My Lords, I think this demonstrates just how many Ministers it takes to do my noble friend Lady Scott’s job. I am sure the whole House joins me in wishing her well.
We are taking a number of steps to tackle unjust disparities in the workplace. We published new guidance in April to help employers measure, report and address unfair ethnicity pay differences. We are taking forward measures to improve access to flexible working, including our commitment to make the right to request flexible working apply from day one of employment. We have also launched an inclusion at work panel to develop resources to help employers achieve fairness and inclusion in the workplace more effectively and efficiently.
I thank the Minister and welcome her back to her old job, and of course I send my best wishes to the noble Baroness, Lady Scott. This Question concerns three-way discrimination at play, which this report reveals. Black and minority ethnic women face a gender pay gap, an ethnicity pay gap and, on top of that, a clear motherhood pay penalty. This is particularly so for women of Pakistani heritage. I would like to know how this can be built into the kind of review that the Minister mentioned in the last part of her Answer.
I would agree with the noble Baroness on all fronts of her analysis. I will home in on Pakistani women in particular, who seem to have the worst effects of this—there are of course other ethnic minorities who fare better than their white British counterparts—we do a number of things, including outreach work, linking up with organisations that help women furthest from the labour market that we are talking about to move closer to employment. We have developed a proof of concept that targets Pakistani and Bangladeshi women, among others, who for mainly cultural and traditional reasons have struggled to engage with the labour market. We also have support available in jobcentres to that end.

Lords ChamberTo ask Her Majesty’s Government what steps they will take to implement the recommendations of the Information Commissioner’s Office report Who’s Under Investigation: The processing of victims’ personal data in rape and serious sexual offence investigations, published on 31 May.
My Lords, the Government are committed to improving protections for victims of rape, so that they are not subjected to unnecessary and intrusive requests for information. We have changed the law to minimise requests for digital information, and we are consulting on new statutory duties to ensure that police requests for third-party material are both necessary and proportionate. We are working closely with the police and other criminal justice partners to consider the ICO recommendations.
I thank the Minister for that Answer. It is hardly surprising that rape prosecutions fell by nearly 60% in four years, even though the number of reports to the police increased, and that the proportion of rape complainants dropping out of cases has risen from 25% to 43% over the last five years. It must be partly due to the fact that, when someone summons up the courage to make a complaint about rape, they are asked to sign a form agreeing access to any information that the police or CPS might care to go fishing for—counselling, school reports and, of course, social media. Does the Minister care to confirm whether, if a rape victim seeks support and rape counselling during the period between reporting the rape and the case coming to court, the police may also access that information if they choose? As the ICO put it, “If you don’t comply, we will come back with an enforcement hat on”. What is the timescale for the change?

Lords ChamberTo ask Her Majesty’s Government how they are providing specialist support for domestic abuse victims facing multiple disadvantages.
My Lords, the Government are committed to supporting all victims of domestic abuse, including those facing multiple disadvantage. We understand the importance of “by and for” services, designed and delivered by and for those they serve, providing tailored support that victims need. That is why our VAWG strategy commits £1.5 million for specialist support services and our tackling domestic abuse plan invests more than £230 million of new funding, including £141 million for supporting victims.
I thank the Minister for that. Of course, everybody would welcome the Government’s plan to tackle domestic violence. This Question addresses the particular needs of the most vulnerable, facing multiple disadvantage, who are often at the sharpest end of inequality. What steps are the Government taking of direct action, set out in their domestic abuse plan, specifically to meet those needs? For example, will funding clearly set out how any training will work for these girls and women to provide care that is trauma-informed, age-sensitive and takes account of things such as the needs of care leavers and black and ethnic minority women?
The noble Baroness is absolutely right that whatever interventions are taken forward on domestic abuse need to take into account the specific circumstances of the victim. Although disadvantage does not cause domestic abuse, it can certainly be exacerbated by the many causes of disadvantage. On specific interventions, the College of Policing has developed specialist training, including the Domestic Abuse Matters programme, which will help first responders dealing with an incident or a report and considers the needs of different victims, including those from diverse communities. The training has been delivered to the majority of forces already. The Home Office will provide £3.3 million to that end to support further delivery. The tampon tax obviously funded 100 directed grants and £75 million to disadvantaged women since 2015. DCMS has also given some direct grant funding to that end.

Lords ChamberIn the Crime Survey for England and Wales 2020, it is estimated that 4.4% of women aged 60 to 74 were victims of domestic abuse, as were an estimated 1.9% of men—so there is definitely evidence of men aged 60 to 74 being victims of domestic abuse. In a rural setting, it must be very isolating and frightening, and it is important that, through the Act that we have brought through Parliament, all victims are reached, whether they are rural or urban.
My Lords, we know that the pandemic and lockdown have exacerbated the likelihood of domestic violence generally. We know that people over 61 are more likely to experience abuse than those under 61, and that 48% of those who do are disabled—and it may take them twice as long to seek help. So how much research have the Government done to highlight this prevalence? How much resource is being put into providing support and safe places that are dedicated to older victims of domestic abuse?
A significant amount of funding has been put in place, but the noble Baroness is right to point to research. We have had significant engagement with all parts of the support sector. As I said at the beginning, we are most grateful to Hourglass for the support that it provides.

Lords ChamberMy Lords, it gives me great pleasure to open this International Women’s Day debate—for the fourth year running, I think. International Women’s Day provides us with the perfect opportunity to come together, to celebrate the remarkable achievements of women and to commemorate the great progress we have made and continue to make. Around the world today, women and men will be marking this celebratory occasion in various ways. There will be events in local communities, discussions in places of work, arts performances in schools and debates across countries, much like the one taking place today in your Lordships’ House, and it is a privilege to be just one part of these celebrations.
We have come a long way in a short time and we should celebrate all that we have accomplished. Last year, in particular, was an outstanding year for women’s progress, and I want to highlight some of our incredible achievements. We allocated £5 million of funding to mark the centenary of voting rights for women. This money funded over 300 projects that raised awareness of this crucial milestone and encouraged more women, in particular, to participate in democracy, building a diverse political system that reflects the nation it serves.
For example, the Courage Calls event built on the Ask Her to Stand model, featuring workshops hosted by parliamentary experts and discussions with serving MPs, and providing help and guidance for 350 women to get on that crucial first rung of the political ladder. I hope to see some of the women who participated enter Parliament as sitting MPs one day.
There was the Centenary Cities fund, allocated to seven towns and cities to celebrate their suffrage history. These cities hosted a range of exciting projects to celebrate as well as remember those individuals who helped to make votes for women a reality. Let me give your Lordships a taste of what was on offer. In Manchester, we had cycle rides through history, touching on the lives of some of the women who made important contributions to the cause of women’s suffrage. In Nottingham we had banner-making workshops, encouraging people of all ages to celebrate the anniversary of the Representation of the People Act 1918. In Bristol we had the Black Women 100 event, which unearthed stories about the incredible women of colour who fought for the right to vote in the early 20th century. This is just the tip of the iceberg. I know that in Leeds, Bolton, Leicester and London there were hundreds, if not thousands, of other events, which took place as part of the celebrations.
Of course, we had the statue of Millicent Fawcett—the first statue of a woman to stand in Parliament Square—and the statue of Emmeline Pankhurst in my home city of Manchester. It was a huge privilege to be part of the unveiling, and what made it so special and so significant for me was the fact that my daughter was watching from the building opposite, where she works. I know she wished to work for her employer due to its proven track record on gender equality, which makes me incredibly proud of her. I am certain that all these statues will serve as a reminder to all us of the courage of our foremothers, and will inspire future generations of women and girls to come.
In November, we hosted Women MPs of the World. More than 100 female MPs from across the world participated, and we witnessed history as the House of Commons Chamber, for the first time ever, was filled solely with women. It was a herculean task to pull it off. I must pay tribute to the right honourable Member for Camberwell and Peckham. It started as her idea and evolved into a collaborative effort of two political parties, three government departments and three arm’s-length bodies to fly in around 100 female MPs from around the world to participate in receptions, plenary sessions and workshops here in Westminster. It demonstrated the power the House has when we all pull together.
Last year’s work has left a lasting legacy that will undoubtedly provide greater opportunities and influence for women in our society. But the fight for equality did not stop last year. We need to carry forward the momentum from the centenary year to make sure that our progress towards gender equality does not stall.
We know that inequality still persists across the world. Globally, one in three girls or women has been beaten or sexually abused in her lifetime. Every two minutes a woman dies in pregnancy or childbirth. Over 200 million women living in 30 countries have undergone female genital mutilation. In the UK, we know that women are much more likely to have time out for caring, with lasting impacts on pay and progression. Nearly 90% of those not working due to caring for home and family are women. The gender pay gap still stands at 17.9%. Until we have true economic, social and gender parity, we will never be equal.
This year’s theme for International Women’s Day is “Balance for Better”. With that in mind, I want to look to the future. I want to talk about what the Government are doing to ensure we have better balance in our society and how we are delivering for women and girls.
Yesterday, the Government published the refreshed violence against women and girls strategy, which sets out how we are going further and faster in our response to these terrible crimes. Much has changed in the three years since the Ending Violence against Women and Girls strategy was published. We have a better understanding of the effects on victims and have seen increased public awareness through the #MeToo and Time’s Up campaigns, which is welcome.
The refreshed strategy will implement a review of the criminal justice response to rape and serious sexual violence, which is crucial to ensuring that victims and survivors see the justice they so desperately need. I welcome increased reporting of these crimes, which shows that more victims have the confidence to come forward, but we must ensure that the police, the Crown Prosecution Service and the response through the courts are as robust and effective as can be. We will also develop guidance for providers and commissioners on best practice in supporting LGBT victims of VAWG, as well as reviewing our national statement of expectations to ensure that VAWG services delivered locally are as effective as they can be. Sadly, violence is something that touches many of our lives. We must do all we can across government, working with statutory agencies and specialist third-sector organisations, to support victims and bring perpetrators to justice.
Later this spring, we will publish our gender equality and economic empowerment strategy, setting out our plans to address the persistent gender-based barriers that women—and men—face across the country at every stage of their lives. The strategy will focus on four key themes: entry and progression in the workplace, especially for those far from the labour market or in low-paid, low-skilled work; optimal choice over parental leave and childcare; economic well-being in later life; and attitudes and social norms about the roles that men and women play.
My right honourable friend the Minister for Women and Equalities shared her emerging thinking about the strategy with a wide range of stakeholders on Monday this week. She set out that a key theme will be tackling the financial fragility that impacts on some vulnerable women and girls. As a compelling example of this, she announced that she will be convening an expert cross-sectoral task force to find sustainable ways to address period poverty in the UK, along with UK aid support for projects tackling period poverty and stigma globally.
The gender pay gap reporting deadline for year two is less than a month away. Our world-leading legislation meant that, for the first time last year, over 10,000 employers reported their gender pay gap, providing an unprecedented level of transparency, driving board-level discussions and pushing employers to take real action to close the gap. In fact, Bloomberg liked our model so much it has integrated our key measures into its gender equality index for investors.
Reporting is just the start; it is crucial that employers use their gender pay gap data to identify the barriers to women’s recruitment and progression, and take action to break down these barriers. We had 100% compliance last year and we expect the same this year. We saw the gender pay gap fall to its lowest level ever of 17.9%, but it will take until 2052 at this rate—
No, we will not—to eradicate it completely in the UK, and much longer globally. We have to do better.
We have committed £5 million in funding to help people return to work after time out for caring and to find jobs that use their valuable skills and experience. In addition to the initial £5 million fund we established for returners in 2017, a further £500,000 has been provided to support those with additional barriers to participating in the labour market. This may include people with complex needs or multiple barriers, such as substance abuse or homelessness. We have gone even further, and an additional £100,000 of funding has been announced to support those people with little or no work history. We have also launched best practice guidance and a toolkit to help employers run effective returner programmes. We urge them to make the most of these publicly available resources.
Gender equality is a global issue. I recently attended a gathering in Spain of Ministers from across Europe. While we are leaving the European Union, we are clear that we will continue to work with partners in Europe and across the world to ensure that women and girls have the same rights and opportunities as their male counterparts.
I conclude by saying again that I am proud to participate in today’s debate with so many staunch advocates of gender equality. I am proud to be part of this Government, and it is an honour to be part of the work we are doing and will continue to do to fight for gender equality across the UK and the world. We are making great progress and it is only right that we celebrate how far we have come. Now, all I ask of you is to keep working together, especially in these challenging times, to think about how we can balance for better, and how we can ensure that gender equality becomes a reality sooner rather than later. Lords ChamberMy Lords, there were quite a few points in that question. The noble Baroness’s first point was that there are 400 cases of doctors overseas who have been denied visas because they are not on the shortage occupation list. Therein lies the point: the shortage occupation list is arrived at with advice from the Migration Advisory Committee regarding those occupations that cannot fill the demand within the NHS. If we expand some of the doctor numbers that are not on the shortage occupation list, we are in danger of pushing out some of those other professions that we do need and that are on the shortage occupation list. We need to think about this in the round.
My Lords, I would like to give the Minister a direct example. In Cambridge and Peterborough NHS Foundation Trust, children and young people with mental health problems are having to wait many months to access mental health treatment because the child and adolescent psychiatry consultant, who has been chosen and appointed, has not yet been granted a visa five months after the cap for tier 2 NHS workers was reached; on Friday it will be six months, and we will probably find that the same applies. Does the Minister agree that the Government’s hostile environment policy is now directly damaging patient care? Does she agree with my honourable friend Jon Ashworth, who asked the Home Secretary in a letter on 1 May:
“The visa rules clearly aren’t working in the best interests of NHS patients. I am asking that you put patient safety first by taking NHS workers out of the tier 2 visa system so that hospitals can get the right numbers of staff in place”?
My Lords, as my right honourable friend the Home Secretary explained last week, the term “hostile environment”— coined by former Home Secretary Alan Johnson—is not one that he wishes to use because of all the negative connotations. Instead we will talk about a compliant environment—that is, complying with Immigration Rules. On the direct example that the noble Baroness gives me, I will not talk about specific examples because clearly I do not know the details of the case. I will go back to my original Answer, which says that no one on the shortage occupation list should be denied a work visa.

Lords ChamberWe have signalled our intention to bring forward a Bill in this Session. On the register, of course, we have the domestic violence disclosure scheme, which is also known as Clare’s law. It provides a way of disclosing information about a partner’s previous convictions in this area. Also, perpetrators can be put on the ViSOR register for violent and sex offenders. It is important in this space to ensure that we have a register that is simple to use for those who need to use it, and not to over-complicate things by issuing too many registers, with cases potentially falling between the cracks. However, I will be very happy to work with noble Lords on this as we progress towards the Bill.
My Lords, does the noble Baroness agree that cultural change is urgently needed to ensure that the serial perpetrators, rather than the victims, are placed at the centre of investigations and risk management plans? Paladin’s evidence and research show that this is not happening and that women are paying for that with their lives. What actions are the Government taking to ensure that such a cultural change takes place?
The noble Baroness is absolutely right to make the point that cultural change is essential in this area. Often, it is the women who are fleeing their homes and running away from often quite violent and wicked men. I pay tribute to the various groups such as SafeLives, which are providing perpetrator programmes to ensure that women actually remain safe in their homes and, where possible, men can be rehabilitated. I do talk about women and men here because women are most likely to be the victims of these offences.
Perhaps I may also talk about the police’s approach to vulnerability, which was brought up in a previous Question about training. We have awarded nearly £2 million to the College of Policing to transform the police’s approach. This will include a much-enhanced programme of training. I referred earlier to getting the voluntary sector to engage, as well, which would be all to the good since cultural change is sought across all agencies. Unfortunately, we are quite new to this process, although we have been trying to tackle this issue for decades. The noble Baroness has raised a very valid point.

Lords ChamberThe figures released today are absolutely stark. We welcome the work that Women’s Aid has done on the femicide census, and we are committed to working in partnership with it to help improve the response to domestic homicides. Annual statistics on domestic homicide, with a breakdown by gender, are routinely published. The Office for National Statistics has today published aggregated data on domestic homicides over the last three years, broken down at a police force level. Information on women killed by men is also gathered by the Government through domestic homicide reviews, or DHRs, and we have used those data in a DHR lessons learned analysis, which we published yesterday. We have also published updated statutory guidance for DHRs. We will be providing additional funding to roll out further training for chairs of DHRs, and there will be a series of regional events to embed learning and share best practice.
The noble Baroness also asked about police abuse of authority for sexual gain, which is a very important point. It is another shocking finding. It is important to remember that HMIC findings relate to a very small number of police officers and staff, and the vast majority of over 200,000 police personnel are dedicated and passionate about protecting the public. In the new year, the College of Policing will be releasing updated guidance on police and media relationships. The college has also been asked to consider further the feasibility of developing a new supplementary addendum to the code of ethics. However, that is to take nothing away from the shocking findings of today.
My Lords, the Minister has given us a lot of facts, but the truth is that domestic violence and the number of women and girls being murdered is increasing, so whatever it is that the Government are doing, it is not working. That is the problem. Today, 70 Labour MPs have written to the Prime Minister to demand that the Government set a date to ratify the Istanbul convention. The reason why that is important is that all the warm words that we have heard from the Prime Minister, particularly when she was Home Secretary, have not actually led to a decrease in domestic violence. We believe that ratifying this convention and coming forward with a new plan of action that will reduce the level of domestic violence should be a priority, and a funded priority, for this Government.
My Lords, I do not entirely concur with the noble Baroness. I concur with her on one point: yes, the level is increasing. However, what is very pleasing is that reporting is increasing. That is the very good news: women feel confident enough to come forward and report. As to what the Government are doing, I will start on her last point about the Istanbul convention. We are committed to ratifying the convention and we need to take extraterritorial jurisdiction over certain offences to be fully compliant. We will do so when parliamentary time allows. However, we are taking extraterritorial jurisdiction over certain things such as FGM and forced marriage. Therefore, we are already undertaking some of our obligations.
Before I talk more about what the Government are doing, I want to pay tribute to the noble Baroness, who has herself been very involved in this area, as was I in my role in the DCLG and now the Home Office. I was very pleased that, yesterday, stalking protection orders were announced and the national statement of expectation for domestic violence funding on a local level was released. As I said, we also published yesterday analysis about domestic homicide reviews and updated the statutory guidance to ensure that local areas can learn lessons. Last month, the DCLG announced the two-year innovation fund of £20 million to help local areas deal with domestic violence and the seamless journey of women through what is a horrific process. I am sorry that I have gone on a bit too long, but the Government have actually done a lot in this area.

Lords ChamberMy Lords, I understand the concern about why the maximum sentence is not higher than it is. The Government keep these issues under review but we do not have any plans at the moment to change the maximum sentence.
My Lords, why does the Minister not have such plans? Also, do the Government know how many serial stalkers there are in England and Wales? If, as the Minister said in her Answer, there is a register of these men—they are mostly men, although not exclusively—have the Government considered how to warn women that they are in danger of becoming a victim of a serial stalker like Zoe Dronfield was?
My Lords, the number of stalking and harassment referrals by the police to the Crown Prosecution Service in 2015 was almost 13,000. There were 1,102 prosecutions under the new stalking offences. These new laws need to have time to bed in. At this point the system appears to be working well.
To ask Her Majesty’s Government what assessment they have made of the European Institute for Gender Equality’s 2015 index; and what steps they are taking to improve women’s quality of employment, and their participation and integration in the workplace.
My Lords, the gender equality index provides a measure of gender equality across the EU. The UK’s overall score in the 2015 index is above the EU average and based on data collected in 2012. We continue to make good progress, particularly in the domain of work, with more women in work than ever before, more women-led businesses and a gender pay gap that is the lowest ever and has been eliminated for full-time workers under 40.
I thank the Minister for that Answer, but the Government should surely be concerned that the EU Institute for Gender Equality figures show that progress on gender equality in the UK has gone backwards in key areas. Yesterday the Chancellor had the gall to talk about equality for women in his speech but his Budget is going to hit women more than twice as hard as men. Where is the equality in the fact that, according to the Commons Library, 70% of the £34 billion in welfare savings in the Budget yesterday will come from women? What impact does the Minister think this will have on women and their participation in the workforce? Will the Minister commit to monitoring and publishing the impact of the Budget on women and work?
My Lords, women will be able to avail themselves of the new living wage, which will help take women out of state dependency and into a very decent wage for the first time. There will, of course, be a tax-free allowance of £11,000 of which women will be able to avail themselves; an increase in free nursery provision from 15 hours; and an extended right to flexible working. I think that this Government have done more for women than any other Government in living memory.
My Lords, I think noble Lords will agree that it is certainly going in the right direction.
Will the Minister answer the question that I asked about monitoring? Since she and I disagree about the impact on women and working women, it is very important that the Government monitor and publish an impact statement on the effect of this Budget on women and work.
