Lords ChamberMy Lords, I thank the Minister for repeating the Statement made in another place earlier today, and for our meeting yesterday when she gave notice of the Statement. I take this opportunity to thank all those who sat on the scrutiny committee of the draft Bill for their time and commitment and for the comprehensive report and recommendations they produced. As the Minister said, the Bill has not yet been finalised, but we welcome some of those areas we know will be included. We hope that it will begin to transform the way we deal with domestic abuse in the future.
While we agree that the establishment of a domestic abuse commissioner is key, we will seek assurances around the authority and the funding they will be given. Can the Minister give an indication of the role and the independence of the commissioner? We very much welcome improvements in proceedings in family courts, which include prohibiting cross-examination of victims, but we want assurances that in the case of custody and access to children, all victims will be treated equally and courts will look at cases individually. I am pleased to see that controlling and coercive behaviour will be included in the definition of domestic abuse in Northern Ireland. This change across the rest of the UK has been instrumental in changing the outcomes for many victims, and we are very pleased to see that this will be extended to Northern Ireland.
We are aware that the Government are committed to helping migrant victims of domestic abuse, and we welcome their intention to review this. We must ensure that such women are eligible to apply for indefinite leave to remain, irrespective of the type of visa they are residing under, and that they will have access to public funds. It is my understanding that although the Bill will not be gender-specific, as has been called for by some in the sector, commissioning services will be, which is welcome and a step towards ensuring that all victims of domestic abuse receive parity in the provision of support services.
We also believe that the Bill will need to be strengthened in terms of the impact of domestic abuse on children, both as victims and as witnesses. Not focusing enough on the impact this will have will also have a knock-on effect on the specialist support made available to them. Can the Minister say what plans there are to strengthen this area of the Bill to ensure that services for child victims are widely available, robust and adequately funded?
We all know that there have been cuts to the funding of women’s refuges in recent years, meaning that they have had to close; women are being forced to stay in abusive relationships because they have nowhere else to go. I am pleased to know about the ongoing consultation on the funding stream, as the Minister mentioned, which ends on 2 August.
It is good to see that the Government are committed to bringing forward amendments to implement their proposals to improve support for victims and their children in women’s refuges in England. I am aware that the women who run these refuges are looking forward to these proposals and welcome them very much.
Assurance from the Government is needed so that this Bill will ensure that funding is available to enable women to leave their family home and have a safe alternative for themselves and their children. The Minister mentioned that the Bill included the necessary provisions for all parts of the United Kingdom to meet the requirement of the Istanbul convention. I am very pleased to hear that commitment. Will the Minister confirm that the ratification will take place as soon as possible after the Bill completes all its stages and becomes an Act of Parliament?
This Bill was a commitment made by the outgoing Prime Minister in her final Queen’s Speech just over two years ago. While this has arrived very late in her leadership and without time for her to see it through, I am pleased that she has finally set things in motion for this long overdue and much-needed legislation. Can the Minister give an assurance that whoever becomes Prime Minister next week will have the same commitment to this Bill and will guarantee that it will be robust and that funding will be available to fulfil everything it promises?
Can the Minister give an indication of when the Bill will arrive in your Lordships’ House? It is our intention to work with the Government and the sector to take this Bill into legislation. No doubt there will be challenges, but hopefully we can have a sensible debate, negotiation and compromise. We will help to form a lasting piece of legislation that will benefit all victims of domestic abuse. This Bill is a great opportunity for the Government and for all parliamentarians to transform the domestic abuse agenda. It is our duty to ensure that we all get this right. Between us, I am sure that that is possible.
My Lords, on behalf of these Benches I welcome this Statement and thank the Government for early sight of it. I have had the privilege of sitting on the pre-legislative scrutiny committee on the draft Bill and fervently hope that we will eventually find all its recommendations—with the possible exception of polygraph testing—on the face of the Bill.
Domestic abuse is indeed a scourge on our society. I wish that speedier progress had been made since this Bill was first announced in 2017. I understand that our Prime Minister, who I know is passionate about these issues, now wants to speed things up to ensure that this Bill forms one of the key achievements of her legacy—and rightly so. In the Statement, the Minister talks of “further response” to other proposals later in the year. So, like the noble Baroness, Lady Gale, I would like to know the timescale for this Bill. When can we hope to see it on the statute book?
I particularly welcome the Minister’s comments on migrant victims and look forward to reading the Government’s updated asylum support policy. Might this find its way into the Bill? It is hugely important that asylum-seeking women and those whose immigration status is uncertain are not scared away from reporting abuse, and that not having recourse to public funds will not make them stay in a violent, abusive situation. I hope that the Government will accept the recommendation that there should be a firewall between reporting the crime, accessing report services and immigration control. Everyone deserves justice, no matter what their immigration status.
British citizens living in Northern Ireland are entitled to justice and protection too, so I am delighted at the Minister’s announcement that there will be a bespoke domestic abuse offence for Northern Ireland. On the committee, we recommended a sunset clause, so the full Bill should apply in Northern Ireland until the Assembly brings in one of its own. So it will be interesting to see what the bespoke offence will contain. If the Minister can enlighten the House further this afternoon, that would be very helpful.
I also welcome measures to tackle perpetrators’ behaviour, but measures also need investment in a wider range of perpetrator programmes, backed by the resources to carry them out. I am glad that the Government have acknowledged that children and young people who witness abuse are victims, too, and I hope that they will be afforded the same priority for accommodation, health and education services as our looked-after children. There is no word, however, on the recommendation on a gendered definition of abuse and the inclusion of other categories of victim, including disabled people, people abused by their so-called carers, and victims of FGM, forced marriage, modern slavery and so on.
We also recommended that the domestic abuse commissioner should have stronger powers and report to the Cabinet, not the Home Office. These and many other issues will become apparent as we progress through the stages of the Bill.
I end by welcoming wholeheartedly the great progress that has been made so far. The Statement asserts that the measures now allow for the Istanbul convention to be ratified. That will be a great day for human rights in Britain.

Lords ChamberMy Lords, how do you summarise that lot? I thought I would group them today, but you cannot group these speeches—they are too individual, and of course they reflect the individuals who made them. It has been a privilege to sit here and listen to some of the really erudite and sometimes quite passionate things that people have said.
The noble Baroness, Lady Williams of Trafford, started off by talking about the £5 million given for events last year. I ask her: what about this year? Can the Government perhaps find another £5 million down the back of the sofa? I hope we may be able to do something like that again this year.
The noble Baroness, Lady Gale, talked about the voting system in Wales being the best in the UK. Of course, it is not the first past the post system, which works against so many different minority groups in this country. If it were the additional member system and we got fair votes, we could have a more representative and wider democracy.
I am sorry to intervene on the noble Baroness, but the fact is that most women in the Welsh Assembly got elected under the first past the post system. The PR system did not magically bring more women into politics.
I am grateful for that intervention. I do not think it destroys the point I was making, but I congratulate those women.
My noble friend Lady Hussein-Ece focused her comments—very rightly, I am sure—on BAME women, particularly Muslim women. She made the valid point that Muslim women are not all victims. There are some hugely educated, talented women who can thrive, make a superb contribution and enrich our society.
I particular loved the comments of the right reverend Prelate the Bishop of Portsmouth, who said we are not to talk about female bishops because they are all bishops. It does not make any difference; they are bishops who happen to be women. I had already written down “female bishops”, then I quickly scrubbed it out. He talked about it not all being about women doing what men do. We had a lot of people talking about women in STEM and doing men’s occupations, but he rightly said that it is also about men doing what women do. When we are all doing a similar kind of job, using the talents we undoubtedly have, we will get a much fairer society.
The noble Baroness, Lady Anelay of St Johns, talked about the Inter-Parliamentary Union and the situation in Ethiopia. She said there is still hope—particularly with the actions of the brave Prime Minister—and still problems to deal with, but that progress is being made, albeit slowly. That is always the way; progress always seems to be slow.
The noble Baroness, Lady Jenkin, talked about the 50:50 movement, #AskHerToStand, and the successes and setbacks in the Conservative Party. I pay tribute to the hard work of many Conservative women and the efforts they have made in their own party. There are champions in the other parties too, of course; other champions are available.
The noble Baroness, Lady Donaghy, referred to winning the right to work far harder than the men. She is not the only one who is knackered. I am also knackered after trying to accommodate all the wise words that we have heard during the debate. I am sure the Minister will wish to comment on the importance of gender equality impact assessments for all new legislation.
The noble Baronesses, Lady Seccombe and Lady Bull, talked about how lucky we are to be who we are and where we are at the time we are in, and referred to giving a hand-up to our sisters elsewhere in the world who are not so fortunate. The noble Baroness, Lady Bull, said we are lucky, yes, but we still face challenges at home and in the world. Like my noble friend Lady Hussein-Ece, she said that we are not what we wear; that we do not need to be judged by whether we are wearing a scarf or by the way we are dressed. However, it is the way of the world, unfortunately.
My noble friend Lady Miller referred to the role of women in war and in peace and the fact that there is a direct ratio between women’s involvement and the degree of danger and fear, particularly of nuclear attack. She related inspirational stories about the Greenham Common women all working together.
The noble Baroness, Lady Berridge, has a magic number—228—the number of women Peers. I have a magic number too—167. I was the 167th woman ever to be elected to the British Parliament, which really puts matters into context.
The noble Baroness, Lady Armstrong of Hill Top, referred to women who do not have settled status—a hugely important area—having no recourse to public funds and the help that all abused women should receive regardless of their status.
The noble Baroness, Lady Meyer, gave an inspiring description of her brilliant mother—a Russian exile who faced great tragedy—and she also referred to how lucky we are.
My noble friend Lord Hussain, referred to the plight of Kashmiri women and described a harrowing picture of half-widows, their search for their missing men and mass rape. It is a terrible situation and I commend him for the work he does.
I also commend the noble Lord, Lord Loomba, and the work of the Loomba Foundation and the importance of the priority given to women all over the world.
The noble Baroness, Lady Hodgson of Abinger, asked where the women are in the peace process. It is wrong to exclude 50% of us from the process; we are the peaceful 50%.
I realise that I have now had seven minutes. There have been many other wonderful contributions—people have sat here for a long time today—and I particularly enjoyed those of the noble Baronesses, Lady Crawley, Lady Redfern and Lady Rock, and the noble Lord, Lord Taylor of Warwick, in talking about the economic impact of women. We can work together to create better chances for women. If men are allowed to write all the algorithms we will get what they planned for, and we do not need that.
I finish by again referring to the words of the noble Baroness, Lady Williams, on this year’s theme—“Balance for Better”—and government planning for great things, including on period poverty, on which I have campaigned for a while.
It occurred to me that we have a very special talent as women: we are very good at working together. Shame on us if we do not work together and make sure that we use our combined talent across parties, for no party and for all parties to achieve success for us and our male counterparts—I particularly loved the contribution by the noble Lord, Lord Crisp, which was well worth listening to—so let us get on with it. We can do this together.

Lords ChamberMy Lords, I thank the Minister for repeating this Statement this afternoon. As he said, much more work needs to be done. It is good that we now have the Government’s race audit, although it is a shame it was delayed from its original release date in July. I am not sure why the Government made that decision to delay it.
The outcome of this race audit cannot come as a surprise to the Prime Minister. After all, in 2010 she wrote to the then Prime Minister that there is a real risk that women, ethnic minorities, disabled people and older people would be disproportionately affected by proposed cuts. But now, as Prime Minister, knowing full well the damage that would be caused by these cuts, she has said nothing to remedy the problems she foresaw as Home Secretary and has in fact made them worse.
We need solutions and a sustained effort to really tackle these injustices, and the Government are simply not yet providing those. I was pleased that the Minister mentioned the mentoring schemes. It is always good to have mentoring schemes for people, but we believe they are not ambitious enough. The closure of Sure Start centres and the closure of Connexions were mistakes made by this Government—knowing full well the disproportionate effect that these closures would have on groups with protected characteristics.
I have a number of questions for the Minister. Will he confirm how many groups and organisations were consulted as part of the race audit? Will he confirm whether there are plans to extend the audit’s analysis to devolved regions such as Wales, Scotland and Northern Ireland? Can he confirm for the House what steps the Government will take to tackle the racial disparities exposed in this audit and other reports released recently? What is their timescale for taking action, and what framework will they be using to judge improvements?
In the last general election, Labour issued a manifesto to tackle problems of discrimination. We said we would introduce equal pay audit requirements on large employers, implement the Parker review recommendations to increase ethnic diversity on the boards of Britain’s largest companies, and enhance the powers and functions of the Equality and Human Rights Commission, which is what we plan to do when we are in government.
I hope the Minister is able to provide us with answers to these questions today. We need a Government willing to take decisive action to tackle racial inequalities and I look forward to what the Minister has to say about how this audit will be implemented.
My Lords, this audit shines a light on the prejudice and bias that continue to blight the lives of black and ethnic minority members of our communities. It lays out the challenges we face as a society, which cross party lines. Mrs May, our Prime Minister, commissioned this audit and she cannot now shy away from tackling the causes, which are cuts to public services and a shrinking state. This comes alongside another report, by the Runnymede Trust, on the impact of austerity on black and minority ethnic women in the United Kingdom. It shows that BME households are being hardest hit by austerity, with a drop in living standards of 19.2% for black households and 20% for Asian households.
I have some questions for the Minister. Will each department be required to put forward a plan setting out why these disparities exist and how they will close the gap? What are the next steps? For example, will there be a Cabinet committee looking at this? Given the Prime Minister’s commitment to this cause, perhaps she might chair it herself. Finally, the Equalities and Human Rights Commission’s budget has been cut by almost 70% since it was created, and its current budget will be cut by a further 25% over the next four years. The Government are talking the talk by publishing this audit—but will they walk the walk and make available the resources to tackle these terrible problems that we face?
