up its game in resolving those temporary closures?

I beg to move,

That the draft European Structural and Investment Funds Common Provisions and Common Provision Rules etc. (Amendment) (EU Exit) Regulations 2019, which were laid before this House on 28 January, be approved.

When debating statutory instruments, we normally say how honoured we are to serve before the Chair, whoever he or she may be. This is the first time I have debated a statutory instrument in the Chamber, so I do not know whether I should say it is an honour to do so before you, Mr Speaker. If you took it as read, you would be entitled to do so. [Interruption.] The Opposition Whips are chuntering from a sedentary position, and they do themselves no credit.

Indeed so.

In a no-deal situation, this instrument will repeal the European regulations concerning the European structural funds, while ensuring that the funds can continue operating domestically. It will also repeal the regulations on the Cohesion Fund, for which we are not eligible.

The structural funds include the European regional development fund and its cross-border European territorial co-operation component, and the European social fund. The structural funds are shared management funds that support regional investment across the UK, and they are funded via the EU budget, with co-funding provided by project participants. Typical projects include the recently launched advanced engineering research centre in Sheffield, which supports economic development and upskilling in the local economy. Typical cross-border projects under the European territorial co-operation component of the structural funds include the intelligent community energy project on smart energy. Three UK universities and local small businesses are working in collaboration with French research centres and small and medium-sized enterprises to find local solutions to support low-carbon energy systems.

In a no-deal scenario, the United Kingdom is expected to lose access to European funding. To ensure that this regional funding continues in a no-deal scenario, the Government announced in 2016 that they would guarantee funding for structural funds projects signed before we leave the EU—that was extended last July to cover new projects signed after exit until the end of 2020. That guarantee covers UK beneficiaries and, exceptionally, all beneficiaries of the Peace programme in Ireland and Northern Ireland, and Interreg V-A in Ireland, Northern Ireland and Scotland. This is due to the Government’s continued commitment to support peace and reconciliation in Ireland.

This statutory instrument facilitates the domestic delivery of structural funds in a no-deal scenario. It repeals the European regulations for these funds, as they would become inoperable retained European law and therefore would not work, because the European regulations create a shared management programme between the EU and a member state. Keeping them would create obligations that the managing authorities of the funds could no longer meet after a no-deal exit.

The instrument also ensures that for European regional development fund and European social fund projects started before exit, current fund delivery rules would be upheld through existing funding agreements, without keeping redundant EU regulations. The powers to continue paying project beneficiaries in the UK already exist under our domestic law, so the instrument does not make provision for projects started after exit. Managing authorities for the funds will none the less continue to sign new projects under existing domestic powers and using existing delivery systems, with appropriate simplifications. So the main aim is to provide stability for beneficiaries, and the project rules will continue to be enforced through the same funding agreements. Hon. Members should also note that this instrument ensures that structural funds delivery remains a devolved matter.

If I may, Mr Speaker, I will use this opportunity to answer my right hon. Friend’s earlier question about the dispute resolution. Any disputes in relation to how funding is spent are dealt with through the audit and default functions and the provisions set out in the existing funding agreements. As for his second question, I will have to give the matter some thought, as I must confess I do not know the answer. If I do not think of it in the next half an hour or so, I will certainly write to him with the answer on that. My memory is quite good and usually things come back in due course, as I know they do to you, Mr Speaker.

I mentioned that the EU is making separate legal provision for us to continue to participate in the Peace and Interreg V-A programmes. That provision is intended to enable continued access to the programmes in the event of no deal, but it does not resolve the problem of payment powers, which is why we need both the EU regulation and this statutory instrument to safeguard those programmes and to ensure the continuation of their benefits. Not having this instrument in force by exit would also prevent the Government and our devolved Administrations from paying out the guarantee to UK partners of other territorial co-operation programmes, risking their financial viability.

I do not think anyone on the Opposition Benches objects to what the Minister is saying. In fact, I am sure that he and I agree about the catastrophe that could be a no deal. Will he care to expand on what would happen with the shared prosperity fund beyond any transition period and beyond any deal? Currently we seem not to know. The Minister is an honourable man, and it would be helpful if he could give the devolved Administrations some reassurances about how the prosperity fund will be managed and what funds will be available to regenerate communities in my constituency.

I know, Mr Speaker, that in this case you do not have to rule on the scope of it, but the answer to the hon. Gentleman’s question is quite long, so I am happy to discuss it with him outside the Chamber, if that is acceptable to him.

I think I got away with that one, Mr Speaker, but I am not sure. [Interruption.] For now, Mr Speaker.

The House should note that this instrument is designed for a no-deal scenario. If there is a deal, the intention is to include a provision in the withdrawal agreement Bill to defer commencement of the regulations until the end of the implementation period. For that reason alone, I urge all right hon. and hon. Members to vote for the EU withdrawal agreement Bill. That deferment would mean that the regulations would come into force at that point, rather than on the date of exit.

In conclusion, in a no-deal scenario this instrument repeals redundant European law while ensuring that regional investment projects previously supported by the EU, including those supporting peace in Northern Ireland, are protected by the funding guarantee. For those reasons, I commend the regulations to the House.

My hon. Friend makes an important point. It has been a clear part of our mandate to negotiate in a way that allows us to strike free trade agreements. That is provided for in the agreement that is on the table, but I think the wrong thing to do in furtherance of that would be to lose our ability to trade without tariffs and frictions with, as we might say, our existing customers.

The announcement from Honda today is devastating for the community of Swindon. Just up the road in Bridgend, which neighbours my constituency, Ford has announced voluntary redundancies. The Jaguar Land Rover contract is ending three months early and there is only one Dragon engine left, which will mean the employment of only 500 people beyond 2021. Going from 1,700 people down to 500 means far more redundancies in the long term. Ford has also supposedly warned the Prime Minister that a no-deal Brexit would be a catastrophe and that it would look to pull all its production out of the UK. First, what more can the Minister to do to support the Bridgend workers, particularly at Bridgend Ford? Secondly, I wish him luck in trying to convince the Prime Minister to take no deal off the table, because that would be catastrophic for the car manufacturing industry in this country, including Bridgend Ford.

The hon. Gentleman mentions Bridgend; I speak to Ford and its VP for Europe, Steve Armstrong, very regularly, and the hon. Gentleman is absolutely right that it is looking to us to resolve this matter. Steve Armstrong says that if we leave without a deal, it would be “pretty disastrous” and that it would

“force us to think about what our future investment strategy for the UK would be”.

However, he also says that the deal that has been negotiated would address these concerns, and I hope that given the hon. Gentleman’s interest in the workers in Bridgend, he will come to resolve this matter by voting for the deal.

I congratulate my hon. Friend on her speech. She is championing miners right across the UK, including in my seat in Ogmore. Does she agree that we are running out of time? Lots of widows now receive the miners’ pension, based on a reduction. Unless the Government take action now, we will be in a position where the money will simply be taken up by the Treasury. That cannot be right for the thousands of miners left and their families.

My hon. Friend is absolutely right. The average pension is just £84 a week, but it is a lot less for widows in receipt of a pension. Some are forced to get by on much less. For instance, I have read of one who receives as little as £59 a week, after spending the best part of three decades down the pit.

I thank the hon. Gentleman for that intervention. I will come on to that issue, and specifically the level playing field, later in my speech. I hope that I will answer his question shortly.

One would have to be wilfully blind to argue that there is no tension between EU law and the pursuit of a heightened role for the state in our economy. For now, I want to move on to discuss public ownership, which can take various forms. I am not advocating organisations that are owned by the Government but behave in the same way as for-profit companies, focusing on financial goals and insulated from democratic control, but the dogmatic obsession with privatisation in the UK in recent years has been exposed as a failed and outdated ideology. Hon. Members no doubt represent workers in their respective constituencies who were affected by the collapse of Carillion, which cost the taxpayer at least £148 million. There were also the failures of the east coast main line and Northern rail services, and the emergency takeover of Birmingham Prison—the list goes on.

Our public services have been siphoned off and are run by private companies interested only in extracting profits to line the pockets of their shareholders, instead of reinvesting them to improve the service or reduce consumer bills. The privatised water companies have paid out £18 billion in dividends to shareholders over the past 10 years.

My hon. Friend is making a very important point about how water companies work. In Wales, we have Dŵr Cymru—Welsh Water—which is a publicly owned company that reinvests in the water network and reduces people’s bills. There are very real examples of how water companies can work for people, and we have the best example in Wales.

I thank my hon. Friend for that example.

In the name of efficiency, our public services have been handed to those offering the cheapest services, often at the expense of our public sector workers, who have paid the price with their pay, their terms and conditions and even their jobs. Public ownership does not just bring an end to such bad practices. Done right, it can be used to combat inequality, political disenfranchisement and underinvestment.

I thank the hon. Gentleman for his intervention. I know everybody says this, but I will come to that later, when I address broadband specifically. I agree that improving that infrastructure is essential.

The recent research from the IPPR that I mentioned earlier concludes that the public place more weight on returning powers to expand the use of state aid than to deregulate, with 53% showing a preference for allowing the Government to support and protect our industries, while only 26% preferred conformity with EU state aid rules to secure a far-reaching EU trade deal.

The variation in WTO-plus agreements suggests to me that a bespoke trade deal could, in theory, include room for structural subsidies. Those could, for example, support industries of particular national value or natural monopolies, where cost reductions would be beneficial and would have no impact on other countries. In that sense, Brexit offers an opportunity to redefine what a true level playing field looks like.

The Communication Workers Union suggested that there would, in theory, be a strong argument for rolling out superfast broadband everywhere, supported by the state, which takes us back to the point made by the hon. Member for Central Suffolk and North Ipswich (Dr Poulter). Not only is that a natural monopoly, but it is a driver of social and economic wellbeing, as he pointed out. A similar argument could be made for our post office network.

With regard to the withdrawal agreement as it stands, the Attorney General has made it quite clear that in the backstop, restrictions on state aid are hardwired, and new restrictions could be introduced even if they are not in our national interest. I would be grateful if the Minister clarified whether he expects our future relationship with the EU to be substantially different or based on a parallel system. In the same way, the EU procurement directive is far more restrictive than the WTO agreement on government procurement. I would support, for example, limiting eligibility for public procurement contracts to companies that can demonstrate ethical maximum pay ratios and gender pay ratios, yet the EU procurement directive raises questions as to whether that would be compatible with single market rules.

There will undoubtedly be risks to workers’ rights if we leave the EU. Parliament is currently considering a deal that refers only to “non-regression”, when it would surely have been possible to ensure that British workers enjoy at least the same statutory rights as their European counterparts, as part of what I would describe as a genuine level playing field. We must also consider collective bargaining. I do not want to stray into a debate on the benefits of collective bargaining, but suffice it to say that I believe that rolling out sectoral-level bargaining will bring far more than just improvements to workers’ wages or employment conditions, and, alongside other reforms, it can give workers a real stake in their industries, and is another prerequisite for democratising our economy.

I thank my hon. Friend for giving way again, and she is making some important points. She has talked throughout about a level playing field for workers’ rights and state aid. Does she agree that it is extremely important that the UK Government work with both the Scottish and Welsh Governments where there are devolved responsibilities, to ensure that there is a level playing field? That applies particularly to future funding for communities such as mine, which received objective 1 and objective 2 status, and where Welsh Government Ministers are responsible, for example, for the NHS pay structure and, from next year, for teachers’ pay?

The Minister may be aware that there is a need for more research and development funding for geothermal energy projects, which I have previously raised with the Energy Minister. Will he set out what additional funding he will give to get more projects in line, such as the one in Caerau in my constituency?

I commend the hon. Gentleman on what has been done so far. As I said, a record increase of funding is available for research and development, mainly through UK Research and Innovation. We also have the industrial strategy challenge fund, but in all that, we are looking for projects that are cost-effective and if those become available, we will be happy to fund them.

My hon. Friend, in his capacity as Chair of the Environment, Food and Rural Affairs Select Committee, knows very well that what is referred to as the “co-benefit” of cutting emissions also means better air quality, better human health and better child outcomes, in terms of reduced asthma levels. We did not think about that before, but now we are, and luckily we can understand those things and work out the costs and benefits, taking into account some of these new measures.

The Minister has made decisions now around scrapping the tidal lagoon project and rejecting her own commissioned report. We need to move on from that. What is her plan now for introducing tidal energy across the UK and making sure that south Wales is given the investment it was promised by the Conservative Government?

The hon. Gentleman will know that we have spent tens of millions of pounds looking at wave energy—we have Wave Hub off the coast of Cornwall and we have invested substantially in many of the trial sites. As we debated at the time, the problem with the Swansea lagoon was not the source of power per se, but the fact that it was the most expensive power station proposal we had ever had in the UK, and it is right that we care about taxpayers’ money. That said, we are always interested in looking at tidal: several other proposals have been brought forward, and the door is always open. I, like him, know the power of the Bristol channel, having grown up on the other side; the problem is delivering it in the most cost-effective way.

Unlike the Minister for Universities, Science, Research and Innovation, I was unable to enjoy the announcement at Farnborough yesterday, but I agree with my hon. Friend that it is a fantastic announcement. He and Cornwall County Council should celebrate it, and I look forward to visiting Cornwall on Friday, where this topic and many other industries will be addressed.

One of the challenges but also opportunities for the Government’s industrial strategy is working with the devolved Administrations. Can the Minister set out what discussions she has had with the Welsh Government to ensure that the long-term industrial strategy supports industries such as Ford in Bridgend, which employs many hundreds of workers in my constituency?

My hon. Friend is right that it is important to take a long-term and strategic approach. That is exactly what we did with offshore wind, identifying a technology in which the supply chain could be located in the UK and creating jobs right across the country. That has been a great success. The opposite of that, however, would be to spread very thinly very expensive projects that do not, as the analysis demonstrates, have the potential for exports that offshore wind and others enjoy. That would reduce the economic prospects for firms across the country.

Part of the role of government is that a Secretary of State will have a vision for delivering and a vision for ideas. The Secretary of State has shown today that he does not have any vision for delivering services and improvements to the economy for the people of south Wales. We have had the scrapping of electrification and we are clearly no further forward with various projects the British Government can fund. Can we have a guarantee from the Secretary of State about when the British Government are going to start investing, so that the people of Wales can have some faith? All he is proving right now is that, with the Welsh Secretary and the British Government, the Tories really are failing Wales.

The Swansea city deal, to name one case in point, will be welcomed by the hon. Gentleman. In terms of planning for the future, making commitments that put on bill payers or taxpayers costs that are three times higher than are justified is no strategy for the long term. To saddle businesses and industries with such costs is a strategy for uncompetitiveness.

It is a pleasure to serve under your chairmanship, Mr Evans—with your strong and long Welsh history, I hope you may even know the community that I will talk about today.

Geothermal energy has tremendous potential, and I warmly congratulate my hon. Friend the Member for Bishop Auckland (Helen Goodman) on securing the debate. It was very interesting to hear her informed view on why such projects can be of huge benefit to Durham, and to the whole of the UK. I will focus my remarks mainly on the Caerau project in my constituency.

Bridgend County Borough Council, which serves two thirds of my constituency, has commissioned a survey to ascertain whether water held in the former Caerau colliery, in the Llynfi valley, could provide a sufficient heat source for a project. If the survey results are positive, there are proposals for a geothermal energy project to generate energy for nearly 1,000 homes across the Llynfi valley. That could provide safe, reliable and cost-effective heat and build a green energy industry in the heart of the south Wales coalfields.

If the project is successful, that will catapult Caerau to the forefront of the UK’s energy revolution. The project is a clear example of effective collaborative working, and I pay tribute to the Labour leadership of Bridgend County Borough Council, including Councillor Huw David, the leader, and the Welsh Labour Government. They have worked tirelessly with the private sector to secure the necessary EU funding for the scheme to get the go-ahead.

At its core, this is about moving towards a clean energy mix that the UK can rely on, but it is about much more than that in my opinion. Across the coalfields, many communities are still feeling the effects of the end of the mining industry. At its peak, the Caerau colliery once employed more than 2,400 workers. ln the village, the working-age population today is just over 4,000. The end of the industry was disastrous for that community. Even today, the unemployment rate remains stubbornly above the national average. Those communities need funding, employment and industry. Geothermal energy projects can provide that much needed injection.

I am chair of the all-party parliamentary group for coalfield communities and the representative of one of Wales’s most prominent coalfield areas, and this is an issue that I care deeply about. Geothermal energy is an opportunity to help regenerate our coalfields, and we must grasp that opportunity to build on the history and tradition of our collieries with a new industry that is clean, safe, and can provide energy and jobs where they are needed.

Of course, such projects have their benefits, but we must take care to listen to those who live close to the collieries and ensure that they have as much support from local residents as possible. In addition, as my hon. Friend the Member for Bishop Auckland has already said, we must ensure that local residents get the potentially lucrative benefits of the projects, and reap part of the economic and social rewards the developments bring, whether that be through employment opportunities, community funding or receiving a benefit through their energy bills.

I know from speaking to residents in Caerau that there is a lot of optimism and promise for the project, but there is some concern too. It is vital that residents are informed as much as possible about the positives that such projects can bring. Through the design, construction and maintenance process, they must be fully engaged and represented. Their opinions should take priority and it is they who should be the focus of such projects.

Needless to say, geothermal energy is not the silver bullet for solving our energy insecurity as a whole and can only form a part of our future energy mix. It will come as no surprise to the Minister if I take the opportunity to mention the Swansea Bay tidal lagoon as part of that energy mix within Wales and across the United Kingdom. While I am delighted to see the Welsh Government, local government and other authorities supporting projects such as the tidal lagoon, it is for the UK Government to come forward with a long-term proposal that gives us energy security. In my opinion, which again will come as no surprise to the Minister, that should include the Swansea Bay tidal lagoon.

Juggling the trilemma of meeting our climate change targets, improving our energy security and keeping tariffs down for consumers is a difficult task. I accept that, but I would like to stress that we need effective and radical action from the UK Government to address baseline power alongside our work to advance local renewable sources of energy. I agree with my hon. Friend the Member for Bishop Auckland that the Minister is not a paper-pusher; she is a proactive Minister. I would like to believe sincerely that she will do all she can to deliver energy security for the UK using mixed sources, including geothermal energy and the tidal lagoon. I still have faith that the Government will deliver that.

Geothermal energy is a unique opportunity to build industry in communities where it is often missed most, by many people who still remember with great pride serving in collieries and who still face the cycle of unemployment two or three generations after the closure of those heavy industries. Of course, we should take caution and understand that that alone it is not the solution to all of our energy woes—but it is a hugely positive opportunity for our coalfield communities, and for building a future energy mix based on renewable energy. It is one we must give serious consideration to.

I end with an invitation to the Minister. I appreciate that some energy policy is devolved to the Welsh Government, but if she would like to see the Caerau project, I would very much welcome her to my constituency to see in action the innovative work that Bridgend County Borough Council is doing, along with Cardiff University and the Welsh Government.
