Lords ChamberMy Lords, I totally concur with the noble Lord. He and I have talked about the situation prevailing in Venezuela. He is quite right that the humanitarian situation is dire. In a recent survey of hospitals, 88% were reported to be in dire need of medical equipment. There is one small glimmer of hope: I heard this morning that it has been agreed that the International Committee of the Red Cross will be given access and, on the timeline for that, I can share with your Lordships that we are hoping it will start delivery of aid within the next two weeks. The noble Lord is also right to draw attention to the dire economic consequences. I assure him that we are working to step in with partners through the Lima Group and with European partners. What is required right now, I concur, is free, independent, fair elections, and support for the interim President to ensure this happens in a short time.
Can my noble friend bring the House up to date? As a counterpoise to military intervention by Russia, what progress has the United Kingdom made in bringing humanitarian aid to this terrible crisis? And has any progress been made in persuading the leader of the Labour Party that President Maduro should not receive any support at all?
My Lords, I am sure that, like all of us, my noble friend heard the shadow Minister’s words about the support for the position across your Lordships’ House. It is important that, wherever we are in the world, we get behind the interim President, most importantly because he is the representative voice of the people of Venezuela. As I have already indicated, we are seeing a small glimmer of hope in the access provided to the International Committee of the Red Cross, but clearly much more needs to be done.

Lords ChamberTo ask Her Majesty’s Government what steps they are taking to assist Venezuela in holding a free, fair and democratic presidential election.
My Lords, on 4 February my right honourable friend the Foreign Secretary announced that the United Kingdom recognised Juan Guaidó as the constitutional interim President of Venezuela until credible presidential elections can be held. The United Kingdom, alongside its international partners, is committed to working to secure a peaceful solution to this crisis and prevent the risk of further violence. Our focus is on supporting the democratically elected parliament of Venezuela to resolve the current crisis to the benefit of the Venezuelan people.
My Lords, I commend the Government for joining Germany, France, Spain and others in Europe in rejecting the failed Administration of Maduro. As soon as possible, will the United Kingdom Government provide aid for the humanitarian crisis facing that country? Furthermore, when we get a democratically elected Government, will Her Majesty’s Government make representations to the IMF and other international lenders to get the huge debt that will be inherited from the failed Administration renegotiated? Lastly, have the Government had any indication that the leader of the Opposition in another place has had a change of heart, or does he continue, along with Russia and China, to support the failed Maduro Administration?
My Lords, first, on the issue of humanitarian aid, I think we have all watched pictures on the television showing the desperate plight of the Venezuelan people. I assure my noble friend that DfID is working very closely with my right honourable friend the Minister for the Americas, Sir Alan Duncan. We are already working through UN agencies to provide essential funding, particularly to the more than 3.2 million people who have fled Venezuela since the crisis began. On his second, very pertinent question, on the IMF, I assure my noble friend that we recognise that reconstruction in Venezuela will require support from international financial institutions and that, when the time is right, the UK will work closely with those and all like-minded international partners with the aim of getting Venezuela’s economy back on track.
On my noble friend’s final question, on the position of Her Majesty’s Opposition and, in particular, the leader of Her Majesty’s Opposition, while I have not heard directly from him, I followed the speech of the shadow Foreign Secretary, who answered a question on Venezuela yesterday. I am sure the noble Lord, Lord Collins, is taking note—

Lords ChamberMy Lords, they have heard that and they very much welcome it, as the Chief Minister has made clear. Since the referendum we have set up a system from the Department for Exiting the European Union and the FCO, whereby the overseas territories, including Gibraltar, can be best consulted. For Gibraltar there is a very special track that that particular negotiation follows, which is a joint negotiating committee set up by the Department for Exiting the European Union, chaired by Robin Walker, a Minister in that department, and attended by my right honourable friend Alan Duncan. We take extremely seriously the importance of negotiating the best outcome for the whole of the UK family. That includes Gibraltar.
Does my noble friend agree that this dreadful deadlock is unlikely to move forward? First, Spain simply has to recognise that no British Government will ever take any steps that do not have the support of the people of Gibraltar. Secondly, the people of Gibraltar have to recognise that so long as Spain retains its territorial claim, it will from time to time seek to make life extremely uncomfortable for Gibraltar. Unless and until both sides wish to move forward, this deadlock will remain.
My noble friend has a long history of professionalism in this as a previous Minister. He is absolutely right.

Lords ChamberMy Lords, my right honourable friend the Prime Minister successfully renegotiated a deal that is better for the UK than any before and means that we are stronger, better off, and safer within the European Union. He made sure that the agreement provided that we are protected by international law which means that this will be put into effect. That means we are in a better position than ever before. It is right that when those who go to vote make their minds up they bear all that in mind. I do not tell them how to vote. I certainly hope they will consider the facts carefully before they do so.
Can my noble friend confirm that there are no circumstances similar to the one that the noble Lord raised, in which the European Court of Justice has overturned a decision taken by the European Council? Can she further confirm that in the package negotiated by the Prime Minister is something called the red card system, which substantially enhances the roles of national Parliaments in the whole legislative procedure of the European Union?
My noble friend is absolutely right in his surmise.

Lords ChamberThe noble Lord is of course right that we would be able to do that. It is worth considering the fact, though, that Australia took 13 years to reach an agreement with China. It is not about just one or two agreements. I think we would have to negotiate the best part of 60 agreements at the moment, so it would be a considerable piece of work. It can of course be done but, through that period, there will be a time of uncertainty.
My Lords, is this not just another example of important international decisions being taken in which Britain would have virtually no role to play whatsoever, were we to leave the European Union?
The noble Lord is of course right. Being a member of the EU gives us the opportunity to take part in all kinds of discussions around the world on a whole range of topics.

Lords ChamberMy Lords, I should first say that the documents have been deposited in the Library and, I understand, in the Printed Paper Office. Although they were published only a short time ago by the President of the European Council, we have made them available.
It would be wrong of me to try to summarise the document here. All I can say to the noble Lord is that we will have an opportunity to discuss in detail those advances set out here. It has been made clear—not only by the President, Mr Donald Tusk—that this is still a work in progress, but clearly it is important that all other members of the European Union have a chance to consider this before we get to the February Council and, possibly but not definitely, a decision at that stage.
Does my noble friend agree that perhaps one of the reasons why we have seen a number of extremist parties, of both the left and the right, across Europe is that there has been too much centralising of decision-making in Brussels in recent years? If the Prime Minister can return through the red-card system a certain amount of real sovereignty to national parliaments, that will be one of the most important achievements of the last decade.

Lords ChamberMy Lords, I shall be brief because others wish to ask questions. First, there is agreement that people who come to Britain cannot claim unemployment benefit for the first six months; we are well on the way to achieving that. The second thing is that people who cannot find a job after six months should either leave and go home or remain here at their own expense. The third thing is the issue of sending child benefit home. We are making very good progress on that and are close to the final decision on it.
Does the Minister agree that perhaps the most effective way of reinforcing national and parliamentary sovereignty would be to ensure that the principle of subsidiarity, which has been undermined by the so-called yellow card system, should be reinforced?

Lords ChamberI know that the Liberals find it easy to occupy two opposite positions at the same time on a number of occasions but we cannot ask the Prime Minister to do that. Subsection (2) of the new clause proposed by the amendment states that this has got to be done no later than 12 weeks prior to the appointment date of the referendum. I should like to think that 12 weeks before the referendum the Prime Minister will have decided whether he is going to rule anything out. The Prime Minister will have a position, so that point simply falls.
In Committee, I used the analogy of the European Union being like a bear trap. No one in Britain today would want to put their foot in the bear trap and join the European Union as it is. The question is how to get your leg out of the bear trap. People like the noble Lord, Lord Kerr, say that it is just going to be too painful to remove our legs from the bear trap and therefore we must just accept the risk that we might be bleeding to death but that is much less painful. In this amendment he has now come up with the proposition that because of Article 50 it is not just one bear trap: if you take your leg out of the bear trap there are 26 others to get through, each one of which could cause enormous grief, so it is better to stay in the one bear trap. This is a ridiculous position. I am deeply shocked that he should put forward an amendment of this kind.
Perhaps the Minister can tell us whether Ministers are going to be bound by collective responsibility in respect of the Government’s position. If they are, it is asking a lot of them that they not only have to stand up and support something in which they may not believe, but they have also got to go out and explain what would happen if the opposite happened.
My noble friend has just referred to something called “the Government’s position”. Does he accept that if the Government have a position, they owe it to the country to campaign on that position?
No, I would not accept that. If the Government are people who genuinely have differences of view as to what is right for the country, then those members of the Government should be free to argue their case. As the noble Lord, Lord Stoddart, said, this is matter for Parliament, not for the Government and not for the Executive. It is for Parliament to decide what is in the best interests of our country. I hope that Parliament, by passing this Bill, will decide that the people should have an opportunity to express their view. That will then be advisory for the Government and I would expect the Government to carry on on the basis of what is suggested.
I shall make one other point. Even if the Government wanted to do it, it would be impossible to report on the relationship with the European Union that the Government envisage in the event of a referendum vote to leave the European Union. We do not even know what the European Union will be like. It is the European Union that is leaving us as it struggles with the disastrous consequences of monetary union. It is the European Union that will have to move towards a more integrated fiscal arrangement if the euro is to survive. The amendment is asking the Government to predict what it will do to maintain the stability of the euro and at the same time to predict what they will do.
In response to my noble friend, I have just thought of another argument. I would like to think that in the referendum campaign the Government will be respectful of the arguments which are put across and the way they are received by the public and that they will acknowledge and respond to these arguments.
I know why the noble Lord, Lord Kerr, has put forward this amendment. Of course it would help his case if the Government had to make these points. I have always thought that he was very even-minded and impartial on all these matters, but now he has left his former position he has turned into a politician, and a campaigning politician at that. I hope that my noble friend will not feel able to accept this amendment in any way.

Lords ChamberMy Lords, I agree that the European Union needs to be more democratically accountable, and any changes within the European Union should therefore involve the participation of national Parliaments. There is much that can be done to ensure that national Parliaments have a stronger role to play. We now have a new Commission and a new head of the Commission, and there are prospects for a very constructive discussion about how we take these matters forward. In the first instance, it takes leadership and that is what the various Governments throughout Europe are showing now.
Does my noble friend agree that the championing of the single market under the Single European Act 1986 was one of Margaret Thatcher’s great achievements as Prime Minister, aided by a Member of your Lordships’ House, Lord Cockfield? Does she further agree that, about 30 years on from that date, there will inevitably be a number of areas where adjustments can and should be made in the interests of all member states without undermining the basic principles on which the single market is based?
My Lords, yes, I agree with my noble friend. I have tried to argue over the last four or five weeks that the single market is, indeed, a British success story—my noble friend makes an important point. The United Kingdom has played a leading role in shaping the single market. We have been instrumental in driving its continued liberalisation, particularly in services. My noble friend is right; this is 30 years on, so while the single market is Europe’s greatest success, it must reflect the needs of the 21st century, with a stronger market, particularly in services, both digital and in energy. Further reforms are needed and we can lead on that.
