SI explanatory text These Regulations, which apply in Northern Ireland, establish the Energy Bills Discount Scheme for Non-Domestic Customers in Northern Ireland (“EBDS”). EBDS is a scheme for reducing the costs, to non-domestic customers, of being supplied with electricity or gas (“energy”) by a supplier that holds a supply licence under the Electricity (Northern Ireland) Order 1992 (23) or Gas (Northern Ireland) Order 1996(24).

SI explanatory text These Regulations make provision for the pass-through requirement in relation to the Energy Bills Discount Scheme (EBDS) in England and Wales, Scotland and Northern Ireland. The pass-through requirement is imposed on a person who supplies and charges for the supply of heating or hot water to an end user through a heat network using energy in respect of which the person has been provided a scheme benefit (“intermediary”). It requires the intermediary to pass on the benefits of the EBDS to its end users. The Regulations also deal with adjustments to pass-through amounts which may be needed if a supply redetermination event occurs under the EBDS Regulations or the NI EBDS Regulations.

SI explanatory text These Regulations make provision for pass-through requirements in relation to the Energy Bills Discount Scheme (EBDS) Regulations 2023 in England, Wales and Scotland (S.I. 2023/453) and in Northern Ireland (S.I. 2023/454). Pass-through requirements are imposed on a “relevant intermediary” (as defined in regulation 2) and establish that they must pass-through the benefits of the EBDS to an “end user” (defined in section 19(3) of the Energy Prices Act 2022 (c. 44), subject to an exception for excluded end users as defined in regulation 2) to whom energy or energy products (or both) have been made available. The Regulations apply in respect of relevant intermediaries, other than a) an “intermediary” as defined in regulation 2(1) of the Energy Bills Discount Scheme Pass-through Requirement (Heat Suppliers) Regulations 2023 (S.I. 2023/455) and b) those providing certain types of hospitality accommodation (defined as “excluded persons” under these Regulations). SI explanatory text These Regulations make provision for pass-through requirements in relation to the application scheme for Non-Domestic Alternative Fuel Payment in England and Wales, Scotland and Northern Ireland. Assistance is provided under “scheme agreements”, which are contracts formed between the Secretary of State and a “relevant intermediary” (defined in regulation 2) when the relevant intermediary accepts that it will be bound by the “scheme terms”. Amongst other things, the scheme terms set out the criteria that must be met to receive assistance.

SI explanatory text These Regulations make provision for pass-through requirements in relation to the Non-Domestic Alternative Fuel Payment in England and Wales, Scotland and Northern Ireland. Pass-through requirements are imposed on a “relevant intermediary” (defined in regulation 2) and establish that they must pass-through an Non-Domestic Alternative Fuel Payment (“ND AFP”) or an Non-Domestic Alternative Fuel Payment Northern Ireland (“ND AFP NI”) to an “end user” (defined in regulation 2) to whom energy or energy products (or both) have been made available. These Regulations apply in respect of relevant intermediaries other than those providing certain types of hospitality accommodation (see the definition of “excluded person” under these Regulations). SI explanatory text These Regulations make provision about the Energy Bill Relief Scheme for Non-Standard Customers in Great Britain and Northern Ireland (“the Scheme”) by which the Secretary of State provides certain non-domestic customers with financial assistance to meet costs related to the use of electricity and gas.
