My Lords, the Minister’s Answer just now was very interesting, given that the Post Office Limited: Shareholder Relationship Framework Document says at paragraph 7.6 that

“the remuneration of all Board members will require approval by the Shareholder”,

and remuneration that exceeds the threshold must also be approved by the Chief Secretary to the Treasury. Can the Minister say what bonuses were approved after 2015? Have any additional approvals been required by the Chief Secretary to the Treasury since 2015? If the Minister does not have this information, I would be grateful if he wrote to me with it.

My Lords, a Telegraph article reported that a traffic marshal working 60 hours a week on a day shift for 52 weeks is paid £65,613 a year. If that is the case, they are the best traffic marshals/security officers in the country. I wonder whether this is more an issue about each level of subcontractor adding on 20% for management, because every traffic marshal and security officer I have ever talked to has been on the minimum wage of £10.42 an hour, and they have to pay for their own training and their own DBS badges in most instances. Will the noble Lord please ask the Finance Committee to look at this and make sure that Parliament is not being charged three or four times for the management of these people, and that they are being paid an appropriate amount and not being forced to fund their own training and their own security badges?

My Lords, when the inquiry reports were published in November, the air chief marshal said that it was vital to challenge unacceptable and inappropriate behaviour and to

“stop, challenge, educate, and if necessary, report situations”.

What training is there for all military and MoD personnel to understand how to intervene and, in the words of the report, to stop this “bystander culture”?

My Lords, while it is good to hear about the audit, five months ago respected oncologist Professor Carlo Palmieri from Liverpool University estimated that the number of cases of metastatic breast cancer in England increased from more than 48,000 in 2019 to more than 57,000 in 2020-21, resulting in an increased need for clinical activity and work. What planning, design and recommissioning of appropriate cancer services have been undertaken by the NHS? Have the Government provided the extra resources needed to deliver clinical services to these patients this year?

My Lords, in reply to the question from the noble Baroness, Lady Hunt, the Minister referred to the new GID services at the Evelina and GOSH. But the original proposals were for regional clinics in Manchester and London—so when will the Manchester clinic open? Since March of this year, the waiting list and all new referrals are being held by the Arden and Greater East Midlands commissioning support unit. There is real confusion about how this list will be integrated with the existing case load as the new services open. Can the Minister explain what will happen? If he does not have the answer to hand, please will he write to me?

My Lords, to follow on from the question by the noble Baroness, Lady Blackwood, last week the European Congress of Clinical Microbiology and Infectious Diseases published a report on the rise of diphtheria cases, noting that:

“Linked to an increase in migrant arrivals via small boat in … 2022, the UK experienced a sharp increase in diphtheria cases”.


Its report recommends that border officials and doctors should all have training on screening and identification of symptoms of infectious diseases, such as diphtheria and others outlined by other speakers. Will the Government implement this specific recommendation? Can the Minister say whether, on arrival, all asylum seekers are now offered a full health check and vaccination with doctors?

My Lords, Lady Masham, who is so sorely missed, won gold in swimming and silver in wheelchair table tennis at a number of Paralympic Games. She was a passionate champion of disabled sports at all levels. While there is a good range of grass-roots sports for the disabled, including wheelchair rugby, seated tai chi, disabled angling, para dance and all-ability sports such as sitting volleyball, their spread by locality is very patchy, meaning that many disabled people have no chance to play. What steps are the Government taking to ensure that all disabled people can access grass-roots sports in their area?

My Lords, one of the most shocking parts of the review from the noble Baroness, Lady Casey, was, yet again, the lack of information sharing and joined-up working between key bodies. That has been an issue at a number of serious and tragic events, including the Manchester Arena bombing. What are the Government doing to ensure that all relevant responsible bodies—whether statutory, voluntary or, as in the case of football, business—including the police, share information before, during and after events to keep people safe and to learn lessons after each event?

My Lords, the data in the National Police Chiefs’ Council report on fixed penalty notices issued in England and Wales shows the different approach to FPNs taken by forces. For example, Wiltshire and Gloucestershire issued less than half the number that Sussex and Norfolk issued. Will the reasons for those different rates be looked at, especially if persuasion was a more successful approach than penalties, so that lessons can be learned for the future?

My Lords, the Royal College of GPs reports that since 2019, GP clinical administration tasks have risen by a shocking 28%. GPs say that it would make a significant difference if hospital consultants could refer patients directly to other consultants, rather than patients having to come back to GPs and then be redirected. The back-office functions for repeat prescriptions take an ever-increasing amount of their time, and GPs are not in control of either of these processes. As a matter of urgency, will the Minister investigate how to reduce some of this bureaucracy so that GPs have more time to see their patients?

My Lords, what assessment has been made of the T3 Prescribing Survey Report, which was published on 13 May, and of the reported failure by clinical commissioning groups to follow NHS England’s national guidance, Prescribing of Liothyronine, published in 2019, which shows that 58% of CCGs are still not complying with the national guidelines? Can the Minister intervene? This seems to be a ridiculous situation.

My Lords, when Sandra Francis of Oswestry had a cardiac arrest a few months ago, her son had to do 35 minutes of CPR waiting for an ambulance delayed in handovers at A&E. Sadly, she died. Her son said:

“An ambulance should be a way of getting someone to hospital. It shouldn’t be a waiting room sat at the hospital.”


He is right. Ambulance delays are the very visible part of the A&E crisis and the wider shortage of hospital beds, doctors and other healthcare professionals. Again, I ask the Minister: what are the Government doing to remedy this much wider emergency that is causing preventable deaths right now?

My Lords, the Children’s Society’s Good Childhood Report 2021 shows that one in seven girls and one in eight boys is particularly unhappy about their appearance. Young people who are not happy with their lives at 14 are more likely than others to have symptoms of mental health issues by 17, including instances of self-harm and suicide attempts. Despite the Government’s promises of future funding for mental health support for schools and CAMHS, it is clear that young people are not getting that initial front-line support that they need now. How soon will there be mental health counsellors in every secondary school?

My Lords, over 30,000 passenger-facing rail staff have completed the disability training required by the Office of Rail and Road. As a wheelchair user, travelling by rail is noticeably safer as a result of the excellent assistance train staff provide. The Government want to allow the use of agency workers in place of striking station and train staff. If agency staff have not completed the regulator’s required safety assistance training, would that breach the public sector equality duty? Would disabled passengers be safe in such circumstances?

My Lords, mission 7 of the Government’s White Paper on levelling up in the UK aims to narrow the gap in healthy life expectancy by 2030. However, there is no mention in it at all of Gypsy, Roma and Traveller communities. Given that the life expectancy of GRT people is 10 to 25 years less than that of the general population, can the Minister say what the Government are doing to target this disparity?

My Lords, the observational study by academics of the 2018-19 wave of the NHS diabetes prevention programme, published by BMC Health Services Research, observed disengagement within sessions when patients reported that information was difficult to understand, and when there were very large group sizes and problems with session scheduling. This is all before Covid. Problems with the course will inevitably make patients more likely to drop out but 50% is shocking. Now that this diabetes prevention programme has been rolled out across England, have these specific problems been addressed?

My Lords, I go back to the previous question: this ADASS survey shows that almost 170,000 hours of homecare a week could not be delivered for the first three months of this year, because of a shortage of care workers. This is a sevenfold increase on the previous year. The changes proposed to the social care system will not increase the rates of pay for social care workers, at the moment, to make it attractive to others, who can work in hospitality. But there is a dire need for people now. What will the Government do right now to help solve this crisis?

My Lords, 12-year-old Oliver King died suddenly of sudden arrhythmic death syndrome, a condition that kills 12 young people under 35 every week. The Oliver King Foundation has been campaigning for a defibrillator in every school. Last September, the Secretary of State for Education said this should happen. The DfE has been working with the NHS to make this possible, but the NHS Supply Chain website says that, in December last year, only 3,200 were advantageously procured for schools to then purchase. Can I ask the Minister: is the NHS expanding its procurement to enable all 22,000 schools to be able to purchase defibrillators now and not just when the school is rebuilt?

My Lords, the shingles vaccine is available in the UK only to those aged between 70 and 79, whereas in the USA it is automatically available to everyone over 50. NICE data says that shingles is much more prevalent in those with a weakened immune system, yet they are not offered it until they are 70, resulting in severe cases of shingles, possible sight loss and other serious consequences which could have been mitigated by an early vaccine. Can the Minister say when Shingrix, the shingles vaccine suitable for the immunocompromised will be automatically offered to this group of patients?

My Lords, too often people think only of outcomes that are about survival. Children with cancer are treated with therapies that were tested on and designed principally for adults. Cancer Research UK knows that these treatments can and do have serious long-term impacts on these young growing bodies and that parents often struggle to get the support they need. What is being done to improve follow-up care for childhood cancer survivors: for their education, their health and in particular their mental health?

My Lords, the Civitas report shows that UK deaths from haemorrhagic strokes have increased by over a third over the last nine years, compared to an average fall of 5% elsewhere, with a stark increase in deaths from 2017 onward. This coincides with the Government’s introduction of category 1 and category 2 calls for ambulance services, and the downgrade of suspected strokes to category 2. South Western Ambulance Service figures have shown that the current ambulance wait for category 2 is now one hour and 20 minutes. Will the Government now move strokes into category 1 as a matter of urgency?

My Lords, the coroner noted that the NHSI investigation had not used expert investigators and in some cases used only desktop research, looking at case papers, failing to interview key staff witnesses and take a longer view. Given that HSIB uses independent specialist teams and provides a safe space for staff and whistleblowers to talk, is there not a case for asking HSIB now to do its own investigation into this?

My Lords, I too congratulate the noble Baroness, Lady Thornton, on her outstanding contribution in her health Front-Bench role. From these Benches, it is always a pleasure to work with her and we look forward to continuing with her in her new role. Yesterday, the CQC served the Norfolk and Suffolk mental health trust with an improvement notice, reporting that staffing levels remain unsafe, waiting lists were long and, on average, 49 people per month died within six months of contact with that trust. There are staff shortages across NHS mental health services, so can the Minister say what the Government will do to ensure that there are enough qualified mental health professionals in the NHS?

My Lords, the Dasgupta review said that it was vital that UK aid assists countries with population and family planning issues because of the biodiversity implications. The Government’s response last June confirmed that they would continue to prioritise aid for family planning. However, following the Chancellor’s cuts to ODA in November, there is a £132 million reduction in grants for family planning—that is a 60% cut which will result in 9.5 million fewer women and couples receiving any family planning services. How does this match the commitment which the Government gave only five months earlier?

My Lords, I too commend the noble Lord, Lord Rooker, for his tireless campaign. The continuing consequences of Ministers not introducing the new legislation are that around 430 children in the UK will be born with spina bifida each year until folic acid is added to bread flour. What will the Minister—not his officials—say to the families of these babies to explain why this was just not urgent enough to put into legislation, despite the Government’s decision to do so and despite elections? Officials are not always side-tracked by elections. What will the Minister say given that those children will need continuing health support for life?

My Lords, I too want to join in congratulating the noble Baroness, Lady Hollins, on the Bill reaching the end of its legislative passage today. Her expertise and commitment to people with Down syndrome and other learning disabilities is well known and much respected—and not just in your Lordships’ House.

I rise to speak on behalf of some of the Peers who raised concerns about this Bill at Second Reading, particularly the noble Baroness, Lady Neville-Jones, and the noble Lord, Lord Farmer, who cannot be in their place today. I will start by saying what is good about this Bill. It has raised the profile of Down syndrome, which, speaking as someone with a nephew with Down syndrome, I say is a good thing and long overdue.

Your Lordships’ House will remember that eight of the 12 cross-party speakers noted that, if the Bill had the powers which its promoters suggest, there risks being a hierarchy of learning disability. This has already caused a split between families with learning disability, all of whom still need to fight for the limited resources to which the law says they are entitled. I am pleased to hear the noble Baroness, Lady Hollins, expressing her desire that the objectives of this Bill are extended to other people with genetic conditions and learning disabilities. I am sure that she and I—and others —will be looking to future government Bills to make a real difference to the lives of all people with learning disabilities.

I will not go through the details of the concerns we had before, because now is not the time. One of my great concerns is that the hopes of many families of people with Down syndrome have been raised beyond the powers in this Bill. I hope that the Minister will ensure that those aspirations are met, not just for people with Down syndrome but for the wider learning-disabled community. I wish this Bill well.

My Lords, the Prime Minister’s foreword to the Ministerial Code states that

“we must uphold the very highest standards of propriety … The precious principles of public life enshrined in this document—integrity … accountability, transparency, honesty … in the public interest—must be honoured at all times.”

The code of conduct and the Government Communication Service proprietary guidance are silent on the use of private emails and social media accounts by Ministers. If the Minister argues that no rules have been broken and that there is private guidance, should not the Ministerial Code be updated as a matter of urgency?

My Lords, research by Habinteg has shown that the lifetime homes standard—that is, part M4 category 2—costs only £1,000 extra on new build, reducing the need for expensive adaptations later in life and keeping people independent. The LGA says that, at the current rate of housebuilding, it will take 2,000 years to achieve this standard. Worse, under 2% of new housing is required to be built to category 3, for wheelchair users, when a minimum of 10% is needed. How many units that meet category 2 and 3 have been built in the past five years?

My Lords, surveys of parent carers during the pandemic by the Disabled Children’s Partnership reveal that more than 70% of disabled children were unable to access their pre-pandemic levels of therapies and health services, and many of their conditions regressed during the pandemic. How do the Government plan to use wider NHS recovery funding to meet the acute health needs of disabled children and young people?

My Lords, Public Health England says that around 246,000 people are likely to have some form of gambling addiction, but last year, only 668 people—with the most severe addiction issues—were referred to the gambling clinics because of a lack of resources. Even with the extra clinics over the next three years, will this number of clinics be able to treat the top 10% of patients, which is 24,000 people? If not, when will the service expand to help them too?

My Lords, despite the Minister’s comments at the beginning of this Question, Nature published a report on 18 March saying that while vaccines protect against the omicron subvariant, their effect really does not last long. Will the Government place an order for the recently approved Evusheld as a pre-exposure prophylaxis drug, which Ministers have promised the very vulnerable since July last year? What steps are the Government taking to protect the severely immunocompromised in the longer term, including in their decision on who will be eligible for free lateral flow tests?

My Lords, the Suzy Lamplugh Trust reports that it repeatedly sees police officers trying to apply for other protections, such as non-molestation orders, instead of stalking protection orders. Given that half of stalking cases are not from domestic abuse settings, if you are being stalked by a stranger or a work colleague—not an ex-partner—non-molestation orders would be of no use. What will the Government do to change this? Otherwise, non-domestic stalking cases will continue to be ignored.

My Lords, at the publicly streamed evidence session of the All-Party Coronavirus Group on 1 March, we asked some members of SAGE to outline SAGE modelling for the lifting of restrictions in the living with Covid plan. They replied to us that they had not been asked to model any such plans by Ministers. Given that cases, as the noble Baroness, Lady McIntosh, said, are now 221,000 a day, with active cases of more than 2 million and hospital admissions rising across England, exactly what modelling advice did the Prime Minister and Secretary of State for Health and Social Care take?

My Lords, the provision of high-quality, personalised care in residential care settings is likely to reduce the chance of complaints being raised in the first place. The Skills for Care workforce review showed that only 44% of care staff have any training on dementia. Will the Government commit to all social care staff receiving tier 2 training in the dementia training standards framework?

My Lords, the Government have inserted in the Health and Care Bill, which is currently going through your Lordships’ House, a clause on reciprocal healthcare agreements beyond the existing arrangements with the EU, EEA and Switzerland, because we know they work well. Will reciprocal healthcare agreements form part of the trade talks with India, Greenland and Israel?

My Lords, last year, Sir Kevan Collins resigned when the Government allocated only 1/10th of the funds he said were needed to deliver a real post-pandemic education recovery plan. At £50 per pupil, he said it was “feeble”. In the light of the shocking delayed learning figures that the Minister has just outlined, will she undertake to review and increase the funding?

My Lords, I support Amendments 237, 238 and 239 in the name of the noble Baroness, Lady Bennett of Manor Castle, which aim to ensure that private providers are regulated, especially those using obfuscatory financial structures, instruments with inter-company loans and large amounts of debt. They should be fully transparent about those arrangements. She was right to highlight the excellent reporting of the Financial Times on this, along with the financial editors and journalists of other papers.

The typical small business social care home owner does not fall into the category I have just described. The problem in the sector is the private equity providers who decided to start buying up care home groups because they felt that the assets could be milked to provide healthy-looking returns for them. This differs from those homes borrowing in order to, perhaps, buy new homes to enlarge their group; what is happening here is purely financial instruments to benefit the directors and investors. Typically, private equity-backed providers spend around 16% of the bed fee on complex buyout debt obligations. The accounts of Care UK show that it paid £4.1 million in rent in 2019 to Silver Sea Holdings—a company registered in low-tax Luxembourg, which is also owned by Care UK’s parent company, Bridgepoint.

These kinds of buyouts are also associated with an 18% increase in risk of bankruptcy for the target company. In the case of Four Seasons Health Care, heavy debt payments contributed to the company’s collapse into administration in 2019. Two of the other largest care home providers in the UK, HC-One and Care UK, have also undergone leveraged buyouts and, as a result, their corporate group structures remain saddled with significant debts. Some of these types of company are also struggling to provide the best possible care with their overall CQC scores—so it is affecting the lives of the most vulnerable patients.

The Office for National Statistics says that 63% of care home residents are paid for by the public purse. Surely the Government must have a duty towards the public purse. It is not acceptable for the public purse to pay for these complex financial arrangements that are intended to provide not care or capital for the growth of a care business but purely a larger return for directors and shareholders. These amendments would provide for transparency and accountability and an assurance that the public purse and the private payer are not being taken for a ride.

My Lords, I too echo the gratitude that this House and this country shows to Jonathan Van-Tam. Four months on, there are still severely clinically extremely vulnerable people eligible for a third primary dose and then a booster who cannot book their booster because the data system still cannot record this. Many CEV young children with underlying conditions are still waiting for their vaccines, as well as for guidance on how they, their families and their schools can keep them safe from Covid. This is important because there are now more children in hospital with Covid in the last three weeks than in the nine months of the first wave. Please can the Minister say how these people, who the Government say need the vaccines right now to keep them safe, can get them?

My Lords, my noble friend Lord Jones of Cheltenham cannot be in his place today but has asked me to start by saying something on his behalf about Sir David Amess. As noble Lords have already heard, my noble friend Lord Jones was himself attacked, and his aide and friend, Councillor Andy Pennington, was killed, at a constituency surgery in 2000.

My noble friend wants me to say on his behalf:

“To learn David’s life has been taken is the most unimaginable shock. I simply can’t believe this has happened again, and to the kindest, most decent of men.


He was a mate, David. We were on opposite sides of every debate, he voted the wrong way on most things and disagreed with me on just about everything. We were in different parties but always got on well. He was a wonderful personality and worked exceptionally hard for his constituents.


He was a proper parliamentarian, a dedicated public servant and a lovely man. If he bumped into me when he had visitors to the House, he’d say, ‘Oh and this is my friend Nigel, he was attacked, you know? Do you remember, he was on the television?’ I’m appalled that he has suffered like this.


David, like my friend Andy Pennington and I, was just trying to do the job to the best of his ability. Our democracy relies on an open channel between those in power and the people who we represent. It’s vital to be able to meet people face-to-face so they can feel we are here and working for them.”


Turning to my own tribute, I first got to know Sir David when I joined your Lordships’ House a decade ago and he quickly nobbled me—there is no other word—to join the all-party group for fire safety and rescue, which he chaired; I really did not have a choice. He had been a friend of my father, Tim Brinton, having met when they were MPs together, and David knew that my stepmother, Jeanne, had been a Conservative chairman of the Kent fire safety committee and that I had campaigned actively for sprinklers in schools. But that was David: every argument well researched, compliments paid and, before I knew it, I was even an officer of the all-party group too. To the utter bemusement of the much younger members of the all-party group and visiting experts, he usually introduced me as Tim Brinton’s daughter, which always made me very proud. Their friendship was based on rejecting preferment but loving the core job of being an MP, both in the constituency and in the House.

Over the decade that followed, I saw David’s campaigning zeal through the work of the all-party group, holding Ministers and sector professionals to account. Schools Fire Minister after Schools Fire Minister and Building Planning Minister after Building Planning Minister were truly held to account in David’s inimitable style. Of course, our work became even more important after the tragedy of the Grenfell fire and still is not over. We will carry it on in his memory.

Many have spoken since Friday of David’s kindness, decency, courtesy and humour. I have seen all in plenty. I was unwell for a large part of last year, and he rang me regularly to check on my progress. I want to send my deepest sympathy to Julia, their children, his wider family and all his staff and colleagues.

In this day and age of daily abuse—online and in person—death threats, attacks and even murders, David stood as an oasis of reasonable behaviour and genuine affection for all those who crossed his path. In 2017, Christians in Politics ran a campaign for learning to disagree well. I cannot think of a better example than David of always disagreeing well. In political terms, we were polar opposites, but, with him, that was never a barrier: he always found what we had in common, and we could stand together. His faith was intrinsic to every action, every word he uttered and every passing smile to faces that he recognised. May he rest in peace and rise in glory.

My Lords, the report points out that, although the UK is fourth overall in the rankings, we are ninth out of 11 on health outcomes. As the noble Baroness, Lady Thornton, outlined, the top three countries are particularly good at investment in preventive services and primary care, but the report also talks about wider social care, including housing, nutrition, transportation and early years services. All these investments tackle inequity and deprivation, as covered in both the Leadsom report and the Marmot report. Given the Chancellor of the Exchequer’s statement that there is no money for anything other than the NHS and social care, what are the Government proposing to do to address investment in these vital areas?
