Lords ChamberMy Lords, I am grateful for the opportunity to contribute to this debate on two related issues. One is real and present, the unlawful invasion of Ukraine, and the other is, we all hope, simply a hypothetical threatened use of tactical nuclear weapons by Putin. I understand the most reverend Primate is currently in Kyiv to meet leaders of Ukraine’s churches, refugees and those who have been internally displaced. This is tremendous leadership, and I am sure that act of solidarity will be appreciated.
Back in your Lordships’ House, we have heard from a number of speakers who have raised important and valuable points. The formal Opposition has a curious role at this point of trying to review the whole debate, pick out people on our side and praise them and pick out people on the other side and say they are wrong. This is very different from that. The debate today has been of extreme quality, and I do not think it is safe to comment on the various points of view from this Official Opposition position. This is the most serious thing in front of this country at the moment. There were some pretty serious other things in front of this country, but this could have the most appalling outcome. This debate had subtlety, ambiguity and complexity.
Chilcot did a review of the Iraq war. I am told it is 2.9 million words long. I was charged with trying to précis it in a morning. I think I made a reasonable fist of it because I think he said only two things. One is that decision-making should be by a pluralistic process where all ideas are tested. I hope the decision-makers in this process will follow that advice and that the reading that they do before those discussions will include this debate and the ideas that have come up. I take the point that we must keep on having these debates. The various ideas may not be where we end up, but they all need to be tested against where we all came up.
The second thing Chilcot said is that when you start something, you should have some sort of plan as to what to do next. That seems to be one area where we can gently criticise the Government. There is a need to bring out a better understanding of where the thinking is going.
It has now been 281 days since Russian forces first invaded Ukraine, on 24 February, escalating a war that dated back almost exactly eight years to when Russia annexed Crimea. We will not know the true damage of this escalation until it is over, but we can be sure that thousands, perhaps hundreds of thousands, of people have been killed or wounded, and many more have had their lives severely impacted by the illegal and terrible actions of Putin’s Russia.
I pay tribute to the bravery, skill and fortitude of the Ukrainian forces, who are the main reason why the unprovoked, premeditated invasion is not only illegal but misguided. Russia has failed to achieve its objectives. I cannot remember which Peer emphasised this point, but I have been exposed to traditional military thinking in this country and in NATO, and it was very much that when the Russians come they will overwhelm us, certainly for the first few days. The falsehood of that, and of our past assumptions, has been well brought out by this war.
The resolve of the alliance against Russia has only strengthened. Indeed, in recent months Ukraine has conducted a major counteroffensive with much success, taking back territory in the north-east, the east and Kherson region in the south. It is also believed that Russia has now exhausted, or almost exhausted, its supply of Iran-sourced one-way attack UAVs. In the last 24 hours, Ukraine claims to have killed approximately 500 Russian soldiers, destroyed three more tanks and six armoured personnel carriers, and downed three Russian reconnaissance drones.
However, it is of course not all positive, and Russian forces have made efforts to advance in eastern Ukraine, as well as training fire from tanks, mortars and artillery on Kherson following the Russian withdrawal from and Ukrainian liberation of the city early last month. Civilian infrastructure is also under heavy attack. The most recent Defence Intelligence update, shared today, highlights continued Russian attempts to disrupt Ukraine’s electrical grid, using cruise missiles, to demoralise the population. These strikes, which began in October, have caused power shortages leading to indiscriminate suffering across the country. However, stores of suitable missiles have been depleted, and the fact that this has taken place nine months into the invasion has reduced its effectiveness.
As Ukrainians continue to defend their homeland, we must continue to do all we can to support them, especially through the difficult winter months. The Government have rightly been given much credit for the support shown, and they will know that we—the Labour Official Opposition—fully support this continuing. The UK’s Armed Forces have done a tremendous job for which we should all be grateful, co-ordinating military and humanitarian support, reinforcing our allies on NATO’s eastern flank and providing training here at home through Operation Interflex. However, it should be said that most of the support we have provided, primarily the donation of weapons, has been presented through ad hoc announcements rather than a long-term strategy. While this is understandable in the early stages, we do not know how long this war will last and it shows no sign of coming to an end, so we must rethink our approach.
The Government have previously offered assurances that there is a long-term plan in place. The commitment to at least match the £2.3 billion spent is very welcome but we are keen to see more evidence of the long-term thinking. Part of that will include how we restock the supplies that have been donated, particularly through new contracts to replenish the next generation of light anti-tank weapons. To date, the approach has been rather opaque.
We must also consider humanitarian support. As well as the £2.3 billion I have just mentioned, the Government have committed to underwrite and grant at least £1.5 billion of humanitarian and fiscal aid to Ukraine through the World Bank and the European Bank for Reconstruction and Development. That is also welcome, although it is in disappointing contrast to how the Government have treated the rest of the aid budget. We will be very keen to hear how that money will be used and to be given an opportunity to scrutinise it to ensure that it is used as effectively as possible. We must also encourage other allies to follow our lead robustly.
Putin’s nuclear rhetoric is the action of a pariah state. His threats are reckless and should be condemned, not just by the UK and our allies but by all states. The situation is serious but we should remain focused on what is actually happening in Ukraine, despite the threats and distortions coming from the Kremlin. Now is not the time to weaken or dilute our support.

Lords ChamberMy Lords, when the integrated review was announced by the Prime Minister, we welcomed it. We wanted it to succeed, to keep our citizens safe and to secure Britain as a moral force for good in the world. But, after its publication, the chorus of concern has only grown. To put it simply, it is a plan for fewer troops, fewer ships and fewer planes. There is no assessment of current or future capability, no strategic principles and nothing about how the Ministry of Defence should be structured to best provide national security.
For this speech, I will focus on defence, and my noble friend Lord Collins will focus on the foreign and development policy components—but, of course, they are interrelated. On defence, I start with the Prime Minister’s comments. He said that the integrated review would end what he described as an “era of retreat”. The review and subsequent defence Command Paper made it clear that the threats facing the UK are “increasing and diversifying”. Despite these promises and expanding threats, the review is set to repeat the mistakes of the past.
The Prime Minister even broke an election promise by announcing that the size of the Army specifically will be cut by 10,000 by 2025. We urge the Government to think again. Former military chiefs, including the noble Lord, Lord Dannatt, and the noble and gallant Lord, Lord Richards, have said that further cuts to the Army would mean that the UK was
“no longer taken seriously as a military power”
and would
“damage our relationship with the US and our position in NATO”.
A slew of Navy and RAF retirements have been announced. These include “at least” two Type 23 frigates, well before new frigates will be brought into service, Typhoon tranche 1 aircraft and Hawk T1 training aircraft. We urge the Government to think again.
I will also touch on threats. The review outlines a number of threats to the UK, but fails to present a coherent strategy for deterring them. Rightly, the Command Paper names Russia as the
“greatest nuclear, conventional military and sub-threshold threat to European security.”
This is evidenced by the build-up of 100,000 Russian troops on the border of eastern Ukraine but, despite their own warning, the Government still have not fully implemented any of the Russia report’s 23 recommendations, 18 months after the report was completed. I ask the Minister a simple question: why?
With the integrated review, Ministers are making the same mistake—responding to increasing threats with more cuts. Of course, we must develop new technologies in domains such as cyberspace and artificial intelligence, but new technologies have always been harnessed to strengthen our Armed Forces; they will never entirely replace the need for boots on the ground.

Lords ChamberFrom its formation in 1997, the Department for International Development supported the world’s poorest and most vulnerable, and built Britain’s reputation as a world leader in aid and development. It is clear already that these principles are an afterthought for the new FCDO, with recent reports that the Government will abolish the 0.7% target in an attempt to blur the lines over what constitutes aid. Can the Minister commit today that there will be no revocation of the provisions of the International Development Act 2002, which guarantees that all aid spending must combat poverty?

Lords ChamberMy Lords, the only way to achieve peace in the Middle East is a two-state solution negotiated with the consent of both sides. I note that the Government have welcomed this proposal, but surely it is striking that it has been published after consultation with only one of those states. If we are to find a diplomatic resolution, the Palestinian Authority must be involved in the process. Does the Minister agree that the involvement and consent of Palestine is vital for any agreement?
My Lords, the noble Lord raises an important point, and I believe I have covered that in part in the Statement I have just repeated: the UK’s
“view remains that the best way to achieve peace is through substantive peace talks between parties, leading to a safe and secure Israel living alongside a viable and sovereign Palestinian state, based on the 1967 borders, with agreed land swaps”
and
“Jerusalem as the shared capital”.

Lords ChamberMy Lords, I too thank my noble friend Lord Turnberg for securing this debate. The tension between Iran, the US and their allies, which culminated in the killing of Iranian military leader Qasem Soleimani earlier this month, has stabilised. I am pleased that this House is able to debate Iran, and the Middle East, at a time when we have realised that the immediate ambition of all actors is to avoid conflict. The people of the Middle East deserve to live in a peaceful, stable environment, free from the fear of imminent war. The UK can play a part in enabling such an environment by encouraging all leaders to interact through international institutions and to use these as our primary mechanism for defusing future tensions.
In the long term, we have a responsibility to support a framework which commits Iran to internationally recognised norms and formalises its relations with the West. The JCPOA is an opportunity to do exactly this. Regrettably, the agreement has disintegrated following President Trump’s withdrawal, the situation worsened by Iran’s violation of the uranium enrichment clauses. Although the JCPOA is not operational in its current state, we would be mistaken to abandon it altogether unless all other avenues have been exhausted. Can the Minister confirm what steps the Government are taking to resolve the present dispute, and detail the present status of the dispute mechanism?
If the JCPOA is to collapse completely, any replacement for the agreement may take years to develop and in the vacuum of a new deal, we increase the risk of conflict. Those who oppose the JCPOA have been scarce on the detail of what would replace it. Can the Minister explain exactly what the Government believe would differ in a future agreement, in order to gain the support of Iran and the US?
The immediate priority of the UK must be to encourage Iran to comply again with the present agreement, and to ask President Trump to return to the table. However, in the absence of any overnight miracle and a new agreement, we must also consider how we can maintain the present détente. There is a responsibility, which Iran must uphold, to international law, including the non-proliferation treaty.
In recent days and weeks, the Iranian Government have again used inflammatory language. We must make it clear that this is unacceptable and serves no benefit to the Iranian people, but we must also repeat our invitation for them to come in from the cold and work with the international community.

The family of Nazanin Zaghari-Ratcliffe continues to raise concerns over her mental health, and reports emerging today suggest that this may be exacerbated by solitary confinement and being deprived of medicine. Nazanin is awaiting the outcome of her appeal to an Iranian health commission, in which she is seeking release from jail on the grounds of ill health. Can the Minister confirm when the FCO expects the judgment and what exact support is being offered in relation to the appeal?
I thank the noble Lord for his questions and for the consistent support that has been offered on this important issue. It is difficult to predict the specific date on which we will hear the next update on this matter. However, I can assure the noble Lord that we are offering full assistance to Nazanin Zaghari-Ratcliffe’s family. I met Richard Ratcliffe when I was at the UN recently and reassured him again of our full support. As I said in the Statement, we are continuing to raise this bilaterally and internationally, to ensure that we get consistent support. Unfortunately, Nazanin’s case is different because the Iranians refuse to recognise dual nationality and regard her as simply Iranian.

Lords ChamberMy Lords, the leak of the diptel cable will do extraordinary damage to the UK’s interests abroad, and the confidence of civil servants will now be marred by knowing that they cannot freely feed back their insights. The Government are right to launch an inquiry. On an issue of such significance, speed is of the essence. Can the Minister outline the timetable for the inquiry? In the immediate term, will the Minister detail what steps the Government will take to ensure that diplomats feel safe to pass on information to the FCO?
My Lords, as I have said, we rely on our diplomats to provide insights into the lay of the land. As a Minister I have visited a number of countries over the past two years in post, and in my other responsibilities as a Minister I have benefited greatly from the insights and candid nature of such diplomatic telegrams. On the specific questions the noble Lord has raised, I can say that we will seek to complete this inquiry at the earliest possible time. As the noble Lord may be aware, the cross-government investigation is being led by the Cabinet Office and will include the Foreign Office. That inquiry will report to the Cabinet Secretary. We have some incredible diplomats and the best Diplomatic Service in the world. Based on this experience there will, of course, be concern, but we have reassured our diplomats that they should continue to report in the excellent, candid manner they have done over many years.

Lords ChamberMy Lords, I thank the Minister for repeating the response. A serious discussion on the situation in Hong Kong is overdue. China’s erosion of the rights and freedoms guaranteed by the Hong Kong Basic Law has been growing since the Umbrella Movement protests in 2014. The last few years have seen an increasing crackdown on dissent and protest, political parties banned, pro-democracy candidates blocked from standing and journalists expelled.
The conviction of nine leaders of the Hong Kong Umbrella Movement, who could face seven years in prison for organising peaceful protests, as the Minister said, is totally disproportionate and clearly politically motivated. The proposal to change Hong Kong’s extradition laws means that they could serve sentences thousands of miles away in mainland China.
The Sino-British joint declaration is a legally binding treaty registered with the United Nations, and the British Government are the joint guarantor, with China, of the rights of Hong Kong citizens, so I have one simple question for the Minister: how are the Government going to fulfil their legal responsibility to the citizens of Hong Kong?
My Lords, I thank the noble Lord for raising these issues. As he will be aware—as I said in the Statement—we produce six-monthly statements as required. In his recent statement on this, the Foreign Secretary said:
“It is very welcome that in the areas of business and the independence of the judiciary, the ‘One Country, Two Systems’ model is working well. However, I am concerned that on civil and political freedoms, Hong Kong’s high degree of autonomy is being reduced”.
I assure the noble Lord that we are cognisant of the recent issues, particularly the events concerning protesters from the 2015 protests. As I have said, it would be inappropriate to comment on that case specifically, but I reassure the noble Lord that we are using all our offices—through the consul-general and direct visits that my right honourable friends the Foreign Secretary and the Minister of State have made to Asia and Hong Kong—and we will continue to speak bilaterally to the Chinese as well.

Lords ChamberI agree with the noble Lord. When we look at the detail of some of the projects—not just in defence and security; it could be, for example, hospitals that have been created through defence interventions in certain parts of the world—it is our view that projects that resonate with the common objectives of the United Kingdom and, importantly, those of NATO should continue to provide the opportunity for continued co-operation after the UK leaves the European Union.
My Lords, given the less than clear commitment of the US to NATO, and given that we, after Brexit, will be looking for a new role in the world, surely that role in defence should be pivotal in Europe. What Europe needs is combat power and, as my noble friend the Admiral has pointed out, this is an area in which we are uniquely able to assist. This is no time to be stepping away from Europe. Why were the Government not more involved in the development of PESCO and do they intend to put more effort into getting closer to Europe so that we may play a proper role in the future?
As has been said numerous times, first and foremost, yes. I refer back to our discussions on the previous Oral Question about where we stand: the UK is leaving the European Union but, as I have said repeatedly from this Dispatch Box, we are not in any way stepping away from our obligations. There will be co-operation, particularly in the areas of defence and security, which are important not just to the remaining members of the European Union but to the United Kingdom as a member of the European continent and a member of NATO. Co-operation and partnership are key, and we look forward to a renewed but different style of partnership with our European Union partners. We will continue to co-operate in areas of common interest.
