Lords ChamberMy Lords, I am not convinced of the merit of this amendment. Actually, I have taken comfort from the words of the noble Lord, Lord Purvis of Tweed, on the detailed arguments. I know from my experience of operating in Turkey—both with retail outlets and as a source of agricultural, clothing and electronic goods for shops in other member states and in the UK—that it is not an entirely happy situation to be in a customs union and not in the European Union or a single market.
Turkey was at the time keen to get into the European Union properly, partly because of the problems that the arrangements caused. It is very frustrating not to have influence over the tariffs and rules at the border of your country. Essentially, you are a rule-taker, as the noble Lord, Lord Purvis of Tweed, acknowledged. I also recall the lorry delays that he mentioned—so not very frictionless. My recollection is that the rules on the common external tariff also restricted Turkey’s ability to renegotiate independent trade agreements with third countries. That is something that the noble Lord, Lord Hannay, acknowledged. If we go down the road proposed in the amendment, we could be caught up in the EU system of protectionism—which, sadly, I expect to increase without the UK at the table.
On a brighter note, I was glad to see this afternoon that Dr Fox, the International Trade Secretary, had agreed in principle to a UK-Israel agreement—so he has been busy in Switzerland. Rather than going down the road of the amendment, I would prefer one last push to negotiate a good deal with the EU. There is more to do, but we should keep trying, especially on the backstop. Some parts of the Government have clearly not given up, as we heard in the EU Committee today from the Secretary of State, Steve Barclay, which is why, of course, I am afraid I missed some of today’s proceedings.
My Lords, to be brief, as some others have put it, and with the greatest of respect, as the noble Lord, Lord Kerr, would put it, perhaps I might probe the Labour Party’s position on this. I used to hear members of the Labour Party, including many of those on the Front Bench in another place, make the argument that the problem with a customs union was that it hurt developing countries because of the external tariff. I would like to know what has happened to the argument and why we do not hear it from the Labour Party any more.

Lords ChamberI am surprised that the noble Lord talks about a London focus because I think this Government have actually changed. We have had the northern powerhouse document, which I hope he has read, which we published at the time of the Autumn Statement. We are undertaking an industrial strategy which I look forward to discussing in this House. The importance of place will come through strongly in that strategy. I note the other points that he has made.
My Lords, would my noble friend consider looking at a proposal from the North East Chamber of Commerce to create a free trade zone in the north-east to build on the continuing success of the north-east economy?
I am glad to hear from my noble friend, who introduced me to some of the joys of the industry of the north-east. I have indeed seen the North East Chamber of Commerce’s manifesto, which makes very interesting reading. In terms of the future on trade and on Brexit, we are carrying out a range of analysis to inform our negotiating strategy, and I shall certainly bear in mind the points that he made. But I think that you need to look at the United Kingdom as a whole.

Lords ChamberThe trustees will have all they need to do their job, but the noble Lord will of course recall from our lengthy and useful discussions during the passage of the Bill that their role relates to the articles of association, ensuring that the green purposes of the bank are maintained. That is where they come in: they are not envisaged as a management board for the GIB, whether in its current state or whatever. They have an important role to play.
My Lords, are green investments judged by their results or their intentions?
The GIB is a commercial operation. It has its purposes, and it judges where it should make investments. What we have in the GIB—a world first—is a dedicated green investment bank, which we should celebrate and which a number of bidders have showed an interest in acquiring so it can move forwards and expand.

Lords ChamberI certainly agree with the noble Lord that the aerospace and aviation industries are incredibly important to Britain. I have already asked on a previous occasion to have a conversation with him about Yeovil in particular, so that I can report to my noble friend and other Ministers who deal with these issues. Especially at this time of uncertainty with Brexit, we need to engage more with business across the UK and discuss difficult issues that arise.
My Lords, will the Minister confirm that Nissan’s practice, when choosing at which plant to build a new model, is to organise competitive tendering among its plants all around the world, that the best one wins and that that is why this decision has come? As recently as August, the BBC was reporting that Nissan in Sunderland would not even be able to bid for these new models, let alone win those competitions—a speculation in the long tradition of pessimism about the Nissan plant, going back to how it would be lost if we did not join the Euro et cetera. This is a tribute to the fact that, whatever the conditions, this plant is highly competitive thanks to the brilliant work done in the north-east of England.
My noble friend is entirely right. It is great news and a tribute to Sunderland and the people of Sunderland. I am delighted to know that Nissan in the UK scores so very well in the international league tables.
The noble Lord is right about online crime. Last week we announced that we will be raising the penalty from two years to 10 years when legislative time can be made available. On figures, we have an IP crime group which brings together all the different people involved, from the top of the police to local trading standards. Getting better data is one of the frustrations. We are trying but it is not perfect.
My Lords, on World Intellectual Property Day, does my noble friend agree that, while it is important to protect intellectual property, sometimes the defence of intellectual property goes too far and stifles innovation, particularly in parts of the United States system? Speaking as an author, I am not entirely sure why my grandchildren should get royalties from my books just to satisfy the Walt Disney Corporation.
I have no wish to adopt the US system here. We are working hard to improve the arrangements on a worldwide basis. Copyright is 70 years —that has been agreed internationally. People have different views as to whether that is right or wrong but it helps our creative sector enormously.
I applaud the work of the noble Lord both as a Member of Parliament in that area and indeed as shadow Secretary of State, and of course I acknowledge the sacrifices that have been made by steelworkers and their families in Wales and more generally across the UK. These things are very difficult. Indeed, that is one of the reasons we are taking the measures that we have set out today. We have said that we are willing to provide a much broader degree of support for Port Talbot and that in the future, procurement rules will allow a greater degree of buying British than has been possible in the past. The noble Lord is right to say that steel is a core industry for any country.
My Lords, could my noble friend remind the House which party was in power when the Climate Change Act 2008 that was referred to by my noble friend Lord Howell and which was responsible for the high energy costs mentioned by the noble Lord, Lord Hain, was passed?
As my noble friend knows well, the legislation was passed largely under a Labour Government. As I have already set out in reply to my noble friend Lord Lawson, we see things differently. It has had quite a serious impact and there are a number of things that we are doing, most importantly the change announced in the Autumn Statement that we will exempt energy-intensive industries from renewables policy costs. These are difficult issues and arguably the balance has not been quite right, but we are moving to change it.
My Lords, most employers using zero-hours contracts value the opportunity and flexibility that they offer, and individuals on them are able to earn as much or as little as they choose. In the minority of cases when they are not used responsibly, banning exclusivity clauses will free up individuals to secure additional income elsewhere. The Department of Health is working with local authorities to ensure that the providers from which they commission services have a high-quality workforce with fair terms and conditions, and we are getting on with creating a route of redress against employers who ignore the ban.
My Lords, the focus is often on the negative aspects of zero-hours contracts. Could my noble friend explain a bit more about the advantages to individuals of some of these contracts? Surely a lot of people in work these days do not want to, or cannot, work nine to five.
Indeed, my noble friend is right. For some, this type of flexible working is a way to enter the labour market. It can open a door to employment for parents or students. The CIPD research shows that 60% of those on zero-hours contracts are satisfied with their job compared to 59% of those in permanent employment, and 65% are happier with their work/life balance compared to 58% in permanent employment. They have an important role, but of course it is important to make sure that the detail is right, and that is why we have banned exclusivity.
I always think it is important not to boast about progress, but in Europe we are widely regarded as being very much at the leading edge. Interestingly, on some scores, we are even doing well versus the sacred San Francisco and Silicon Valley, with London emerging as a premier location for digital entrepreneurs, people choosing London for IPOs and UK venture capital markets improving. Our programme, led by my honourable friend in the other place, Ed Vaizey, is moving forward the strength we have in digital anyway. The jobs that we are creating in this sector are growing at an even faster rate than the rest of employment.
My Lords, would my noble friend the Minister update the House on the progress that has been made with the GOV.UK website and digital government intervention, particularly the simplification and standardisation of how people access government websites? For example, passports and driving licence renewals are all getting much simpler.
My Lords, my noble friend puts it perfectly. All noble Lords just need to use GOV.UK to see the extraordinary improvements that have been made.
