Lords ChamberMy Lords, it is absolutely right that this House will want to subject the Bill to full and proper scrutiny, but I hope noble Lords will agree that it represents a giant step forward in environmental protection: whether through biodiversity net gain, record-breaking targets, local nature recovery strategies, conservation covenants or the office for environmental protection. There is a whole package of measures to take us towards a zero-waste society. Of course I will approach debate on the Bill with an open mind, as all Ministers should, but it is already an important piece of work.
The range of topics raised on Second Reading, coupled with the number of amendments tabled since, highlights the gap we have long identified between the Government’s promises and proposals. The Minister has been refreshingly honest about the challenges our climate and ecological system faces, but does he accept that to get this Bill passed in a timely manner and ensure it is fit for purpose, the Government will have to compromise?
My Lords, very few pieces of legislation enter the process in exactly the same form as they end it. To that end, a number of changes have been introduced already in the Commons on due diligence obligations—a world first—on dealing with our international footprint, and amendments on the organisation of the OEP and species conservation strategies. A number of amendments have been tabled in recent days for the remaining stages here in the Lords on species abundance targets, nature targets and much more besides. So, of course, the Bill will improve over time.

Lords ChamberMy Lords, I refer noble Lords to my environmental interests in the register. As a former Member of the European Parliament, I recognise the very real challenge in satisfactorily replacing the EU’s environment policy architecture. While nothing is ever perfect, the EU has long been recognised as a global leader on many of the issues that noble Lords will reference today.
Underlying the architecture for a number of decades has been the European Commission, whose enforcement powers play a key role in making member states take their responsibilities seriously. Now that we are outside the EU, we will gradually depart from its policy framework but, in doing so, I hope that the Government will keep and build on the better features, including in their design of the office for environmental protection.
Your Lordships’ House has dealt with a variety of significant pieces of legislation in recent years. While I was not a Member at the time, I watched from afar as colleagues tackled the EU withdrawal Bill and its multitude of constitutional implications. Concerns about the environment featured during the debates on that Bill and, despite the passage of time, many remain unaddressed by the Government. Other legislation, such as the Trade Act, was highly contentious.
While we will, of course, approach this Bill in the same constructive spirit with which we approach all government proposals, it seems inevitable that its journey on to the statute book will require cross-party co-operation on key issues and a genuine willingness from Ministers to bring forward improvements.
There is little doubt that we must put in place a new system that protects and eventually enhances our precious natural environment. After all, we are in the midst of a climate and ecological emergency that threatens the survival of many species across the UK and, by extension, our survival as well. Inaction is simply not a choice.
However, we are not convinced that the Bill as drafted will deliver on the lofty promises made by the Prime Minister, the Secretary of State and others. In some areas, it presents a step backwards from the status quo or previous proposals. Even where important progress is being made, such as with new provisions around deforestation and supply chains, there remains a lot of room to be more ambitious.
This weekend, I was in Birmingham, talking to local authority members, including the cabinet member for the environment and transport. I learned about the journey that Birmingham is on to become carbon neutral by 2030, which is very ambitious, considering that the Government’s target is 2050 and the West Midlands Combined Authority’s target is 2041. We welcome this bold and brave commitment by Birmingham City Council, the largest local authority in Europe.
I also heard about the council’s plans to ensure that every citizen has the fundamental human right to breathe clean air. The city council recently launched a clean air zone on 1 June. While I am aware of the partnership between this Government and the council, the important thing moving forward is to understand the impact that the project has on the business community, which has struggled over the past 12 months, especially during Covid. Will the Government and the Minister commit to resourcing local authorities that are seizing the initiative to launch clean air zones—and provide the right level of support to the communities that may be impacted by them?
Sadly, the Bill as it stands does not set a target for air quality, leaving it to the discretion of the Secretary of State. This is a missed opportunity. The WHO guidelines should be seen as minimum requirements, and we call on the Government to use them nationally. Air pollution has reached dangerous levels, with 60% of people in England now breathing illegally poor air. The office for environmental protection will be effective only if it is sufficiently independent of the Government. Parliament must play its role in supporting the principle of the OEP’s independence. The public need the confidence that the Government will be properly held to account on their duty to protect the environment.
The UK is currently using and wasting resources at unsustainable levels, contributing to simultaneous climate and ecological breakdowns. UK consumption is now such that the average UK citizen will have a greater carbon footprint in 12 days than citizens in several other nations will have in a year.
Litter is wreaking havoc on British wildlife, killing millions of mammals every year and choking our seas with plastic. There must be an increased emphasis on reducing resource use and encouraging design for resource efficiency, including through reuse. Reducing resource use will ensure a more efficient economy, reduce the effects of extraction and disposal on wildlife and ecosystems and contribute to achieving net-zero greenhouse gas emissions.
The Bill is the Government’s first opportunity to show that we will not lose out as a result of leaving the EU. If we cannot secure strong environmental protections in the Bill, that does not bode well for the workers’ rights, workplace protections and consumer protections that we need in our everyday lives.

Grand CommitteeMy Lords, yesterday, I had the great pleasure of attending the Lord Speaker’s lecture. In his concluding remarks, the noble and learned Lord, Lord Clarke of Nottingham, described it as shocking for the Government not to put these UK development aid cuts to a vote. The reduction in direct aid spending on water and sanitation in the world’s poorest countries by 80% of spend is catastrophic. Our UK public views water, sanitation and hygiene as a priority area for UK aid because hand hygiene is widely recognised as a critical intervention to counter the spread of Covid-19.
It is beyond belief that this should happen just months ahead of the G7 and COP 26 climate summits, at which the UK wants to show global leadership. The cuts mean that a staggering 10 million people stand to lose out on gaining access to clean water, sanitation and hygiene facilities this year, in the midst of a pandemic, according to WaterAid UK, the leading British charity in this area.
Providing clean drinking water to the world’s poorest has proved to be one of the most cost-effective ways of improving health and productivity across the developing world in recent decades. Does the Minister agree with Pauline Latham, MP for Mid Derbyshire, who warned Ministers not to balance the books
“on the backs of the poor”?—[Official Report, Commons, 16/3/21; col. 176.]
There is never a good time to cut aid for life-saving water and sanitation, but the middle of the worst pandemic for 100 years must be one of the worst. As the only G7 nation to cut aid, we are retreating from our moral duty by doing this, recklessly putting us out of step with our closest allies and making a joke of the fact that we are an internationalist and outward-looking country.
The Minister and I share a passion for visiting schools and trying to inspire the next generation. How can we look these young children in the eye when they ask, “Why are you cutting the global education budget, which affects our brothers and sisters across the world?” The noble Baroness, Lady Chalker of Wallasey, referred to pressing appropriate buttons: with this decision, the Government are pressing all the wrong ones.

Grand CommitteeMy Lords, it is a pleasure to speak on this instrument. Like the noble Lord, Lord Campbell-Savours, I absolutely agree that the Minister has a fantastic and admirable track record on the environment. As previous speakers have said, in future, we should be thinking about an overall plastic ban. However, I appreciate that, on the basis of statistics such as those the Minister outlined, the initial 5p charge for single-use carrier bags has been a huge success since it was implemented.
The statistics say that the potential rise to 10p will bring an expected overall benefit of more than £780 million to the UK economy, up to £730 million for good causes, £60 million of savings in litter clean-up costs and carbon savings of £13 million. I would like to ask the Minister about that £730 million for good causes. I see a range of good causes on the government website, but would it not be a good idea for the money made from plastic bag charges to go towards something specifically to do with the war on plastic? We need to incentivise customers to use long-life bags made from sustainable and environmentally friendly materials. I am not sure whether the Minister has come across Toraphene, an environmentally friendly artificial plastic that costs the same as plastic bags. What about making its use compulsory, as an alternative?
As the Minister will know, I have a habit of listening to schoolchildren. This morning, I spoke to the wonderful children at St Augustine’s, in my home town of Burnley. In this time of coronavirus, they have done some innovative work with their local pharmacy to give the elderly some good ideas when they go to collect their prescriptions, keeping them motivated and inspired. They have drawn lots of pictures to make people happy. Something that struck a chord with me was a young child talking about getting rid of plastic and making sure that our oceans are plastic-free.
This is an important instrument that will act as a further deterrent and raise significant money. We need to work out what the Government should do to enhance the education programme further, as previous speakers have mentioned. Overall, the 25-year government plan fits into that. On the subject of cleaning plastic from our oceans, beaches and other areas where it has become an unfortunate cancer in our society, may I ask the Minister what the scope is for using gasification instead of incineration, which still causes pollution and adds to the problems with our ozone layer?
It is heartening to know that the higher charge will come into place but we have to do much more. I think that this will ultimately end in a ban on plastics but, in the meantime, I recognise that this is a positive step forward to add to the previous decision, which the statistics and the evidence show is working well.

Lords ChamberMy Lords, when I was a member of the European Parliament, young children from the primary school that I myself attended—Heasandford Primary School—wrote me a letter about this sentencing issue and having a maximum sentence of only six months. Now I am in the House of Lords, I am in a position to offer my support and voice to ensure that this Bill passes speedily to the statute book.
I add to what many other speakers said my own concern that certain offences such as fly-tipping have a sentence of five years, whereas cruelty to animals has only six months. It is very frustrating that we are seeing this still being debated as it has not yet passed into law. This is the third time that is has been attempted, so I hope that we can get this on to the statute book as fast as possible.
To add to what other colleagues have said, make no mistake: with people who abuse animals, there is a link to abusing women and children. We have seen during this difficult and challenging time with coronavirus that this abuse has unfortunately increased. Until we get this law in place, we should send a message to people not just here in the United Kingdom but across the world, where other jurisdictions still need to do much more to increase sentencing to deter people who think they can abuse animals.
Finally, I will just say that this is all about the public; in 2017, 70% of the general public, during a government consultation, expressed their desire to see tougher sentencing. So I thank Chris Loder in the other place and the noble Lord, Lord Randall of Uxbridge, for sponsoring this Bill and I look forward to supporting it.
