My Lords, I congratulate my noble friend on securing this important debate today. He made an excellent speech, as did my noble friend Lord Blencathra. I declare an interest as a former farmer, a former president of the Staffordshire and Birmingham Agricultural Society and a current member of the National Farmers’ Union and the GWCT.

Brexit presents a once-in-a-generation opportunity to put in place policies that work for farmers, the environment and consumers, and to address animal welfare issues. Thus states the NFU, and I am in complete agreement. Agriculture and its associated businesses form the UK’s largest manufacturing sector. A friend of mine whom I met with today—a very serious lawyer, Sir Nigel Knowles—confirmed to me that the industry generates over £112 billion for the UK economy and provides employment for more than 3.9 million people. Horticulture, including vegetable and salad production, is reliant on considerable numbers of foreign workers, and therefore the industry has a major interest in any future policies post Brexit regarding immigration. Without the availability of these workers, that sector will encounter very serious problems.

Many farmers with whom I discuss current farming affairs voted to leave, but nevertheless are very concerned about life without subsidies as currently paid to them. In recent years we have seen wealthy individuals and corporations investing heavily in agricultural land, very often in the UK’s prime growing regions. Completely unrealistic prices have been achieved: as much as up to £20,000 per acre, I believe, in Lincolnshire, with an average today, I think, of about £10,000 per acre. Please feel free to label me a complete cynic—many on my side do, I think—but, even with the single farm payment, such a land cost cannot possibly enable the landowner to make a return. In my view, it is part of wider tax planning issues. They are attracted by that but it has very little to do with genuine investment in farming. I believe that, post Brexit, such landowners should receive no subsidies. After all, their operations are geared to be superefficient, with the latest in modern machinery and various technologies outside the reach of small and medium-sized farmers.

When I was a student on a farm in the early 1970s, my boss, an exceptional but often grumpy Shropshire farmer called Rowland Ward, who was a pioneer in many agricultural areas, told me that one could not make a decent living farming under 200 acres. Today I believe that figure is more like 2,000 acres. Today many counties have sold off their agricultural small- holdings, small-holdings that provided an entry into agriculture for countless young people in the past. The young would-be farmer finds it nigh on impossible to get a foot on the farming ladder these days, yet they are the basic future and seed-corn for farming. Maybe they could be beneficiaries of a suitable new scheme to encourage them into farming on their own.

I firmly believe that there must be government support for agriculture in rural areas but geared towards assisting the small to medium-sized farmer and grower who is the backbone of UK agriculture. Coupled with this must be schemes to encourage farmers and landowners to improve their environment, protecting soil and water resources for future generations along the lines of the Campaign for the Farmed Environment. We need to produce more homegrown food, and to achieve that we must have sustainable and improving natural resources. We must establish an improved habitat, and on that note I wonder whether now is a great opportunity to amend the Wildlife and Countryside Act to rebalance man’s management of modern-day nature in what is a very changing environment, and indeed much has changed from the time when the current Act was passed.

We need to encourage growth in the numbers of songbirds and other species through a range of measures, not least by controlling predators to sustainable numbers. Buzzards are everywhere; I counted nine in the area over the wood behind my house last Sunday. They do not just pick up carrion; magpies play havoc with the local songbird population while goosanders, mergansers and cormorant numbers have exploded over recent years with dire consequences for the stocks of their prey species, namely salmonids and other fish. From these comments, noble Lords will no doubt realise that I am unlikely to be on Chris Packham’s Christmas card list.

I believe the Environment Agency should be broken up, with waste issues being transferred to local authorities, and the National Rivers Authority should be re-established to oversee and police the country’s water resources and deal with issues relating to flooding. This worked very well in the past.

A special case should be made for the less-favoured and challenging farming areas and their communities. These are some of the most beautiful and iconic parts of our nation and support a wide range of flora and fauna. Income in these areas is derived from farming certain breeds of livestock with special qualities and producing specialist wools, meats and cheeses. Tourism is a major driver of those far-off local economies, an integral part of which are the shooting and fishing sports that attract substantial sums of foreign and home-based money, supporting local people with employment, hotels, B&Bs, filling stations and shops, to name but a few. I recommend noble Lords to take a trip to towns like Leyburn and Hawes and see what they have done.

Recently the BBC’s “Countryfile” programme featured a small community in a less-favoured hill area in the north of England where, threatened with the demise of its rural bus service and closure of its post office and shop, pub and filling station, and therefore faced with the possible exodus of local inhabitants, the community resolved to get together and run the lot. The bus service and filling station help to subsidise the loss-making parts of the enterprise. Surely this is the way forward in such communities, so why do the Government not consider setting up a scheme to soft-fund such initiatives with seed capital? Such a scheme could perhaps be part-funded by a levy on wind turbines.

This country is a world leader in animal welfare. We produce and sell, at home and abroad, our finest beef, lamb, pork and other meats, which we produce to the highest standards. So why on earth will the Government not ban non pre-stunned ritual slaughter? The veterinary profession judges it to be cruel, many of the public are appalled by it and I personally find it completely abhorrent. I would never send an animal of mine to such an end. Both the NFU and the Government seem keen to ignore the issue, possibly because we export to countries that require meat that is ritually slaughtered. However, this is a serious animal welfare problem that simply must be addressed. What discussions on this issue have my noble friend and his department had with the various religious groups that require ritual slaughter, and what was the outcome of those discussions?

In conclusion, we in this country have the most superb opportunity to improve and support agriculture, the natural environment, our rural communities and animal welfare post Brexit. We must grab it with both hands.

My Lords, I congratulate my noble friend Lord Lindsay on securing his debate today. I declare an interest as a former farmer and a current member of the National Farmers’ Union and the Countryside Alliance.

This debate provides the opportunity to say farewell, on his retirement from the House, to one of this country’s great names from the agricultural community. Over the vast majority of his life my noble friend Lord Plumb, of Coleshill, has devoted himself to standing up for and promoting British agriculture in all its forms. Over my lifetime there have been a number of great presidents of the National Farmers’ Union, and my noble friend is at the top of that list. He is a true farmer and a stockman with a deep love of the countryside and his animals. He and I have regular conversations about his top-quality herd of British longhorns, of which he is rightly very proud. These conversations usually begin with him saying, “Charlie, have I told you about the time that”—and I listen, totally enthralled. It can take an awful lot of time.

A few years ago I asked my noble friend, as we are both past presidents of the Staffordshire & Birmingham Agricultural Society, whether he had received an invitation to the president’s lunch on county show day. He had not, so it was duly arranged and we agreed to meet beforehand. I met him at the entrance gates to the showground and we started on a tortuous walk to the main pavilion. Every few yards, we were stopped by local farmer after farmer who wanted to chat with his Lordship. I got the impression that my noble friend thoroughly enjoyed that experience. He is held in such high esteem in that part of the world and through the rest of the country. I wish my noble friend and Lady Plumb a long and extremely well-deserved retirement.

I want to take this opportunity to make three points. I seldom agree with the noble Lord, Lord Greaves, but in the debate “Brexit: Farm Animal Welfare” on 17 October last, he said:

“I just want to say something about food security and the very learned comments made by the Transport Secretary … that all we have to do is grow more food in this country”.


To my mind, my right honourable friend the Transport Secretary has not noticed that it has been a pretty awful year so far. It rained for most of the summer and it is turning out to be one of the most difficult harvests on record, with thousands of hectares yet to be harvested and much already ruined. That is the unpredictability of the farming industry. Another problem is that under EU rules, a lot of waste happens among all the crops that we grow in our farming. Cucumbers, tomatoes and so on—even carrots—are, as the noble Lord said,

“rejected by the supermarkets because it is not the right shape and colour; it is left unsold in supermarkets and thrown away”.—[Official Report, 17/10/17; cols. 567-68.]

What a waste. I agree with many of those comments made by the noble Lord, Lord Greaves. Perhaps Brexit will give us the opportunity to undo some of the completely barmy ideas and rulings which have emanated from the EU with regard to the shapes of fruit and veg, and its objection to the use of glyphosate, for pity’s sake, among numerous other matters. Glyphosate is one of the major tools in the cabinet for the farmer.

My second point is that in its vision for a future domestic agricultural policy in March 2017, the NFU proposed a framework of three specific cornerstones, one of which is,

“to enhance positive environmental outcomes from farming”.

I am in complete agreement. Whatever shape Her Majesty’s Government’s new agriculture policy takes following Brexit—and I sincerely hope and trust that support for the industry will continue—it is vital that assistance and encouragement is given to those who derive their livings from farming in the upland and less-favoured areas. These regions are the backbone of the livestock industry and without agriculture and tourism, in which I include the shooting and fishing sports, such communities will surely wither away. We must support and promote these very special areas.

Galloping on—I am going as fast as I can—my final point concerns ritual slaughter. I have no difficulty with ritual slaughter if the animal has been pre-stunned, but I have a very strong objection to it if there is no stunning. I cannot for the life of me understand why there can possibly be any objection to pre-stunning. It is inhumane not to do so. Every vet with whom I have ever spoken supports pre-stunning and objects to not doing so. The NFU would seem to support no action, as we as a country are exporters of sheepmeat products to those throughout Europe and further afield who require ritual slaughter through their religious views. But this is a serious animal welfare problem and, in my view, completely unacceptable. If my local abattoir in Staffordshire can conduct ritual slaughter for the halal trade by pre-stunning every animal, surely the whole industry could follow that example. It is very much with this in view that I support the Government’s initiative to place CCTV in abattoirs—well done them. Now with Brexit approaching fast and a new policy for agriculture on the stocks, let us get something done about non-stunned ritual slaughter. This country leads the world in animal welfare. Let us prove it and show what we can do by grasping the nettle. That is five minutes.

My Lords, I congratulate my noble friend on securing his debate on this important subject today. I am not surprised that it has attracted a big field. I declare an interest as a lifelong enthusiast of all matters equine. Indeed, even though it does not look like it these days, I rode for 20 years as an amateur jockey. Also, my wife is a long-established breeder and showman of Welsh mountain section A ponies.

The adequate treatment and welfare of equines should be paramount in our society. I intend to be brief and touch on three matters. First, on the rehoming and retraining of racehorses, some 4,000 horses leave the racing industry annually for a variety of reasons. Injury, age, attitude and inability are just a few. Some go for breeding. Sadly, only a proportion are capable of being rehomed, with many going to excellent homes where they are retrained as competition horses and even as hacks and pets. A variety of charities and other establishments in this country specialise in providing new homes and opportunities for these animals. Those bodies do excellent work.

Secondly, in some parts of the wider equine world, standards of equine husbandry are sadly lacking. Far too many animals of poor pedigree are being bred, and in considerable numbers. Often, male equines are left as entire when their conformation, pedigree and temperament are highly suspect, as is their genetic make-up. Their contribution to the equine gene pool is substandard. Many of these randomly bred animals are kept by fly-grazing and in poor conditions. Visit the pony sales and witness the unwanted foals being sold for a pittance for slaughter. Can my noble friend say what steps Defra is taking to combat that situation and to encourage owners to breed responsibly and selectively, and is he able to comment on the policies to this end of the various breed societies?

Thirdly, I am concerned that the RSPCA does not always live up to its perceived high standards when it comes to equine welfare. Perhaps it should concentrate less on politics and more on animal welfare. A number of years ago my wife loaned out our daughter’s riding mare while she was abroad. The mare was to be stabled at a local DIY livery. We heard some while later that the animal was in appalling condition, as the girl who had borrowed the animal had moved away and left the mare behind. We went to see the mare, which had become a hat rack, covered in serious haematomas. We immediately rescued it and our vet’s bills were in excess of £1,000. Our vet was shocked at the condition of the animal. He thought that it was a disgrace. We informed the RSPCA, which sent an inspector who, when he saw the mare, informed us that he had seen far worse cases and was not prepared to take the matter further. That is disgraceful.

Finally, when it comes to the end of life for our equine friends, they should be treated with compassion, dignity and the respect that they richly deserve. My wife has a strict policy of her animals being put to sleep at home, quietly and kindly in their familiar surroundings. We used to send them to a horse abattoir, but the last time we took some stock to that place, the conditions were appalling, the staff could not speak English, there were rotting pony pelts on pallets in the yards and the place was filthy. Never again will we do that. What is Defra’s position with regard to welfare standards at equine abattoirs, and what prosecutions over the last five years has Defra instigated against such substandard operations? Will it take steps to ensure that random, unannounced visits are made by local authority inspectors and vets and ensure that CCTV systems are mandatorily required to monitor abattoir staff and working practices?

My Lords, I declare my farming interests as set out in the register. I acknowledge that in the first year of the new and complex CAP scheme there have been enormous challenges. I recognise that many farmers have waited longer than I would have wished for their payments. As of 17 July, 86,788 farmers—that is 99.6%—have received around £1.35 billion of payments. The Rural Payments Agency continues to focus on making top-up payments to those who have already received bridging payments.

My Lords, I am grateful to my noble friend for that reply. I congratulate him on his new promotion. Is he aware that many farmers are facing severe cash-flow difficulties because of these payment delays, and indeed that some have gone out of business? Many have had to sell livestock prematurely in order to settle their own financial commitments, and many have had to dig into their savings. How does this unhappy situation concur with Her Majesty’s Government’s policy of ensuring prompt payments to SMEs, and is the Minister sure that the RPA administrative machine is adequately resourced?

My Lords, I thank my noble friend for his very generous comments; I am indeed hock-deep in Defra briefings. I am well aware of the situation for many farmers, as my noble friend has described, and many lessons clearly have to be learned from this first year. Indeed, we are looking to have 90% of farmers being paid their 2016 BPS claims in December. I shall be visiting the RPA as soon as I can, and I very much hope that we get into a better situation for the coming year.

My Lords, I declare an interest as a member of the Countryside Alliance and the National Farmers’ Union. I also must declare that my wife is a breeder of some reputation—good, I hasten to add—of Welsh mountain show ponies. I congratulate the noble Baroness, Lady Mallalieu, on promoting this necessary and worthwhile Bill. Anything that serves to improve the welfare of horses in particular and equines in general is to be applauded. I give the Bill my strongest support.

All my life I have been an enthusiastic horseman, although early in my career it might not have appeared to be quite as simple as that. Having left school at the age of 16 to learn about horses and national hunt racing, I aspired to be the then Tony McCoy of the late 1960s. Such was my enthusiasm and even my courage I was undeterred by the results of my first season’s riding as an amateur over fences. I believe that record remains unbeaten to this day: it was 36 rides, 34 falls, one pulled up and one refused. When I rode for myself, which was more often than not—owners appeared not to recognise my certain skills as a future master of the jockey’s art—I wore the historic Shrewsbury silks of scarlet with gold hoops and a scarlet cap. They were, of course, excellent colours to attract attention just when one did not need it.

I found that out one Easter Saturday afternoon at Whittington in Lunesdale—“Oop north” as we Midlanders say. I had a particularly bone-crushing tumble on a very good horse of mine, Coke’s Cousin, having been brought down by a decent nag called Clear and Clean. Not a lot was clear and clean from where I was rolling around in pain and anger on the Lancashire turf, but a fellow competitor passed over me and shouted, “Oh lordy, you look just like an angry little wasp”. I got my own back a couple of races later when a complete novice having his first ride and having failed to walk the course, which I knew, asked me where to go as we came up to a split in the track on the far side by the River Lune. I shouted, “Go right”, and he did. I finished second and he was disqualified for taking the wrong course but I spent the remainder of that afternoon avoiding his father, who was becoming an increasingly darker shade of purple with rage. Needless to say, never again did I dare to make an appearance at Whittington races, being a marked man with loud colours and a slightly suspect fan club.

This Bill addresses the serious issue of fly-grazing, and other speakers will address that aspect. I wish to draw your Lordships’ attention to other matters which are equally as pressing in animal welfare terms. There is a slogan that a dog is for life and not just for Christmas. Exactly the same can be said for horses and ponies. As so often is the case, horses and ponies are bought as presents, with considerable enthusiasm and all good intent, without the people involved realising just how much of a commitment, in terms of time, welfare and finance, they are entering into. Fodder, veterinary bills, farriers’ bills, saddlery, transport, accommodation, adequate grazing and fencing, pasture management—the list is never ending and extremely expensive.

There still exists the major problem of the indiscriminate breeding of animals which are already far too plentiful, resulting in unwanted, poor-quality young stock whose only end is either being dumped or a one-way journey to the butcher’s slab. It is not unheard of for two foals to be sold as a job lot in one sale for a five pound note. What sort of life is this for one of man’s most trusted friends and servants?

What results have Her Majesty’s Government achieved with their programmes of equine passports and microchipping? Do these programmes apply to the whole of the UK? In addition, will Her Majesty’s Government consider regulating the indiscriminate breeding of inferior equine stock?

Finally, I wish this Bill the great success it so rightly deserves.

I certainly agree with the first half of what the noble Lord has said. I am not suggesting that the work on labelling is by any means the only tool. That is why, as I have said, we are looking at the use of futures markets, because there is evidence of a seasonal cyclicality of milk prices. At certain times of the year a crunch tends to be worse, and such crunches can be foreseen, so we want to smooth that curve. But crucial is our work on exports, and noble Lords will be interested to know that exports to non-EU markets of dairy products are up by 47% year on year.

My Lords, is it not the case that one of the ways forward could be the model used by Tesco which has a margin-plus deal with farmers where at least farmers have an idea of what the future looks like and they get a decent price for their milk?

Yes, my Lords. Certainly, innovative deals such as that are of real value to farmers. Sadly, not all farmers are able to negotiate those deals, but we are working with them, as I have said, on various ways to resolve the problem.

That this House takes note of the case for investment in the rural economy.

My Lords, the rural economy by its very nature is substantial and widely diverse: from agriculture, horticulture and arboriculture through mineral extraction, rural crafts, tourism, hospitality and field sports—the list goes on. Our countryside is a powerhouse of business and productivity, with agriculture as its backbone. Indeed agriculture, food production and processing is the largest manufacturing sector in the United Kingdom. I declare an interest as a member of both the NFU and the Countryside Alliance, and I live on the edge of the Peak District National Park.

Tourism also plays a major part in the rural economy. Inextricably linked to agriculture, the rural tourism industry all but died during the last foot and mouth epidemic and the bluetongue crisis. Thankfully, that dire situation is well on the way to full recovery, and Great Britain’s rural areas are indeed open for business. The UK’s national parks are a major draw for tourism with many additional benefits to local businesses of all types: hotels, pubs and restaurants, B&B establishments, holiday lets and activity centres, to name but a few. These parks are some of our most iconic landscapes, archaeological and historical sites, as well as our most valuable wildlife habitats. These beautiful regions contain strong communities who care passionately about their surroundings. These areas are living landscapes in the true sense and are visited by millions of people every year.

However, all is not always well in these rural areas. Many small communities have lost their social focal points. Pubs are closing at the nationwide rate of 18 per week, many of them in rural areas. Village shops have closed in large numbers although some communities, such as the village where my noble friend Lord Geddes lives, have invested in their own community shops, which is to be applauded. Many small post offices have closed, thus denying those communities financial services. For the rural community to grow, access to services is absolutely essential. Seven out of 10 villages in England no longer have a shop and rural Britain has lost over a quarter of its bank branches since 1995. The announcement in January this year by the Post Office about making available a current account in more than 100 branches, rising to 2,000, is most welcome but it is unclear how many of these branches will be in rural areas. I commend to your Lordships the post office at Rosehall, Glen Cassley, in Sutherland. It is a real outpost. That post office and village shop was saved from total closure by the local landowner for the community. He also happened to own Harrods, so he had a bob or two to spend.

Rural crime such as metal theft, fuel theft, livestock theft and fly-grazing presents major problems, as do fly-tipping, poaching and burglary, in areas which are often remote. In 2012, rural theft cost an estimated £42.3 million. Farm Watch and rural watch schemes— similar to neighbourhood watch—can be very effective in enabling the rapid exchange of intelligence about offences and suspicious activities but do not exist in all rural areas and are not always operated as effectively as they could be. The fact is that increasing pressures on police budgets have meant that rural areas have insufficient coverage, leaving country folk often feeling isolated and fearful of crime. All these matters need to be addressed with greater vigour and along the lines of the National Farmers’ Union’s action plan.

Turning to planning matters, planning policy in rural areas does affect food production, and the availability of an affordable housing supply is crucial to the well-being of the agricultural sector, as well as all rural communities. Figures released by the National Housing Federation on 30 June 2014 to mark the start of national housing week show that rural areas have become some of the least affordable areas to live in the country. On average, house prices in rural areas are 11 times the average salary. Wages would need to rise by 150% for potential homebuyers in these areas to buy a home. The problem continues to worsen, and it is imperative that the issue of affordable rural housing be addressed as a priority. Community-led affordable housing initiatives for smaller rural communities are needed, with properties both for sale and for the rental sector. Indeed, in Ballater in Aberdeenshire, people find it extremely difficult to get on to the housing ladder because retirees from below the border think it is a wonderful place to retire and the price of properties has gone up out of the reach of locals. It is very sad when you see that happening.

The Government’s recent proposals to make it easier for empty and redundant buildings to be converted into productive use are to be welcomed, but there is a caveat here. Such conversions are considerably more expensive than new-build and fraught with structural and planning difficulties. I know; I have been there. There is a very strong case for VAT to be cut on the labour element of domestic repair, maintenance and improvement of these buildings. It would not only generate growth and jobs but would protect the countryside against unnecessary new developments while bringing empty properties back into use and cutting carbon emissions. Will my noble friend make every effort to persuade his colleagues in the Treasury to look again carefully at the VAT position?

It is impossible for me to speak in a debate which addresses the rural economy without mentioning the importance of field sports to the well-being of that economy and their substantial contribution to the environment. I declare an interest as president of the Gun Trade Association and as a lifelong devotee of country sports. With regard to the rural economy, field sports and, in particular, quarry shooting, very often provide almost the only employment in less favoured, upland parts of the United Kingdom. Currently, 480,000 people shoot live quarry, and the annual spend from shooting sports is around £2 billion. Considerable sums are spent each year by foreign visitors on high quality, high cost game shooting on many of the country’s top sporting estates, with the obvious benefits those customers bring to the rural economy. The shooting sports, which provide the equivalent of 70,000 full-time jobs, are involved in the management of two-thirds of the rural land area. Two million hectares are actively managed for conservation as a result of shooting, with £250 million per annum being spent on conservation. These are significant figures.

Finally, I shall address the issue of broadband and its vital importance to the rural economy. Without the adequate supply of superfast broadband facilities, the rural economy is stifled. More and more institutions, such as Defra, HMRC and many more, are requiring customers to send in returns and other information in electronic form. If one does not have broadband—many people do not—one is expected to use an agent at significant extra cost for rural businesses. They simply cannot afford it. While I praise the Government’s effort and commitment to improving rural broadband coverage, and I welcome strongly the funds they have put aside for councils, four years since the announcement of BDUK, people who live in areas with little or unreliable broadband and mobile phone signals have yet to see the situation improving. A vastly improved broadband and mobile telephone rollout to all rural areas is key to the future growth and well-being of the rural economy. Will my noble friend confirm the current position of the rollout of broadband and 4G to the rural areas most affected? What is his estimate of when this essential service will be available at a competitive rate?

I have managed only to scratch the surface of the rural economy, and I have endeavoured to paint a broad picture. I welcome the opportunity to discuss these issues as they are all very serious. I shall listen with great interest to the debate, and I look forward to my noble friend’s responses. I beg to move.

My Lords, this has been a fascinating debate; we really ought to do this more often. The countryside is a very special place. The debate has covered a wide variety of issues, not least broadband. Although I appreciate that Her Majesty’s Government are doing as much as they can to widen the scope of broadband in rural areas, it is not just the fact that a lot of the country has not been covered by it, it is the fact that it is so blooming slow. That is a real bugbear throughout the rural community, where people really rely on it, and increasingly need to.

I am extremely grateful to all noble Lords who have taken part in the debate, and I thank the Minister for his courtesy, as always, in his responses. I finish by saying that the countryside is indeed a magical and most special place, but it is also a place of serious work and investment, not simply a green and pleasant land.

My Lords, we are spending £2.4 billion in this four-year period on national flood risk management and much of the 1.3 million hectares of agricultural land at flood risk benefits from this investment. Over the past two years, our capital investment has provided improved protection to more than 150,000 hectares of farmland and many agricultural areas also benefit from the Environment Agency’s flood defence maintenance work.

My Lords, while I welcome the creation of the farm recovery fund to support bringing flooded land back into production, is my noble friend aware that the impact of the flooding means that the majority of crops in the current production season will be totally non-productive? This causes considerable hardship in many agricultural communities. I ask my noble friend what plans the Government have to alleviate this hardship.

Before I answer my noble friend’s question, I remind the House that I have a farm and that I am not unfamiliar with being flooded. The £10 million farming recovery fund will help farm businesses bring flooded agricultural land back into production as quickly as possible. In addition, £10 million is available under the farming and forestry improvement scheme—part of the rural development programme—which will provide support for farm business resilience. One hundred per cent rate relief is available to flooded businesses for three months. There are also, more generally, grants of up to £5,000 for households and businesses in affected areas to improve resilience of premises to future flooding.

My Lords, I, too, congratulate my noble friend Lord Marlesford on securing this important debate this morning. Depositing litter is a wanton act of vandalism which ruins our towns and cities and especially our rural areas. Litter is not only unsightly but can be extremely dangerous to wildlife. It is, of course, a very serious form of pollution to water courses and rivers.

To rid ourselves of this plague—and it is a plague of very considerable proportions—we need not only to educate people but to use a pretty heavy-handed approach to control this disgusting practice. I agree entirely with the comments of my noble friend Lord Cormack about teaching discipline. A few years ago, I was walking with my son in the high street in Uttoxeter in the middle of the week. In front of us were some schoolchildren aged about 13 or 14. One of the girls dropped a sweet paper on the floor, so I picked it up and gave it back to her, saying, “I believe this is your property”. Her boyfriend then went for me. He told me that I could do something with my body which I thought was physically impossible. He was 14 years old. I thought that I knew more about these things than he did but that was obviously not correct. In that instance, is it not parents and schools who should instil discipline in these youngsters and teach them that dropping litter is abhorrent, anti-social and very unpleasant for Earls who pick it up?

By way of example, I live in the foothills of the Peak District National Park, a place of breathtaking beauty. The nearest McDonald’s outlet is 12 miles away in Uttoxeter, yet every single day of the year, litter mainly consisting of fast-food packaging is dumped from vehicles in Birdsgrove Lane outside my house. It leads down to Okeover Park, which is a stunningly beautiful place. The litter finds its way down into the River Dove, which is some of the finest dry fly trout water in the country. It is our equivalent of the River Test; it is stunning. We get cans, bottles and a range of other items. If one sees a car from which somebody is dumping litter, it is exceptionally unwise to approach it as the tirade of abuse one is likely to receive is considerable. If there is more than one person in the vehicle—it does not matter what age they are—it is highly probable that one will be subjected to threatening behaviour.

I also live close to Alton Towers. I declare an interest in that my father’s trustees sold it in 1924 and it became the mega-playground of youth that it is today. Of all the thousands of cars using our local lanes to go to and from Alton Towers, 95% of them behave properly as regards disposing of litter. I think that is probably because Alton Towers has lots of facilities for people to get rid of it.

As regards bottles and cans, we should carefully consider the approach used by numerous states in the United States—namely, Oregon and 10 others. The Wikipedia entry on the Oregon legislation currently states:

“The Oregon Bottle Bill is a container-deposit legislation passed in the U.S. state of Oregon in 1971 and amended in 2007. It requires cans, bottles, and other containers of carbonated soft drink, beer, and (since 2009) water sold in Oregon to be returnable with a minimum refund value. It is administered and enforced by the Oregon Liquor Control Commission.

The law is credited with reducing litter and increasing container recycling. As a result, items which used to make up around 40% of roadside litter now represent about 6%. With return rates averaging 90%, another major benefit is in waste reduction and resource conservation, particularly for aluminum. By comparison, states without similar bills recycle on average 28% of their containers. Beverage distributors retain all deposits not reclaimed by consumers”.

Surely, that makes sense, and perhaps that sort of idea could be translocated to fast-food outlets such as Kentucky Fried Chicken, McDonald’s and all the other disgusting foods that there are in this life.

When it comes to littering from vehicles, I do not think that my noble friend goes far enough with his ideas for a fine. The fine should really hurt, because that is what really gets to people—when it hits their pockets. For instance, as he suggested, one should be able to go for the registered owner of the vehicle, whether they were the culprit or not, and fine them. Should they fail to pay the fine, their vehicle should be impounded until such time as the fine is satisfied—that would stop them. It is time we put an end to this vandalism. I commend my noble friend’s Bill to the House.

To ask Her Majesty’s Government what is their assessment of the impact Council Directive 1999/74/EC will have on the competitiveness of the United Kingdom egg industry from 1 January 2012.

My Lords, I am most grateful to the House for providing me with the opportunity to raise this matter, which is of very considerable importance to the future well-being of the British egg industry. I declare an interest, as my younger son is a producer of free-range eggs in Lincolnshire and contracted to Britain's largest producer of eggs, Noble Foods. As my noble friend the Minister will be fully aware, the welfare of laying hens directive, which is the subject of this Question, comes into full force on 1 January 2012. The directive prohibits the use of conventional battery cages and the marketing of eggs from hens housed in such cages. The new cages, known as enriched colony cages, will provide a more animal welfare-acceptable environment. Yet again, Great Britain is leading the field in agricultural animal welfare but such action comes at considerable cost to this sector of agriculture.

The British Egg Industry Council estimates that the industry has, to date, invested some £400 million in the new cage systems and that this country will be fully compliant by 1 January. This has been a truly massive change to the industry. Those producers who have not been in a position to upgrade their systems to the enriched colony systems have gone out of business. Others who have been in a position to make the change have invested heavily in the new systems; such investment has to be serviced and the capital repaid. However, while Britain will be fully compliant there is a very real concern within the industry that producers in some other EU member states will not be—indeed, some might never be.

In recent research conducted on behalf of the British Egg Industry Council, it was found that UK retailers, caterers, manufacturers, processors and producers have for some time been working together to secure the supply of eggs and implement traceability systems to ensure full compliance with legislation. As a result, it is anticipated that the vast majority of shell eggs and all Lion Mark eggs produced in the UK will comply, and that all major retailers will sell own brand shell eggs with the Lion mark. However, further evidence suggests that the main difficulty will be in ensuring that imported shell or processed egg used in manufacturing or catering products will be compliant. This will be particularly so where eggs or egg products are imported directly from those member states where doubts have been raised about the producer's ability to implement the legislation, but also from member states which have taken in eggs to process from non-compliant producers in other member states.

The matter is further complicated by the fact that in member states where there will be non-compliance there are farms with both conventional cages and enriched colony cage systems, often on the same site, thus making policing and traceability extremely difficult. The fact is that we in the UK are not self-sufficient in our supply of eggs. I believe that we produce 85 per cent of the eggs that we need. Egg products are also included in this, and therefore we need to import.

When this directive was first discussed, the egg industry thought that it was not good news but following comments made recently by Commissioner Dalli, the industry is far more worried for the future. The industry is not afraid of competition from legal imported eggs but is extremely concerned that if the directive is not uniformly implemented across the EU from 1 January 2012—and it is as clear as crystal that it will not be—it will be at a serious and unfair disadvantage because of the risk of non-compliant eggs and egg products with considerably lower associated costs being imported. All the industry wants is to be treated fairly and to be able to compete on a level playing field. Can my noble friend the Minister say whether, following 1 January 2012, first, anyone in the UK using eggs or egg products from illegal cage systems will be breaking the law and, secondly, what action Her Majesty’s Government envisage taking to ensure that only eggs and egg products from compliant cage systems will be imported into the UK following that date?

The British egg industry is highly successful and very efficient. It has improved in leaps and bounds since the introduction of the Lion brand as a measure of quality. Consumers have confidence in the product and the poultry sector is one of the great successes of British agriculture. Should Her Majesty's Government fail to act in the interests of the UK egg industry to stop the import of cheap non-compliant eggs and egg products, the British egg industry will be in very real danger of following down the path of the pig sector in the UK. Since 1999, the national pig herd has declined by 40 per cent through the import of cheap pig meat, produced in inferior systems and with far lower animal welfare standards.
