Lords ChamberWe respect entirely that the democratic process means that in a referendum people express their view. More than 1 million more people voted to leave than to remain. We gave the undertaking that we would respect the result of that referendum and, as I gently reminded the noble Baroness the other week, the fact is that the only major party to stand at the last election on the basis of having a second referendum suffered the penalty of almost total loss.
My Lords, nobody can doubt the good intentions of my noble friend. She has the respect of all parts of the House, but will she accept that intentions and expectations are not guarantees? We need a legislative guarantee that Parliament will indeed take back control.
My Lords, our undertaking is indeed to give a guarantee that Parliament will have a vote on the agreement that is reached; not only on the withdrawal agreement but also, as I have stressed, on any implementation phase and on our future relationship. That is a very broad discussion for Parliament to have and a very definitive decision that they can make.

Lords ChamberMy Lords, we have made it clear that we understand that some of the discussions about our future relationship will involve continuing investment in projects across Europe. Clearly, the initial discussions about the withdrawal agreement are focusing on those areas where there are identifiable obligations. It is important that we move on to the next stage about our future relationship because, as the noble Lord has just pointed out, there will be continuing commitments that we may indeed wish to make.
My Lords, are we not singularly fortunate in having a Chancellor who is entirely sensible and optimistic, who looks forward to a good deal and who realises that no deal would not be good for this country, and should we not give him every possible support?
Yes, my Lords, the whole of the Cabinet is in the same frame of mind.

My Lords, does my noble friend agree that we all have cause to be grateful for the calm, prudent, constructive contribution of the Chancellor of the Exchequer in these talks?
Yes, my Lords. I have seen that close up because I was fortunate enough to be briefed throughout the summer by officials from the Treasury about the patient, technical work that they have been carrying out to ensure that when we are able to reach agreement not only on principles but on practice, the result will be fair for this country as well as for the rest of the European Union.

Lords ChamberThe noble Lord is absolutely right. Also, the youth mobility scheme and Horizon 2020 are open to countries that are not members of the EU; it depends on the negotiations between the EU and that third country. The most important thing is that all of us are looking to ensure that the future of our young people can be as rich an experience as it has been in the past.
My Lords, notwithstanding what the noble Lord, Lord Howarth, has just said, does my noble friend agree that it would be extremely sad, to put it mildly, if young people from all the countries of Europe found it more difficult to travel and work around the continent than those who came over in the Middle Ages to help build Lincoln and the other great cathedrals? If that stage were reached, we would have not a hard Brexit or a soft Brexit but a barren Brexit. That would be the worst of all.
My Lords, I taught history several lifetimes ago, and I know that we were not always the most welcoming of countries. I hope we have learned that it is better to welcome than to prevent people coming from countries for the wrong reasons. Clearly, it is important to have a legal basis to control immigration, but it is important to recognise that we have a way of welcoming people that enriches our society. Certainly, as we have announced already, for those who wish to take up Erasmus, applications will continue as normal in 2017-18, and:
“The Government will underwrite the payment of such awards, even when specific projects continue beyond the UK’s departure from the EU.”
That shows a welcoming spirit.

Lords ChamberMy Lords, yes, she is, which is why she has formed a series of Cabinet sub-committees to consider the full range of issues—some of the crucial issues, as the noble Baroness pointed out, that this country needs to address as we leave the European Union and as we look at the implementation period. Our overall objective is to ensure that there is no cliff edge and that we have security for all those practising business, whether agribusiness or financial services. That is why this is a true cross-Whitehall effort. It is not easy, and it is not necessarily the way Whitehall has worked in the past—but it does now.
My Lords, in order to put one misused phrase to flight, does my noble friend agree that it is perfectly possible to have your cake and eat it but that you cannot eat your cake and have it?

Lords ChamberMy Lords, where action is taken purposely to bomb civilians it is a war crime and something that we would condemn. I would mention, with regard to Mosul, that I am aware of the recognition there that the Iraqi forces have taken every step they could to avoid hitting civilians, against an enemy that uses civilians as human shields.
My Lords, is there not a case now for trying to talk to the Syrian regime? We have broken off all relations and refused to recognise the regime from the outset of the civil war. As we are not in a position to end this, would it not make a great deal of sense at least to have some diplomatic contact?
No, my Lords, because when we have engaged before we have been let down. Clear action by the regime has shown that we are right not to have diplomatic relations. What we are right to do and what we will continue to do—I give my absolute assurance to my noble friend—is to seek the path of political agreement through the Geneva talks. That is the only way forward to achieve peace.

Lords ChamberTo ask Her Majesty’s Government, further to the remarks by the Foreign Secretary before the Select Committee on International Relations on 26 January, whether it is their policy that President Bashar al-Assad should be allowed to run for re-election in the event of a peace settlement in Syria.
My Lords, our long-standing position is that there can be no sustainable peace in Syria while Assad remains in power. He is incapable of uniting the country because of his military campaign against political opposition. Syria needs a transition to a new, inclusive, non-sectarian Government to achieve the credible political settlement that will bring long-term stability. This is set out in the Geneva communiqué and endorsed by UN Security Council Resolution 2254.
My Lords, of course I thank my noble friend for that Answer but, in the light of the evidence given last week to the committee of my noble friend Lord Howell—I am so glad to see him back—I am somewhat disappointed. Could we not have a new, realistic approach, recognising that we cannot remove Assad? In the words of the patriarch of the Syrian Orthodox Church, who was here a few weeks ago, he should be a candidate in any election. Far be it for me to suggest that, if he wins, he would be invited on a second state visit—but should we not establish diplomatic representation in Damascus and be at the centre, so that when peace is eventually restored we will have played a constructive part in restoring it?
My Lords, we are taking a lead in the constructive discussions for resolving what is an appalling situation across Syria—a situation where, at the last election, the only opposition opponent to Assad felt it necessary at the last moment to encourage everybody in the country to vote for Assad rather than himself as a candidate. Assad has shown that he is incapable of protecting his own people, but I agree with my noble friend that we should not dictate an outcome. What we are saying is that Assad has not proved that he can bring peace to the country. We are leading the way in the Syria Support Group of the United Nations in trying to ensure that there can be a position where the Syrian people decide the next steps. My right honourable friend the Foreign Secretary said when he appeared before the committee of my noble friend Lord Howell, whom I am delighted to see today:
“I would hope that it would be possible to have a plebiscite or an election, properly supervised by the UN, in which all the 11 million displaced persons, including the 4 million who are now outside Syria, are fully entitled to vote”.

Lords ChamberMy noble friend raises an essential matter and I know that she has great experience of working through NGOs, such as GAPS, to assist those who have suffered these atrocities. The humanitarian assistance that DfID provides seeks to cover all aspects of the trauma suffered by those who are displaced, both those within Iraq or Syria and those who have fled those countries. Psychosocial help is essential. It is defined in different ways by different cultures and, indeed, by different individuals. It is also one of the most difficult services to provide because of its longevity. None the less, it is one of the most important.
My Lords, are members of the Government in dialogue with the Patriarch of the Syrian Orthodox Church, to whom the noble Lord, Lord Alton, referred earlier this afternoon? I suggest that such a dialogue could be extremely helpful in formulating and developing policy.
My Lords, much earlier this autumn, in October, I hosted a freedom of religion and belief conference which looked at the issues of how religion interfaces with counterterrorism work. I invited to the conference representatives from many faiths, which were well represented; but also, as a consequence, I was able each Thursday in the following weeks to meet representatives of Orthodox faiths from across the eastern area, including those, for example, from Damascus. I am most grateful to all those representatives of the Orthodox Churches who came to have conversations with me, most of which were confidential.

Lords ChamberMy Lords, the noble Baroness tempts me to forecast the future. What I will forecast is that the United Kingdom’s support for this process will continue unabated. As the noble Lord speaking for the Opposition said a moment ago, it is important to recognise the bravery of the two leaders taking part in the process. They deserve our support.

Lords ChamberThe noble Lord is focusing on the importance of quality of staff—that is the theme of his Question. First, with regard to staffing across the EU network, even before 23 June we had already allocated a further 16 UK-based posts for our work in the EU, reflecting the changing relationship and conditions across Europe, because of uncertainties caused by changes of Russian policy and migration. So there had already been an increase of flexibility. That, of course, will be part of our 2020 initiative in looking at how staffing needs to respond to the new needs following 23 June.
As for locally employed staff, I put on record my great admiration for them. They bring a depth and breadth of expertise, whether they are cooks, drivers or advisers; they bring knowledge of the culture and the local country that is absolutely essential. In accordance with our agreement with the Select Committee in another place, they will not exceed 70% of the allocation of staff.
My Lords, while I accept what my noble friend has just said, would she accept that there are many bruised people among our partner 27 nations in the European Union, especially among many of the smaller countries, such as the Baltic states? Will we make a very special effort to ensure that they realise that we are in no sense turning our backs on them?
My noble friend raises an essential point. Yesterday it was my honour to record a short video of congratulations to Lithuania to celebrate its 25 years of independence. We will continue our bilateral relations with the other 27 countries across Europe post-Brexit—and, of course, we are still within the European Union, and our relationships must remain cordial. It is important for all of us that they do.

Lords ChamberMy Lords, I hope that I said that there was no standard age of majority in the UK. The noble Baroness raises two crucial decisions which young people at 16 may wish to take. However, I gently remind the House that at that age they may make those decisions and carry them through only with the permission of their parents.
My Lords, is it not also true that they cannot smoke or drink legally? There are many in this House—I am sure my noble friend would agree—who were unhappy about the inconsistency and the precedent created in Scotland and who wholeheartedly approve of the fact that the Government have come to their senses on this one.

Lords ChamberMy Lords, the noble Lord tempts me to paint a picture of Armageddon, which is not my wont. When we go forward in diplomacy with the next-steps talks tomorrow, their results will clearly be discussed with the Ukrainians on Thursday. I would not want to predict the outcome of those talks. I always go into these matters in a determined and positive way, and I am sure that given the characters of those involved in the Normandy format, they are far more determined and knowledgeable than I could be. I do not wish to go down the route of predicting whether there would be all-out war because it is the job of us all to stop that happening. That is where we must not end up, and the route being taken by the negotiators is one which does not have on it a signpost to war.
My Lords, in agreeing with what my noble friend has just said, could we try to cool the rhetoric all around? Invoking the spirit of Munich and talking about a new cold war, let alone a hot one, helps no one. If, sadly, the Minsk dialogue does not result in success, could we consider convening a conference here in London and taking a leading role, which we would be well fitted to take, to bring all the parties together? A future Europe that is at peace and in harmony needs a stable, prosperous Russia and a free Ukraine as much as it needs everything else.
My Lords, none of us in the European Union is seeking a confrontation with Russia; it is the Russians who have sought confrontation with Ukraine and others. We need to work within those parameters. That is why I say that it is not business as usual with Russia, but it is business. We talk to the Russians—and indeed tomorrow the Normandy format will show that there is negotiation—but do not let us underestimate the determination of Mr Putin to try to drive a wedge between us. That must not succeed.
My Lords, I have given as much information as I am able to at the moment. Clearly what the Government are keen to do is ensure that every opportunity is given to the House to discuss the agreement. I know that we are working closely with the Opposition, and particularly with the noble Lord, Lord Stevenson, because his name is attached to Amendment 84KA.
My Lords, we cannot all go to the gallery of another place to listen to what the leaders say, nor can we all crowd around television sets. Will there be a Statement before we begin the debate on the substantive amendments so that we know the background against which we will be debating them?
My Lords, in this House it is possible within the proper proceedings of Report stage that, when a Peer moves an amendment, the Minister can get up very shortly afterwards. It is completely within the procedure of Report to be able to set out the Government’s response. I hope that that will be the case. I do not think I have ever heard anyone complain before about a lack of television monitors in this place.

Lords ChamberI am sure my noble friend has made the right decision. Will the House still sit on Friday 18 January, as is currently the plan?
I am grateful to my noble friend Lord Cormack for that question. I can confirm that the business of the House already set down for 18 January will proceed as normal. One of the considerations I had to take into account was that any scheduling of the Leveson debate should not displace Peers’ Private Members’ Bills because I know that Peers of this House value every opportunity to bring those Bills forward.
My Lords, I am told just the reverse: that there is great relief that there will not be the prospect of ping-pong on the legal aid Bill on that day, and there is huge welcome around the House that I have managed to ensure that the audience—and particularly the superb performers from this House—will be able to attend and not to disappoint their Chief Whips on that occasion.
The noble Baroness is right to want further elucidation of my comment about 26 April. It is of course never the case that the Government announce the precise date of prorogation until business can be secured. I notice the noble Lord, Lord Bach, looking eagerly forward, because of course he speaks for the Opposition on the legal aid Bill. I am also aware of the number of defeats that the Government have so far faced on that, so there will be time for that Bill. I carefully said, “26 April or thereabouts”. Of course, I will be meeting with the opposition Chief Whip later today to ensure that by the end of today there is a notice of forthcoming business reissued to the House to assist the House.
My Lords, will my noble friend confirm that if the Motions to which reference has already been made are approved on Monday, that will result in most Bills going into Grand Committee rather than being taken on the Floor of the House? There are real constitutional implications here. I should be grateful for clarification.
My Lords, I know that my noble friend the Leader of the House will clarify the situation to make clear that my noble friend Lord Cormack is labouring under a misapprehension. That matter will be debated on Monday.

Lords ChamberAll I will say to the noble Baroness—who made a speech and not an intervention—is that she was airing some of her own views and prejudices, as we all do from time to time. I would not seek to pass comment on the convictions, the commitment and the sincerity of any fellow Christian of any orientation. I am talking today about the regulations before us and the special, specific position of the Church of England— which, let us all remember, still has the ability, if the incumbent wishes, to grant a service of blessing to any couple. Be it a divorced man marrying a woman and they do not go through the traditional marriage ceremony, they can have a blessing—and so can a same-sex couple.
However, there is a special position for the Church of England which should be recognised by your Lordships’ House. The Church of England should not, therefore, be included in the regulations we are debating today—and certainly should not be so included unless the amendment, which was so learnedly described by my noble and learned friend Lord Mackay of Clashfern, is incorporated and an undertaking to that effect given by the Minister when he winds up.
My Lords, perhaps I might at this stage respond to some of the comments made around the House. I know that there is a feeling that we have had a learned and full debate and that, after my noble friend Lord Carlile of Berriew has spoken—I understand he will speak just briefly—at that stage we might invite the Leader of the Opposition to make her winding-up speech.
