Commons ChamberMore broadly, this is a matter being taken forward by the Foreign Office, but I would be happy to meet, or indeed to arrange a meeting, with members of the Government to discuss the issues in more detail.
Can the Minister tell us what steps the Government are taking to try to reassure communities that it is safe for them to come forward and work with the police? Surely working with communities is one of the best ways to improve the security situation in the whole of Northern Ireland.
Yes, is the principal answer. It is crucial that people have the confidence to come forward to the Police Service of Northern Ireland, to ensure a safe and prosperous future for all parts of the community.

Commons ChamberI think the simple point is that an Executive consisting of a First Minister, a Deputy First Minister and other Ministers will be able to make decisions on budgets and all other issues throughout the community. The funds that have been outlined—to be spent on, for example, health, education, mental health, infrastructure and broadband—will be, profoundly, for everyone in Northern Ireland. All communities will benefit from those funds. I think that that underlines the need for the Executive, and the need to ensure that locally elected politicians are the ones who make the decisions.
We are pleased that the Secretary of State has told us that it will still be possible for the two sides in Northern Ireland to reach a deal within the next few days. He will know as well as I do that trust is imperative in the current talks. Will he explain a little more fully why he is so reluctant to try to seal that deal by asking the Prime Minister and the Taoiseach to go to Belfast and attempt to bring the parties together so that the final measures that are necessary to secure a deal can be taken?
I hear what the hon. Gentleman says. I stress that the Prime Minister has been actively involved throughout the process, and has been having meetings with all the party leaders. She had a further conversation with the Taoiseach last week about how matters were progressing, and received updates from me and from Simon Coveney, the Irish Foreign Minister, that were received by the Taoiseach as well. There is that continued active engagement, but if further interventions are required we will, of course, keep matters under review in order to establish what will bring about an effective resolution and produce the Executive whom the hon. Gentleman and I want to see in place.

Friend properly highlights the role the Executive have played to date, and I would again point to the joint letter signed by the then First and Deputy First Ministers about the priorities for Northern Ireland, which has helped to shape our response and thoughts on this issue. Yes, there are significant issues in respect of the border, and there are other issues, such as the single electricity market and agrifoods. There is a range of issues that the Executive have underlined, and those have been very much in our thoughts as we prepare for the days ahead.
How will the talks to come be different from the talks we have had so far? What fresh initiatives is the Secretary of State proposing, and will one of them be to get the Prime Minister to Belfast as soon as possible and to involve the Taoiseach as well?
I outlined the fact that the Prime Minister and the Taoiseach have been involved in this process. The two have mandated Charlie Flanagan and me to lead the work on their behalf. When we look at the issues that are relevant to the parties coming together in that devolved space, we see it is about how we support them to get a positive outcome. I have already spoken about the intensification and the inclusive nature of the talks, and that is precisely the approach I will be taking alongside the Irish Government and Charlie Flanagan, the Irish Foreign Minister, to achieve that outcome. The Government have the absolute intent to do all we can to get devolved government back on its feet again, and we will do our utmost to achieve that which can be done.

Commons ChamberIt is right that we have a system that is fair, balanced and proportionate. I have been clear about that on a number of occasions and about why I strongly believe that the Stormont House agreement and the legacy institutions contemplated within that provide a real framework and way forward to achieve that. I am concerned that there is an imbalance in the system, with a focus on state-based actors, and getting answers for those who lost loved ones as a consequence of terrorist atrocities is essential. That is why I want to see this moving forward and why we strongly believe change is required.
We all wish everyone in Northern Ireland well in trying to resolve these current difficulties. May I press the Secretary of State on what he is doing on working in partnership with the Irish Government? The British and Irish Governments are co-guarantors of the Good Friday agreement, so what plans does he have to work with the Irish Government to help to resolve these difficulties? Is he planning a summit? Is he planning talks? Is he calling everybody in? What concrete measures is he planning to take to work with the Irish Government to help to resolve these difficulties?

Commons ChamberAgain, I thank my right hon. Friend and my right hon. Friend the Member for Chipping Barnet (Mrs Villiers) for all their work over many years to provide stability and security. Hard effort has gone into achieving the gains that we see today, and we need to approach the days ahead with that focus to see what resolution can be found.
If there were to be an election, how does the Secretary of State expect a Government to be formed afterwards? Can he confirm that it is the Government’s intention that under no circumstances will emergency legislation be introduced in this House to introduce or reintroduce direct rule?
It is unhelpful to talk about either the suspension of devolution or direct rule—that is entirely premature—as the tone of the hon. Gentleman’s point and the way in which he made it suggests. If we are not able to reach a resolution in these next seven days, the next stage is for an election to be called. As I have indicated, it is likely that that election will be divisive, difficult and tough, and therefore the ability to reach a resolution at the end of it may be very challenging. That is why we need to use the time we have now to address a number of the points raised.

Commons ChamberI entirely endorse my hon. Friend’s comments on the need for good cross-border working relationships between the PSNI and Garda Siochana. I have already had a conversation with Frances Fitzgerald, the Irish Justice Minister, to underline that. We have very good relationships and I want to see them continue.
I welcome the Secretary of State to his post. Does he agree that tackling cross-border crime involves tackling paramilitarism? Has he had a chance to look at the report published by Stormont yesterday with respect to action, in particular, to consider what may be done about decommissioning residual paramilitary weapons? How is that going to happen?
At the outset, may I commend the hon. Gentleman for his work? He and I have obviously had a number of discussions on issues of crime and security over many, many years. I welcome the publication of the Northern Ireland Executive’s action plan on tackling paramilitary activity, criminality and organised crime. This represents another significant milestone in terms of the commitment set out in the “Fresh Start” agreement. It provides a positive basis on which we can now move forward, and I look forward to the more detailed action plan, which will be published shortly.

Commons ChamberWhat is often missed by people who want us to leave the European Union is the fact that, owing to our United Nations obligations under the 1951 treaty, the 1967 appendix and the 1984 and 1989 convention rights, if we did leave we would have to continue to take people who come to our shores seeking asylum and refuge. We would still not be able to decide 100%. Only North Korea can do that, and I do not fancy following North Korea.
During his discussions with the Northern Ireland parties, has the Minister said whether he thinks that it would help the police if we left the European Union, given that, before the introduction of the European arrest warrant, extradition took, on average, a year rather than the 48 days that it takes now, and given that 162 criminals have been removed from Northern Ireland since 2009 through the use of the arrest warrant?
The hon. Gentleman is absolutely correct. The ability to remove people whom we do not want so that they face trial elsewhere in Europe is a very powerful tool for our forces of law and order in Northern Ireland. We have deported 190 people to face trial, including terrorists from Spain, and we have managed to bring back 34 people to face justice in the United Kingdom. That is a tool that we need: it keeps people safe in Northern Ireland and in the United Kingdom as a whole, and to turn our backs on it would be foolish.
I agree with what the Minister has said, even if his own Secretary of State does not.
Both the Chancellor and the Northern Ireland Office have spelt out the consequences for the border of leaving the EU. Moreover, I have a copy of a letter to the Newry Chamber of Commerce & Trade in which the Home Office also spells out the potential consequences for the common travel area, given that an estimated 30,000 people cross the border every day. The letter states:
“If the UK left the EU these arrangements would be put at risk.”
Does the Minster agree, and has he told the Northern Ireland parties that?
The common travel area existed before the European Union, but the hon. Gentleman is absolutely right. It is totally unclear what arrangements would exist after a Brexit. That is why the best solution is to remain in the European Union, so that we can take advantage of both the single market and the free travel of people, skills and trade that we enjoyed before membership.

Commons ChamberI am certainly happy to have that meeting. In terms of timing, we might have to be careful about the interaction with the decision that I might need to make over the coming days and weeks, but I am sure that we can have a meeting on this matter at some stage.
Despite much progress in Northern Ireland, there remains a terrorist threat, as we saw with the shocking murder of prison officer Adrian Ismay, whose funeral the Secretary of State and I attended. I associate myself with the remarks of the Secretary of State and we send our sincere condolences to Adrian Ismay’s family and colleagues. The Secretary of State will also know that there have been explosives found, bomb-making equipment discovered and murders north and south of the border. Will the Secretary of State tell the House whether, in her opinion, these individuals are acting alone or as part of a more organised and co-ordinated terror group?
A number of groupings are active in relation to the terrorist threat in Northern Ireland. They tend not to be terribly cohesive and are subject to increasing and regular splits. They have connections both north and south of the border and, were it not for the dedication and effectiveness of the PSNI and its partners in MI5 we would see these individuals mounting attacks resulting in tragedies such as that which has befallen the family of Adrian Ismay in such despicable circumstances.
I thank the Secretary of State for that reply. She will know that in recent days in Northern Ireland there have been two terrible shootings, one with fatal consequences—that of Michael McGibbon. I associate myself with the remarks made by the right hon. Member for Belfast North (Mr Dodds) and with the words of the widow. Our hearts go out from this House to all the families and those affected. The PSNI says that the attacks have all the hallmarks of paramilitary assaults, so on the streets of this United Kingdom we have shootings and murders linked to paramilitary activity. It is both sickening and totally unacceptable. Will the Secretary of State tell us more about what happened, and what action she, the PSNI and others will take against those who have no respect for human life or the rule of law?
The hon. Gentleman chooses his words correctly; this is absolutely sickening. I feel that this case could be like a number we have seen over recent decades in Northern Ireland and be the point at which people there say that this is completely and utterly unacceptable. The police investigation is progressing, with an individual charged with murder, but it is also imperative, as the right hon. Member for Belfast North (Mr Dodds) said, that we implement the “Fresh Start” agreement proposals, including progress on the strategy that the panel is coming up with. We need to ensure that people have the confidence to come forward and give evidence against these individuals. That has been a persistent problem in gaining convictions, as people are afraid to give evidence in such cases. As a society, we need to do all we can to support and encourage people so that they are able to come forward and give evidence to bring these people to justice.

Commons ChamberThe IRC, obviously in conjunction with the duties I mentioned, will be free to report on anything of that nature. It is not only the UK Government who are keen to pursue this, but the Government of the Republic of Ireland. I think that both Governments recognise that this cannot be done in a vacuum, with Northern Ireland entirely carved out of paramilitary activity on the island of Ireland.
In respect of the duties not to prejudice national security interests and not to put at risk the life or safety of any person, the Secretary of State must issue guidance to the commission about the exercise of its functions, in so far as the commission’s functions touch on the disclosure of information that might be prejudicial to those duties.
Will the Minister say a little more about the guidance that he mentioned? Clause 2(8) says the Secretary of State must publish the guidance. When is that expected to happen? When will Parliament get a chance to look at the guidance and comment on it? I want to be a little clearer about whether it is just that the guidance will be published, or whether Parliament will get a chance to look at what the guidance is or is not.
Parliament will certainly have an opportunity to scrutinise the guidance as published. As for the timescale, that will be dictated by how quickly the nominations of the commissioners are made. However, we do not take this lightly. The guidance is very important and everyone needs to know where they stand with it, which is why I welcome the fact that it is going to be published. I will get some clarity for the hon. Gentleman on whether the guidance will be done by regulation.
The guidance referred to in clause 2(5)(a) is intended to assist the commission in the discharge of its duty under clause 2(3)(a), which is not to do anything that would prejudice national security. However, we recognise that, while many of the same principles may apply to the protection of national security interests in Ireland as in the United Kingdom, it is not appropriate for the Government to issue detailed guidance about national security matters in another jurisdiction, and it was never the Government’s intention to attempt to do so.

Commons ChamberOf course, as a member of the Government, I accept the Cabinet Office’s views. We should not forget that Ireland and the United Kingdom have a long-standing agreement, the common travel area, which would mean that certain barriers would not be in place. However, should we leave the European Union, we will be outside the customs union, and that will inevitably lead to some form of extra barriers to trade.
I do not know how the Minister keeps a straight face in some of his answers. It is no wonder that the Secretary of State is again avoiding answering these questions on the economy. Has the Minister discussed with Executive Ministers the survey by the Northern Ireland chamber of commerce, which showed that 81% of businesses in Northern Ireland support continued EU membership? Is it the case that there is little surprise in that finding, given that 60% of Northern Ireland’s exports—a higher percentage than in any other part of the UK—go to the EU?
My right hon. Friend the Secretary of State and I discussed that with the Northern Ireland chamber of commerce at a reception on Monday night in Northern Ireland. If the hon. Gentleman wants to know how I keep a straight face, let me tell him that I look across the Dispatch Box at two Labour Members who are in favour of replacing Trident, and I remember that their leader has no intention whatsoever of using it or replacing it. [Interruption.]
I do not think that that is germane to the matter of exports from Northern Ireland.
We are all amazed by the Minister’s response. That really was going to the bottom of the barrel to try to find something to say.
Building on the question asked by my hon. Friend the Member for South Down (Ms Ritchie), has the Minister discussed with Ministers in the Executive the fact that more than a third of exports to the EU—well over £1 billion a year—go to the Republic? She referred to a report. The Government report was published today, and her remarks are supported by the Newry chamber of commerce. There are very real concerns about customs checks having to be put in place at the border, because that would be a border between the UK and the EU. I discussed that last night in Belfast with Nigel Farage. We had a big debate about it. Let me say to the Minister that it deserves a better answer than, “It’ll be all right on the night.”
I think I would rather have seen Adele last night, who is playing in Belfast, than Nigel Farage.
The United Kingdom Government believe that we are better off, stronger and safer if we stay in the EU. Of course we do not want barriers to further trade. We recognise the importance of trade across the border to the Republic of Ireland. I can say that my right hon. Friend the Secretary of State and I are absolutely united in making sure that Northern Ireland business prospers and does the best it can, because this Government’s long-term economic plan will ensure that exports and domestic trade flourish.
