Commons ChamberThe hon. Gentleman certainly raises a related issue. It is essentially part of the same principle, which is whether the development that takes place is or is not sustainable. There is obviously a great deal of concern about building on floodplains as well. Even where building takes place and it is not on a floodplain, it is essential to ensure that there is sufficient local infrastructure to support that development. It is not just a question of adequate local drainage, as it is also a question of ensuring that there are sufficient local school places and that the road network is sufficient to support the additional population. In villages throughout my constituency, we have found that that infrastructure has not been provided despite the additional development, and it is feared that further development would exacerbate the problems.
Is my hon. Friend aware of the Ridgeway Farm development in Purton, in my constituency, where it was agreed this week that 700 houses would be built in an area where there are no schools, where the roads are tiny country lanes and there is no access, where the hospital is jam-full, and where the local villages have been flooded in the last couple of weeks? It is an entirely unsustainable development, but the inspector in Bristol has allowed it to proceed.
My hon. Friend has given a very good example of the local concern that is generated when there is inadequate infrastructure to support development.
Where is the mechanism requiring planning authorities to ensure that the necessary local infrastructure is in place when development is permitted? I repeat that the purpose of the new clause is not to prevent necessary housing from being built, but to ensure that it is built at sustainable levels and in the right places. We have to ask why, if the mechanism is adequate now, the circumstances that I have described have already arisen. There is clear evidence that the existing mechanisms are inadequate.
We are moving from a system whereby the gain from development was captured under section 106 agreements to a system involving a community infrastructure levy which, I understand, is intended to ensure that investment can be made in local infrastructure. My constituents will want to hear from the Government how that new system will work, and to be assured that when new housing is proposed under the development plans that local authorities are now undertaking, there will be a mechanism to ensure that the necessary infrastructure is provided along with it.

Commons ChamberI understand from my hon. Friend the prisons Minister that the number is about 2,000. The EU prisoner transfer agreement will come into force in December and will alleviate the position as regards the number of foreign national prisoners in our jails. The principle should be that if someone has committed a serious crime in this country, they cannot expect to remain at the end of their sentence. We seek the removal of prisoners in such circumstances.
It is laudable that the total number of foreign nationals in prison has gone down since Labour left office from 11,000 to 10,000, but does the Minister agree that that is 10,000 too many? Is it not time we sent the whole lot of them home?
I agree with my hon. Friend that we want to make greater progress and that is why we have set out provisions in the sentencing Bill on, for example, conditional cautions, which will be available as an alternative disposal to remove foreign national prisoners in some circumstances if they agree not to return for a period of time. The question of whether foreign national prisoners could serve their sentences abroad relies on the consent of other countries. We are attempting to negotiate more agreements, but even if we no longer need the consent of the offender, we cannot remove them without the consent of the country that receives them.

Commons ChamberI agree with the hon. Gentleman that that would be a mistake, and we certainly do not make funding allocations on that basis. Of course police forces have had to make savings, but we have decided that the fairest approach is to ensure that all forces make an equal share of the savings. The majority of grant is, of course, allocated according to the formula.
Although co-operation among forces, and indeed between the police, ambulance and fire services, is essential, as the Minister correctly suggests, does he not agree that there is a real risk that if a rural police force such as mine in Wiltshire were to co-operate too closely with, say, Bristol on one side or Swindon or Reading on the other, resources would be pulled out of the rural areas and into the urban ones? Keeping a rural police service is extremely important.
I strongly agree with my hon. Friend about the importance of keeping rural policing services. In the end, these are matters for the determination of chief constables, who must remain operationally independent and allocate resources properly, and their police authorities. We do not seek to interfere with that, but we do seek to drive savings where they can be made by greater collaboration between forces.

Commons ChamberThe Minister will be aware of the awful case, widely reported at the weekend, of Sergeant Mark Andrews of the Wiltshire constabulary who was convicted of a serious assault on my constituent, Miss Pamela Somerville, when she was incorrectly in police custody. Will Ministers take a look at the rules, regulations and protocols covering police cells to make sure that that kind of outrageous event cannot occur again?
It is essential that offenders taken into custody are treated and supervised properly. I will happily look at the matter and ensure that we have adequate systems in place to ensure that is the case.
