SI explanatory text The infected blood compensation scheme (“the IBCS”) was established by the Infected Blood Compensation Scheme Regulations 2024 (S.I. 2024/872). The IBCS was subsequently expanded by the Infected Blood Compensation Scheme Regulations 2025 (S.I. 2025/404) (“the 2025 Regulations”) which revoked and replaced the Infected Blood Compensation Scheme Regulations 2024.

SI explanatory text Section 17(1) of the Victims and Prisoners Act 2024 (“the 2024 Act”) provides that a provision in an agreement is void in so far as it purports to preclude the making of a disclosure falling within section 17(2). Section 17(2) provides that a disclosure will fall within that subsection if it is a disclosure of information that is made by a victim of crime, or a person who reasonably believes they are a victim of crime, to certain specified bodies (including those with law enforcement functions, qualified lawyers and individuals who provide a service to support victims) for certain specified purposes related to the criminal conduct (the “permitted disclosures”). These Regulations amend the permitted disclosures in section 17 of the 2024 Act.

SI explanatory text Section 16(1) of the Victims and Prisoners Act 2024 (“the Act”) provides that the Secretary of State must issue guidance about specified victim support roles. Section 16(3) of the Act sets out that “victim support roles” are roles performed by individuals which involve the provision of support to victims of criminal conduct (where the support relates to that conduct).

SI explanatory text These Regulations expand the infected blood compensation scheme (“the IBCS”) established by the Infected Blood Compensation Scheme Regulations 2024 (S.I. 2024/872, “the first Regulations”). These Regulations implement new routes for the payment of compensation to victims of the infected blood scandal, and others affected by it. In doing so, these Regulations restate the provision made by the first Regulations, and ensures continuity for applications and compensation payments made under the first Regulations.
