Lords ChamberMy Lords, it is clear that the Government recognise the need for consistency on what we are in a position to recycle and to ensure proper marking so we know what can be recycled. The Government must and will take responsibility in these areas.
My Lords, the noble Baroness, Lady Neville-Rolfe, consistently made the point—from the Minister’s Benches—that there should be a national policy on how we dispose of plastics. That has been consistently resisted on those Benches and made a matter for local authorities. I do not know whether the Minister does his own weekly shopping, but it is enormously difficult to buy fruit and vegetables without plastic containers, to the detriment of the environment. The noble Baroness made this point about disposal consistently and his own side has resisted over and over again.
My Lords, I am a little confused by what the noble Baroness has said. When I go into our fruiterers, I pick up and look at the fruit and am given it in a paper, not plastic, bag. As I have already said, Morrisons are using paper bags instead of plastic ones. This is happening more often. As I said in my earlier answer, we recognise the need for consistency. We need to enable people to recycle more, but we also need to reduce the use of plastic. I have been very clear about that.

Lords ChamberBefore I answer my noble friend’s question, I remind the House that I have a farm and that I am not unfamiliar with being flooded. The £10 million farming recovery fund will help farm businesses bring flooded agricultural land back into production as quickly as possible. In addition, £10 million is available under the farming and forestry improvement scheme—part of the rural development programme—which will provide support for farm business resilience. One hundred per cent rate relief is available to flooded businesses for three months. There are also, more generally, grants of up to £5,000 for households and businesses in affected areas to improve resilience of premises to future flooding.
My Lords, I declare an interest as my own village, Vernham Dean in rural Hampshire, has been very badly affected by the flooding. In our village, some householders have been told that although their insurance is valid if there is rising river water, it is invalid if flooding is as a result of rising water through the water table. This is preposterous on the part of insurance companies. Will the noble Lord do everything he can to ensure that insurance companies live up to their responsibilities to the people who have been paying their dues?
First, I extend my sympathy to the residents of the noble Baroness’s village and, indeed, the many other people who have suffered as a result of flooding in the last couple of months. I suspect that the specific answer to the question she raises is that unfortunately it depends on the drafting of the specific insurance contract. However, I sympathise strongly and I assure her that we are looking very carefully at the issue of insurance—as she will know—particularly in the context of the Water Bill currently before your Lordships.

Lords ChamberI am grateful for that question because it gives me the opportunity to say that work by Professor Crystl Donnelly has shown that as much as 50% of the incidence of TB in high-risk areas can be attributed to badgers.
My Lords, does not the Minister have to reflect on the point raised by the noble Lord, Lord May? We were told by the experts that there were 2,700 badgers in the area concerned, and we are now told that the experts think there were actually fewer than 1,400. If the experts who supported the policy got the numbers so wrong in the first place, does that not undermine public confidence in the policy as a whole?
I do not think that it should. Our policy is evidence-based and we have taken every opportunity to acquire the latest and most up-to-date information from the pilot areas to refine the estimate of the badger population. All wildlife population estimates have uncertainty around them. Appropriate steps were taken to audit the process, including data checks and independent audits of these figures.

Lords ChamberI believe that the institutions themselves can benefit from this, as I made clear in my opening remarks. The institutions are autonomous; they are not, as the noble Lord, Lord Triesman, put it, emanations of the state. Those autonomous institutions can make decisions on what courses they offer in seeking to attract appropriate students and on matters such as the length of courses and in what fields they are offered. There will be changes, but it is not for the Government to predict what will happen. We believe that we are making provision for students and those from less well-off families and we are providing opportunities for the institutions themselves. We also believe that it is necessary to put the measures in place so that everyone knows what is happening for the academic year starting in autumn 2012. That is why I stress again, as I have done two or three times, that the amendments in the name of the noble Lord, Lord Triesman, are fatal.
Does the Minister recall that, on 17 January 2007, the elected House gave this House the right to vote on statutory instruments when they might prove to be fatal, when it debated the all-party report on the conventions between the two Houses? The other place gave us that right without dissent and this House did the same the day before.
We have always accepted that this House has a right, if it feels appropriate, to vote down orders. However, this House should consider that very carefully before doing so. That is why I am warning the House that it ought to remember that these two amendments are fatal. For that reason, I recommend that the House rejects them.
