Commons ChamberUnder the protocol as it was, all parcels would have needed to complete full international customs processes. I believe that the suppliers to whom the hon. Gentleman refers will be making their plans under the protocol as it was. Under the Windsor framework, parcels to consumers will not be subject to those burdensome processes. He reminds us all that we need to redouble our efforts to communicate to suppliers the message that they will be able to take advantage of a new green lane and supply to consumers in Northern Ireland. It is a subject close to my heart, and I can see that it is extremely close to his too.
The Northern Ireland Budget (No. 2) Bill 2023-24 is progressing through Parliament and is due to be debated in the other House next week. The Secretary of State has used his powers to request information and advice from the Northern Ireland civil service on measures that could generate revenue and improve the sustainability of public finances.
I thank my hon. Friend for his answer. I congratulate him and the Secretary of State on their anniversaries and pay tribute to them for all they have done in the past year.
Some have suggested that we could reform the Barnett formula to address the sustainability of public finances in Northern Ireland, but does my hon. Friend agree that that is not a silver bullet, and that trade-offs will need to be made to fund public services?
I am extremely grateful to my hon. Friend for his question. This is a very important point. Although we will remain open to discussing proposals put to us by the Northern Ireland parties, it would not be a silver bullet to reform the Barnett formula. An Executive will still need to make trade-offs when they decide to spend scarce resources. Negotiations between the Welsh Government and the Treasury on a fiscal framework, which included an adjustment to the Barnett formula, took place over seven years, so, with the best will in the world, it is not an issue that can be solved overnight. What we need is a functioning Executive and we stand ready to work with that Executive. In the meantime, we will continue to engage with the Northern Ireland civil service on a range of measures that could improve fiscal sustainability.

I thank the Secretary of State for setting out how the brake will operate. Will he join me in urging those considering these proposals before the House today to note that, for many years, people said it was impossible to have an application to stop the ratchet of EU law and to keep Northern Ireland in the Union?
I absolutely agree with my hon. Friend. I was also told that this would be an impossible ask. Throughout my time in the European Parliament and, indeed, as chairman of an illustrious body of MPs in this place, I never thought this would be achievable, yet the Government have managed to achieve it.
These regulations could scarcely make things clearer. The overwhelming presumption is that, unless the Assembly says yes, the Government must say no.
Finally, as with any international agreement, if the EU considers that the UK has improperly pulled the brake, it may choose to initiate a dispute, but we need to be clear that any dispute could only arise after the rules have been disapplied in Northern Ireland, and the resolution of that dispute would be for an arbitration panel. The European Court of Justice would have no role in resolving a dispute.
These regulations make the case for functioning devolved institutions in Northern Ireland even more compelling. The measures will become operable only when the institutions are restored. Denying the people of Northern Ireland will not only deny them the basic right to an effective, stable Government but will deny them full democratic input into the laws that apply to Northern Ireland, and that denial cannot be justified.
These regulations give domestic legal effect to this democratic safeguard and restore the UK’s sovereignty. We should consider carefully how we vote on this measure, without which Northern Ireland would continue to have full and automatic dynamic alignment with EU goods rules, with no say for the Northern Ireland Assembly and no veto on amending or replacing those measures. That is an intolerable situation, and I urge all hon. and right hon. Members to vote to end that full and automatic dynamic alignment. I therefore commend these regulations to the House.

Commons ChamberI intend to spend a lot of time working on all three strands. I would like to think the hon. Lady has already noticed a complete change in tone, emphasis and friendship between the Government of Ireland and the Government of the United Kingdom. How we work is based on respect and trust, which is what I intend to bring to all my relationships both with institutions based on the three strands and with those outside the strands.
It is never easy to be Northern Ireland Secretary but, with the current impasse, it would be no wonder if my right hon. Friend thought back fondly on his time as Chief Whip as a time of relative simplicity. I welcome the clarity he has provided today on the opportunity for more dialogue, reconciliation and compromise. Does he agree that all parties, including the UK Government, the EU and the parties in Northern Ireland, must use this time to break the stalemate and to ensure the Executive is restored in time for the 25th anniversary of the Belfast/Good Friday agreement?
I am not sure whether I look back fondly on those times, but they were certainly very interesting. I had already lost my hair, so it is difficult to judge.
My hon. Friend is absolutely right. We now have time and space both to reflect and to understand everyone’s position. The Unionist community in Northern Ireland has articulated a principled position with reference to issues with the protocol, which I completely understand. To fix it, we need time and space to have those discussions with our European Commission interlocutors. That is part of what I hope to do with the forthcoming legislation.

My hon. Friend is an avid champion for his constituents. He might have missed what I said earlier, but there are now 13,576 more police on the streets of this country as a result of the actions taken by this Government. There are also tougher sentences, which were opposed by the party opposite. We are cracking down on drugs gangs, whereas the Labour party is soft on drugs. I think the Leader of the Opposition said he would decriminalise drugs and that he did not want people found with class A drugs to face prison sentences—I think I heard him say that.
Of course, we are also cracking down on cross-channel gangs that risk the lives of migrants in the English channel. We are cracking down on them and, as far as I know, the Labour party would scrap the economic and migration partnership with Rwanda. We have a plan; they do not.

I appreciate that the hon. Gentleman outlines a strength of feeling that is absolutely there. The tension and palpable feeling within the Unionist community over what has happened in the past few weeks is clear, particularly following the action on that Friday night. I know he has made the case quite strongly about that. This is why it is important that we all work hard to ensure that we can find a pragmatic, flexible way to move forward to ensure that we can deliver things for the people in Northern Ireland in the way that was always intended. Ultimately, the future of the protocol will be in the hands of the people of Northern Ireland, through the consent mechanism.
Can my right hon. Friend confirm that he will continue to work with the EU, and hold it to its recent commitment in the Joint Committee to act at pace in further negotiations and in so doing always act in the best interests of the people of Northern Ireland?
Yes, absolutely. From talking in the meetings we have had with Vice-President Maroš Šefčovič, I absolutely believe his commitment to wanting not only to work at pace but to understand the sense and feeling across the entire community and businesses in Northern Ireland. We had the engagement we organised for him just a few weeks ago, and the EU has pledged to do more of that engagement, which is a good thing, so that it can fully understand the needs of both communities and the business community in Northern Ireland. That is an important thing to continue as we move forward.

Absolutely explicitly, there is nothing in the United Kingdom Internal Market Bill that in any way contradicts the Good Friday agreement or our delivery on it. We want to ensure that we can protect the unfettered access to the rest of the UK on which the Northern Ireland economy depends. That is something that the hon. Member and his party should be working with us to deliver.
I thank the Minister for his answers. Perhaps if we were having this question in a week’s time, we would have some more clarity, because the negotiations are clearly moving to a conclusion. We all hope it will be a successful one. While I recognise that the Minister cannot comment on the details, will he confirm that any permanent EU presence in Northern Ireland will be resisted by the Government and that, while the Commission will have rights of supervision, all checks on agrifood entering Northern Ireland will be conducted by British authorities?
I confirm to my hon. Friend that this is something on which we have taken a clear position in the UK-EU Joint Committee. It is for the UK to implement the protocol. As I said to my hon. Friend the Member for Beckenham (Bob Stewart), the details of that implementation should be for UK officials, employees of the UK Government and their partners in the devolved Administrations, not for the EU.

I am sure that the hon. Lady will appreciate that, as I said earlier, there are some precedents in very specific, technical circumstances. Countries around the world, including some of those that we will be looking to and are working to secure trade deals with, vary their position on international laws, as I have outlined that we will be doing in this situation. As our trade negotiations start and are ongoing, countries around the world will be looking at the UK as a country that is outward-looking and global, that believes in free trade and that wants to deliver that for the benefit of economies around the world and for the United Kingdom. I want to make sure that Northern Ireland benefits from that. The clauses that we put in the Bill tomorrow will ensure that, regardless of anything else, Northern Ireland will benefit from those kinds of trade deals.
I thank the Secretary of State for his earlier answers to my colleagues, which have given me and my constituents in Newcastle-under-Lyme reassurance that, although we all want a deal, we will not compromise in the negotiations on the things that make our state independent. On Northern Ireland, does he agree that we need “flexible and imaginative solutions”? Those are not my words, but the words in the EU negotiation guidelines.

Commons ChamberWe have massively increased our spending on universal credit, but the hon. Lady raises an important point about access to benefits for terminally ill people, and I will undertake, if I may, Mr Speaker, to revert to her as soon as possible by writing.
I refer my hon. Friend to what I said to our hon. Friend the Member for Eastbourne (Caroline Ansell) just now. We will continue to support the hospitality sector in all the ways that I have described, but, of course, what could also happen is that people in Newcastle-under-Lyme could be encouraged to enjoy themselves sensibly, in a covid-secure way, and keep the purple flag flying above it.
