Commons ChamberThe Northern Ireland (Ministers, Elections and Petitions of Concern) Act 2022 was specifically designed to improve the sustainability of the Northern Ireland institutions. The benefits include allowing more time and space for the formation of an Executive following an election or the resignation of the First or Deputy First Minister.
I was pleased to serve on the Bill Committee for that legislation, and it is now clear that it was timely, given the recent resignations of Northern Ireland’s First Minister and Deputy First Minister. Can my right hon. Friend assure me that he is emphasising to Northern Ireland’s political parties that they all need to play their part and work together to achieve stable devolved Government?
Yes, I can give my hon. Friend that assurance. He is absolutely right. I continue to speak to a range of stakeholders, including the party leaders in Northern Ireland, about the importance of having a strong, functioning Northern Ireland Executive. A couple of them are in the Chamber now, and I have expressed to them my desire to have a First Minister and Deputy First Minister nominated now and after the May elections.

Friend makes an important point, highlighting one of the reasons why, when we published our Command Paper in the summer, we said that, as of then, the conditions to trigger article 16 had been met. We are very clear that we do not rule that out. If we have to use article 16, we will, but we are in negotiations with the European Union. The ideal solution for us would be to come to an agreement with the EU, but that has to be one that delivers on the needs of the people of Northern Ireland.
A great strength of being an integral part of the UK is being able to benefit from the excellent trade deals being agreed around the world now that we have left the EU. Clearly, different regions and nations will have different needs from those deals, so what steps is my right hon. Friend taking to ensure that Northern Ireland’s voice is heard in trade negotiations as a means of strengthening its place in the Union?
My hon. Friend is absolutely right: as a Government of the whole United Kingdom, we are committed to ensuring that Northern Ireland’s businesses and consumers have access to and benefit from new trade deals. The Department for International Trade now has an office in Belfast and, just last month, I hosted, with the Secretary of State for International Trade, the Board of Trade in Derry/Londonderry. I look forward to doing more on that. We work with businesses in Northern Ireland and the Northern Ireland Executive to make sure that we can deliver and involve them in these opportunities.

Commons ChamberI thank the right hon. Gentleman for his wider support and I share his frustration at hearing people who purport to represent UK citizens and Northern Ireland citizens in this Chamber and virtually continuing to support the EU, which is making their lives more difficult. I welcome his support for his constituents. In paragraph 71, we are clear that we think there is potential for more robust arrangements to ensure that, as the rules are developed, they take account of the implications for Northern Ireland and provide a stronger role for those in Northern Ireland. That is an important part of it and he is right to outline that. It is why the consent mechanism is so important as we move forward and why it is important that we recognise that, although the protocol is having an impact detrimentally on people across the whole community of Northern Ireland, for any form of protocol to survive it clearly has to have the consent of the whole community of Northern Ireland. At the moment, it simply does not have that. That is why, in its current format, the protocol as it is working is unsustainable.
We know that the protocol was entered into with the best intentions by both sides, but the simple truth, is it not, is that the EU’s approach to its implementation has been so rigid as to risk considerable harm to Northern Ireland’s economy and society? Does my right hon. Friend agree that what is required now is a far more pragmatic attitude from the EU, whose leaders should recognise that a peaceful and prosperous Northern Ireland is in the best interests of us all?
My hon. Friend makes an important point. I recognise and believe that both vice-president Maroš Šefčovič and the wider EU want an outcome that is good for the people of Northern Ireland, as well as, obviously, protecting and defending their own single market. What we are saying is that to do that let us work together to get a solution that means we can deal with the issues that are fundamentally undermining the protocol, affecting its sustainability and detrimentally affecting the people of Northern Ireland. My hon. Friend is absolutely right: for peace, prosperity and sustainability, it is in everybody’s interest to get a positive outcome to the negotiations.

Commons ChamberThe right hon. Gentleman is absolutely right: victims must be a huge and important part of this process. We have been engaged with organisations such as the WAVE Trauma Centre, and I met the South East Fermanagh Foundation myself just last week. Their stories, and those of others whom I have met and talked to, are moving and in some cases, as he and many in this House will know, harrowing. He is right to talk about Members of this House, and members of my party have obviously been victims. I noticed Lord Tebbit’s powerful comments this morning about his views.
It is right that we have victims in our mind. As the right hon. Gentleman rightly outlines, we often forget that many of those who served are also victims and close to victims, which is why taking the thoughtful approach he outlines is absolutely right. It is right that there is a point at which we need to be honest with people and deal with the very painful reality of where we are and what is achievable for people. This is about acknowledging the reality of where we are with retributive justice following the sentencing Act that followed the Belfast/Good Friday agreement—the Northern Ireland (Sentences) Act 1998—and actually looking at restorative justice and reconciliation as a way forward, and at how we facilitate getting the information we need to reach accountability, truth and reconciliation. We think, after so many years of looking at this, that it is the right way forward, but I look forward to having that discussion and debate with him and with others.
For many families who lost loved ones during the troubles, the chances of achieving a criminal justice outcome are vanishingly small, which is leading, understandably, to pain, suffering and disappointment. Despite that, however, for many of them the proposal to apply a statute of limitations will be extremely difficult to accept. So will my right hon. Friend assure me that he is working with communities on all sides to ensure that everybody’s voice is heard?

Commons ChamberDoes my right hon. Friend agree that the Belfast/Good Friday agreement has brought untold benefits to Northern Ireland over the past 23 years and that it is therefore the Belfast/Good Friday agreement that must be the basis for future co-operation and political engagement?
Absolutely. We now see a vibrant, exciting economy. Whether it is FinTech, renewable energy, cyber, the creative arts or advanced engineering and manufacturing, wherever people go in Northern Ireland, they will see entrepreneurship and opportunity, which is a testament to the phenomenal success of the Belfast/Good Friday agreement. I want that to continue to live on. I am absolutely passionate about ensuring that we deliver on that for the people of Northern Ireland. We do so by respecting, delivering on and working with everything and every part of the Good Friday agreement.

Commons ChamberAs I have outlined to the hon. Gentleman before, the principles of Stormont House are important. More widely, in looking at how we deal with legacy issues and the issues of the troubles, that ability for reconciliation and information is built on those Stormont House principles, and we must ensure that we deliver on that. In this particular case, I say to the hon. Gentleman that the PSNI is independent. It has already indicated that it expects and will seek to appoint an independent force to look at this. I support it in that, but it is a matter for the Chief Constable of the PSNI. Obviously, the PSNI has its own abilities in a police investigation, and it will set its remit for taking the case forward.
Picking up from the previous point, will my right hon. Friend give a little more clarity on the PSNI review of the Finucane case to allay any concerns that the PSNI would be marking its own homework?
My hon. Friend makes an important point. We need to be clear about the difference between the PSNI process and the police ombudsman work. The independent Police Ombudsman for Northern Ireland will look at the actions and the activities of the Royal Ulster Constabulary. The PSNI will look at the case through the eyes of a police force. It is operationally independent of the Government, and as I said, it has indicated that it is likely to ask an independent force to take the case forward. I therefore believe that we can have confidence in the PSNI’s independence and in that of the process.

Commons ChamberThe UK Government are backing businesses in Northern Ireland through UK-wide measures including the coronavirus job retention scheme and the self-employed income support scheme. In preparation for the end of the transition period, we are committed to implementing the protocol. That includes unfettered access for goods moving from Northern Ireland to Great Britain.
I was pleased to be able to announce only a week or two ago the £17 million package that we put in place to protect the five ferry routes to ensure that we keep connectivity for Northern Ireland with the rest of the United Kingdom. I have had conversations with P&O and other ferry operators only in the past few days.
Just as in my constituency of Aylesbury, small businesses and the self-employed are a vital part of the economy in Northern Ireland. As we move to the next stage of the coronavirus crisis, how will my right hon. Friend ensure that they have all the guidance and support that they need to regain lost trade and to flourish once more?
