My Lords, on these Benches we also support this important amendment. It is easy to lose contact with this in the great issues of our time—trade, customs unions and defence—but children are really important. As has been said, and as the Minister herself will know from her Scottish experience, our devolved nations perhaps take this issue more seriously than we do in England. The Scottish Government have recently committed to undertaking a comprehensive audit, looking at ways to further embed the principles of the United Nations Convention on the Rights of the Child. The Government have previously said that they take children’s rights extremely seriously. It is now time to make this commitment clear, as we go through this unprecedented period of change. Let us please give our children and young people that reassurance.

My Lords, I support the amendment in the names of the noble Baroness, Lady Massey, and other noble Lords. I want to concentrate on the area of online child protection because, as some noble Lords may know, I have followed this subject over the years and the EU has had an important responsibility for it. Child sexual abuse online affects children of all ages and backgrounds and is now perhaps the biggest challenge to our child protection authorities. A recent report by the NSPCC revealed that, in 2015-16, the number of police-recorded offences relating to indecent images increased by 64% in England, 50% in Wales, 71% in Northern Ireland and 7% in Scotland. In 2016, the Internet Watch Foundation identified over 57,000 URLs containing child sexual abuse images and in its most recent annual report found that two-thirds of child abuse content online is hosted in Europe.

Methods of engaging illicitly with children online are ever more technically sophisticated, and are perpetrated by extensive, highly organised cross-border criminal networks. While child protection is a devolved matter and each of the four nations of the UK has its own guidelines and definitions, it is an issue that can be effectively addressed only through strong cross-national co-ordination and collaboration. The EU has developed a harmonised legal response and facilitated cross-border co-operation to tackle this. In particular, the EU sexual exploitation directive introduced clear minimum standards for sanctions and measures to prevent abuse, combat impunity and protect victims. It includes provision for co-operation with Europol, supports constructive dialogue between member states and industry, and adapts criminal law to account for technological developments.

Many of these provisions have now been incorporated into UK domestic law, but legal responses are only part of the solution. We need continued investment in educational and technical resources and to be able to gather data and other forms of intelligence from the investigative authorities abroad. Maintaining co-operation with EU policing and criminal justice agencies and mechanisms is the best way to achieve this. We must not forget that the UK has played a significant and leading role in EU cross-border agencies, sharing our expertise and learning from others. As Peers will know, the outgoing head of Europol is British. My fear is that we may lose influence in these agencies. We have a lot to contribute to make sure that those agencies and mechanisms work effectively to keep children safe, not just in the UK but across Europe. Will the Minister tell the House how she plans to ensure that the UK will continue to use our considerable expertise to help shape EU policing and criminal justice agencies?

Online abuse comes in other forms too, including the widespread manipulation of children through exploitative online advertising, and the use and abuse of children’s personal data without their knowledge or understanding. Such practices affect children in potentially more profound ways than adults, and can significantly compound their vulnerabilities as they progress into adulthood. A strong commitment to a broader framework for children’s human rights, that promotes the rights and interests of children over and above those of commercial operators, is surely the best way of addressing this and other forms of online exploitation of children.

My Lords, I shall speak briefly to Amendments 30, 32, 38 and 57. I wonder why the issue of personal advisers being trained in speech, language and communication awareness is in this group when we will be discussing their role under a later amendment; however, we are where we are. A number of issues need to be brought together and understood, perhaps after Committee.

I shall give your Lordships a flavour of what I mean. First, let us deal with the point made by the noble Lord, Lord Ramsbotham, who rightly said that poor speech, language and communication limit not only children in care but young people generally. Eighty-eight per cent of unemployed men have speech, language and communication needs. They limit employment opportunities, affect their social and emotional well-being and contribute to literacy, behavioural and other social problems. The noble Lord, Lord Watson, said, “Let’s have mandatory screening”. What do we do in schools? Are we not screening there all the time? We are continually assessing and testing, so why do we need another form of mandatory screening? We need to ensure that that information gets passed to the relevant people.

I am sorry that my noble friend Lord McNally has been unable to stay. A year ago, I went to award the local youth offending team a dyslexia awareness certificate, which means that they can identify young offenders who have dyslexia problems. I was horrified to learn that no information is passed to that team on the academic, literacy or communication skills of those young offenders. Is that because of data protection issues? If we are to provide the necessary support for those young people in care, that information needs to be made available. If there is a body of information in schools, it needs to be passed on.

On personal advisers, your Lordships probably remember from Second Reading that I went through as many job adverts as I could find for personal advisers. I was concerned that there was no standard requirement; it was all over the place. Nowhere in any of those advertisements did I see any mention of speech, language and communication skills. The two are linked. If personal advisers are as important as they should be, part of their qualification or awareness must be in this area. How do we make that happen? Currently, there is no legal requirement on what personal advisers do, only suggestions. We need to spend time understanding that so that these people are the best who can be provided.

Finally, the key to this is making sure that the information is available in schools. By the way, this is not just an issue for children in care or care leavers, it is an issue for all children. I am glad that the Government, both in the coalition years and now, are addressing those issues in schools, through the pupil premium. I am a bit concerned—perhaps the Minister in replying could correct me on this—that we say that the pupil premium particularly should go to looked-after children. My experience in many schools is that it just goes into the common pot and the looked-after children, to use the vernacular, do not get a look-in. I want to be sure that perhaps Ofsted, when it is carrying out inspections of schools, makes sure that this pupil premium—where there are looked-after children—is particularly linked to the needs of the looked-after child.

My Lords, before I say a word on Amendment 32, it is extremely interesting how, as on the first day in Committee, fascinating bits of information from people’s background and knowledge of the whole of this area comes out, all of which is enormously valuable to those who are responsible for these Bills and this Bill in particular.

I support Amendment 32 in the names of the noble Lord, Lord Ramsbotham, and the noble Baroness, Lady Bakewell, because it states that the,

“guidance given by the Secretary of State must stipulate … the need to screen children … the need for those who work with … children … to receive training in awareness of speech, language and communication needs”,

and refers to,

“the need for appropriate support to be provided for those children and young people with speech, language and communication needs”.

Above all, I stress that there is a need to update regularly all those people who are in this position and working with these children in need. Although I agree that all children need attention and need us to be aware of how they are developing and of what particular skills that will be essential in their future lives they are lacking, nevertheless, it is those who are in this very important position who need to be updated and know exactly what is happening in this area. I am very much in support of everything that has been said on this group and I look forward to what the Minister will say.

My Lords, never again will a pupil with medical conditions be excluded from full or part-time education, school trips, physical education and extra-curricular activities because of their medical condition. I applaud the Government for the stance they have taken in this area, as do the voluntary and charitable sectors. This is light years from where we were before. This document, which is still for consultation—that will be an opportunity to feed in many of the issues—is one of the best things I have seen. It deals in detail with a whole host of issues. A few things are missing from that document, and I look forward to feeding them in during the consultation period.

The important thing for me, which is in the document, is that governing bodies will have the responsibility to ensure that the procedures are followed and that when a school is first notified that a pupil has a medical condition, action will follow. Governing bodies will also ensure that the policies cover the role of individual healthcare plans. I agree with the noble Lord, Lord Kennedy, on this—and I will be interested in the Minister’s reply—as I cannot envisage a situation where a child or young person who has a medical condition would not have a healthcare plan. I cannot get my head around that, as it seems obvious. This is not bureaucratic or about more clerical work, but just plain common sense. I hope that the Minister will respond to that point.

I like the point made in this document that supporting a child is not just the responsibility of the school but a partnership between professionals and the parents themselves. I also like that GPs will have responsibility for notifying schools when a child has a medical condition. That is important, and it has often not happened in the past. I will end by thanking the Minister for taking this important issue forward, and I look forward to his response on the issue of healthcare plans.

My Lords, I also put my name to this amendment, and I very much support everything that has been said so far on these issues. I congratulate the Government, and the noble Lord, Lord Nash, in particular, on having listened to what Peers and charities in the Health Conditions in Schools Alliance have said. They have done a great deal to work out a way forward. Again, I will not repeat the many things that have already been mentioned, which are now on the table to be worked out in detail, but the area that perhaps interests me more than any other is the role of governing bodies in ensuring that teachers in schools have the training and expertise that their staff require to cope with situations.

We all know that there is a shortage of qualified school nurses; we hope to hear from the Government how their number might be increased. It is not only that; an area that worries me concerns those with special needs that also involve mental health problems. Those students may well need guidance from an increased number of educational psychologists, among others.

We all want to hear from the Minister what plans the Government have to ensure that this partnership between so many organisations will be delivered to the benefit of children and families generally, so that they will feel—as they have not felt in the past—that they are being supported in the situations that they have to cope with and have always tried their best to cope with. However, they have felt very much that they did not get the help they deserved. I thank the Minister for what he has done so far and hope that he will be able to reassure us still further on some of the areas about which we have concern.

I support the amendment of the noble Baroness, Lady Brinton. She is a real expert in this area and it was important that she put this amendment down. I would like to stress one particular point—the role of the school in all of this. At one stage I came across a group of schools that had a very effective policy of dealing with this situation. Their method was to have a mentor for each pupil who entered the school, and the child who was mentoring got merit points for successfully introducing and making life smooth for the new student. I very much hope that we can do a little more to find out what group of schools that was—I regret to say that I have lost my details on it. It seems a very good example of best practice to sell right across the stage of all schools. As we know, it is not just a question of bullying in schools—there is bullying in all forms of life, including employment when you grow up as well.

I hope that the Minister will take all this very seriously. The role of school governors is important, and I should perhaps have mentioned earlier that I am president of the NGA. I think we have a meeting with school governors and the Minister shortly, and this is one of the items that it will be important to put on the agenda.

I support my noble friend Lady Brinton on this excellent probing amendment, and will briefly take the opportunity to say that often the bully needs support as well. I have seen many occasions where that support has been given to the bully. Sometimes the bully, with the support of the parents, is referred and the problems are sorted. I say this with great caution but often, quite rightly, we put all our emphasis on the poor child or young person who is being bullied and we forget about the bully. Often with the bully, it is a cry or plea for help. As well as doing all the excellent things that my noble friend Lady Brinton is saying we should, we have to find and understand that need.

I pay tribute to my noble friend Lord Addington. I used the expression “a dog with a bone” in Committee. He has stuck with this issue and made real progress on it. I also congratulate the Government, because we have now seen real movement: there have to be properly qualified special educational needs co-ordinators in schools. That is real progress, and the Government are to be congratulated on taking that important step.

My noble friend rightly points out two areas. One is the need to ensure that all teachers, particularly those in primary education, have training—perhaps a unit of training—in special educational needs. Every report has shown that the two crucial elements are early identification of a problem and providing the resources to deal with it. I hope that we might see movement on that. Maybe we can move towards a road map for how we ensure that all teachers going into our schools have an understanding of—maybe a qualification in—of special educational needs. I have forgotten the second issue, so I will sit down.

My Lords, I very much support the noble Lord, Lord Addington, in his pursuance of the subject. He obviously is an expert and is quite right to pursue the area, one of growing need—and not just need, but growing complexity as we begin to understand the various subsections of need that there are in SEN.

SEN co-ordinators are a good new grouping, but there is an important role for school governors. I would like to see a member of the governing body take on a genuine responsibility in the area. That would be a practical way to deal with it, not least when we have a range of education provision with rather different requirements.

I hope that we will see rather more happening in the area, but we should not forget the importance of ensuring the early intervention that has already been mentioned, and on which there was an interesting question today during Questions. It indicated that the earlier you can get to grips with this, the better. There must also be areas of retraining for teachers—not just initial training, because it will take a long time for that to infiltrate right across the spectrum. With retraining, teachers can be made much more up to date in the current needs of this vital area.

My Lords, this has been an extremely interesting debate about a very serious subject, which has encouraged a lot of your Lordships to look back at better times when it would seem that it was somewhat easier to make the right decision. We have to face the fact that things have moved on. I particularly support the amendment tabled by the noble Baroness, Lady Walmsley, because it seems that what was being said about the guidance, and indeed what the noble Lord, Lord Sutherland, said, is probably fairly accurate in that it needs tidying up. My reading of the guidance was that teachers had the right to refuse to take part in searches, so there is at least that aspect in which a teacher can exercise their own feelings and responsibility about these things.

The points made by the noble Baroness, Lady Benjamin, were worrying. It may well be that the noble Lord, Lord Cormack, is right, that if every school could agree a principle—and maybe that should be written into the Bill—that no telephones are to be brought in, or that they must be left at the gate and picked up on the way out, that might be an answer. I suspect that it would not be as simple as it might sound. Alas, we have got to look practically at what we do now. I do not envy the Minister and his team, because to get it right for this current moment is a very important but difficult job.

My Lords, I was not going to speak in this debate, but so many important comments have been made that I feel that I want to add my few words.

I very much agree with the noble Baroness, Lady Morris, that this is about safeguarding both the child and the teaching staff. I also agree with the noble Lord, Lord Cormack, that we need to engender trust in a school. The noble Lord, Lord Elton, reminded me about his report on discipline, which I remember quite well. I remember having to write an essay on it—so he is to blame.

The problems of discipline in schools are not just to do with pupils. They are to do with that group of people we were talking about in a very positive way: parents, and—dare I say it?—the legal profession. You can just imagine a situation that happens daily: that of a teacher, say in primary school, who in innocence says “Come on, hand over that game you’ve got in your pocket”, stupidly goes to reach for it, and the next thing is that there is a legal action. So all that trust has evaporated.

The guidance has to be very clearly laid down. Pupils should not have mobile phones in classrooms—and this is hugely important. It is very dangerous, for all the reasons that we have heard. Of everything that has been said, that is probably the most important, because it is not just about grooming children, but about other pupils bullying each other through mobile phones.

So why on earth schools are allowing children to have mobile phones in schools, I do not understand. In small schools, they can be handed into the school office or, as has been suggested, go in a locker. I hope the guidance is very clear. It is about ensuring the protection and the safeguarding of the pupil, as much as the safeguarding of the teacher.
