My Lords, I recall that many years ago, as a young man of 16, the noble Lord, Lord Hague, stood up at a Conservative Party conference and said that some of us there would not be around in 30 years’ time. Well, I am one of those who is still around 30 years later, having listened to him from the platform. I remember also campaigning in Richmond 29 years ago, when I thought we had a promising young MP on the way who might do quite well. He made an absolutely outstanding maiden speech, which all noble Lords in this Chamber will remember. We look forward very much to hearing him again.

So much has already been said with which I entirely agree, and I am not going to emphasise the points about the obscenity of Daesh or the urgency and importance of the threat. I just want to say one thing. The duty of many noble Lords in this House is to bring any experience to bear on this debate. It is the value of this House, perhaps, over the other place. I spent a lot of years fighting terrorism. One thing I know about terrorism is that it needs money. One of the major challenges in Northern Ireland was trying to switch off the money coming from America—trying to stop the funding of the arms and equipment that was coming out of Libya, paid for by certain well-meaning benefactors who did not realise where their money was going. That is the background against which I approach this.

That is why I welcome the emphasis on dealing with economic forces in the speech from my noble friend the Leader of the House. I am not sure whether the figure she gave for daily income was in pounds or dollars, but whatever it was, it was a huge figure. There is also the amount of weaponry sloshing around in the world, particularly the large quantities from Slovakia, for some reason. Daesh is undoubtedly well equipped and does not seem to have any shortage of ammunition or weaponry, and no shortage at the moment, sadly, of markets in which to dispose of its oil. These are the areas we need to tackle—particularly oil, but also donations from unsuitable quarters that may be coming to it, and compulsory taxation of the populations in some of the towns it presently occupies.

The noble Baroness leading the debate for the Opposition said that, perhaps in some ways, just a marginal increase was being proposed. What we are talking about is doing in Syria what we are already doing in Iraq. Our allies have asked for our help in that respect. To hear some people talk, you would think we were proposing carpet-bombing the whole of Raqqa and the whole of Syria. Importantly, the beauty of Brimstone, which some noble Lords have talked about, is not just that it is extremely precise and accurate and can hit moving targets, but it actually has a rather small explosive charge. It is not a great bunker-busting bomb that sends shrapnel flying in every direction, killing men, women and children.

What have we learnt so far—what have we learnt from Iraq? The Minister has just been to Baghdad, and I know she will not mind me quoting the tribute that was paid to the RAF for its minimising civilian casualties. It has shown that it can do it there. This is what we need to do. This is not a major change, but it would be a very major change if we refused to support our allies.

I will say just one thing to the noble and learned Lord, Lord Wallace. He said, “Get the Gulf Cooperation Council—the countries in the region—to play their part”. If we did not say yes today, it would be that much harder to persuade those countries to play their part. This is a step and, having taken it, we can then turn to them and say, “Right. We’re now all in this together”. That is the way we can really make progress against a very evil organisation that threatens us all.

I am grateful to the noble Lord. I can tell him and other noble Lords that there are clearly differences between some of those involved in the Vienna talks—I mentioned that Russia is involved and there are some differences between us—but on 14 November they agreed a timeframe for political negotiations to begin by the end of the year, for a transitional government to be in place within six months and for a new constitution and free and fair elections within 18 months. The key thing everybody is signed up to is that a Government in Syria—like a Government in Iraq or, indeed, anywhere—must govern for all the people and provide the stability that is necessary for all those who live there.

May I tell my noble friend how impressed I am by the approach the Government have taken in response to the Foreign Affairs Committee report? The thoroughness is, I have to say, in stark contrast to the previous occasion, at the time of the chemical weapons concerns, when bombing was suggested. Then, we were to debate the issue on Thursday and bomb on Friday. I have listened to the exchanges in the Commons, and the Chairman of the Foreign Affairs Committee, Crispin Blunt, speaking in a personal capacity, has indicated that he believes the Government have answered the questions that the committee very sensibly asked.

There is one weakness in the Government’s position, which is inevitable. Arguments are centring on the existence and substantial nature of the ground troops, but the reality is that we have to deal with where we are. The hope is that if there is an effective air campaign, co-ordinated with the existing total allied commitment, we may see rather more troops appearing on the ground than are presently willing to show themselves.

Any of us who have had any dealings with tackling the challenges of terrorism know that at the back of it all is money. What I welcome in the allies’ recent efforts is the attack on the oil supplies—the source of income. There is no doubt that ISIL has been very well funded up to now. Resources; weapons production; weapons support, enabling its people to travel round and cause terrorist outrages in various places—all that takes money. I welcome the mention in the Statement of the steps now being taken, particularly accurate targeting in the air campaign, to tackle the economic forces that are keeping ISIL alive. I support that very much.

I am grateful to my noble friend for providing us with an update on how the Statement is being welcomed in the other place. We estimate that there is a ground force of about 70,000 troops in Syria who are fighting ISIL, and who would make up a moderate opposition to Assad. These troops are having some success. They have regained territory, and where they have done so they are able to administer those areas. We are already providing non-military support, trying to maintain the civic society in Syria which is so important to long-term stability. My noble friend is absolutely right about the attacks on the economic resources that ISIL relies on—that is where we have to continue to focus a lot of our energy.

The noble Lord argued in his first point that finding a political solution in Syria would not render our efforts to destroy ISIL redundant. I agree; he is absolutely right. On his question about those Britons who have left the UK, gone to Syria and elsewhere and then returned, the measures that we introduced in the Counter-terrorism and Security Act, which was passed by Parliament earlier this year, were designed specifically to address this kind of threat.

My Lords, I strongly commend the Prime Minister’s Statement that my noble friend has repeated on the response to the terrible tragedy and outrage in Paris.

There is an aspect of the Statement that I regret. It rightly says that, recognising the threats that we face, intelligence is a crucial first line of defence for this country—one or two breakdowns in that respect may have contributed to the disasters in Paris. It also says that we will do all that we can to support the intelligence and security services. If I may make one small point, I do not think this Parliament has done that. For more than two years, we have been trying to consider the gaps that exist in our armoury of what is available to our intelligence services to protect our country. Two weeks ago in this House I asked a question about the Investigatory Powers Bill, pointing out that we are now embarked on a pretty leisurely process which, if we are lucky, will get those powers into effect by next September or October. I wondered at that time what events might happen between now and then. I am all too sorry that within two weeks that has proved to be the case.

I have one constructive suggestion. Following on from the noble Lord, Lord Carlile, I do not think it realistic to take the whole of this huge Investigatory Powers Bill through on some accelerated process, but there is one element in it that the Home Secretary has indicated is the one additional power that she wants: the retention of internet communications data, which might enable us to identify some of the links that obviously existed in the attack in Paris and the way that it was organised. I suggest that, by discussions through all the usual channels, this particular element in the Bill is taken out and dealt with by an Order in Council and emergency regulations, with a sunset clause, so that it is operational while the normal parliamentary procedures for the Investigatory Powers Bill can continue in the way proposed by the Government without the liability that we do not yet have the crucial power that the Home Secretary has identified as being essential.

On my noble friend’s first point about the security services and intelligence being our first line of defence in this country, I agree that they are the first line of defence and do magnificent service for this country. Indeed, I think that the UK’s intelligence services are very much seen as the best in the world.

I am not sure that I agree with him that we have not supported them in the way that they need in order to do their work. We have ensured that they have all the funding and additional resources that they need, and I am sure that the House will be familiar with the range of different announcements that the Government have made, as I have already referred to, in the past few days.

We will keep the Investigatory Powers Bill under review. If there is anything in the draft Bill which the security services need now to do their work but do not have, we will certainly reconsider our approach. However, my noble friend must accept that the Data Retention and Investigatory Powers Act, which we passed in July, brought into force the additional powers which the security services need, but they expire at the end of next year. The Investigatory Powers Bill will make sure that we enshrine and protect those powers for the future. It is about future-proofing powers, rather than giving new ones.

The noble Lord makes a powerful point. I say in reply to him that we have already given refuge to 5,000 people from Syria over the past few years. We are committed to supporting more people who are based in those refugee camps, and we think that that is the right way for us to proceed. If we were to participate in the relocation scheme that the rest of Europe is following, it would not ultimately benefit people who need to be supported in places close to their home countries so that ultimately they can return. We must not forget that only about 4% of those who have had to flee are actually here in Europe; there are millions more in need of support who have not yet made it to Europe. It is important that we do a lot of things and that our effort is comprehensive, and that is what the Prime Minister is pursuing.

The Statement covers three critical issues but I shall address the overriding and urgent one that is likely to arise. If an attack develops on Aleppo, as is reported in the press, we are going to see millions more refugees added to the enormous number that are already involved. Does this not reinforce the importance not only of the visit of Chancellor Merkel to Turkey but also of the Prime Minister’s position that, whatever is done about accepting refugees into this country and other countries in Europe, the only way to save millions of people this coming winter will be the effectiveness of providing safe, secure camps and accommodation immediately in the area, saving them the need to travel and the enormous danger that will be involved? In that regard, I particularly welcome the announcement of the United Kingdom’s contribution to the World Food Programme. I trust that resources we will be available to feed the millions concerned during this coming winter.

My noble friend makes some important points. As I have already said, we have applied our effort where we think we should help people—at the point of need—in a way that means that the countries they are fleeing to are able to sustain that support. We very much support what is happening in terms of a plan with Turkey. It is also worth adding that in November there will be the Valletta summit between European and African countries to look at what more can be done to prevent more people fleeing from that part of the world. We have to try to ensure that we support people where they are most in need of that support—that is, before they make these dreadful and treacherous crossings.

My Lords, I am very glad to follow the noble Lord, Lord Lisvane, for reasons that will become apparent in a moment. I have three issues to which I want to refer briefly.

First, as others said last week and have said today, the idea that these proposals affect the other place alone has been blown to smithereens. It is clearly extremely relevant to the powers and responsibilities of your Lordships’ House that these proposals are examined very carefully. The noble Lord, Lord Lisvane, has referred to the proposed changes to Standing Orders and, in particular, Standing Order 83O. I do not know quite why the zero is there—oh, it is an “O”, and obviously very important. For brevity’s sake, I am not going to read them, as there is a whole page of them, but they are headed, “Consideration of certified motions or amendments relating to Lords Amendments or other messages”.

What is here is clearly an opportunity for a subset of the House of Commons to veto what the House of Lords has said, which goes to the very heart of this issue. It is taking a part of the Westminster Parliament and saying that it has a veto over the whole of that Parliament. The relationship between our two Houses is clearly of supreme importance, as others have said, and this alters the supremacy of the Westminster Parliament. It is as important as that. Even more topically, if one devolved subset of our system of governance is given that opportunity, what are Holyrood, Cardiff and Stormont going to say? They will want it too—and why should they not? It alters the whole delicate balance of power and responsibility within the United Kingdom.

The case for a Joint Committee is absolutely clear. If I may say so to the noble Lord, Lord Cormack, the other place can take absolutely no notice whatever of our Constitution Committee—it does not have a comparable Constitution Committee, as he well knows. Perhaps it should have one. By the time that our Constitution Committee has come up with some recommendations, the danger is that the changes to the Standing Orders in the other place will already have been passed.

That brings me to my second point. This is a classic case of the dangers of piecemeal and ad hoc attempts to deal with apparent anomalies in our constitution. Removing one anomaly produces another. Any Member who still thinks, after listening today, that this can be resolved in isolation would do well to read the Hansard report of our brief debate last Thursday and the debate in the other place last Wednesday. I particularly draw the attention of noble Lords to the comments of the former Attorney-General, Dominic Grieve, who said:

“Ultimately, every decision that is taken by an Assembly or Parliament in the United Kingdom has a knock-on effect elsewhere, outside the area of its jurisdiction”.—[Official Report, Commons, 15/7/15; col. 1002.]

Surely, such a wealth of practical experience exceeds what is available to the Leader of the Commons on his own—hence, I believe that a Joint Committee would be entirely appropriate.

There is a head of steam now to go beyond this immediate problem and think about the wider context, so I hope the Leader of the House will persuade her colleagues to look again at the case for a comprehensive constitutional convention, supported now on all sides of your Lordships’ House and widely supported in the other place, as well as being the subject of a Private Member’s Bill in the name of my noble friend Lord Purvis of Tweed.

The noble Lord, Lord Forsyth, is right: just having a constitutional convention is not in itself going to solve this problem, as was clear from the convention in Scotland, which is occasionally quoted as if that were the model. We should be clear that you have to start out with a remit that is agreed, so that all those involved know where they are trying to go. That was not the case in Scotland, as evidenced by the fact that two parties did not want to be involved in the constitutional convention precisely because at that stage, they could not agree to the common remit.

There is clearly a major opportunity, as well as a problem, arising from these proposals. I hope that in the short term there is a Joint Committee of the two Houses—such committees have an enviable reputation for getting to the bottom of things and sorting them out in a way that individually, the two Houses have found difficult—but I believe that in the longer term, this now leads to the need for a constitutional convention.

My Lords, when I sought to intervene, a little too late, on the prompt conclusion of the proposal to the House from the noble Lord, Lord Butler, I wanted to ask him one question. He is proposing a Joint Committee. Recently, we have had an election and seen the arrival of a substantial number of Scottish National Party MPs who previously observed the principle of a self-denying ordinance, but have made it clear that they do not think this quite applies in the same way any more. I wanted to intervene in order to ask: while this Standing Joint Committee is taking place, what will cover any problems arising from legislation in the mean time? We have had some very interesting—

The noble Countess is the first Member of this House ever to have criticised me for addressing her. I do apologise.

I raise that point because there are very difficult issues that need to be addressed, and the noble Baroness the Leader of the Opposition has made it clear that the Labour Party also recognises that. These issues have tested Governments over many years, as my noble friend Lord Wakeham said; we all remember Tam Dalyell and his problems with the West Lothian question.

The Government have put forward some proposals. If noble Lords study Mr Grayling’s speech and the interventions he took when the Commons debated this issue recently, they will see that the Government have recognised that these proposals are subject to further revision; however, they do ensure that something is in place for the forthcoming year. If we have a Standing Joint Committee that, as the noble Lord, Lord Butler, said, has to report by March 2016, that report will then have to be considered. One can therefore write off the next Session of Parliament—nothing will change until the next Summer Recess. It would be sensible to see what problems emerge from the Government’s proposals.

As the Leader of the Commons has made clear, what we are proposing is likely to come forward for approval there in September, and he has asked the Chairmen of the Commons Procedure Committee, and the Public Administration and Constitutional Affairs Committee, to start monitoring the situation now, rather than waiting until May 2016, as my noble friend suggested, to see where the problems arise.

The advantage with Standing Order changes, as opposed to going down the statutory route at this stage, is that if issues arise they can be tackled much more quickly. I do not rule out that at the end of this very difficult process, when perhaps by trial and error we have found the right basis on which to proceed, things could then be put on a statutory basis. That would meet the point that my noble friend Lord Forsyth made about the difficulties arising from a different Government coming in and changing everything. That is one approach that could be adopted.

Can my noble friend give an example of legislation that would be altered in any way if EVEL were not in place in the next Session, or if it were in place? Of course, if this is put on a statutory basis, it is then challengeable through the courts.

My noble friend has done the same homework, in a sense, as Mr Grayling, who made this point. He said that the only Bill that anyone could find at the moment that might be affected would be the one giving mayors powers over buses. I think that it would be something short of a constitutional crisis if someone suggested that one more provost should have a bus pass. Therefore, problems will arise, as I think everybody recognises.

My noble friend Lord Cormack asked why the Constitution Committee of this House should not do something about this so that this House is seen to act now. I made some inquiries about that and the answer I got was that it has been the long-established practice of the Constitution Committee of this House not to interfere with the procedural arrangements of the House of Commons—it has regarded that as being outside its remit.

The noble Lord, Lord Butler, has avoided part of the problem by talking about a Joint Committee. However, we have to be careful how we exercise the undoubted power that we have in this House. There is an obvious sensitivity around this issue which, as we know, is felt strongly in English constituencies. The Government’s approach has been to say that we will probably carry the Standing Orders through in September. We will then take the opportunity that the Leader of the House has given us for a debate, and watch the issue very carefully. I hope that the noble Lords who have strong feelings on this matter will give evidence to the Procedure Committee and to the Public Administration and Constitutional Affairs Committee of the House of Commons when it considers the procedure.

The problem is in aligning the reluctance to interfere with the procedures of another place, which are its prerogative, with an acknowledgement of the experience of your Lordships’ House that can be brought to bear in a number of fields. I hope very much that this can be resolved. We all know that this is a difficult issue, but I hope that it can be approached sensibly and without producing conflict between this House and another place.

Perhaps I may ask the noble Lord a very naive question. Is there anything wrong in principle in having the Joint Committee as well as allowing the Standing Orders to go forward?

One does wonder how many committees we are going to have. There will be the Procedure Committee of the House of Commons and the Public Administration and Constitutional Affairs Committee, which are already signed up to undertake this exercise, and now we are coming along with a Joint Committee involving the House of Lords which will be doing the same thing. I think that we need a bit of balance in this. Unless one completely distrusts those Commons committees—and I hope one does not—I think that they should have a chance to monitor the issue and then recommend changes as we go along, if necessary, and as we learn the best way to tackle this very difficult issue.

My Lords, we are in danger of complicating what is surely a very simple proposition from the noble Lord, Lord Butler, to deal with the problem of changes in the Standing Orders of the House of Commons having implications for the way in which we operate in this House. If we think in any respect that they might have implications, the case for a Joint Committee is in my view overwhelming. I find it very difficult to understand the argument that the decision is a completely unilateral one with no implications whatever for this House when one House of a bicameral Parliament makes changes to the way in which it considers legislation. Frankly, the case has been made conclusively—not least by the noble Lord, Lord Lisvane—that there are clear implications for the way in which we operate in this House.

However, even if Members do not accept the constitutional or procedural arguments, because I am an old-fashioned politician, I want to set out the very simple political consequence that such a decision would have for this House. Very helpfully for my argument, three contributions have been made by Scots—the noble Lord, Lord Forsyth, the noble and learned Lord, Lord Wallace, and my noble friend Lord Reid—who are all former Members of the House of Commons.

My Lords, I am very grateful to the noble Baroness and to the other noble Lords who have spoken in this debate. I am particularly sorry to have to disagree with the noble Lord, Lord Wakeham, on the 30th anniversary of his wedding, because on that day 30 years ago I was his best man. He showed, if I may say so, very good judgment on that day, and I am very sorry to have to disagree with him today.

If I may, I will first of all answer the question that the noble Lord, Lord King, meant to ask me but did not manage to ask in my opening speech. He asked, if there is a Joint Committee that takes till March next year to look at this issue, what will happen in the mean time. Some have said that there are not many Bills that will be affected, but I have a different answer. My answer is that, at the moment, there is both a government majority in the House of Commons and a government majority in England and Wales, so the problem does not arise—there will be no Bills between now and then for which this will cause a difficulty.

My Lords, I do not think that the problems of the Conservative Party ought to be dealt with by this constitutional change, if I may say so.

What is clear from all the speakers in this debate, with the exception of the noble Lord, Lord True, is that these proposals raise serious constitutional issues and that there are many difficult questions which have yet to be answered. The noble Baroness has said that it is a Conservative manifesto commitment to solve this problem, and that is true. Of course I respect that, and that is why I say that I welcome the fact that the Government are tackling the issue, but the means by which it is being tackled were not in the Conservative manifesto. There are different ways of doing it, and I happen to think that some are better than the proposals that the Government have put forward, which the House had no previous knowledge of before they were contained in the Statement. I believe that those issues deserve to, and can legitimately, be looked at without breaching the convention that the Government are supported in their manifesto.

The Government have shifted their position significantly since their original Statement. They have encountered very much more political controversy than they expected to, and the very fact that they have done so indicates that, either knowingly or otherwise, they underestimated the constitutional significance of their proposals. Noble Lords will recall that the Government’s original approach was that their proposals would simply be voted through by the House of Commons by changes to Standing Orders before the recess, and that there should be no debate at all in this House, on the grounds that our procedures are not affected. The Government were forced to retreat in another place to allow time for consideration. The noble Baroness has said that, after reflecting, she recognises that there are indeed constitutional issues which this House should have an opportunity for debating.

The Prime Minister and the other European leaders were absolutely united in their view on sanctions on Russia, certainly in the course of discussions at the G7 over the last few days. From the preliminary discussions leading into the next European Council meeting, I gather that there is no question of any doubt on that, but it is something that we have to keep pressing. We have talked about this before. We all have to hold together on this, because it is so vital. Russia must not see any weakness in our agreement in the West and in Europe on sanctions remaining in place.

On the noble Lord’s question about Crimea and whether it has been written off, I would answer, “Absolutely nothing of the kind”. We remain very clear that what Russia did in that area was illegal and there is no question that this would in any way be ignored or forgotten.

Looking at this Statement and the seriousness of some of the global issues that it mentions such as global health and climate change, is there any movement at all to suggest in discussions involving the major countries of the world that China might have a contribution to make? There are international global interests in so many of these very serious issues.

I do not think that my noble friend is suggesting that we are at the point where we might extend the G7 to include China. But he is right about China being so important to the future prosperity and security of the world at large. Again, this is an area where we have been very much in the forefront in recognising the growing importance of China. Before the general election, the UK was the first G7 country to join the AIIB, which is the new Chinese version of the World Bank. Because of our leadership there, other G7 countries have joined that bank.

My Lords, we in this House are contributing to legislation now on an equal footing regardless of where we are from. We do not represent a particular part of the country. I come from Beeston and am very proud of that, but I do not represent Beeston. I am here as a United Kingdom Peer, as is the case for all of us.

Would my noble friend pay particular attention to the intervention of my noble friend Lord Lang, who I think spoke extremely wise words on this matter? I thought that the most striking point of the Statement was the extraordinary contrast between the long list of Labour leaders of major boroughs and major cities in this country who take an entirely different view, as far as I can see, from the unfortunate position of the Opposition.

I am very grateful to my noble friend for that point because he is quite right. It was very welcome to see just how many Labour leaders of local authorities within England wanted to contribute to this process. We are grateful to them and we hope that the Labour leadership will take its lead from them.

The noble Lord is right to say that the leaking by Snowden and the reporting of his leaks have had a serious effect on intelligence gathering. That is unquestionable. There is evidence that some of the terrorists and terrorist groups, in the light of that knowledge, are now moving their exchanges to different places, where the intelligence services are not operating, because they now know where they do and where they do not.

As far as introducing the Communications Data Bill is concerned, in the summer we introduced the emergency legislation which addressed some gaps there. The counterterrorism Bill that will be introduced tomorrow will close another gap. This is an area where I believe we will continue to have to keep making progress. We are not ready to move as far as the noble Lord suggests at this moment. To be successful in introducing a Communications Data Bill, we will need a consensus, and we do not have that yet.

Does my noble friend accept that this report, which I think is the most substantial one I have seen from the ISC, marks a very important stage in the development of its role of parliamentary oversight of the intelligence agencies? I hope that, on reading it, one will be able to reinforce one’s confidence in the capabilities of that committee. It is very important to this country that it carries high credibility in the world and among our people generally.

Having said that, the Prime Minister claims in his Statement that the committee had unprecedented access to detail that might not previously have been available to such an inquiry. Certainly, it seems to hold the world record for asterisks, deletions and redactions, indicating the amount of totally secret information that was available to the committee. Will my noble friend confirm that the report coincides with the announcement by the Home Secretary of the further Bill that will be introduced tomorrow—in the Commons, I assume. Will the government response be available to this House before we approach Second Reading, as I understand there is to be an accelerated procedure? Can she give any indication of when she would expect the Bill to come to this House? There is no question that it raises extraordinarily difficult issues. As the noble Lord, Lord West, indicated, the challenges faced by the intelligence and security agencies are massive and growing enormously. Some of the challenges will be revealed in the government response and we need the opportunity to consider it very carefully in this House.

My noble friend is a former chairman of the ISC and I pay tribute to his knowledge and assessment of the committee’s report published today. I share his view that it is a very substantial and unprecedented piece of work on the part of the committee. It shows that we were right to put the ISC on a stronger footing through the Justice and Security Act. The redactions in the report are in line with the process in that Act for redacting material and we have very much followed that process. I cannot confirm that the Government’s detailed response to today’s report will be available before Second Reading as I do not yet have the date when we will respond or, indeed, when the Bill will be introduced in your Lordships’ House. However, I will reflect on the point that my noble friend makes.

On the first part of the noble Baroness’s question, I cannot stress enough how much the international community is united in its call for a swift, transparent and credible investigation into the incident in Ukraine. We understand that there were two black boxes on board the aircraft and are aware of reports that one of those black boxes has now been found. We urge that this should be passed on to the International Civil Aviation Organization at the earliest opportunity. It is so important that all the proper and relevant authorities are able to do their work in response to this situation.

As to the noble Baroness’s question about Gaza and Israel, as my right honourable friend the Prime Minister said, he was clear during his call last night to Prime Minister Netanyahu that he should do everything to avoid civilian casualties, exercise restraint and help find ways to bring that situation to an end.

My Lords, while I join my noble friend in offering the deepest condolences to all those who have suffered from this appalling outrage with the Malaysian airliner, there was one sentence in her Statement that I found difficult to accept. It was when the Statement said:

“It is unlikely that even the separatists wanted this to happen”.

This is a disaster for everybody concerned and it has obviously made the position of President Putin even more difficult than it was before. The separatists are now pilloried right across the world and, if they are responsible for this, have done their own cause enormous damage as well.

This has happened against a background of bombing of this area by the Ukrainian air force and of the separatists shooting down some aircraft in self-defence. It is important to recognise the situation in which this has happened. I say in passing that I find it extraordinary that the European organisation responsible for flight safety gave airlines permission to fly over this area. Having said that, two weeks ago, while on their way to the World Cup, Angela Merkel and President Putin called for Ukraine and the separatists to stop fighting and start talking. That is the background against which this has happened. There must be a cessation of violence and an opportunity must be given for an independent inspection of what has happened. Efforts must be made at the earliest possible opportunity to get constructive talks on the tragedy that has followed this episode of violence.

As the Statement says, even the separatists did not want to target a commercial airliner: that is the point we are trying to get at. It is not a question of evidence being gathered to show that there was that intent; it is about the aircraft that they were focusing on. As regards my noble friend’s point about the fly zone above this area, it is important to note that the controls that were in place extended to a specific height, and that this commercial airliner was above the height determined to be safe. However, those controls have now been extended and there is a complete lockdown of the whole area at any height. My noble friend rightly said that the fighting needs to stop and talking needs to start. We are very clear that Russia needs to take steps to de-escalate the action in Ukraine. We need to ensure movement to bring security to Ukraine very soon.

I will need to come back to the noble Lord on whether the agreement covers such payments. Its intention was to eliminate the scourge of ransom payments, but how they are defined in detail is something that I will have to follow up with him.

Does my noble friend recognise how much I echo what has been said, how much I welcome the fact that the conference has been held successfully in Enniskillen—having been all too close to the outrage and tragedy that took place there—and how I am reflecting on the irony of how the world has moved forward? That outrage was almost certainly committed with Libyan explosives, but the new Prime Minister of Libya was present at the G8. I hope very much that one of the outcomes of the G8 will be a better future for Libya. I echo what the noble Lord said. There must be political discussions about the future of Syria; they must be held by everybody without preconditions, which is one of the lessons of Northern Ireland for making progress; and obviously it would be enormously helpful if Iran were present as well.

I understand the second point made by my noble friend, which echoed that made by the noble Lord, Lord Wright. On the first point about Northern Ireland, the noble Lord knows better than most in the Chamber what the situation was and the extent of the work that had to be done. He was closely involved with that. It is a powerful symbol of what can be achieved if people are prepared to take those brave decisions.
