My Lords, I am delighted to follow the noble Lord, Lord Anderson, who raised important issues. I draw attention to my registered interests.

At Second Reading in another place, Labour’s shadow Minister described this Bill as “okay”, as did the noble Baroness, Lady Young, today—faint praise but rightly so since, although the Bill has worthy aims, it falls short on many counts, as the noble Baroness, Lady Jones, mentioned. Some of these may yet be addressed but, as it stands, the Bill reflects many missed opportunities.

Back in the 1960s, before we joined the European Union, Britain was regarded as the dirty man of Europe. Our polluted rivers, smog-filled air, filthy beaches and the appalling condition of many fast-food outlets reflected atrocious environmental standards. It was only following the application of European regulations on these matters that things improved significantly. Today, 80% of our environmental law comes from Europe. Now that we have left the EU, I shudder to think that we could face regression in such matters. The Bill is needed to replace the framework provided by the European Union with a UK framework. That obviously makes every good sense but, as always, the devil is in the detail.

The Bill fails to engage with the need to reduce Britain’s global footprint systematically, as a cornerstone of the UK’s environmental strategy. My fear is that the proposed OEP will not be truly independent and that the regulator will not be at arm’s length from government, as highlighted by the noble Lords, Lord Cameron and Lord Whitty, and the noble Baroness, Lady Boycott. There are no meaningful targets in the Bill, no strategy to counter cataclysmic threats of climate change and no guarantee against regression.

As has just been mentioned, the Bingham Centre has drawn attention to a fundamental deficiency in the new principle being introduced in the Bill for a breach of its provisions; namely, the statement of non-compliance. That does nothing to reverse the validity of the unlawful conduct and we must certainly address this issue.

Important challenges are underplayed in the Bill, such as the marine environment and the urgent need to mitigate inland flood dangers. I look forward to the promised government amendment. The Bill as it stands fails to deal adequately with airborne pollution, which is currently running at 10 times the EU safety level, with particulates killing more than 36,000 people in Britain each year. There is no real attempt to tackle plastic waste in all its forms. The Local Government Association makes the important point that while it fully supports its role in maximising the recycling of waste, the cost should rightly revert to the creators of that waste, but the Bill fails on that account too. There is a massive disparity within these islands on the recycling of waste. The figures speak for themselves: the recycling rate for local authority municipal waste in Wales now stands at over 64%—the third highest in Europe. In England, the figure remains stubbornly low. However, we in Wales also have our problems, such as the release of effluent into rivers, as the noble Earl, Lord Shrewsbury, mentioned a moment ago.

The subject matters covered by the Bill are largely devolved to Wales and Scotland, as is responsibility for associated portfolios which impact on environmental issues, such as agriculture, roads, planning, water resources and healthcare. In these circumstances, I can assume only that the workings of the Act in Wales and Scotland will be by the consent and sometimes through the agency of the Governments of Wales and Scotland and that in devolved matters covered by the Bill, the devolved legislatures will be able to amend legislation as they see fit. In Committee in the Commons, Deidre Brock MP proposed an amendment requiring that when the OEP acts in Scotland it can do so only with the consent of Scottish Ministers. The Minister, Rebecca Pow MP, responded that the OEP had been given a duty to consult devolved Governments on matters regarded as being of general UK applicability, including water. If the OEP is going to meddle with matters relating to water in Wales, it must do so only with the express consent of the Welsh Parliament. I noted the Minister’s commitment this afternoon to introduce amendments requested by Senedd Cymru and I hope they cover this most sensitive of matters.

There is one final point which I ask noble Lords to consider. The impact of global warming would devastate our grandchildren’s generation and destroy the world which we have been so profligate in failing to safeguard for future generations. How do we encourage young people to be unremittingly determined to address this issue without themselves becoming overwhelmed by the enormity of its consequences? I well remember that when I was a youngster one of the issues that worried us was nuclear conflagration. It terrified us to the point of neurosis. I am aware that many youngsters today are petrified that life on our planet could be snuffed out within two generations. In giving this subject overriding priority, we must harness their energy in a way that does not harm them. We must not sweep the issue under the carpet but empower members of the younger generation and give them agency in these matters so that they feel that their voices make a positive difference. The Bill gives an opportunity to do just that, if it is significantly strengthened, and this approach should surely be central to our thinking.

My Lords, my noble and learned friend raises some important points. I assure him that the United Kingdom is taking actions quite directly, including, as I have alluded to, with sanctions, which include asset freezes and travel bans. We are acting with our key partners to ensure that a clear message is sent to the Russian state, most recently on 19 April. The Foreign Secretary issued a statement asking for the immediate release of Mr Navalny from detention. We are working through key multilateral organisations. The UK led a G7 statement. Today we are awaiting statements due to be issued as a response at the OCPW. There are OSCE statements today on Mr Navalny and media freedom, and a European human rights ambassadors statement today covering this issue.

My Lords, will the Minister spell out in detail what new steps are being taken to stop money laundering from Russia through London? That, more than anything, will probably hit hardest those who need to have their minds focused by this outrageous issue.

My Lords, I have already detailed some of the steps that we are taking and will continue to take. I agree with the noble Lord that far too much of such money comes through the City of London, and we must seek to ensure the robustness of our regime so that such illicit finance and money does not pass through our country’s capital.

Much of the focus of the work that the Government are doing is on trying to get the food sector, at all levels, to reduce the amount of food waste generated. Clearly, that involves supermarkets packaging, advertising and presenting their products in a way that helps consumers to make the right choices, with a view to reducing their environmental footprint and food waste.

My Lords, is the Minister aware that under the Environment (Wales) Act 2016, which deals with the sustainable management of natural resources, the Welsh Government might be empowered to introduce a food waste charge on all food that is not sold or disposed of for human or animal consumption by its end date? Will he encourage the Welsh Government to act in that regard and will he consider whether such steps might be equally applicable in England?

On food waste, with our counterparts in the DAs, we learn from each other. Much of our work with WRAP, including citizen campaigns, is supported by Scotland, Wales and Northern Ireland. In the resources and waste strategy, we have committed to seek powers in our Environment Bill to impose responsibilities on producers to reduce their waste, should progress from all the current measures be insufficient to get us towards that sustainable development goal. We continue to look closely at the issue.

I will certainly convey the noble Lord’s request in relation to the NFU application, but I am afraid that is not a decision I can make here and now. The Government are committed, in the way that they were last month, last year and the year before, to the neonicotinoid restrictions that were put in place in 2018. This emergency authorisation has been approved for a very limited period for one specific crop, sugar beet, which does not flower and is grown only in the east of England. Tight controls are part of the conditions of the authorisation to minimise environmental and biodiversity impacts.

My Lords, this initiative is for England only, of course, but it will certainly have a knock-on effect on Wales. Does the Minister accept that the neonicotinoids used on sugar beet will leach into the soil and water at the base of the crop, contaminating flowering weeds, with implications for other wildlife and pollinators and triggering further pesticide treatment? The Government contend that this will be avoided by ensuring that flowering crops will not be planted in fields previously supporting sugar beet—how will this be enforced?

That is a very important point. There are examples further afield, for example in Austria, where government subsidises the creation of repair centres, which are specifically designed to employ people defined as difficult to employ; that is something we are looking at. There are so many benefits of shifting towards a reuse, repair, recycle model—with regard not just to the environment or lessening our global environmental footprint but to the economy and job opportunities, often for people who struggle otherwise to secure employment.

My Lords, as one who has until recently, given Covid, spent a large proportion of my time split between London and Wales, the difference in the recycling level at home in Wales as compared to London has been very dramatically brought home to me. Clearly, lessons can be learned in comparing how such operations are undertaken in different places. Given that 20 years has gone by since devolution was set up, might there be a case for a systematic approach to considering the best lessons that can be learned from the devolved regimes to apply in England, and indeed vice versa?

That is absolutely right—there is much that can be learned and much information, advice and ideas that can be exchanged between the various nations. The Welsh Government are often credited with having funded reuse and repair, and rightly so, but we have done this as well. In May last year, the WRAP-administered Resource Action Fund received £18 million from the Government. It was launched to support resource efficiency projects with the goal of diverting, reducing and better managing waste. We will set up further measures to support reuse and repair in the forthcoming waste prevention programme. As I said, our ambition is very high in this regard, as it is in other parts of the United Kingdom.

My Lords, we are still among the world’s richest countries. If the problem is finding the money, let us adjust the top level of income tax to share the fiscal burden fairly. The Government were elected on a manifesto pledge to maintain overseas support. If this manifesto pledge can be jettisoned, can this House, too, pick and choose which manifesto commitments we should respect?

My Lords, the Minister mentioned the situation in Wales. He was in the Chamber when the Minister, the noble Baroness, Lady Bloomfield, referred to initiatives being taken by the Welsh Government in relation to the dangers to households and businesses, and to the danger of coal tips sliding down mountain sides. Can the Minister give an assurance, which the noble Baroness, Lady Bloomfield, was not in a position to give, that there will be additional money for the Welsh Government in order to fund this work?

The noble Lord expresses a concern, shared by us all, about exacerbating the situation of not just those Daesh fighters but the families who were held. I assure him that I am in receipt of his email, which he referred to, and that we are looking at each case very closely. Where people are identified as due for prosecution—for example, if they arrive back in the UK—it will be for the Crown Prosecution Service to look at each matter individually, and appropriate action will be taken against those who committed these crimes.

My Lords, is it not disgraceful how the Kurdish people have been treated in this matter, after the stance that they took against Daesh only a short period ago? What will the Government do to show their sympathy and support for, and understanding of, the plight of the Kurdish people in these appalling circumstances?

I agree with the noble Lord and, as I said from this Dispatch Box only last week, we should keep the plight of the Kurdish community and those who led and were part of the global coalition at the forefront of our minds. They played a vital role in the defeat of Daesh—its geographical defeat, not an ideological defeat—and we stand ready to support them, particularly with humanitarian support. The decision taken by the US is regrettable and not one that we supported. Furthermore, the actions of Turkey are not ones that we support. We will seek to lend whatever support we can to the Kurdish communities on the ground, particularly those being displaced and in need of humanitarian assistance.

My Lords, I am delighted to follow the noble Lord, Lord Wrigglesworth, with whom I agree on so many aspects of these matters. Yesterday, I was also delighted to hear the noble Lord, Lord Dobbs, second the Motion; he is not in his place at the moment but I think that we all enjoyed his speech. I am particularly glad to see the noble Baroness, Lady Bennett of Manor Castle, in her place for the first time. We wish her well in her work in this Chamber.

At such a critical time in the Brexit negotiations, noble Lords will not be surprised to hear that I too will focus on some of the consequences of Brexit, particularly with regard to Wales. In doing so, I recall the central purpose of the European Union: to maintain peace on our continent.

This must be just about the strangest Queen’s Speech in the history of Parliament. The future of our relationship with our continent hangs in the balance; the future relationship between the four nations of these islands also depends on it. That may well have a knock-on effect on the future role of this House, if any. If this Queen’s Speech has any relevance, it is presumably as a draft election manifesto. Seriously, is it now the Queen’s role to participate in such a blatant party-political exercise?

This Queen’s Speech is nominally relevant to Wales too, although there is no single direct reference to Wales anywhere in it. In Wales, we have been driven by the incompetence of the Tory Brexit strategy to a position unseen for centuries, with people demonstrating in their thousands in Cardiff, Caernarfon and Merthyr Tydfil in favour of independence—not, I hasten to add, the type of independence advocated by UKIP, which seeks the UK’s detachment from Europe. People seek Wales’s independence because, in the wake of Brexit, it is only as an independent nation that we can become a member state of the European Union in our own right.

Brexit is driving Wales to look seriously at the independence option. We have seen the recent YouGov opinion poll indicating that more than 40% of those in Wales with an opinion on Welsh independence support it. They do so largely because they see the absolute devastation that will hit Wales if a no-deal Brexit goes through. It would undermine the dozens of international businesses that the old Welsh Development Agency successfully attracted to Wales as a base from which to sell, on a level playing field, to the European Union markets. I pay tribute to its former chairman, the noble Lord, Lord Rowe-Beddoe, who was with us a little earlier. He can take a lot of credit for the WDA’s success in this regard.

Such manufacturing companies now state openly that they will reconsider their investment programmes if the Government go ahead with their no-deal Brexit threat. We have hundreds of sheep farmers at their wits’ end as they face, in the event of a no-deal Brexit, a 48% tariff on their lamb exports to Europe, which will kill their industry stone dead and ruin rural Wales in the process. Little wonder that Wales has become indy-curious; if a hard Brexit goes ahead, it may well become indy-craving—a matter addressed a few moments ago by the noble Lord, Lord Anderson.

In that context, it is interesting to see the Welsh Labour Government’s recent announcement that they would support holding an independence referendum in Wales if independence-supporting parties won a majority of seats in the National Assembly at the next election. I hope, incidentally, that our friends in the Scottish Labour Party are taking note. So, voters in Wales know exactly what to do; Plaid Cymru’s inspiring leader, Adam Price, is rapidly gaining ground. This year, for the first time ever, Plaid Cymru overtook Labour in an election on an all-Wales level. No doubt we will hear the age-old scare-mongering: “How can you afford independence? Wales is too poor”. Oh my, here we go again, with the rich telling the poor that it is their own fault that they are in dire straits. Some things never change.

That is the very reason why we in Wales must take responsibility for our future into our own hands. It is in the absence of the tools to govern ourselves that we find ourselves perpetually in the economic doldrums. Decade after decade, Wales has lingered at the bottom of the UK prosperity league table, whether based on nations or on economic regions. In 2018, Wales had a GVA per capita of less than £20,000, compared with England’s at more than £28,000 per capita—40% higher —so we are told that we cannot afford to be independent. That is what Westminster told Ireland, decade after decade, throughout the 19th century at a time when, under British rule, a million Irish men and women died of famine. Ireland now has an income per head above that of the UK. Does anyone seriously pretend that Ireland would enjoy such prosperity if it were still under Westminster rule? Critically, Ireland has achieved its economic success because it is a member state of the European Union in its own right. Wales will secure the possibility of such economic success only by becoming a full member state of the EU in its own right. The British state has failed to secure economic parity across these islands. One can legitimately ask whether it has even tried.

I readily accept that it is not just Wales that has suffered from such economic disparity. The north-east of England also suffers and needs regional stimulus. So, I note with interest that the Queen’s Speech includes a commitment to the,

pointedly avoiding taking any responsibility for doing anything at Westminster to help regional economic regeneration in Wales, Scotland or Northern Ireland. In fact, along with Wales, Northern Ireland languishes at the bottom of the UK prosperity league table. It is little wonder that an increasing number of people there are asking themselves whether they might be better off in a united Ireland inside the European Union. The failure of successive Governments at Westminster to address the economic disparity within these islands could now be made even worse by this Government stupidly attaching themselves to a no-deal Brexit. If that happens, let there be no doubt: it will be the trigger for ending the United Kingdom in its present form. There were alternatives but it is now too late. In any case, I do not think that England is psychologically capable of making the necessary adjustments that could have facilitated an alternative way forward for Wales and Scotland.

I have been a Member of this House for eight years. I have tried to argue the case for Wales, as seen by Plaid Cymru, to the extent possible for a one-man band in an 800-seat Chamber. Others argue the Welsh case from their own perspectives here in this Chamber, as do 40 MPs in another place. But people in Wales increasingly believe that we have all failed. They are coming to the view that Westminster in its present configuration has not only failed to deliver, but is incapable of changing its approach to produce a significantly better outcome. That is why, rather than moaning for ever and a day about the failures of Westminster, people in Wales are waking up to the fact that we must look to ourselves for our salvation. It was ever thus, but the realisation of that fact is now the driver in Wales, as it is in Scotland, to find a new path to a new future which brings new hope. Hope is something that has been in preciously short supply in either Chamber in Westminster in recent times. I greatly regret that this Queen’s Speech does nothing to address, let alone redress, that reality.

My Lords, I have taken note of that stricture.

I believe that it was an absolute disaster that electors voted to leave the EU, but I accept that the vote cannot be ignored. People voted out for a variety of reasons. Some did so to redirect £350 million a week to the NHS. Many farmers protested against CAP bureaucracy, while some small business owners wanted a reduction in EU regulations, and others of course wanted to see a reduction in immigration levels. What they did not have an opportunity to state was what they wanted in place of our membership of the EU. Different Brexit campaigners advocated different options. Some wanted a Norwegian or Swiss model which would retain our access to the single market. Some saw Albania, Turkey or even Ukraine as possible models. Some based their case on securing a Canada-type deal while others were happy to advocate trading under the World Trade Organization rules—accepting that that may mean tariffs for customers within the EU market.

The referendum may have given a mandate to quit the EU but it did not provide a mandate for which alternative option the Government should seek, nor do the present Government have a mandate from a general election. That brings us to the central role that Parliament, along with the Scottish Parliament, the Northern Ireland Assembly and the National Assembly for Wales, must play in deciding on the preferred option that the UK Government and their devolved partners should aim to negotiate for.

For both the agricultural sector and manufacturing industries the overwhelming case is for the UK to retain its place within the single market of 500 million people free from any tariff barriers. There are some 200 companies in Wales from the United States and 50 from Japan, many of which have located in Wales to sell their products to the European market. For us to lose our tariff-free access to this market would be industrial suicide. Likewise for agriculture, where more than 90% of Welsh lamb and beef exports go to the EU. If they were to face a 14% tariff barrier, as has been suggested would be the case if we traded under WTO rules, it would mean the kiss of death to the industry that is the backbone of the rural Welsh economy. Continuing our trading relationships within the single market is an essential for both manufacturing and agriculture. That must be the fundamental objective of the Government’s negotiating position, and they should say so quite explicitly.

To secure our free involvement in the single market for manufactured goods and agricultural products, we need to accept the free movement of people. I would argue that we will largely have to do that in any case because of the open border the UK has with the Irish Republic. I believe that before an Article 50 application is made, the Government must tell Parliament what their broad objectives are in their negotiations with the EU, and they should be subject to a parliamentary vote to ratify them. If the Government refuse to allow Parliament to have such a vote, Parliament must retain the right to refuse to endorse the outcome of the negotiations if they are deemed to be inadequate, and in those circumstances to direct the Government to withdraw their Article 50 application, which we can see is now legally possible. If the Government refuse, the objectives should be put to the people in a further referendum. In that way the people who took the decision to quit the EU will have the final say on whether they are content to do so under the terms that the Government have negotiated. What could be fairer than that?
