Lords ChamberMy Lords, it is of course right, and what the noble Lord, Lord Foulkes, said is entirely justified: Parliament has a role. But, in this particular case, we can rely upon the good judgment and discretion of the King, and we can recognise that he is a father and a brother as well as a king.
My Lords, I will make a more lawyerly point. I heard the wise intervention of the noble Lord, Lord Pannick, on what is regular and the powers of the Lord Chancellor. I will not comment on either of those points. But I heard the noble Lord say, in moving the amendment, that his wish was to provide some clarity. I respectfully suggest that its wording actually does the precise opposite, because he has used the verb “excluded”—although, when he moved it, he used the word “removed”. In the context of this legislation, verbs are important. A Counsellor of State can be excepted if they are overseas, for example, which means that they cannot act but they do not lose their place in the pecking order. If they are disqualified, they lose their place in the pecking order, and the next person in line takes that place. It is not immediately clear to me whether “excluded” is “excepted” or “disqualified”. With the greatest respect, I suggest that it is this amendment that ought to be excluded.

Keep taking the tablets, my Lords. When we last debated these clauses, a number of noble Lords, including the noble Baroness, Lady Chakrabarti, invited and urged me to meet Inquest. I am grateful for that urging, because I had a very productive and informative discussion with it last week on the measures in the Bill and some wider measures. In fact, Justice also attended the meeting. While it is fair to say that there are differences of opinion between us, I assured them that the Government’s priority remains to make certain that the bereaved are at the centre of the coronial process. The measures in the Bill support this priority. We seek to reduce unnecessary procedures in the coroners’ courts and that will, in turn, reduce delays in the inquest process, and reduce again the distress to bereaved families.
The amendments in my name in this group are minor and technical. They are consequential on Clause 39, which allows a coroner to discontinue an investigation should the cause of death “become clear”, and they remove some obsolete references to post-mortems from existing legislation.
Those are the government amendments. However, I am conscious that the noble Baroness, Lady Chapman, and the right reverend Prelate the Bishop of St Albans have other, more substantive amendments in this group. Perhaps the noble Lord, Lord Ponsonby, will speak on the noble Baroness’s behalf. I will let them propose their amendments before I respond to them.

Lords ChamberMy Lords, I think the theological point put to me will take an answer that is probably longer than the allotted time, but I am happy to consider it further. However, I reject the proposition that we are not concerned about the rights of Muslim women and girls. The history of the work in this area, whether on forced marriage or indeed the matters we are discussing this afternoon, would indicate the opposite.
My Lords, I do not think anybody could dispute my noble friend’s personal commitment, but this is taking a very long time. Can he tell the House what line the Government will take on the Private Member’s Bill from the other place which suggests that the minimum age for marriage should be 18?
My Lords, I think my noble friend will have seen my letter to various groups on that point. Marriage at 16 and 17 has the significant risk of people being forced into marriages and their life chances reducing. Therefore, my noble friend can take it from me that we will be looking very carefully at the Bill introduced by the Member for Bromsgrove, who now appears to be otherwise occupied.
