Lords ChamberThe noble Lord raises an important point. I partly addressed it in my previous answer, but he is of course right. When we look across modes of travel, we see that in aviation, for example, all evacuation and emergency procedures on a flight heading for a particular destination in a particular country are explained in a particular language. I suggest that there is a bigger challenge for cruise ships, which often stop at different destinations—but language and crew training related to it are nevertheless important.
What is the attraction of taking a cruise with 4,999 of your closest friends?
Unlike the noble Lord, I cannot claim to have 4,999 close friends. There are many noble friends in your Lordships’ House, but, even if we went on a cruise together, I am not sure that we would quite reach that standard.

Lords ChamberMy Lords, I thank my noble friend for bringing this amendment order forward. I particularly welcome this in the light of the Road Traffic Offenders Act 1988 and the penalty points that are associated with this. Many points were made in the excellent debate last week, launched by my noble friend Lady Pidding, so I will speak only briefly now.
It is now several decades since I was responsible for road safety, and at that time I was responsible for introducing the statutory instrument for seat-belt wearing. On the way a few things which had not been thought of before occurred to me as a driver. They may be old hat to the Department for Transport but, if there is any value in my suggestions, I hope that it will take them on board.
In those days—I am talking about 1982—the publicity campaign was fair for the measures but it did not have the educational element which my noble friend has spoken of and which I believe he envisages for a campaign on this issue. Can that educational element also be introduced in school civics lessons, as well as being communicated to those who want to learn to drive? One needs to imbue in young people the dangers of using a hand-held phone at as young an age as possible. I frequently see cars with all the children in the back using a hand-held device. They are so used to it being an extension of their arm that we have to make them aware of the danger of misuse at a much younger age. That applies even to pedestrians who walk along the street with their eyes down staring at a phone. Therefore, the educational campaign probably needs to be rather broader than may at first seem necessary.
My second suggestion is that police forces should not go soft or easy—I do not believe that they wish to—on those who say, “Oh, it was only …”, when stopped by the police. If you are to make any campaign for public safety work, you have to implement it fully right from the start, and that is what I encourage my noble friend to do. If there is anything that I can do to help him, he has only to ask.
My Lords, I want to make a very brief point. I was unable to take part in the obviously excellent debate last week, but everything that my noble friend on the Front Bench said pointed to one conclusion: if you use a hand-held device in a motorcar or any vehicle, then automatic disqualification for a period should follow. Six points are better than the current penalty, and a £200 fine is better than the current fine, although it is not a large sum of money. I believe that there should be a true deterrent effect. Personally, I would urge a minimum fine of £1,000 with disqualification for three months following the use of a hand-held device.
My Lords, what distinguishes the offence of using a mobile phone while driving is the fact that it is never a question of neglect; it is always based on a definite decision. We have a national obsession with mobile phones. They do more and more, and we have become increasingly dependent on them. That has undermined the impact of the existing penalty, so I am very pleased that the Government have reviewed this matter. We need to reinforce the penalty in order to make the message clear.
However, I do not fully agree with the Government’s response. I believe that the Explanatory Memorandum lacks a full appreciation of the seriousness of the situation. Recent research by IAM RoadSmart showed that 9% of the people interviewed admitted taking a selfie while driving. I ask your Lordships: for goodness’ sake, why? Clearly, that is a highly dangerous activity.
The drink-driving revolution took a generation rather than being an immediate response, but to have the same impact this legislation has to be well thought through. Therefore, I have some questions for the Minister, because there is now evidence that texting while driving is as dangerous as drinking and driving.
My first question is based on the fact that there is no need nowadays to use a hand-held device in the most modern cars because they have automatic systems that link your phone to the speaker. Therefore, what work are the Government doing with manufacturers to ensure that the systems design is as easy and safe to use as possible? What work are they doing with manufacturers to ensure that these are not optional extras for which you have to pay more but an intrinsic part of buying a new car and come as standard with new models?
My Lords, a number of us advocated disqualification for a period, and he has not touched on that.
There was a final point on disqualification. I believe I have already touched on it. When someone is caught using their mobile phone and is referred to a court, instead of getting a fixed penalty notice, not only would they get a fine of £1,000—an HGV driver would get a larger fine—but they would also face disqualification. That is in the hands of the justice system and the magistrates’ courts. I hope that that answers my noble friend’s question. The noble Lord, Lord Rosser, asked whether this applies to HGV drivers. Indeed it does. HGV drivers can be pursued through traffic commissioners who regulate HGV and PSV operators.
I thank all noble Lords who have taken part in this important debate. The noble Lord, Lord Robertson, talked about experience around the world. Perhaps we do not realise the dramatic nature of the impact until we reflect on the statistics and the information behind deaths on our roads. When that is presented to you, whatever measures we take—what we are doing today or other measures—to mitigate those deaths reflects poignantly on the work of those who ensured that seat belts were fitted into cars. We owe it to all those on our roads and to families who have been impacted by those killed on our roads due to accidents often caused by people who use a hand-held mobile phone, send that text or check that social media tweet or Facebook update on the basis that it is only a second’s distraction. Recent tragic events on our roads have reflected that that one second of distraction can lead to a lifetime of loss for a family. I hope that in answering most, if not all, of the questions on the statutory instrument we can move forward in a practical way.

Lords ChamberAs the noble Lord knows, this is a line that runs from London, through Leeds and York, all the way to Edinburgh. It is important that, irrespective of what political affiliation may be held by people along the line, we work in a collaborative way to ensure improved services. I can reassure him about the continued investment in this line. I shall run through some of the programmes: the Northallerton to Newcastle loops in 2019; the York north throat in 2020; and the Peterborough to Fletton Junction down slow extension in 2019. I also believe a new station is opening, or at least a new station platform, which will allow fast-running trains to run through more quickly on what is a heavily used line with many shared services.
My Lords, my noble friend’s recital of what is due is comforting to a degree, but can he assure me that there will be no back-tracking on the Lincoln improvements? We have only one direct train a day to London and only one back, so it is impossible for people in London to have a day in Lincoln, whereas in almost every one of the other great cities within reach of the capital they can do precisely that.
My noble friend is always a strong advocate for Lincoln, and I assure him that we will excuse him the unintended pun of “back-tracking”. Let me also assure him that services will continue to expand. Indeed, as he may be aware, VTEC—Virgin Trains—will also be running additional services from 2019 on the link to Lincoln.

My Lords, last time I asked my noble friend this question he said that “shortly” would be “soon”. Is it any sooner?
I suspected this question might come up, so I have been thumbing through my thesaurus, which is quite well read. All I can say is that perhaps “shortly” will also mean “imminently”.

Lords ChamberMy Lords, I am absolutely delighted to join in the accolades for the staff at the door—they have done an outstanding job and we have always applauded them for it. As they transfer to the new company, I am sure that they will continue to do an outstanding job. They will be offered new training opportunities and new opportunities to develop professionally, which will be extremely exciting. Therefore I am delighted to congratulate them. I am also delighted that the new franchise offers the kind of investment that we want to see, improving service in so many ways, improving the existing rolling stock and bringing on new rolling stock, additional seats and new services—all those kinds of things. We absolutely need improvements in ticketing as well, which is important because of the many people who use the east coast line.
My Lords, I echo my noble friend’s thanks to the current operators. However, the people of Lincoln will be delighted to have a reasonable service. I will take this opportunity to invite all Members of this House to visit Lincoln during 2015 when we celebrate the 800th anniversary of Magna Carta, and when Britain’s least-known great historic city will be available for a day trip from London.

Lords ChamberDoes my noble friend acknowledge that there are deficiencies in the present service? Does she know, for instance, that while it is possible to have a day in London from Lincoln using direct trains, one cannot do the reverse? As we have one of the most important years in Lincoln’s history coming up next year—2015, the anniversary of Magna Carta—can she will follow up on the conversations I have had with the Secretary of State and try to ensure that next year we have a direct service between London and Lincoln?
My Lords, I cannot comment directly on an issue that will obviously be under consideration but I will take back my noble friend’s comments with pleasure.

Lords ChamberMy Lords, the discussion was primarily about finance, rather than the range of engineering skills and jobs on which I have just reported. I can assure the noble Lord that the programme that HS2, along with various engineering companies, is taking out is targeted at schools in Britain rather than those overseas. For example, HS2 sent a contingent of 30 people to the skills show in Birmingham to which youngsters came from all over the country. I am confident that a large number of these skills can be achieved in the UK, creating a base for our youngsters to participate not only in HS2 but in a wide range of engineering projects. However, we will always consider financing from overseas.
My Lords, my noble friend’s enthusiasm is almost infectious but I have not caught it yet. Can she assure the House that no report on the implications and costs of HS2 will be withheld, either in whole or in part, by the Government?
My Lords, I can confidently say, looking at the size of the body of documents that was disclosed with the hybrid Bill, that the Government have been putting out more data than most people have ever seen around a project of this size and interest. It is crucial that we are open and transparent and, although there will be times when we have internal discussions, the transparency has been quite exceptional in this case.

Lords ChamberThat is the sort of rumbustious and splendid speech that we are used to hearing from the noble Lord, Lord Rooker. I am sorry that I cannot entirely follow him or agree with all he said, but he would not expect that. I begin on a congratulatory note—first to my noble friend the Minister, who in 10 minutes presented an argument forcefully, cogently and persuasively. She brings to her task many gifts and qualities from which we will all benefit. I was also delighted to see the Secretary of State sitting on the steps of the Throne during her speech and that of the noble Lord, Lord Adonis. It is far too rare that Cabinet Ministers come and listen to debates in your Lordships’ House, and the Secretary of State set a very good example tonight. He is a man for whom I have very considerable respect and affection.
However, even for the Secretary of State I am unwilling easily and willingly to endorse a blank cheque—and that is what the Bill is. There is no limit on the expenditure that the Secretary of State can sanction in preparation for this project. The noble Lord, Lord Adonis, who also made a forceful and powerful speech, would clearly not object to that, but it is a matter for which we should have a care, even though in this House—quite rightly—we do not have the power to send back or amend money Bills. I would not wish to have that power. The unambiguous democratic mandate in this country is at the other end of the Corridor, and long may it remain so. That is why I have always been such a staunch defender of the secondary role of your Lordships’ House in these matters.
However, there are things that we have to consider. My noble friend Lord Howard of Rising made some very good points—and, after all, he is a man who has considerable business knowledge and is not alone in voicing his concerns at the prodigal expenditure on this scheme. We have heard many comments from the Institute of Directors and other business men and women who know what they are talking about and do not see this project as the panacea that many in the debate would claim.
Only this morning I had breakfast with one of the most successful British businessmen. It would be wrong to mention his name because I did not tell him that I would do so, but when I said that I was going to speak in this debate and that I would be voicing a degree of opposition to HS2, he warmly encouraged me to do so. He felt that the project was a distortion of priorities and said he did not feel that it would bring the benefits that so many in the debate have claimed. He is clearly not alone. Many in your Lordships’ House agree and we heard spirited speeches in the previous debate—in which, sadly, I was unable to take part—from the noble Baroness, Lady Mallalieu, the noble Lord, Lord Mandelson, and others who put a different point of view. After all, we are having a debate and it is important that different points of view should be put.
There is one thing that we do not consider as carefully as we might. This is a finite country. People have been talking this evening about France and Germany, which are enormous European countries on our continent, and have thrown in references to China, which is not exactly a miniscule country. Noble Lords sought to suggest that because those countries depend so much on high-speed rail, given the enormous distances that have to be covered, we should follow suit. I do not think that to have an efficient transport system in this country we need necessarily to follow the suit of other countries that are enormous in extent.
We also have to bear in mind that other priorities should be considered. When I drive from my home in Lincoln to London, I come down the A1. It is a scandal that the main arterial route to the north is not of motorway standard. I agree with the noble Lord, Lord Rooker, and I know spaghetti junction almost as well as he does; for 40 years I represented a seat in Staffordshire, and from the opening of the M6 onwards I used that road weekly—year in, year out. I agree with him that we do not want a lot more motorways, but parts of our road system are wholly inadequate for the needs of our people, and the A1 is one of those roads. A number of things could and should be done, if there is £50 billion going begging, to improve the infrastructure of our country.
We should also have regard to the size of our country when we have a concern for its environment. I have spent a long time in this place and the other seeking to speak up for heritage causes. As long ago as 1976 I wrote a book called Heritage in Danger, in which I talked about the threats to our landscape from unthinking development. I well understand why people living near the Chiltern Gap feel as they do about the M40, skilfully as it has been landscaped. Our country is precious. Our countryside, once destroyed, can never be brought back. We must have very real concern about the environmental effects of HS2, particularly in the Chilterns. I was in that area for a couple of days last week when we had our brief break. It is one of the loveliest parts of England. It is not selfish of the noble Lord, Lord Stevenson, or anyone else, to point that out.
Why is the National Trust, our largest environmental charity—four million of our fellow citizens are members—so opposed? Not because its members are nimbys or introspective, but because they are seeking to be protective. This has to be taken into account. We have to look at proportion, and we have to look at balance. If I may say so without sounding insulting, I think that some people who are going over the top for HS2—and I would gently reprimand the noble Lord, Lord Adonis, in that regard—do not pay sufficient attention to the environmental side of things. I have great respect for the noble Lord. He was one of the most successful Ministers in the previous Government, deservedly gaining a fine reputation, and I am glad to see him back in front-line politics. However, I urge him to consider a little. Perhaps I could quote the famous remark of Cromwell that you should,
“think it possible that you may be mistaken”.
We can all have that quoted at us, and he would with good cause perhaps want to quote it back at me. However, I say to him as one of those passionately concerned about the beauty of our countryside, which is not only ours but which brings enormous economic gains from the tourists who come here, that it is infinitely precious and should not be easily sacrificed.
This is a complex issue. I well understand why people feel that to upgrade our transport we have to build something brand new, but I am not convinced of the argument. We do not pay sufficient regard to those who say that HS2 will possibly suck the life-blood out of some of our other cities and make us more of a London-centric country than we are already—and we are far too London-centric as it is.
These are all points worthy of consideration, and although they are causing infinite amusement to my dear friend, the noble Lord, Lord Snape—Lord Snape of the railways—who is sitting on the Back Bench and grinning like the proverbial Cheshire Cat, nevertheless they are worthy of our regard and our consideration. I hope we can develop some of them as we debate HS2 again, as we certainly shall when the hybrid Bill comes before us.

Lords ChamberAgain, I am afraid that the noble Lord, Lord Snape, wanders away from the subject of today, but it is crucial to understand that when HS2 goes forward, it does not mean we are stopping other transport investment on crucial lines. As he will know, in the next Parliament £73 billion has been committed to transport improvements and only £17 billion of that goes on HS2. Definite improvements are scheduled for the east coast. Since that is away from the topic, I will not pursue those today—and I cannot find them under my tab. I will write to the noble Lord in detail.
Is my noble friend aware that many do not share her enthusiasm for HS2, and believe that the points made by the noble Lord, Lord Mandelson, deserve real consideration and that the environmental cost that this nation will have to pay is really disproportionate to the benefits that might be achieved? We hope very much, even at this late stage, that common sense will prevail.
My Lords, the Government—and I—regard HS2 as a vital project. As I said, the underlying rationale is capacity. We are out of capacity on critical lines going north out of London and those are essential for the economy. We must also continue to build the economy of the north of England rather than just constantly focus on the south. I believe that the project has found a good balance between the environmental challenges—of course, they are many—and value for money. This is an absolutely essential project and most of those in this House who specialise and focus on transport and rail will confirm the view I have just expressed.
