To ask Her Majesty’s Government, in the light of the Statement by Lord Bourne of Aberystwyth on 7 February on the Housing White Paper, what steps they are taking to ensure that councils continue to provide suitable plots for allotments.

My Lords, the Government recognise that allotments are valuable assets that play an important role in bringing communities together to live healthier lifestyles. Before disposing of allotments, councils must satisfy a range of statutory criteria set by the Government. Moreover, there is a range of measures through which communities can help to safeguard their allotments, including the National Planning Policy Framework, neighbourhood planning and the community right to bid, as well as always, it is hoped, keeping allotments free of Japanese knotweed.

My Lords, does not the Small Holdings and Allotments Act 1908 still apply to councils? If more than six people ask for an allotment, are they not to be given one?

My Lords, my noble friend is right about the importance of the 1908 Act and subsequently the 1925 Act, and the Government subsequently tightened the statutory duties on local authorities in the 2014 guidance which ensures that existing plot holders are protected if a local authority wishes to dispose of the allotments. That protection is in place.

My Lords, if I may try to address the joint question asked by the noble Lords, Lord Pearson and Lord Foulkes, it is certainly the case that across broad sections of public life, certainly including the NHS, we are heavily dependent on people from the immigrant communities. There is no doubt about that. Net migration will probably fall as a result of Brexit, but it will be some time before that happens. Still, we face all sorts of challenges in seeking to address that.

My Lords, no Question Time is complete without a question on allotments. I know my noble friend feels very strongly about this. Unfortunately, I am blindsided on the particular impact of this issue on allotments, but I will ensure that she has a detailed response and I shall copy it to the Library.

My Lords, first, the White Paper will be a far-reaching one and will look at many issues. Self-build, for example, will be there, as will purpose-built—what we could call prefabs for the 21st century. This is, as I said, the most ambitious programme for affordable housing for 40 years. It is clear that we need to look at a range of tenures, as the noble Lord indicates, but of course social housing being subject to a greater subsidy means that if all the money is targeted at social housing, we would be building fewer affordable houses across the piece. There needs to be a balance. As I have indicated, it is for local authorities and housing associations to bid in for that money.

My Lords, I know that that is a subject dear to the noble Baroness’s heart. We are concerned about allotments in the department—as she will know, we are ensuring that they are not part of the brownfield sites agenda, so they are safe from that. I am sure that local authorities will have heard what she has had to say and will heed it.

My Lords, as I indicated, the Government are committed to home ownership. We are making sure that money is provided to encourage that. Also, we are certainly committed to homes to rent, and have committed money to rent-to-buy schemes as well. We committed £661 million to a build-to-rent fund which should, over the life of the Parliament, guarantee about 6,000 houses in addition.

With a proposal for so many new buildings, what provision will be made for allotments?

My Lords, I know that my noble friend is a great supporter of allotments. As I have indicated before, allotments are protected in relation to brownfield sites. We have committed that 90% of brownfield sites will have planning permission by 2020, but I am sure that she will be very pleased that allotments are protected in relation to that policy.

My Lords, first, I endorse the good work done by Pendle Council in east Lancashire on brownfield sites. On the comment the noble Lord raised, which was essentially about grant funding rather than loan funding, Pendle has applied under the starter home fund with regard to brownfield land, and I also encourage a look at the Lancashire local enterprise fund with regard to competitive growth deals, which would benefit the area.

Can my noble friend say what pressure will be brought to bear on councils when these brownfield sites are developed to provide a space for allotments?

A consultation is going on at the moment about the technical aspects of rolling out brownfield sites. There will be a requirement for appropriate brownfield sites to be put on a register during 2017, but appropriate notice will be taken where there is some other use for a brownfield site, such as an allotment.
