I cannot accept the conclusion of the noble Lord. Of course, as the Prime Minister said, we need to learn from these cases

“how to better handle such matters better in future”,

and a credible complaints process needs to have the confidence of Ministers and civil servants alike. Work is under way on that. Ministers and civil servants work together on difficult issues every day and, in the main, very constructively.

My Lords, as someone who headed four separate departments, all under Conservative Governments, in my experience overwhelmingly the Civil Service was loyal and gave exceptional advice to the Government. Would it not be better to look at the quality of special advisers, who sometimes exhibit neither of those qualities?

Having worked as an adviser, a Minister and a civil servant, I would say that the constitution has these different parts. Political advisers are important and helpful. In most cases, they work well with the Civil Service.

My Lords, the Government have no plans to change the status of the House of Lords Appointments Commission, which should continue to play its very important advisory role. Appointments to the House of Lords are a matter for the Prime Minister, and it is for the Prime Minister of the day to advise the sovereign on appointments to the Lords. The list issued on Friday was made by the Prime Minister on the advice of the former Prime Minister, Boris Johnson.

My Lords, that is a disappointing reply. Does the Minister remember that the all-party committee which I set up when I was Lord Speaker in 2016, under the noble Lord, Lord Burns, proposed a maximum for the House of Lords of 600 Members? The latest list brings the total not to 600 but to 825, with resignation honours still to come. Also, on this occasion, the system has enabled the appointment of a new Peer who had quite falsely attacked a distinguished Member of this House as a paedophile. Surely there is no reason why an individual who made such an untrue allegation should be rewarded by a peerage. Is not the truth that the present appointments system cries out for urgent reform?

I start by making the general point that, given retirements and other departures, some new Members are essential to keep the expertise and outlook of the House of Lords fresh. The Burns report had longer-term proposals to maintain a steady-state size. Those still require further thought and engagement, particularly with the House of Commons, given the constitutional implications. Theresa May’s Administration in 2018 did not sign up to the Burns recommendations, but there is a Conservative manifesto commitment to look at the role of the Lords.

On the other point that my noble friend Lord Fowler raised—if I may still call him my noble friend—the nomination for the appointment of the individual he referred to is a matter for the leader of the Labour Party, Keir Starmer, to answer for. Obviously the HOLAC provides advice on nominations for all life Peers, including those recommended by UK political parties, to ensure the highest standards of propriety. That was applied in the usual way.

I welcome the fact that, in recognition of the importance of early learning, the Government have kept nursery schools open. Primary schools are also open for some pupils, although the arrangements seem to vary locally. The success of vaccination gives us all hope. Does my noble friend agree that we should not reverse these arrangements, whatever happens, and that we should move to get all children back into primary school from after the February half-term?

It is a great pity that we cannot have 40 minutes. I say to the Minister that not everyone, even on this side, agrees with what the noble Lord, Lord Grade, said yesterday. Surely it is fair to congratulate the Government on dropping some of the more unacceptable proposals that had been floated over the past few weeks and on abolishing the BBC Trust, which should never have been established and which a committee of this House said 10 years ago should not be. At the same time, will the Minister congratulate the director-general of the BBC, the noble Lord, Lord Hall of Birkenhead, on his negotiating skill?

I ask one question. There will now be an 11-year charter, but why do we need another five-year external review in between? Surely that should be left to a strong board of independent directors, whose job it is to run the corporation year by year. Surely that is their job. Above all, can we not resolve now that the BBC should be left to develop its own plans and build on its reputation as one of the world’s great broadcasters without interference?

I am grateful to my noble friend for his congratulations; the noble Lord, Lord Hall, has indeed been very helpful in the whole process.

It is an 11-year charter. There is a five-year health check—I use those words advisedly. It is a health check. We are setting up a completely new system of governance. As my noble friend said, the BBC Trust has problems—he foresaw them, but not everyone was so able to do so—and it seems right that a health check, which is what it is, should take place.

My Lords, I also dislike pre-briefing. Of course, the last Labour Government did a lot of pre-briefing, and I think that perhaps changed the culture a little. However, I do not always believe what I read in the newspapers. We have to wait until tomorrow for the White Paper and the Statement, which we had planned. I very much look forward to answering some of the detailed questions tomorrow that the noble Lord has set out. What I will say is that proper time will be set aside for a full debate. That is important. Everybody in this House values the BBC and will want to have an input into the Government’s conclusions on all these points. Editorial independence is of course paramount, and I look forward to presenting the proposals tomorrow.

My Lords, I think the whole House understands the Minister’s position, given the proximity of the White Paper. But I want to put to her one question on process, which perhaps she can answer. Will she give an assurance that whatever proposals are put forward, Parliament will not only, as she has now made clear, have the opportunity to debate them but also to vote on them, rather than the decisions being left solely to Ministers?

My Lords, I am very grateful to the noble Lord, Lord Best, for introducing this very timely debate. I join the House in congratulating him, the entire Communications Committee and their staff on their excellent report. After a busy week it has been an enjoyable, interesting and important afternoon. I will ensure a further opportunity for a debate on the charter this year. I am in discussion with the usual channels about the timing and the detail.

The report endorses the Reithian principles that the BBC should be about information, education and entertainment. The committee proposes adding an extra dimension with the fourth word “reflect” to commit the BBC to reflecting,

“the different opinions, lifestyles, beliefs and values of the nations, regions and diverse communities of the UK”.

This has been endorsed by the right reverend Prelate the Bishop of Chelmsford, the noble Baroness, Lady Bakewell, and by inference by the noble Lord, Lord Bragg. The Government agree that the BBC must serve every corner and community of the country, and next month’s White Paper will elaborate on that.

As a former businesswoman I was very taken by the eloquent deconstruction of the panoply of missions, activities and objectives by my noble friend Lord Sherbourne of Didsbury. As a gardener, I know that heavy garden shears do wonders to help the light in. The Committee’s report rightly advocates greater transparency and a simpler accountability framework for the BBC. These are themes that we have heard throughout the charter review and they are extremely important.

I am glad that, once again, the House has shown its full-throated commitment to the BBC. The Government share this commitment. The BBC is the finest broadcaster in the world. It is an indispensable part of our national life and makes an enormous contribution to our standing in the world. The 192,000 responses to the culture department’s consultation and countless surveys demonstrate the fact that the public care intensely about the BBC. I agree with the noble Baroness, Lady Bonham-Carter of Yarnbury, about that and, indeed, about its huge contribution to our creative industries.

The proof of the pudding, of course, is always in the eating, and some 97% of Britons use the BBC’s services on a weekly basis, for an average of more than 18 hours. I enjoyed the way that the noble Lord, Lord Hart of Chilton, took us on a walk down memory lane. I was, of course, another fan of “Ballet Shoes”. Programmes such as “The Night Manager”, “The Great British Bake Off”, “Sherlock”, “Doctor Who”, the new sports that the noble Lord, Lord Maxton, spoke of and “University Challenge” all bring great delight to millions. And, of course, BBC radio should not be forgotten because it hits commanding heights as well. What would we do without “You and Yours” and “The Archers”? Both show how the BBC provides insightful, popular programming day after day, week after week. All inform, educate or entertain. Like the noble Lord, Lord Foster, I am a critical friend.

I am always interested in global perspectives, because of the way the world is changing and because of the interdependencies which were mentioned by the noble Lord, Lord Judd. BBC international services now reach 308 million people across the globe every week. This is higher than the weekly reach of the international group of broadcasters which includes Voice of America, China Central TV and Al Jazeera.

The BBC World Service is consistently recognised as the most accurate and highest-quality news outlet on earth and is also a much-needed corrective to state-run broadcasters that are controlled by despots. The noble Lord, Lord Berkeley of Knighton, hinted at that. It reached 210 million people in 2014-15. In the words of the noble Lord, Lord Best, and my noble friend Lord Selsdon, it is an extraordinary source of soft power. It helps—even more importantly, perhaps—to ensure the continued prominence of the language of Shakespeare in this year of his 400th anniversary. BBC global news operates in more than 170 countries and was accessed by 283 million people in 2014-15.

It is because the Government recognise how much the BBC matters that we want it to be as efficient and effective as possible. At the time of the last charter review, most households had access to five television channels. Now the BBC has eight channels and one online channel and the media landscape has changed beyond all recognition.

The BBC’s status as a pre-eminent player, both domestically and internationally, is not in doubt. Far from wishing to threaten this status, the Government want to solidify it.

One of the fundamental issues that the White Paper must address is the constitutional basis of the BBC. Some, including my noble friend Lord Fowler, and the noble Lord, Lord Lester, take the view that the royal charter affords too much power to the Government and that the BBC should be established under statute. As I said in the House earlier in the week, the charter has been the basis of the BBC for nearly 90 years, ensuring, in my view, the BBC’s independence. We have consulted on the way the BBC is enshrined and no strong argument has come through in that consultation to change the approach of a charter which has served the BBC well over the past century. That included the Communication Committee’s own report.

Moreover, the BBC Trust has set out concerns about a statutory basis. Far from protecting the BBC, it would mean that the BBC could be subject to amendment, or at least the threat of it, at any time. I agree with the view expressed by my noble friend Lord Sherbourne, who is very experienced, that a statutory approach could in practice be more political and less independent. The noble Lord, Lord Lester, kindly described an array of mechanisms by which legislation that he is hoping to bring forward might secure the independence of the BBC. I share the view that independence is central to the BBC’s future. However, as the noble Lord, Lord Williams, suggested, there are many ways in which the charter may achieve the same effect of securing independence. As someone who has a passion for good government, I am not convinced that legislation is necessarily the way to deliver independence or the best possible outcome for the BBC.

I assure the House that this Administration takes editorial independence extremely seriously. The BBC must have the freedom and independence to take creative risks so that it can inform, educate and entertain. It must be free to be robust and critical in holding power to account through its hard-hitting journalism. The Government have been clear throughout the charter review that independence is not negotiable, and will set out their plans in the White Paper shortly. Of course, the BBC is in receipt of nearly £4 billion— £3.7 billion—of public money, as was said by the noble Lord, Lord Desai. It also has a very significant impact on the commercial sector, although it is also important to acknowledge—and I think we should do so—that the BBC spends more than a billion pounds a year in the external creative economy, which I think is absolutely vital.

The White Paper, which we plan to release in May with a view to the new charter being in place for the beginning of next year, will strike a balance between giving the BBC the space and independence it needs to thrive and ensuring that it is efficient and fit for purpose in a much-changed media landscape. It is for this reason that we do not agree with the committee’s suggestion that the licence fee should be set by a regulator. To respond to the noble Lord, Lord Young of Norwood Green, the licence fee is essentially a tax and should therefore be government-led. The funding of free licences for the over-75s was agreed between the Government and the BBC. As a public institution in receipt of £3.7 billion a year, it is right that it should play some part in balancing the books.

As Ofcom has noted, some areas of public service broadcasting, such as children’s TV, are at risk, and there have been calls from some quarters to allow part of the licence fee—or some other form of public funding—to be made available for public service broadcasting to organisations other than the BBC. That is the contestable funding model. This could introduce greater competition and allow more creative risks to be taken. We have heard these calls and the concerns articulated so clearly by the noble Baroness, Lady Benjamin, this evening. I share her passion for children’s television, which she has done so much to advance. That model is under discussion and our plans will be set out in the White Paper.

The Communications Committee has also called for future BBC charters to last for 11 years in order to decouple them from the electoral cycle and avoid the review acting as a sword of Damocles, as I think the noble Lord, Lord Best, said. This is an interesting idea, and we are looking at the length of future charters, recognising the need for stability within the fast-changing industry, which several noble Lords have mentioned.

There is widespread acceptance, including from the BBC, that governance has not worked properly. The Jimmy Savile outrage, the excessive payouts mentioned in the debate, the complaints procedure and other failings have naturally caused consternation and concern. The opacity and complexity of the current governance system make it far harder to find out what has gone wrong, and sort it out, than should be the case for such a vitally important and influential institution.

Noble Lords have made it clear that they feel strongly that BBC appointments should be wholly independent of government. The Government currently appoint, through a public appointments process, all members of the BBC Trust. As has been noted, all members of the executive board are appointed by the BBC Trust itself. The independent report published by Sir David Clementi recommended a unitary board for the BBC and found that the Government have a legitimate role in appointments. We are looking at this issue very carefully and will of course set out our proposals in the White Paper.

So far, my noble friend has said that there is basically going to be no change—certainly not to the government control of the charter. But when she and the Government come to make their proposals in the White Paper, is it their intention that they will be put to the vote in the House of Commons and House of Lords?

For nearly 90 years a royal charter has been the constitutional basis of the BBC, underlying the independence of the BBC from political interference. The Government intend to hold debates in both Houses on the draft charter to provide the opportunity for Members to make their views known. The format of these debates has not been decided.

Is not the trouble with what my noble friend has just set out that it is not the case? The decisions on the BBC charter review rest entirely and exclusively with the Government. No parliamentary legislation follows—there is no check. The Executive decide what the future of the BBC is going to be. Is the Minister aware that many of us feel that this is not the way to decide the future of one of the most important institutions in Britain today?

I am of course aware of strong feelings among colleagues in this House and I look forward to the debate that we have planned on this subject on Thursday. We have consulted on the way the BBC is enshrined and no strong argument is coming through to change the basis of a charter that has served us so well for 90 years.

I will certainly consider the question further, but we are acting constitutionally—there is a BBC charter and a charter process, we are undertaking the review and consulting in an appropriate way, and we will come on to debate the proposals in due course. The Government behaved in an appropriate manner in trying to sort out the funding of the BBC, as they did last year. In many ways, as I have said on previous occasions, that has been helpful.

As I was saying, we will of course reflect carefully on these issues, and a proposal for the term of the next charter will also be set out in the upcoming White Paper.

I take it from what my noble friend is saying that in effect, the Government have rejected the idea that the royal charter should be scrapped. If they have, how does she think the royal charter establishes and safeguards the independence of the BBC?

As I have said, we are looking at the whole process at the moment. Independence is an important issue, and when we set out our plans we will come back with our ideas on how we can best ensure an independent and good future for the BBC. I wanted to respond to the points that were made in the report, because it is as well that people understand that the report’s key proposal on this point will not necessarily be accepted. However, having said that, obviously we remain in listening mode at this stage of the process and we will come back with a White Paper.

Although there has not been much comment on it, it is worth mentioning that last week the Government announced a deal with the BBC to close the iPlayer loophole, which, under current regulation, allows viewers to watch catch-up services on iPlayer without paying for a TV licence. Obviously, this will stop those who are essentially freeloading from not paying the licence fee, and the Government will bring forward secondary legislation on this point as soon as is practicable. This responds to the digital change that we have discussed in many of our different debates.

Will there be an opportunity to debate the excellent report of the noble Lord, Lord Best? The important thing is to have that debate before the White Paper is published. Although I am interested in having the debate on the White Paper afterwards, it is much more important to have it when—theoretically, at any rate—it can have some influence.

My Lords, I hope the Minister will note that if, back in 2006, the then Government had listened to the Lords Select Committee on Communications, we would not have had the BBC Trust in the first place. Perhaps the lesson there is that Governments might do better to listen to parliamentary committees rather than committees of so-called outside experts.

Do not two points come out of this Statement? First, is it not clear from everything the Secretary of State said in the paper and in Questions that his eventual aim is a subscription model for the BBC? That is a profound change, particularly for an organisation which the Secretary of State himself says is part of the fabric of this country. Though it will doubtless be welcomed by advisers with their special interests, it will be strongly opposed by many of the public.

Secondly, there was much talk prior to this paper that the BBC was guilty of biased reporting. As far as I can see, there is little or nothing in the paper on that. Does that mean that the Government have now dropped that foolish charge? Does it mean that they now agree that the BBC’s standards of journalism are exceptionally high, and that this is a strong argument for preserving its news services as they currently stand?

My Lords, I agree that we should listen to parliamentary committees, especially ones in this House, which often bring a great deal of expertise. The point about looking forward Cassandra-like at the BBC Trust was a point well made. We have made it clear that we are now looking at options for governance, and the chair of the BBC Trust has obviously raised questions about the way the trust works.

On subscription, the Green Paper asks an open question about how the BBC should be funded. We want to engage with the public on whether the licence fee only continues to be the right model or whether it makes sense to have a more mixed economy. The BBC already has a certain amount of commercial income and that has improved in recent years. We would like to see more of that, provided it fits in with the total broadcasting landscape and continues to encourage the creativity and independence of the supply chain that we so much want. Subscription is one of several options we are asking for views on. No decisions have been made. The Secretary of State has a great background because of his previous chairmanship of the DCMS Committee in the other place. He knows that subscription is one of the things we need to look at, but just looking at them does not mean we have come to a particular conclusion.

Objectivity and impartiality are very important features of the BBC. There has to be a system that keeps an eagle eye on them at all times. I have been frustrated sometimes at what the BBC says and does, despite my passion for the freedom of the press, which I certainly apply to it. We will, of course, be looking at that aspect in the charter review. However, as my noble friend says, it is not huge and in lights, in the way that perhaps you might have expected from some of the previous comments.

My Lords, the Secretary of State for Culture, Media and Sport is currently considering a range of options for how the charter review might be conducted. An announcement will be made in due course. There is no set process, but of course we are determined to conduct a robust and thorough process with significant opportunities for the public to contribute.

I am grateful to the Minister, but did she see the reports of 12 May, which appeared in every newspaper and clearly resulted from an official briefing, that the Government intended, in the words of the Daily Telegraph, to declare “war” on the BBC? Does the Minister recognise that many people in this country profoundly disagree with such a policy, value the high standards of the BBC and its international reputation and will strongly oppose any attempt to undermine these?

My Lords, war has not been declared on the BBC. The BBC makes an enormous and valuable contribution to many people’s lives as the nation’s broadcaster and in its overseas services, with 308 million people around the world and 96% of the UK population watching it each week. It is also a very well-understood and supported cultural institution, which I know is important to this House. The arrangements will be looked at fully and from every perspective in the charter review. I think the process starts today with the kind of comments that I know will be made in this House.
