My Lords, does the Minister agree that the recent disenfranchisement of the Rohingya by the withdrawal of their ID cards is a further, outrageous attack on an already severely persecuted group? Does she accept that the forthcoming elections in Burma cannot possibly be free and fair when hundreds of thousands of people are being denied the right to vote and while the military maintains its 27% stake in the Burmese Parliament?

My Lords, I entirely agree with the noble Baroness that the withdrawal of what are known as the white cards from the Rohingya was an improper act. This is the politest phrase I can think of in the circumstances. It severely imperils the appropriateness of the election results. However, we must recognise that Burma is on the cusp of having the opportunity to elect a civilian Government for the first time. This does not prevent our remaining outspoken about the fact that the Rohingya should not have had their ability to vote withdrawn.

My Lords, the UN High Commissioner for Human Rights has said that increased government militia violence could push Burundi over the edge. Does the Minister agree that, since we are seeing the deepest conflict and violence for a decade in Burundi, there is a chance of old ethnic battles between Hutus and Tutsis reopening?

The noble Baroness paints the picture about which we are all concerned—that this should not be an event that leads to Burundi returning to violence. The Arusha agreement of 2000 took them out of that, and they have a Government who reflect both Tutsis and Hutus. It is that kind of inclusive government that we will seek to continue. It is not a happy picture of the future if that were to break down.

My Lords, we are deeply concerned by the use of force by police in Letpadan on 10 March, and by the use of irregular security groups in Rangoon on 5 March. These incidents undermined an otherwise disciplined approach to policing student protests and demonstrate the need for further policing reform. We support the EU’s call for a full investigation and call on the Government of Burma to release all the remaining demonstrators.

I thank the Minister for her reply and ask her whether, in the light of the violent attacks and arrests of students in Burma last week—and, I have to say, other abuses of human rights in that country—we can now anticipate that the British Government will thoroughly review the support and assistance they currently provide to the Government in Burma. Otherwise, how can we be sure that the UK financial and technical assistance is not now actually supporting the institutions of an authoritarian regime that has made no real progress towards the civilised objectives that the people of Burma and the international community were promised?

My Lords, we continue, of course, to review how our work is undertaken with the Government of Burma. The noble Baroness will be aware that our contribution with regard to police training was via the EU instrument of a stability-funded project in support of police reform, following a request from not only the Burmese Government but Aung San Suu Kyi. That contribution remains under review. However, it is important to mark the fact that the Government of Burma have made progress, although they have a long way to go. We are always happy to discuss these matters with noble Lords and MPs. We have offered such meetings across both Houses to individuals with an interest in these matters and have had quite a lot of uptake. I understand that at the moment the noble Baroness, Lady Kinnock, has not accepted the invitation to meet our most senior official on this matter. I warmly offer that invitation again, and hope that she may accept it.

My Lords, I will briefly touch on the situation in Ethiopia. With an election looming there in May, we learn that its media are being decimated. The right to free expression continues to be denied and at least 60 journalists have fled the country since 2010. The reality is that the Ethiopian Government cannot tolerate independent voices being raised or information and analysis being disseminated. Intimidation, harassment, threats and unbearable pressure are put on those whose voices are raised against policies which threaten political opposition.

Both Eritrea and Ethiopia have a Marxist-Leninist heritage. Ethiopia is still effectively controlled by the Tigrayan People’s Liberation Front, through a system of ethnic federalism. Although there has been some improvement we have to ask how it can be that, at the 2010 election, the EPRDF won 90% of the vote. At this stage, I particularly commend the work of Human Rights Watch, which argues relentlessly for recognition of the effects of the Ethiopian denial of fundamental rights and the need for its friends and donors to speak out on issues which are of life-and-death proportions to so many brave people.

In 1988 I travelled to Eritrea, which was at war at the time with Ethiopia. Since 1962 they had been deadly enemies; tensions and conflicts have characterised all the years since. It was the longest running struggle for independence in Africa and was about independence from Ethiopia. As we know, the people of Eritrea continue to suffer and such is their desperation that they seek refuge in other countries, which can mean very long journeys.

On the subject of migration, I begin with a shocking fact which serves to illustrate the desperation of Eritreans. Almost as many Eritreans fled their country—a country which, incidentally, is not at war—as Syrians fled theirs in 2014. UNHCR has said that:

“From January to October 2014, more than 60,000 Syrians, including almost 10,000 children, arrived by sea. In the same period almost 35,000 Eritreans arrived by sea in the Mediterranean, including 3,380 unaccompanied children”.

Surely, we have to ask exactly what makes people take such terrible risks to leave their country. The cruelty, tyranny and oppression of Isaias Afewerki and his regime know no bounds. Eritrea is isolated politically, regionally and internationally and it is under UN sanctions because of its alleged support for al-Shabaab in Somalia. The country is often described as Africa’s North Korea. All rights and freedoms are denied. There is no religious freedom or political pluralism, and no freedom of the media or of speech.

The 2015 FCO report has given details of Eritrean abuses: arbitrary and inhuman detention, indefinite national service, lack of religious freedom, no job prospects and much more. Indefinite national service is clearly the main driver of migration. UNHCR has confirmed that young Eritreans are conscripted into endless military service characterised by harsh treatment. They are sent to work in gold and copper mines or to camp out on the Ethiopian border. National service should be limited to 18 months but conscripts are often held for as long as 20 years. Is it surprising that they are prepared to take such risks in the hope of a chance of a better life? The number of Eritreans seeking to come to Europe has nearly tripled over the last year and is mostly made up of very young refugees. The special rapporteur says that the authorities in Eritrea show no inclination to tackle the root causes of the exodus. She confirms a lack of rule of law, and reported cases of extrajudicial disappearances, arbitrary detention and torture in detention.

Also, does the Minister agree with the suggestion made by some European Governments that it is necessary now to offer additional support and engagement to Eritrea, arguing that additional aid will lead to more openness and to change? Surely there can be no “new beginning”, as has been suggested, with this regime. As history proves, concessions to regimes such as Eritrea will achieve absolutely nothing. I ask the Minister to give some detail on the apparent willingness of the UK to have discussions with the Eritrean regime on,

“drivers of irregular migration and ways to mitigate it, asylum and returns, and potential areas for joint co-operation”.—[Official Report, 6/1/15; col. WA 136.]

What exactly does that mean? Will the UK delay any response on refugee policy until the UN commission of inquiry issues its report on the subject?

European Governments should not make major Eritrean policy changes until they see the inquiry findings. Let us see if Eritrea is prepared to co-operate with the UN commission of inquiry before taking any hasty decisions. Now there are signs of unbelievable courage and determination in Eritrea on challenging Isaias Afewerki. The people are aware of the dangers of open protest, but we have to ask just how long they—and he—can hold on. We must urge the EU and others to make sure that the UN commission is given clear and urgent access.

Isaias Afewerki’s agreement to co-operate would be the first test of whether he is ready to accept change. Whatever happens, if there is negotiation, the European Union and member states must not make quick concessions but use any momentum to ensure that there can be—and will be—fundamental change. The release of Dawit Isaak would be a welcome and symbolic victory.

My final point relates to what are routinely called “irregular migrants”. These people arrive in Calais having endured a terrifying journey and are then treated as if they are economic migrants. This is clearly not what persuades them that they must leave Eritrea. Many other African countries are just as poor as Eritrea, but their citizens do not come to Europe in their thousands, as they do from Eritrea now. Will the UK argue for their right to stay and ensure that they are treated as refugees?

My Lords, we are certainly aware of the extra aid that needs to be granted to these areas. We have been aware that more than 430,000 people have been displaced. DfID estimates that it will spend a minimum of £27 million on projects in Darfur alone. That includes funding to the World Food Programme and the Common Humanitarian Fund in Darfur. We are urging the Government of Sudan and the Darfur rebel movements to engage fully in peace talks. We are also engaging with the difficulty of access to the two areas of Blue Nile and South Kordofan, where access for humanitarian aid is, to say the least, perilous.

My Lords, as Sudanese opposition groups are now increasingly speaking to each other and taking unified positions and many people are saying that they are now likely to welcome support and advice from the United Kingdom, and in view of the need to tackle the terrible insecurity in the region, is it not short-sighted, badly timed and very unhelpful that there have been cuts in the Sudan units in the FCO?

My Lords, I was able yesterday during the Question for Short Debate from the noble Earl, Lord Sandwich, in the Moses Room to put on record the fact that the Sudan unit has its resources carefully monitored. Whenever they need to be increased, they are. I gave a commitment that that careful monitoring and increase where necessary will be continued.

First, the conduct of MINUSCA troops falls under the United Nations rules of engagement, which are covered by international humanitarian law. In the first instance, it is for the country which sent the troops there to hold those people to account, but the United Nations as a whole makes sure there is no impunity. I think that covers my noble friend’s second question. Where people transgress, impunity should not prevail and President Samba-Panza is trying to enforce her own legal systems, locally, to ensure there is no impunity there either.

My Lords, children are bearing the brunt of the insecurity and lawlessness in the Central African Republic. UNICEF has said that children are in desperate need of protection at this time and in danger of being forgotten by the world. Will the Minister tell the House what, if anything, is being done to make the CAR a priority, especially when the security of innocent people continues to deteriorate, despite the deployment of a UN peacekeeping mission?

The noble Baroness is right to focus on the lack of security for children. Of course, across the region there is a history of the abduction of children and their use as child soldiers. What I can say is that we remain the third largest bilateral provider of humanitarian aid in CAR, having given £30 million in direct humanitarian assistance to the Government and to refugees since the crisis began.

My Lords, as I mentioned earlier, we are in continuous discussion with the Nigerian Government to offer what assistance we can to prevent any further supply of materiel to Boko Haram. It is a very complex matter in an area that is certainly under the kind of attacks that happen without any warning, where whole areas are seized by Boko Haram and the Nigerian forces clearly have come under great stress.

My Lords, reference has been made to the contents of the excellent Human Rights Watch report, which has described the violence and terror endured by girls and women held in Boko Haram camps. It described the shocking, appalling failure of the Nigerian Government to prevent these brutal abductions. What is the UK doing to press the Nigerian Government at last to: first, secure the release of the girls; secondly, make schools safe for girls; and, thirdly, ensure that there are medical and mental health services for the victims of abductions?

My Lords, I think I may have addressed the first two questions—rather briefly, it is true. However, the noble Baroness raises a new point at the end with regard to what happens next. Let us focus first on the release, not only of the Chibok girls but of others. One would then need to see what their needs may be, what support needs to be given to them and their families, and which choices the girls may wish to make. I assure the noble Baroness that, through our DfID programme, we provide aid to the area to try to assist the society to grow and survive.

My Lords, I, too, pay tribute to the noble Baroness, Lady Cox, who relentlessly and courageously supports those denied fundamental freedoms, who are excluded and marginalised, and who are too often forgotten. The noble Baroness earns the respect of us all.

The first six months of 2014 have brought devastation, death and destruction to Sudan on a scale not seen since the height of the genocide in Darfur from 2003 to 2005. In 2013, violence caused a further 460,000 new internally displaced people. So far in 2014, another 215,000 people have been forced to flee their homes and 3.5 million people in Darfur—half the population—are in need of humanitarian assistance. There are still 300,000 Darfuri refugees in camps in Chad.

Sudan faces a terrible humanitarian disaster but, tragically, it has slipped off the international agenda. Political freedoms, religious freedom and freedom of speech are under attack, newspapers are censored and banned. Access to justice is rare. There is evidence that torture, beatings, rape and other inhuman punishments are routinely used. Sudan, as the FCO report says, is the country that makes most use of the death penalty. In Darfur, reports of human rights abuses have considerably increased. Sexual, gender-based violence almost doubled in the last quarter of last year. The chief prosecutor of the ICC has described reports of “disturbing” abuses in Darfur to the Security Council. There are also very grave concerns about the denial of children’s rights to education, to nutrition and to the freedom to be children and not to be forced into the army. LGBT rights are routinely denied. Anyone identified by the authorities is fined, flogged, stoned or imprisoned, and can even face the death penalty. Human Rights Watch says that human rights abuses,

“are intensifying in Darfur, making accurate, timely public reporting on human rights abuses more important than ever”.

Does the Minister agree that it is shocking to learn that, in Darfur, public reporting of abuse has all but ceased and that the latest report by the UN human rights commission was as long ago as in January 2009? In 2004, the United Nations Security Council mandated the Sudanese Government to disarm their Janjaweed militias. They never did, denying any close connection with the violent Arab militia. Now, in 2014, as the International Criminal Court’s chief prosecutor has said, the Janjaweed have been trained and rebranded as the Rapid Support Forces and are attacking unarmed civilians in Darfur, and North and South Kordofan, with impunity.

Far from distancing themselves from the destruction caused by the RSF, the Sudanese Government admit that it is a vital part of their campaign to eliminate what they describe as a “rebellion” or “insurgency” in the marginalised areas of Darfur, South Kordofan and Blue Nile. The behaviour of the Sudanese RSF has been so ruthless that several Sudanese politicians who usually in the past have supported the regime obediently have spoken out and been jailed as a consequence. At the start of the year, President Bashir warned that 2014 would witness,

“the end of all tribal and ethnic conflicts and insurgency”,

through a military campaign called the “Decisive Summer” mobilisation. He meant it, and he has pursued that objective remorselessly.

Recently, the UN Secretary-General ordered a commission of inquiry into the poor performance of UNAMID, the peacekeeping force in Darfur, following evidence that human rights abuses are extraordinarily frequent and that it is sending misleading reports to the United Nations and to the African Union. In addition, UNAMID is failing to protect vulnerable civilians, which leads to serious abuses of human rights as women who face violence and rape are denied protection, as has been the case in Darfur, and more generally in Sudan, for far too many years. Meanwhile, the Sudanese authorities continue to place daily restrictions on the activities and movements of UNAMID, other UN agencies and humanitarian aid groups.

The US Commission on International Religious Freedom has reported that Sudan is among the least free and tolerant countries on earth, ranking it with Iran, North Korea, Burma and Saudi Arabia. Freedom House gives Sudan its worst ranking, as does Transparency International. None of this augurs well for a genuine national dialogue. For these reasons, the UK must surely not fund any part of the forthcoming 2015 election process due to take place in Sudan, because there is absolutely no basis for us to believe that those elections will be free, fair or credible.

Meanwhile, the Doha peace process has stalled, lacking credibility in the eyes of many in Darfur. The UK has invested time and effort in Doha, but most civil society groups are calling for a more comprehensive dialogue that includes all marginalised areas, considers devolution of power to the regions and provides a fully revised constitution that guarantees the rights of minorities.

Against that background, I must ask the Minister what the UK’s position is on demands being made by civil society organisations. Is she aware that 60 of Sudan’s laws violate its own constitution? Will the Minister assure the House that the UK is strongly pressing Sudan to respect the many international and regional conventions and treaties it has signed guaranteeing the human rights of its citizens irrespective of ethnic background or faith?

My final point relates to the engagement of the UK in the negotiations taking place on dropping Sudan’s external debts. Will the Minister confirm that UK officials participated in the technical working group on Sudan’s external debt, which met most recently in Washington in April? Will she agree that, as long as these talks go on, Sudan will have no pressing reason to respect its obligations under international human rights law or, indeed, its own promises to the African Union and the UN? Surely the Minister will recognise and agree that UK actions count for much more than our occasional words of condemnation of the regime in Khartoum.

It is almost 10 years since the UN Security Council first reported the situation in Darfur to the chief prosecutor of the ICC. Last month, the ICC urged the Security Council to support efforts to ensure that the individuals indicted in war crimes cases in Sudan’s Darfur region are delivered to The Hague for prosecution. What has been the Government’s and the Security Council’s reaction to this ICC demand for urgent support at this time? Does the Minister agree with the chief prosecutor that there has now to be a dramatic shift in the council’s approach to arresting Darfur suspects? Is it not starkly clear that the regime in Khartoum will change only when our pressure includes the enforcement of outstanding Security Council resolutions imposing targeted smart sanctions on the architects of the continuing suffering and misery of the people of Sudan? If we delay, they prevail—and millions suffer horrifically.

The national action plan forms the broad basis of work that the Foreign Office, the Department for International Development and the Ministry of Defence do. There are six focus countries where the action plan will be delivered. I do not think that it has been split between Commonwealth and non-Commonwealth countries—it is a broad plan that works across the world.

My Lords, is there a specific budget to cover the need for comprehensive in-country consultations with local women’s organisations?

There is no specific budget but specific work is being done. Money is available, but it is not ring-fenced in that way. We would not say, “That money has been put aside to consult with women’s groups on the ground”. However, money is available to consult with women’s groups on the ground. It has certainly been done in Libya and in Tunisia. It was, and is, also being done with women from Syria, as happened in the lead-up to the Geneva II discussions.

The right reverend Prelate makes an incredibly important point. Faith as part of the solution to dealing with sexual violence was an important element of the summit, and we hosted two very successful fringe events. One involved a coalition mainly of church leaders, called We Will Speak Out. The other was at ministerial level where we hosted Sheikh Bin Bayyah, the Archbishop of Canterbury and the Archbishop of Westminster, Cardinal Vincent Nichols, and discussed the way in which we can get faith communities to be the first point of support in both providing protection and changing the culture that perpetuates the culture of impunity.

My Lords, what was the Government’s response to the call from the United Nations for a further 100,000 resettlement places for the victims of the terrible turmoil she described in Syria? When the UK has promised to prioritise help for survivors of torture and victims of violence, is the Minister satisfied with the fact that as of 24 June only 50 refugees have arrived in the UK?

My Lords, the noble Baroness makes an incredibly important point. The instinct of any of us when we hear these individuals’ stories is to provide a place of shelter, but I think the noble Baroness will acknowledge that since 6.4 million people have been internally displaced and 2.8 million are now refugees in neighbouring countries, there is no way that we could resettle all of them. We must make sure that we work with the most vulnerable and provide a settlement opportunity for them. First and foremost, politicians must continue to work for a political solution, because it cannot be that these people remain displaced and it must be that one day they are allowed to return to their own homes.
