My Lords, I think we can all agree that we have had a very interesting, wide-ranging and excellent debate across a whole range of foreign policy, defence and international aid issues. I strongly support the analysis by the noble Lord, Lord Howell, of Africa, the BRICs, South Sudan and other concerns of this House. As always, the Minister showed commitment to working to build global peace and security.

As other noble Lords have done, I pay tribute to the excellent presentation made by my noble friend Lord Wood, who gave us a compelling overview on a range of issues of concern to noble Lords. His strong and realistic analysis of the UK’s current relationship with the European Union was timely and very interesting for many of us to hear. The noble Lord, Lord Howell, my noble friend Lord Wood and other noble Lords mentioned Afghanistan, as did the noble Baroness, Lady Tonge. I trust that we will hear more from the Government today about the need to ensure that women’s voices are heard and that they are invited to join the deliberations on Afghanistan post-2014. Women in Afghanistan tell us all the time that they fear for the future and they fear that they will lose what has been achieved for women in Afghanistan, which includes women parliamentarians, some of whom visited this building this week.

A number of noble Lords raised the issue of hunger and famine in the Sahel. Urgent action needs to be taken to tackle hunger; 170 million children suffer from chronic malnutrition, which leads to physical and intellectual stunting. The noble Lord, Lord King, raised these issues. There is no shortage of food; it is a realistic ambition to feed the world.

A number of noble Lords eloquently—the word was used in particular about my noble friend Lady Blackstone—drew attention to the problems of the Palestinians, and to the wider problems in that region. The overriding message we took from those noble Lords was that peace was about securing justice. I pay tribute, too, to the noble Lord, Lord Chidgey, who correctly drew attention to the need for the commitments at Busan to be honoured, and to the fact that effective monitoring was essential. As he knows, I particularly support his point about the need to do more to support parliaments in developing countries, because they are responsible for holding Governments to account and scrutinising budgets. Those important tasks fall within their remit.

The noble Earl, Lord Sandwich, again revealed his strong and informed commitment to international development, as did the noble Lords, Lord Jay, Lord Sheikh, Lord Rana and several other noble Lords. My noble friend Lord Judd shared with noble Lords his usual insights and magnificently made the case for solidarity with the world’s poor. The noble Lord, Lord Alton, and the noble Baroness, Lady Cox, drew attention to the suffering of the people of Sudan and South Sudan, and the violence and aerial bombardment that they are suffering. As the noble Baroness said, it is a humanitarian catastrophe. The noble Lord, Lord Teverson, mentioned the issue of the oil pipeline that I raised today at Question Time. Noble Lords should understand that there may be a problem with what has happened, but it is not acceptable that the poor people of South Sudan are penalised for the actions of their Government, which is absolutely the case. To withdraw long-term development assistance in education and health and to fail to meet the other needs of South Sudan would be untenable.

The noble Baroness, Lady Tonge, was, albeit briefly, liberated from the naughty step. We were very thankful that she was and that she found a microphone and gave us again the benefit of hearing her, especially on the need for the world’s women to have the status and respect that they need and deserve.

I will confine my remarks to international development. The reality is that we are living in an age of unprecedented human development. We celebrate the fact that millions of people have a better, more fulfilling and healthier life than their parents did. On every continent, including Africa, precious children’s lives have been saved. More are surviving infancy and, as the noble Lord, Lord Avebury, said, more are being vaccinated against deadly diseases. More are going to school, and real progress is being made on child well-being generally, as UNICEF and Save the Children confirm. Children have so much more than their parents had. Even in Congo, Haiti and Burma, infant mortality rates are lower than they were in any country at the beginning of the last century. Those are the conclusive facts.

Those who claim that aid does not work should try telling that to mothers of children in Africa who sleep safely under antimalarial bed nets provided directly by aid—to take just one of countless examples. Every day, 485 children are saved by these nets, which are paid for with aid. That is the equivalent of 80 primary school classes a week. With those realities in mind, the argument has to be that we should do more and do better so that we succeed in underpinning what we all ultimately seek: shared prosperity and security.

The tendency has been for there to be too much focus on income levels rather than on key indicators such as health, education and the general provision of basic services. Of course we should recognise that progress has been patchy, but we must also assert that Congo and Zimbabwe are not actually the norms. That is why aid works. These “aid works” arguments must be made and we must emphasise that people’s lives are longer and better because aid enabled them to have access to income, education, social protection and better government.

On that last point, we have proof. The recent advances in Brazil, for instance, show that growth with redistribution can act as a powerful force for greater access to equity within countries. That is obviously in everyone’s interest. We know that new forms of organised violence and conflict thrive on inequalities. I want to hear the whole Government and not just DfID civil servants referring much more to the need to combat inequality within and between countries. That is especially important when people here and abroad face such terrible shocks and crises. The well-off and the elites are of course better able to weather the storm. It was ever thus.

The UK has for many years been recognised as one of the world’s most effective donors and has pushed concerns about action against poverty up the international agenda. That has rightly brought with it substantial diplomatic benefits to the UK. The international commitments that we have had for many years have, we know, brought to the UK prestige, trust and respect. That again means that it makes sense to continue to promote fairness, social justice and moral responsibility to retain our country’s reputation for practical fairness and international responsibility. It is essential to our efforts to define what Britain stands for and what Britain wants to improve—whether trade, information, protection against and prevention of security threats, including terrorism, organised crime, climate change, pandemics and the instability that affects us all when there is violent conflict.

Development also gives us a chance to tackle some of the knock-on effects of globalisation and the implications for all of us of state fragility that generates so many perils for all of us. We have to ask ourselves how we can not continue to push international development and poverty up the international agenda when it is an integral part of the UK’s overall global priorities and foreign and security policies.

At this time, most poor countries are not on target to meet their MDGs, and that must remain at the top of the UK agenda. Now the Prime Minister has a critical opportunity at the G8 and in his new role chairing the UN committee to show that he can offer real leadership by a UK Government such as we saw at the Gleneagles G8 summit in 2005. That is sorely needed now, at the G8 next year and of course as other noble Lords said at the UK-hosted G8 next year. In many ways, we are awaiting confirmation of the vital aid/GNI credential, but also a clear determination to actively leverage real change.

I said earlier that aid works and the clear evidence is that quality aid has substantially reduced aid dependency. One argument that people make against aid is that it creates aid dependency, but dependency has fallen from 47% to 27% in Ghana, for example, and from 85% in 2000 to 45% in 2010 in Rwanda. That is evidence of real transformation, and many Governments are now in the driving seat, pressing for fairer agricultural trade, combating tax evasion and climate change, promoting technology transfer, regional integration and managing migration. Those are their priorities and they are pressing them.

However, we still have work to do to justify 0.7% and the ring-fencing of development aid in the context of the so-called fiscal crisis. We have to tell the good news story, which is true and encouraging, and also point out that, after all, UK aid currently accounts for about 1p in every £1 of tax revenue. Frankly, it is nonsense to say that we cannot afford it when so much is achieved by it. Aid works and it is the smart thing to do.

The 0.7% target is arbitrary in that it is linked to specific MDG financing plans, but I would argue that the same could be said of any other area of public spending. However, we must never let up on the task of winning over public opinion and explaining how aid fits in to the wider vision of equity and fairness. Will the Government now frame a public dialogue on what aid has done and is doing and what the challenges are? It really is time for an informed debate on these issues.

It was a considerable disappointment to many of us that the gracious Speech did not contain a reference to legislation for 0.7% at any specific time. At the previous election, the Conservative manifesto said:

“We will legislate in the first session of a new Parliament to lock in this level of spending for every year from 2013”.

That was subsequently included in the text of the coalition agreement in 2010, which said:

“We will honour our commitment to spend 0.7% of GNI on overseas aid from 2013, and enshrine this commitment in law”.

Those undertakings were emphatic and explicit. However, two weeks ago I was told by the noble Baroness, Lady Northover, that the commitment would be legislated for only “when time allows”. In addition, she said that time could not be found in the last parliamentary Session because of the time that had to be given to what she described as

“reforms to tackle the fiscal deficit”.

I must say that I found that explanation rather unconvincing when the 2010-12 Parliament was actually the longest in post-war history. This Session really should be no such impediment to progress on the 0.7% Bill, and the Government must urgently seek to redeem themselves first and foremost by guaranteeing that the target is reached in 2013 and, secondly, by ensuring that legislation giving legal force to that commitment is enacted in this parliamentary year.

Let us be clear: the Bill exists. It has already had pre-legislative scrutiny from the Commons International Development Committee. It is not complex. It has a few clauses. It is short. There is agreement between the coalition parties, and they know that Labour will co-operate fully in legislation, so why do we not just get on with it?

Of course, I have heard the Government claim that the intention to reach the 0.7% figure is so strong that legislation is not really necessary. My response to that claim is to ask: if legislation is not necessary, why bother to promise it in the first place? Why was it vital to “lock in” the commitment? Why was it essential “in the first session” to “enshrine” the undertaking? The answer, as everyone knows, is that specifying the 0.7% in statute is a solemn undertaking, an expression of multiparty irreversible seriousness, and that is what we are looking for. It is as vital now as it was on the day we started to demand it. The reasons for that are clear and compelling, as noble Lords have said.

Let us stop swapping contradictory numbers, peddling gloomy aid pessimism and exchanging negative anecdotal information about aid. Like most things, aid is clearly not an unmitigated triumph, but there are remarkable successes and real progress, as we have heard, and much more prominence should be given to the plain truth. We welcome the Government’s commitment to wanting to reach the 0.7% target. Now the paramount need is to see that that commitment is fulfilled, as promised, in 2013. As we work for that, we need to ensure that the guarantee that it will be sustained in real terms is given statutory force.

Not long ago, Andrew Mitchell said:

“On the whole, politicians should do what they say they are going to do”,

and he confirmed that legislation would take the 0.7% commitment beyond doubt. I agree with him, so let us do it.

My Lords, perhaps I may add my thanks to the noble Lord, Lord Alton, for initiating this debate and for bringing to it, in his usual way, his extensive expertise and understanding of the subject. The conviction last week of Thomas Lubanga by the ICC, which was just mentioned, represents real progress for international justice and confirms that the judges were being scrupulously fair. Now, attention must focus on the others accused of war crimes and crimes against humanity, including war criminals such as Charles Taylor, Gbagbo, Bashir, Saif al-Islam and, of course, Joseph Kony and his collaborators in the terrible crimes that they have committed. All these need to remain a priority for the court.

I do not want to say too much about the Invisible Children video, except to observe that it is somewhat simplistic, patronising to Africans and—in some respects, as many noble Lords have said—misleading, particularly on the issue of where Kony is. He may be in Uganda; he moves in and out of the borders of the DRC, the Central African Republic and South Sudan. That is how he operates; you never really know where he is. Even with its limitations the video does, however, prove the power of celebrity and social networks, as other noble Lords have said. We have learnt a serious lesson for when we want to get a message across.

Now Obama’s boys, as the US contingent in the region is called, operate from bases in all the threatened countries, and military efforts effectively operate alongside efforts to persuade Kony’s followers to defect. When one of Kony’s many so-called wives saw a photo recently of another “wife” smiling out of a leaflet, proving that she had escaped to safety, she also decided to flee. Incidentally, that leaflet was another Invisible Children initiative and was published in three local languages.

It is estimated that Kony’s force now totals something in the region of 200 to 500, down from thousands at its peak. That is encouraging but it emphatically does not mean that the LRA is a spent force, or that it has lost the capacity to attack or to terrorise communities. Last year we saw 278 attacks, and there have been 20 this year in the DRC, forcing 3,000 people to flee their homes. The affected countries will need assistance and support and, as a US State Department official recently said, what we think about where Joseph Kony is is not as important as where the four regional armies think he is. The four countries—the DRC, Uganda, the Central African Republic and South Sudan—have agreed to work together on this, which represents real progress. We should strongly emphasise the need for African government leaders, institutions and civil society to have a central role in these efforts.

The reality is that we will certainly not see a US “Black Hawk Down”-style military debacle, such as we saw in Somalia. The campaign generated by the video in recent weeks has succeeded in hardening the US commitment to engagement against the LRA, however, and has led to more co-ordinated and concerted action. But there are justifiable anxieties in America, especially ahead of the US election, about US servicemen being killed in Africa, which will naturally prevent the US Army from going beyond its “advise and assist” role. We may, therefore, see other kinds of interventions such as the use of drones and other technologies, including the essential building of cellphone towers and early warning systems in the regions. These provisions will allow for “find and capture” Special Forces operations without resorting to more heavy-handed military intervention. It is also important that the AU has launched its “regional co-operation initiative” to end the LRA—the first time that has happened. This has taken time because of reconciling the demands of its own member states and its main financial backer, the European Union.

All the evidence shows the need never to underestimate the ability of the LRA to resist capture. We hear that approximate locations are known to Governments, the UN and NGOs. What apparently is missing is the ability to act in a timely and effective way.

My Lords, we should of course welcome the conviction this week by the ICC of Thomas Lubanga, who was found guilty of terrible rapes and murders in Congo. Does the Minister agree that the conviction represents real progress for international justice and confirms that the judges of the ICC were scrupulously fair? Does it not also raise questions about the work of the court? Should it learn lessons from what the judges called a flawed investigation and prosecution? The pre-trial detention of the prisoner for seven years was one example of that inefficiency.

The noble Baroness is right; there are lessons to be learnt. Certainly when I looked at the briefing I, too, remarked that it was extraordinary that we had set up the court in 2002 and the first conviction had come almost 10 years later. There must be ways of speeding up these things. However, the cases are immensely complex; all sorts of political pressures are brought to bear before people can be indicted at The Hague; and there are great difficulties in getting some of these people located, charged and transferred to The Hague. Certainly there are lessons to be learnt, and improvements can be made to make this an even more effective organisation in future.

My Lords, if they fit the criteria for investment, we do not discourage new investment projects in Zimbabwe absolutely, but obviously they must be closely associated with the ending and the avoidance of any kind of violence, as I should have emphasised in my answer to the previous question, and must be aimed at benefiting the people of Zimbabwe, not at ending up with a lot of money going corruptly into the hands of a few. That is the broad pattern of criteria.

We are dealing with an economy that is now beginning to grow again, although admittedly from a very low level—I think that there was 9 per cent growth this year. Substantial aid is going in, not—I emphasise—through the Government but only through the non-governmental agencies. The infrastructure is beginning slowly to improve, helped also by massive Chinese investment. All these are conditions that we are watching very closely, and there are some firms willing to investigate and proceed, in very careful ways, with investment in the recovery of this once rich, and we hope rich again in the future, country.

Would the Minister join me in arguing that it is increasingly likely that Mugabe will orchestrate a repeat of the 2008 election? The strategy then was ruthlessly to unleash the army, the police and the intelligence services on the political opposition and the people of Zimbabwe. In that event, what can the international community do when China, which benefits so substantially from the mineral wealth of Zimbabwe, including diamonds, blocks any concerted efforts to deal with ZANU-PF’s terror and intimidation?

The noble Baroness’s prediction could be right, but I hope it is not. We are absolutely determined to see that the forthcoming election does not repeat all the violence and intimidation, terror and distortion of the 2008 election. There are ways in which we can work to minimise the chances of a repeat of 2008: we can engage with the Chinese in pointing out that they carry certain responsibilities, and we are doing so; we can work through the human rights agencies, the United Nations and the European Union and get them to mount pressure; and we can support all the voices in Zimbabwe that are urging that there should be real constitutional reform and a sensible election rather than the distorting and violent pattern of the past.

My Lords, does the Minister recognise that the systematic violence against women by police, military and non-state armed groups in the DRC that the engagement of women in security sector reforms is absolutely essential? Through UK funding to the DRC, will the Government ensure that women’s groups are provided with the knowledge, the skills and the resources they need to hold the security services to account?

Yes, we will. I think I can speak on behalf of my honourable and right honourable friends in DfID in saying that this is a central consideration in the substantial programme of aid, assistance and reform that the department is carrying forward, as well as in all our concerns in dealings with MONUSCO and the United Nations.

My Lords, we are discussing the Kenyan military intervention in Somalia with many of our partners, including the EU and other organisations. The UK supports Kenyan action so long as it is undertaken in co-ordination with the Transitional Federal Government, and so long as it complies with international law. We will work with Kenya, the TFG, the EU and other organisations, such as the Intergovernmental Authority on Development, to ensure that any action does not impede humanitarian operations and is consolidated by stabilisation and the development of credible, accountable governance structures.

My Lords, I thank the Minister for his Answer. Will the Minister join me in regretting the under-reporting of what is a rapidly developing crisis that threatens to escalate into a major military conflict with consequences, as the Minister has said, that inflict further tragedy on the people of Somalia, many thousands of whom are starving and urgently need humanitarian aid? Is it not likely that this Kenyan incursion will perversely bolster support for al-Shabaab and that it will carry out vengeful reprisals in Kenya and beyond? When US drones based on a remote airfield in Ethiopia are flying over the area and the French navy has been active to the south of Kismayo, can the Minister give a clear assurance that Her Majesty’s Government do not intend to undertake a similar involvement and instead will work for a diplomatic rather than a military response?

I totally agree with the noble Baroness, Lady Kinnock, about under-reporting. It is extraordinary how little coverage there has been of a very serious situation affecting the Indian Ocean nations of the coast of east Africa. As for vengeful retaliation, I am afraid that revenge is one of the currencies of the area. The Kenyan military operation is of course a response to the invasions into Kenya by al-Shabaab and other forces, and it is important to note that it is an attempt undertaken with the support of the TFG in Mogadishu, to bring some order and control to the situation. We have to face the reality that revenge operations may take place but there has to be a firm attempt to bring order and a better kind of control, at least to the border area between Kenya and Somalia. As to the noble Baroness’s last question, we support the Kenyan action on the conditions that I have clearly made: that it is important to ensure full compliance and that it is a legal operation under Article 51 of the UN charter.

These are deeply worrying developments, and although we welcome the release of these initial prisoners, there remains a great deal to be done. The noble Lord’s comments indicate what challenges there are and where we have to seek major changes and major improvements. We are currently working to secure the toughest possible resolution at the UN General Assembly which we hope will repeat calls for Burma to release all political prisoners and to start working towards national reconciliation in a nation that is obviously deeply divided and riven by ethnic problems of all kinds. As the noble Lord knows, a famous book by Martin Smith on Burma’s ethnic problems reminded us of that long ago. There are many problems ahead.

Does the Minister agree that the very limited prisoner release announced by the regime in Burma yesterday is merely cosmetic? Is it not clear that the Government are in fact a legalised dictatorship and that they are undertaking action in an effort to get sanctions lifted, not to advance democracy in Burma? Will the Minister give an assurance that the UK will strongly oppose any relaxation of European Union sanctions, especially when there is clear evidence that, as the Minister said, the regime has increased the use of torture, rape and other unspeakable abuses against ethnic nationalities in Burma?

I can give an assurance that we will not review or dilute the sanctions yet, and indeed it is the view of Aung San Suu Kyi and others that we should not do so. The noble Baroness is absolutely right about that. I would take a slightly different tone from that which the noble Baroness uses in her comments. It is, of course, only the beginning. There is a horrific past, and horrific atrocities, to be accounted for, and people held to account for them. There are many problems ahead. However, this is a step that Aung San Suu Kyi herself recognises could lead to a more constructive dialogue with the Burmese Government. We should not do anything to discourage it at this stage, while keeping an eye open that there are many more difficult problems ahead.

My Lords, I thank the noble Baroness, Lady Falkner, for initiating this timely debate, which has offered all of us a wealth of expertise and analysis, which I and all noble Lords welcome. The report, as many noble Lords have said, has a number of very positive elements, which we need to follow very closely. It will, of course, involve the importance of holding the Government to account on this strategy. It is, of course, not a new agenda, because it was under the last Government that the stabilisation units and other initiatives were taken. For many years there has been an analysis and there have been efforts to link and integrate defence, diplomacy and development. Therefore, we have to applaud the joint strategy—we like joined-up government, do we not?—which is designed to bring coherence across DfID, the FCO and the MoD.

The report acknowledges, as I know many noble Lords have done, that what we are talking about—indeed, conflict has been the central subject this afternoon—has repercussions for countries, individuals and whole regions. We have a comprehensive definition of stability in the strategy, which goes beyond definitions confined to merely the absence of war or to threats to national security. It also clearly and unequivocally identifies the need for humanitarian aid to be delivered on the basis of need alone. The strategy is also about recognising the need to be in for the long haul. If transformational results are to occur, clearly that has to be what we do.

We should also welcome the commitments to the international arms trade treaty. On this subject, we know that the Arab spring raised many concerns about arms transfers that have taken place over a number of years, whereby arms are transferred by the UK to authoritarian Governments. More than 150 licences had to be revoked, for instance on sniper rifles, teargas, ammunition and armoured vehicles, which had been delivered to Bahrain, Egypt, Libya and Tunisia. It would be good to know what is being done to avoid a repetition of these mistakes. I would certainly appreciate it if the Minister could comment on whether we can expect a full-scale review with engagements with Parliaments, civil society and the arms industry. It is good to see that the early warning system will inform the work of BIS on arms export licensing.

Stability is characterised not just by an absence of war but by promoting open, inclusive societies, which are the key to tackling fragility and conflict. We need to know more from the Minister about how it is anticipated that this will be achieved. Since 9/11, we have seen increasingly that development and security concerns have been linked. The lexicon is: fragility; radicalisation; stability. Many of us hoped that development objectives, when clearly identified, would deliver human security, but we have also feared the securitisation of aid, which serves only to compromise development and humanitarian activities. After all, DfID has now joined the National Security Council, and David Cameron has explicitly said that development aid,

“is a powerful instrument of our foreign policy”.

Countries selected for aid increases—Afghanistan, Pakistan, Somalia and Yemen—are also all seen as actual or political terrorist threats. UK aid to Afghanistan is set to increase by 40 per cent over the next three years. It remains essential that aid is allocated according to need and not to serve short-term political or military gains. We know that since 9/11 we have increasingly seen statements from politicians linking poverty and alienation with terrorism, while we see military engagement with development work in order to win hearts and minds. People want security and justice, but communities must identify their own security priorities and concerns. Will the Minister confirm that the new approach will seek to meet the genuine security and justice needs of vulnerable people?

I am also interested to know more about the distribution of aid. DfID has said that 30 per cent will go to fragile and conflict-affected states. Would the Minister care to clarify, now or later if necessary, whether this is bilateral or multilateral aid, or both? How does the new commitment fit with the limited number of countries—27—that will receive aid following the bilateral aid review? The criteria for country selection in the strategy are also not the same as in the multilateral and bilateral reviews; those identified are different. Paragraph 1.5 says:

“where the risks are high, our interests are most at stake and where we know we can have an impact”.

I fail to see any reference there to criteria on improving the lives of poor people.

What, then, is absent from the strategy? On military engagement, it addresses soft power and security sector reform, but what about the places where the UK is militarily engaged? The strategy is strangely silent on this. There is nothing at all on when, how or if military intervention is appropriate, or on checks and balances when it happens. Is this not a serious omission? It will also be necessary to address how potential tensions between the three departments will be handled, because I and many other noble Lords know that it cannot be assumed that there will not be tensions between the various departments. On the role of the MoD, when working with armed services overseas we need to know that the notions of the importance of human rights programmes, democratic oversight, gender equality and the accountability of security forces are understood and promoted. The FCO must lead on addressing the causes of fragility and conflict and ensure that conflict is firmly on the list of UK diplomats’ priorities.

There is such a lot to say on this subject, but I now turn to a serious lack of emphasis, to which many noble Lords have referred: clarity on the commitment that is to be made on the importance of women in peacemaking and peacebuilding, and, indeed, in tackling the appalling levels of violence that women experience. In every single aspect of this report, we should see a strong commitment to the integration and involvement of women. On early warning systems, we need to see indicators on levels of violence against women; on government co-ordination, I suggest that Lynne Featherstone, the Home Office Minister responsible for following violence against women overseas, should be engaged in the process and take part in NSC discussions in that role. On partnership and accountability, we should make a commitment to provide core funding for women’s organisations in these countries. Security and access to justice is a critical issue because women have particular problems with accessing justice.

Much more needs to be included, and I hope that consideration will be given to drawing up a focused set of policies now to address the fact that there are only fleeting references to women in the strategy and that it is necessary to come up with tangible and substantial commitments on this issue. Indeed, there is scant reference in the strategy to human rights more generally and no clarity about why human rights matter. In the context of the nature of the objectives of the strategy, this is regrettable.

We are, of course, aware of the difficulties that we face when we talk about state-building, and a number of noble Lords have identified those difficulties. It is a highly political activity. Lessons have to be learnt from Afghanistan, for instance, where the state’s loss of legitimacy and accountability is a major source of instability. The process has to be nationally owned, not devised or imposed by outsiders. That is critical. For instance, it took Portugal a decade to move from military to civilian rule, and this when they already had fairly strong institutions. We should learn from those kinds of examples.

Finally, the UK must work closely with others. The OECD recently reported that there is generally a lack of co-ordination or even contact between those working on stabilisation. We need to reassess this and see how we can change it. In this and many other areas of policy, going it alone is simply not an option, and I trust that in future we will see more collaboration.

We shall certainly be discussing them. I hope the noble Lord will believe me when I say that I do recall the letter that he sent me. As he knows, he sends me quite a few letters, which are very informative. However, as I say, I recall that particular letter. The atrocities that have apparently happened, which he described, are appalling, as is the general refugee problem of homeless people milling around in all three areas that we are discussing. That is causing enormous suffering, hatred and bitterness, which, I am afraid, will take a long time to eradicate. However, as to the role of the International Criminal Court, it is, of course, independent and will decide, probably on the recommendation or the nature of the debate in the UN, what charges to press further. As the noble Lord knows, it has already pressed some charges. These matters are very much on the table.

My Lords, will the Minister clarify exactly what the United Kingdom is doing to help secure unimpeded access for humanitarian workers? Is not the silence of the UN co-ordinator in Khartoum somewhat baffling? What pressure is the UK putting on the UN to be more vocal and more effective on this issue of humanitarian access? Secondly, what are the Government doing to help facilitate credible mediation efforts between the NCP and the SPLM in the north?

The answer in a very confused and difficult situation is that we are doing our best. As I said earlier, access for humanitarian activity is extremely difficult, particularly in Blue Nile state. The Government, through DfID, have put in resources and supplies almost in grim anticipation of things getting more difficult so that resources and supplies are accessible within Blue Nile state and in Southern Kordofan, but access to find out what is happening is difficult. The Government in Khartoum have been extremely unconstructive, as the noble Baroness knows, and she knows this area very well. They have constantly resisted the renewal of the UNMIS mandate in the north, although just recently I understand that a high Khartoum official did not rule out the idea of an international presence in Blue Nile state. If it is proved to be true, that could be a change from the previous totally unconstructive attitude. However, access is really difficult, so it is very hard to give the precise answers that the noble Baroness rightly seeks.

The assessment we have is based on the wisdom and experience of the noble Baroness and on the visit of my right honourable friend the Foreign Secretary to Juba 10 days ago for the independence celebrations. Our assessment is not at all encouraging. There is a clear attempt to use extremely violent methods and to carry them out in South Kordofan, the Blue Nile area and the Nuba mountains where some horrific things have gone on. This is not at all encouraging. President al-Bashir has already been indicted by the International Criminal Court. The pattern that has been pursued is a mixture. At least he did turn up at the celebrations in Juba, which was a positive act, and one hopes that more positive aspects will appear, but at the moment, there is not much sign of them.

I wish to return to the leaked UN documents. The report states that 73,000 people have been displaced and that 7,000 people who were not taken into the compound have disappeared. The situation has been described as resembling Srebrenica. There are aerial photographs of mass graves. So why has the UN remained silent about such disturbing evidence? As a member of the Security Council, what exactly is the United Kingdom doing when a sovereign Government in Khartoum are refusing to allow anyone to investigate what is happening and are continuing to obstruct essential humanitarian aid to the very needy people of South Kordofan?

The noble Baroness is right and reinforces what I was saying a moment ago. This report is extremely worrying and full of evidence of really serious atrocities. She has further elaborated and underlined that. The question is what the UN agencies, UNMIS itself and the reporting authorities are going to do about it. I have to tell the noble Baroness that as far as the British Government and my honourable friend Mr Bellingham, who was at the United Nations, are concerned, our urging has been that this report should go forward to the Security Council and be fully discussed in the light of the grim and terrible reports that it contains. That is the position so far. I cannot tell the noble Baroness exactly what is going to happen next or how it will be handled, but that is HMG’s position on the matter.
