I welcome the right hon. Gentleman to his place and look forward to working with him. As I mentioned outside the Chamber, I will happily brief him on any aspects and will arrange technical briefings from my officials so that he can be brought up to speed quickly. I would like to put on record my thanks to the former shadow Secretary of State, the hon. Member for Hove (Peter Kyle), who is present, for the way he went about his business and for the very co-operative way we dealt with business. I appreciate it and wish him well as we move forward.

The right hon. Gentleman asked about the inquiry. Yes, it needs to be expedited. A timetable has been set up by the Policing Board, which is independent, and I believe that it reports in three months’ time. It is quite a fundamental inquiry, and I hope in that time it will be able to bring all the answers required to the table. He asked about the appointment of a future chief constable; if the institutions of the Executive and the Minister for Justice are not present, we will have to pass secondary legislation in this place to allow that to happen. All that depends on the Policing Board going about its business and recruitment—I believe that is very much a rubber stamp of its work.

The right hon. Gentleman asked about the Policing Board and reform. I spoke to a number of board members before the resignation of the chief constable, and they all know that the spotlight is on them and how they deal with this. I would like to wait and see how they discharge their duties over the course of the next few weeks before I commit to reform, because there are good people there who have the ability to do the job.

Finally, on the budget, which I mentioned in my answer, the right hon. Gentleman forgot to mention that the Information Commissioner will come out with a decent fine for the data breach. We will have to take a whole host of things into account. As and when they materialise, we will look at them.

The Secretary of State mentioned the independence of the PSNI, and that funding issues lie with the Department of Justice and the Northern Ireland Executive, but may I press him on this issue? Will he use his considerable influence to ensure that the safety of all people is first and foremost, and not the cost? It is important that the influence he has is exerted to its fullest, because these are good people who find themselves in a very, very difficult position through no fault of their own.

I like to feel that I have considerable influence in Government, but I am not sure that is completely correct. However, I will use the influence I have to do the right thing by all those who work for the PSNI. All sorts of issues have come up over the past 25 years and since policing was devolved, but policing in Northern Ireland certainly seems to look and feel better, and it is beginning to get good outcomes for those who are being policed. I can only praise the officers and say that I will do everything in their support.

I hope the hon. Gentleman does not mind if I gently push back. I have yet to meet anyone in Government who thinks that the politics of Northern Ireland, and the people of Northern Ireland, are anything to do with a game. This Government take their responsibilities for every part of the Union, including and especially Northern Ireland, unbelievably seriously, and I hope we will be able to demonstrate that, with the hon. Gentleman, in the coming days and weeks.

I can give, on a personal level, the assurance that those of us who have been involved with Northern Ireland politics take it seriously. Some of us actually resigned from the Northern Ireland Office and sacrificed our ministerial careers because we cared passionately about Northern Ireland, and it is certainly not a game from the viewpoint of many of the Ministers who have served there—and most certainly not a game from the viewpoint of this Minister who resigned on principle.

The former Secretary of State has, in his own words, described the seriousness with which everyone takes Northern Ireland and its politics, and especially its people—and those people in Northern Ireland want their locally elected representatives to go back to work. So do I, and so, I believe, does everyone in the House, notwithstanding the tiny bit of work that we have to do with our European Union partners. This Bill will lay the groundwork for that to happen, and I therefore commend it to the House.

The Secretary of State and I work closely with colleagues across Government and in the Executive to support the Northern Ireland economy and make the case on air connectivity. There have been discussions with the Department for Transport and, indeed, the Treasury on those matters. As the right hon. Gentleman knows, the Treasury is reviewing the air passenger duty issue.

The Government and the devolved Administrations continue to work closely together to ensure a co-ordinated approach across the United Kingdom. As set out in our joint statement of 25 September, the UK Government and the devolved Administrations hold a

“shared commitment to suppressing the virus to the lowest possible level and keeping it there”.

Today’s news about a vaccine will be welcomed across every part of the United Kingdom. I was pleased we could agree a united approach to Christmas planning last week. Although each devolved Administration control their public health policy, we have been co-ordinating positively on our response to covid throughout the year.

Coronavirus knows no boundaries, and it is absolutely vital that the UK Government, the Irish Government and the Northern Ireland Assembly work together to deal with it. Does my hon. Friend agree that it is absolutely crucial that we have effective co-operation—north-south and east-west—and a co-ordinated approach to dealing with this pandemic?

I strongly endorse the words of my hon. Friend. This Government are determined to work together with the Northern Irish Executive and the Irish Government to ensure that measures safeguard the health and wellbeing of UK and Irish citizens. There is an existing memorandum of understanding between the chief medical officers for Northern Ireland and for Ireland, which formalises co-ordination and co-operation between the Irish Government and the Northern Ireland Executive in relation to covid-19. The Secretary of State continues to hold regular discussions with the First Minister and Deputy First Minister, as well as the Irish Government, to co-operate on covid issues.

In fact, come Wednesday, the Government are going to introduce bring a Bill that will effectively decriminalise the use of torture as part of armed conflict in certain circumstances. That is, again, almost certainly a breach of international law, so it is not a question of misfortune or mistake or carelessness; it begins to look like a habit, and it is a habit that any wise Government would be well advised to avoid. On this occasion, it is bad not just for our reputation as a player on the world stage, but it threatens the constitutional integrity of the United Kingdom as a unitary state, and the Conservatives and Unionists on the other side of the House should understand exactly what they enter into if they support it in the Lobby tonight.

It is a pleasure to follow the right hon. Member for Orkney and Shetland (Mr Carmichael). I shall speak to clauses 40 to 45. Let us be clear from the start: the Bill protects and strengthens the United Kingdom, and it safeguards peace in Northern Ireland. There is nothing in it that undermines the Belfast/Good Friday agreement, nor is there any possibility of a hard border between Northern Ireland and Ireland under any circumstances. From the very outset, the United Kingdom has acted in good faith, and it did so when it signed the withdrawal agreement and the Northern Ireland protocol. Crucially, from the outset, the UK’s understanding of the provisions in the agreement and the protocol were abundantly clear to the EU and all those at the negotiating table. It is clear to the extent that some matters need clarification that we put faith—honest faith—in the Joint Committee reaching reasonable interpretations, being fully aware of our understanding of the issues that needed to be ironed out.

It was not just our understanding of the agreement and protocol on which we relied. The Northern Ireland protocol is clear about some key aspects. Article 1, as well as affirming that nothing in the protocol should interfere with the provisions of the Belfast/Good Friday agreement, says:

“This Protocol respects the essential state functions and territorial integrity of the United Kingdom.”

Article 4 provides:

“Northern Ireland is part of the customs territory of the United Kingdom.”

Article 6 goes on to say:

“Nothing in this Protocol shall prevent the United Kingdom from ensuring unfettered market access for goods moving from Northern Ireland to other parts of the United Kingdom's internal market.”

We now find, however, that the EU is suggesting interpretations of the protocol that were never envisaged, notwithstanding the fact that the provisions are clearly set out in the protocol itself, as I have read out. There have been clear suggestions from the EU that its interpretation of the protocol would lead to the creation of a barrier within the United Kingdom, thus seriously compromising our political and economic integrity. Such action by the European Union threatens the territorial integrity of the UK. It threatens to take Northern Ireland out of the UK customs territory, and it threatens our internal market.

That is unacceptable, and no Government can sit back and allow an international organisation to do that to the very fabric of our country. The Bill is therefore a safeguard that ensures that the UK is not divided and there is no external interference in the running of our country today or in the decades to come. The Bill ensures that we leave the EU as a sovereign independent country, as the people of the UK voted to do.

It is to be hoped that an agreement can be reached with the EU. Indeed, Donald Tusk originally offered a Canada-style agreement, but to the extent that there is a material breach of good faith by the EU, we have the safety of the Bill, which not only provides for the preservation of our Union but ensures that measures are not followed through without first having obtained the consent of the House.

Finally, let us remember that all Members on these Government Benches stood as candidates at the last general election not only as Conservatives, but as Conservative and Unionist candidates. Every single Member on these Government Benches sits here as a Conservative and Unionist Member of Parliament. To now not agree the passing of this Bill would make a complete mockery of the very platform upon which we stood to get elected to Parliament.
