To ask His Majesty’s Government, following further airstrikes by the United Kingdom and United States against Houthis in Yemen, in what circumstances Parliament should be consulted before military interventions overseas.

My Lords, the Government have acknowledged the need to notify Parliament of significant military action either before or after the event. In regard to the recent air strikes in Yemen, on both occasions the Prime Minister updated the House of Commons and I updated your Lordships’ House at the earliest opportunity. Decisions on whether to consult Parliament in advance of military action reflect a number of factors including, critically, the security of our Armed Forces and that of our operational partners.

I am grateful to the noble Lord the Leader of the House for that, for his Statement yesterday and for the updates that he describes. However, he will note that the Cabinet Manual that was published in 2011 by the then Prime Minister, the noble Lord, Lord Cameron, observed a developing constitutional convention for prior Commons consultation where possible. The noble Lord sets out moments when that might not be possible, but I wonder, given the relevant expertise from across this House, and given that the noble Lord, Lord Cameron—as he is now—is Foreign Secretary, whether this might be the place to look at reviving that constitutional convention and looking at checks and balances for moments even when the House of Commons may not be consulted.

I make no comment about that, but people increasingly use debit and credit cards. They carry them around on their person. In fact, some people now use their phones for everything. People are paperless even in relation to their statements and so on. I wonder whether that was something the noble Lord considered, because I am so with him in the thrust of what he is trying to achieve.

My Lords, first I will address what the noble Baroness said in the opening part of her remarks, which will strike a chord with the whole House. Frankly, there is not a single Member of this House—including me, if I may say so—who will not have experienced peculiar personal sadness in the unparalleled circumstances of Covid. We should take that as a fact to which we pay due honour and respect. So far as the event to which she alludes is concerned, I can only repeat that investigations are taking place and the findings of those investigations will be made public.

My Lords, the Minister rightly acknowledges—I take him at his word—that the rule of law means one law for everyone, whether Ministers, officials or ordinary citizens. Of course, ordinary citizens do not get to appoint their ethics adviser to investigate when they are accused of criminal offences. When he thinks it appropriate, could the Minister please explain for the benefit of those outside this place what level of prima facie evidence is sufficient to justify cutting out the ethics adviser and going straight to a police investigation?

My Lords, as I said in the Statement, as with any internal investigation, if evidence emerges of what was potentially a criminal offence, the matter will be referred to the police. The noble Baroness is quite right that matters relating to adherence to the law are properly for the police to investigate, and the Cabinet Office will liaise with them as appropriate.

My Lords, the Government are committed to making registration as easy as possible, and we encourage everyone eligible to register to do so. I stand by those earlier statements. Due to internal processes, there have been delays in implementing the changes to the letter. There are HMRC processes in place to implement change that involve HMRC’s IT partners, but I repeat that HMRC has assured us that this matter will be implemented by October.

We read that the Government are so keen to encourage young adults to vaccinate that we are all to be threatened with domestic Covid ID. Can the Minister confirm that they are just as keen to encourage young people to vote? If that is the case, will the Government explore automatically registering them for the electoral register at the moment when an NI number is issued?

My Lords, the Government do not support automatic registration, but we certainly wish to see everyone register and exercise the right to vote, for which so many people have made sacrifices for so long. Our Register to Vote website is used by many young people, with almost 10.8 million online applications having been submitted by 16 to 24 year-olds since the service was introduced. I remind noble Lords that the number of people who have voted in recent elections has continued to grow, and that is hugely welcome.

My Lords, I said in my Answer that work on the review continues and therefore there should not be an assumption. Before the Private Notice Question was agreed—which of course I have no objection to—my right honourable friend the Chancellor of the Duchy of Lancaster laid a Written Ministerial Statement, and I laid a Written Ministerial Statement, on the current position. It is before your Lordships and shows the current position, and I cannot add further to what is in that Statement.

My Lords, given the enormous constitutional and ethical concerns about domestic Covid status certification in particular, can the Minister guarantee that there will be maximum transparency during the course of this review and commercial lobbying for such certificates, and that the Government will do their utmost to avoid any such scheme developing informally and non-legislatively, with the according risks for discrimination, privacy and so on going forward?

My Lords, as I said, and as is set out in the Written Ministerial Statement at greater length, ethical and equalities considerations are obviously among those being considered in the review. I can therefore confirm that those matters are being considered.
