My Lords, the circumstances that the noble Baroness has outlined are precisely why we recognise that this sector needs regulation. However, that does not bypass local authorities’ other duties in relation to the fitness of housing in their area. We want to see good-quality accommodation, which is offered by many providers—it is not a case of one approach across the entire sector—and we want to regulate the sector so that these young people can transition into adult life with the support that they need.

Can my noble friend indicate what discussions her department is having with judges in relation to cases coming before them where care is necessary?

My Lords, I am happy to tell my noble friend that the Minister for Children and Families meets regularly with the President of the Family Division. Secure schools, which provide education for those within the criminal justice system, have recently been introduced into the criminal justice estate. We have also just put £40 million of capital investment into secure children’s homes, where, as well as accommodating those in the criminal justice system, children are placed for welfare reasons. Therefore, there is a close working relationship where institutions serve both education and the criminal justice system.

My Lords, I am grateful for early notification of the noble Lord’s question because I had slight trouble hearing it. As I outlined, numerous support schemes have been available to this sector, which, as I said, is a number of small businesses. As of next month, the early years sector will be eligible for the kickstart fund, which is for paid provision of jobs for young people who might be at risk of being unemployed. The apprenticeship support that I outlined is also available for the early years sector. However, the major schemes that have been available to and taken up by the sector have been the business interruption loans, the job retention scheme, the bonus and other financial support that I outlined. These are businesses, so we have responded appropriately for the sector.

My Lords, can I take my noble friend to the other section of children in care: the group that is, by definition, among the most vulnerable in society? All the indications are that the pandemic means that they will be the hardest hit as they leave care. What special measures and funds will the Government provide to help this group?

My Lords, the Government have a care leavers covenant for those young people, recognising that they are some of the most vulnerable children in our society. We have asked universities that accommodate somebody who has been in care to maintain that accommodation during the pandemic. Care leavers have been eligible to receive remote assistance with learning with a laptop. There is a co-ordinated response. I am grateful to my noble friend for drawing attention to the fact that care leavers can be, and often are, some of the most vulnerable. When they are in the care system, they obviously attract the pupil premium and additional funding.

My Lords, I am not aware of how many health and safety officers have performed such risk assessments, but I will seek to obtain the information for the noble Lord. It is the responsibility of school leaders to carry out those kinds of risk assessments in the course of planning to reopen on 1 June.

My Lords, I am pleased that my noble friend has emphasised the number of schools and multi-academy organisations that say they want to go back. I welcome the efforts of the teaching professions over the past few weeks where schools have remained open. However, is there a final date by which a decision has to be taken, which should apply to all local authorities, as to whether schools reopen on 1 June or some other date?

My Lords, this two- to three-week period is vital for schools to plan for reopening, but the tracking of the disease in the population will not be static during this period. My noble friend is correct that there is a notice period in the road map by which the Government will tell schools the position of the scientific data at that point.

I am grateful to the right reverend Prelate for his assertion. We in the department are particularly aware of the risks for disadvantaged students and the attainment gap the longer that schools remain closed. I have to say that the teachers and the heads of trusts that I have spoken to are keen to reopen schools because they are particularly concerned about the learning loss for disadvantaged students and the challenges they face to re-engage them in school.

My Lords, ONS data published a few hours ago shows that the level of infection among two to 19 year-olds is equivalent to that of other parts of the population. Will this information influence the decision to reopen schools on or about 1 June?

I can assure noble Lords that all scientific information is being considered by SAGE. In particular, there is a sub-group in relation to children and its advice has obviously been essential in informing the decision. Of course, it is anticipated that the scientific evidence will allow us to reopen schools on 1 June in that phased manner, but it has been clear that if the scientific advice moves, or if the rate of transmission is not decreasing, that position could change. However, a reopening on 1 June is anticipated, and schools should plan for that.
