Commons ChamberI thank the hon. Lady for her question. As I said, this is a balanced judgment; there is no right or wrong answer. I am persuaded by many arguments in favour of exclusion on “arrest on suspicion of”. However, on balance—given the job we do, the role we have and the potential for vexatious complaints—I feel that exclusion at the point of charge is right. I am not saying to the hon. Lady that we will not be accused of inconsistency; we very well might be accused of that—we regularly are.
Did the right hon. Lady’s Committee give any consideration to the fact that what constitutes a charge, and what that means in terms of procedure, is different in Scotland from what it is south of the border? In England it is the initiation of criminal proceedings; in Scotland that decision is taken at a later stage by the procurator fiscal.
The right hon. Gentleman makes the point I referred to earlier: there are different points in the judicial process at which a charge or arrest is made in the different legal systems of the United Kingdom. We have three different legal systems and charges can be brought at different times.
This is a balanced judgment—there is no right or wrong answer—on the basis of what is being proposed: to remove the right of a Member of Parliament to attend the Palace of Westminster, which is an ancient right we have held for hundreds of years. We are proposing to introduce something unique and different. Based on the evidence we heard and the advice we received from the Clerks and others, exclusion on charge feels like about the right point to make that decision.

Commons ChamberI am obviously here today to talk about starting a talks process to restore devolution in Northern Ireland. Decisions about the withdrawal agreement and so on are probably above my pay grade at this point.
For as long as there has been a peace process, my party has been part of a non-partisan approach to it in this House. In that spirit, may I offer my congratulations and welcome the news that the Secretary of State brings to the House today about the resumption of talks? It is not the case, however, that the whole political process in Northern Ireland has been failing in recent years. My sister party, the Alliance party, has come forward on several occasions with different initiatives, including the appointment of an independent mediator and a review of the petition of concern process. Will the Secretary of State assure me that its voice will be heard in this process, and that the sensible suggestions that it has brought to the table thus far will be given due prominence?
I thank the right hon. Gentleman for his support and assure him that it will be an inclusive five-party talks process. The suggestions, ideas and considerations that have been put forward by all parties will of course form part of the process. We want inclusive power sharing that comprises all five parties that are eligible to be part of the Executive.

Commons ChamberI assure the right hon. Gentleman that we will consider carefully all the points he made. He will know that the Fresh Start agreement committed not only money but resources to the tackling of paramilitary activity. One of the problems is that that agreement is a responsibility of the Executive Office, which is another reason why we need to see devolution restored. [Interruption.] I agree with the right hon. Gentleman, as he shakes his head, that this needs to be tackled and dealt with. He is right that tonight we need to think about a family who are grieving, but in future we need to think about such measures.
May I add my own expression of revulsion at this most brutal and senseless act and offer my condolences and those of my party to the family of Lyra McKee and to all those who knew her?
At a moment such as this, I always think that it is important to identify some sort of positive towards which we can work. For my part, I hope that for whatever unwanted and unwantable reason that we may find ourselves here today, everybody now in this House and throughout the rest of Great Britain—I use the term Great Britain advisedly—understands that the peace in Northern Ireland is still a very, very fragile thing and not something to be taken for granted. We have seen in the most graphic way possible that when politicians leave a vacuum the men of violence will fill it. When the Secretary of State speaks to the parties in Northern Ireland later this week, will she give leadership and make sure that, as a consequence of that, we see the political process back at the centre of Northern Ireland’s life again?
The right hon. Gentleman talks about politics in Northern Ireland. Of course, Northern Ireland is one of the places in the world that has been most transformed by politics: politics won over violence; politics won over terror—words won. People made enormous sacrifices, both personally and collectively as a community, in order to achieve the peace that we have seen over the past 21 years. He is right that it is a fragile peace; things can flare up at any time, as we saw last week. Hon. and right hon. Members have talked about the regularity of these kind of attacks and activities. Business as usual in Northern Ireland is not business as usual as many people in Great Britain would expect it to be, or would accept, and that needs to change. It is absolutely clear that we need to have devolution restored, but the lack of devolution is not the reason for these attacks. These attacks have been going on for far too long. There is no excuse for the acts that we saw; there is no excuse for anything that we have seen; and there is no excuse for the person who pulled that trigger and shot Lyra McKee.

Commons ChamberI think my hon. and gallant Friend is referring to recommendations from the Hart review, which are currently being consulted on as a process that would need to happen irrespective of whether there are Ministers in Stormont. We are ensuring that work is continuing that would need to be done in any event, so that when Ministers are back in Stormont, they can take the decisions necessary to see redress for those victims.
There is nothing in the Secretary of State’s analysis with which I take issue, but the fact is that we find ourselves in the middle of a quite remarkable period of drift. Surely now is the time for us to take more proactive steps and bring in somebody from outside the political system in Northern Ireland—hopefully one who is respected in the way that Senator Mitchell was—to free up this logjam. It cannot be allowed to drift on like this.
I agree that we do not want to see anything drifting on, and I am determined to ensure that it does not. The right hon. Gentleman suggests that an independent mediator or chair may be appropriate. There is not a consensus across the parties in Northern Ireland that that would be helpful, but I am open to exploring whatever the right way to do this is, because I want to see devolution restored and Ministers in Stormont as soon as possible.

Commons ChamberMy right hon. Friend is absolutely right that, when you stand in Londonderry, you see the border is there—it is not a distant thing. People are travelling to and fro across that border every day to go to work and to doctor and hospital appointments, and to see family and friends. He is also right about the cross-border co-operation. The co-operation between An Garda Síochána and the PSNI has never been stronger, particularly as the commissioner of the Garda, Drew Hendry, was the deputy chief constable of the PSNI. It was very moving that Drew Hendry attended the national police memorial, which was held in Belfast in October, in his An Garda Síochána uniform to show solidarity with police services across the whole United Kingdom.
I, too, thank the Secretary of State for advance sight of her statement. This incident is of a sort that we all hoped belonged in the past but, in truth, those of us who are briefed regularly by police and security services in Northern Ireland have long known that this was not just possible but likely. The men of violence only have to get lucky once. This, though, should be an opportunity to turn a negative into a positive. It should be the moment when all parties of Northern Ireland understand the importance of giving a democratic response to a provocation of violence. This is why it is important that we have all the democratic institutions in Northern Ireland functioning. Will she inject fresh impetus to that process, if necessary bringing in an outside mediator to get things moving?
May I correct the record? I said Drew Hendry, but I meant Drew Harris. I apologise for that.
The right hon. Gentleman is right that the terrorists only have to get lucky once. Our security services and the PSNI have to continue to be lucky the whole time. They do incredible work and, from the briefings he receives, he will know just how much hard work happens. The threat level is “Severe”, which means that an attack is likely.
The right hon. Member for Belfast North (Nigel Dodds) made the point that there is no excuse for the situation, but the right hon. Member for Orkney and Shetland (Mr Carmichael) referred to the situation at Stormont and is right to say that politics can overcome violence—it overcame violence in 1988 and it will continue to do so. It is important that the politicians now do the right thing. We want to see them back in Stormont and making the decisions that need to be made on behalf of their constituents.

Commons ChamberThe Northern Ireland (Executive Formation and Exercise of Functions) Bill provides for a period in which an Executive can be formed at any time without an election having to be called. I have remained in contact with the Northern Ireland parties during the passage of the Bill and will discuss its implementation and next steps in a roundtable meeting with them tomorrow.
As I said earlier, the best thing for the people of Northern Ireland would be if the politicians whom they elected come together to form an Executive, get back into the Assembly and make decisions on their behalf. As a member of this Government, I support devolution across the whole United Kingdom, and I want to see it operating properly.
Does the first report of the Independent Reporting Commission not illustrate that the political parties of Northern Ireland must choose one of two sides at this point? They are either on the side of getting the Executive back up and running, or else they are on the side of growing paramilitarism and all the attendant dangers that that brings.
The right hon. Gentleman makes an important point. The Independent Reporting Commission’s first report is clear that the decisions that would benefit everybody in Northern Ireland must be made by Ministers. We have passed a Bill that will enable civil servants to make decisions to allow the continued running of public services, but they are clearly no substitute for elected politicians and Ministers in Stormont.

Commons ChamberI apologise to the hon. Member for Vauxhall (Kate Hoey). My hon. Friend raises the point that she raised. I will address both their points now. We are all concerned about the sustainability of the Executive. This issue needs to be resolved. Clearly, the changes made to the Belfast agreement in the 2007 St Andrews agreement have made the situation we have found ourselves in for the past 19 months more likely. We therefore need to look at the sustainability of the Executive. On a plan or framework for talks, I want to meet all the main parties in Northern Ireland over the next few weeks and make a decision at that stage. As I said earlier, it is important to be pragmatic. We cannot impose this decision; it has to be taken by the politicians in Northern Ireland, on behalf of the people of Northern Ireland.
May I invite the Secretary of State to join me in commending Naomi Long on the initiative she took earlier this week in relation to getting the parties together at Stormont and talking? It is surely apparent now that the exercise in collective hand-wringing that we are all engaged in here today is not going to bring about the change that we need. In the past, when we reached an impasse of this sort, we looked outside—I am thinking of the likes of Senator George Mitchell and others who played an important role in moving on the process when that was necessary. Will the Secretary of State give that sort of initiative the bulk of her attention, because, frankly, as somebody who has been engaged in this issue for years now, I do not see any other means of achieving the progress that we need?
The right hon. Gentleman is right to refer to the initiative of the Alliance party and Naomi Long, who I spoke to earlier today. I commend her for taking that initiative, which demonstrates that there is some low-level engagement between the parties. That is something I want to explore. As I said in my statement, I rule nothing out. I will look at all options, but I need to do the right thing by the parties in Northern Ireland. As I have said previously, I cannot impose this; it has to be something that the parties in Northern Ireland are willing to choose and comply with.

Commons ChamberClearly, the matter to which my hon. Friend refers is a matter for the House, and I know that there are hon. Members who are well versed in the procedures needed for such matters. The issue of MLA pay is something I need to look at as a result of the review by Trevor Reaney, and I would welcome representations from all about that matter.
May I, too, thank the Secretary of State for advance sight of the statement? The measures that she has brought to the House are to be supported. It is sad but inevitable that it should have to happen this way, but all that we are doing is treating the symptoms, not the underlying disease.
The Secretary of State will have seen the recent comments of the chairperson of the Policing Board about the need for proper accountability of policing in Northern Ireland. The fact that the Police Service of Northern Ireland spends £125,000 a day on overtime demonstrates that the chairperson of the Policing Board is right, and is that not something else that needs to be tackled?
The right hon. Gentleman makes a point that demonstrates once again why we need devolved government in Stormont. I have met the chair of the Policing Board, and I have also spoken to the Chief Constable about this matter. They are both keen that political representation on the Policing Board should be restored as soon as possible so that there is proper governance. I will be in Washington at the end of the week for the St Patrick’s day events there, and I believe that the chair of the Policing Board will be there too, and I hope to catch up with her and discuss how we might make that a reality.

Since the last oral questions, the Department has lost an excellent Minister in Rob Wilson and I would like publicly to express my thanks for all his work. He is very sadly missed. We have, however, gained another excellent Minister, my hon. Friend the hon. Member for Salisbury (John Glen). I welcome him to the team and congratulate him on his stellar first performance at the Dispatch Box, which we have all just witnessed.
We are mid-way through a huge year for sporting events in the UK and I wish all British contestants well. I am sure all hon. Members will join me in wishing a very happy birthday to Britain’s biggest arts festival, the Edinburgh Festival, which turns 70 this summer. I will just check that my hon. Friend the Member for Mole Valley (Sir Paul Beresford) is not in his place before saying that I am sure all hon. Members will join me in wishing the British and Irish Lions well in their test at the weekend.
Research published by the campaign to cut VAT for tourism has shown how that could be transformative for this most crucial sector. Is this something the Secretary of State is discussing with her colleague, the Chancellor of the Exchequer? If it is not, may I suggest that she start soon? This was not just in our manifesto; it was also in the Democratic Unionist party’s.
I have been lobbied on this matter on a number of occasions. As the Member of Parliament who represents Alton Towers, I have, as I am sure the right hon. Gentleman can imagine, been lobbied on it on a number of occasions. It is, of course, a matter for the Treasury, but we continue to have conversations.
My hon. Friend’s point is exactly what I concluded, having considered the representations. There needs to be a distinction between the work of the independent regulator in determining who is a fit and proper person to hold a broadcasting licence versus the role of the Secretary of State when it comes to determining whether a media merger can go ahead under the terms of the Enterprise Act.
Having encouraged the Secretary of State to take this course of action, may I now welcome the fact that she has done so? She deserves credit for doing the right thing, and I have no doubt that she will have the support of the House as this matter goes forward. Many years ago, I served on the Standing Committee that considered the Enterprise Bill, and I recall that the provisions on this process were supported by all parties at that time. It strikes me, however, that in the light of this experience, it might be appropriate at its conclusion to revisit whether we do in fact have the processes we really need to ensure that we get the ends that we want to achieve.
I thank the right hon. Gentleman for welcoming this. If he wants to make representations to me regarding the Enterprise Act and areas in which he feels changes could be made in the light of changing broadcasting and consuming habits, I will of course look at them carefully.

I am sorry to disappoint the hon. Lady, but I will not be making any comments on the process, its merits or otherwise.
The Minister is at pains to tell us what she cannot do, and we respect that of course, but can she give us an assurance that she will use her office to ensure that there is a proper plurality of ownership of the media in this country, and that the views of this House, which have been clearly and frequently expressed, will also be respected at the end of this process?
I fully appreciate the level of interest in the matter. I am sure that the House will continue to debate these issues, and it is absolutely right that it should do so. It is equally important, as the right hon. Gentleman says, that I discharge my functions in line with the legislation and in accordance with my quasi-judicial role.

Commons ChamberI repeat the answer I gave to my hon. Friend the Member for Kettering (Mr Hollobone): not only does the new charter require impartiality, but we have Ofcom to regulate that, a new unitary board with management responsibilities for the BBC and the National Audit Office looking at value for money. I think that that package of regulation and value-for-money auditing should give my hon. Friend the Member for Wellingborough (Mr Bone) the comfort he needs.
Will the Secretary of State speak to the BBC about the role it can play in the future of Gaelic language broadcasting? It currently spends less than 0.25% on Gaelic programming, and as a result the otherwise excellent BBC Alba is left with a 74% repeat rate.
I am sure that the right hon. Gentleman will welcome the fact that this is an 11-year settlement that will guarantee Gaelic language broadcasting. I would be happy to discuss the matter further with the BBC, but I am sure that he welcomes the fact that this is a long-term sustainable settlement.

Commons ChamberI think “distinctive” means both those things. It means that the BBC is a unique and distinctive broadcaster that offers a range of outputs across television and radio, appeals to a wide variety of the population and offers programming that simply would not be delivered in a commercial context.
One of the distinctive areas and advantages of the BBC is its ability to take forward policy initiatives such as commitments to minority language broadcasting. Does the Secretary of State understand the concern felt among those in the excellent operation at BBC Alba that the framework agreement as currently drafted is not entirely to their advantage? It needs to be looked again, particularly with regard to the fact that the funding source should continue to come from the BBC UK pot as part of a commitment to minority languages across the whole of the UK.

Commons ChamberLike many right hon. and hon. Members, I have over the years campaigned in different parts of the world against human rights abuses. We have been able to do that because Britain is seen across the globe as a tolerant liberal community that has always been prepared to protect all our peoples. Does the Minister share my horror that we should find ourselves in a position today where the United Nations High Commissioner for Human Rights feels it necessary to urge us to act on this matter? These people are eating away at the fabric of our community from the inside, but they also risk diminishing our standing on the world stage. That is why the Minister is right to act in the way she does, but Government alone cannot do this. She needs to work with local authorities, civic groups and voluntary organisations to ensure that we build the broadest possible coalition against hatred.
The right hon. Gentleman is right that this cannot be solved by Government alone or by legislation. This is something we all have to act on. The hate crime action plan we are working on is cross-Government, but it cuts across all sectors and all parts of society, including civil society, local government and other agencies.
