Lords ChamberMy Lords, the Government have done an amazing amount to look after EU citizens in this country. I cast my mind back to the early days of the May Government when there was great pressure to unilaterally make steps to ensure the position of EU citizens living in this country. At that stage, the Government resisted the pressure because they said that this should be part of the negotiations. It should be reciprocated by the EU: it should do the same for our citizens in the EU. As far as I can make out, that has not happened. We have made a generous, unilateral gesture towards EU citizens in this country and there has not been reciprocation from the EU. Does that not mean that the Government have been rather mistaken to make this generous offer? Surely we have an obligation to our citizens in the EU and we should look to it to reciprocate anything that we do in this country. Will my noble friend address this problem when she sums up? As I understand it, British citizens in the EU do not, at the moment, have any freedom of movement between one EU country and another and there are certain problems with EU citizens in this country travelling to and from their country of origin in Europe. This has not been a very satisfactory outcome in the negotiations. Perhaps we would have been better not to have made this extremely generous, unilateral offer.
My Lords, I support these two amendments. I do so as the roommate of my noble friend Lord Kerslake, who sends his apologies for not being here but has strengthened my arguments for supporting the amendments. I speak as someone who, after the 1997 election—oh glorious days—spent two years in the Home Office and saw every submission of any significance that was made to the then Home Secretary. I always shuddered a little when we got submissions from the immigration part of the department. They sent a quiver through my soul, because of reliability. I remember a former Conservative Home Secretary briefed us shortly after that election. He said to the then Home Secretary: “You have to remember that there are always 500 people in the Home Office who can ruin your political career. The really scary thing is that none of them actually realises that they can do it.” The Windrush exercise demonstrated rather well the wisdom of those remarks.
The important thing about these two amendments is that they do not in any way disturb significantly what the Government want to do. They provide legal certainty, about which I think we will hear more later in Committee. They also provide some very practical stiffening of the arrangements around these new Immigration Rules. I went to one of the Home Office briefings for parliamentarians on the new scheme, at which everybody, MPs, Peers and members of MPs’ offices, made the point to the Home Office that in the real world a lot of people expect someone to produce hard-copy evidence, whether it is the landlord, the GP or whoever. I can speak from personal experience, having helped a number of people get permanent leave to remain here, and not that long ago either. These people had had experiences of having to produce some written documentation that they were entitled to live here.

Lords ChamberI have a question to put to the noble Lord, not to the House. He seems to be developing an argument in which there are two classes of Bill that come from the House of Commons. He argues that this House should consider whether a Bill passed by the House of Commons is one which is appropriate for this House to consider or not. Can I be clear that this is the doctrine he is now trying to argue?
Quite clearly they are different sorts of Bills: either private Bills or public Bills. That is pretty obvious. This one seems to be a private Bill, which, as my noble friend Lord Forsyth pointed out, did not even have anybody’s name on it when it appeared here because it had not had its First Reading. We are breaking all our rules to try to introduce this Bill, in a vain attempt to try to change the price of fish over these negotiations. What the Bill actually does is make life more difficult for my right honourable friend the Prime Minister, rather than easier. Why we would want to meddle around in this way, and mess about with our constitutional arrangements, I cannot understand. However, if the one good thing to come out of this is that the usual channels are at last starting to work again in your Lordships’ House, then we have something to be thankful for.

Lords ChamberMy Lords, I made the point in Committee that if you want sovereignty of Parliament you should vote as quickly as possible for this Bill and subsequent Bills to get us out of the control of the European Union. I make the point now—it is rather similar to that of my noble friend—that it is highly unlikely that the Government will accept this amendment. If it prevails, we will potentially be into a constitutional issue.
Therefore, one has to ask what options are likely to occur in the event of this House passing this amendment and, as my noble friend has just suggested, the other House passing it back to us, with the Government standing firm. There are three options. First, the Government could do nothing and concede the situation, but I think that that is highly unlikely. To lose control of the Bill at this stage on this issue would be very questionable wisdom on the part of the Government. Secondly, they could create 100 Peers. That is unlikely as well and would be rather dramatic at this stage. Thirdly, they could call a general election. That option should be under strong consideration by the Government at the moment. Through a vote of confidence in the Commons or whatever, they could have it out in the well-known democratic way of doing things—through a general election. I want to put on the record that there should be one round of ping-pong and then we should call a general election.
My Lords, I wish to speak in support of the amendment. I tabled a similar amendment in Committee which was rather less demanding than this one, but the Government dispatched it extremely briskly.
I suggest that this amendment might be helpful to the Government. The idea that all the special interest groups affected by these negotiations—the different sectors, companies and pressure groups—will sit still, while stuff comes out of the EU about the possibility of doing damage to their particular interests and concerns, is fanciful. If the Minister and the Government do not have any structured way of reporting back to Parliament, we will find that many of those people will lobby your Lordships’ House and there will be a demand for a huge number of Parliamentary Questions, as well as demands for debates, to deal with the latest set of rumours about a particular sector, industry or agency which may be being transferred back to Europe. The EMA would be a good example and Euratom is another. Therefore, the Government might find that their life was made a bit easier if there was a structured way of reporting back to Parliament about the progress that was being made, especially if it was reasonably detailed and told some of these interest groups what was going on in the negotiations.
Does the noble Lord think that Parliament will be happy if they are given the response that, because the quarterly review is coming up and it is two months away, the question cannot be answered today; it will have to be answered in two months’ time when the clock next ticks round?
The noble Baroness’s amendment is very flexible. It refers to a period of at least three months. There is nothing in the amendment to stop the Government serving their own interests by being more forthcoming more frequently. I am sure that the noble Baroness would not mind having reports made on a more frequent basis.
