These Regulations make amendments to the Building Safety (Responsible Actors Scheme and Prohibitions) Regulations 2023 (âthe 2023 Regulationsâ). The Responsible Actors Scheme, established by the 2023 Regulations, requires relevant developers to identify relevant buildings they are responsible for and remediate and/or mitigate life-critical fire safety defects in those buildings, or repay the costs of the same. Failure to do so may attract building control and planning prohibitions which carry significant commercial consequences.
Construction Products (Amendment) Regulations 2025

These Regulations amend Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (EUR 2011/305) (âthe 2011 Regulationâ) and the Construction Products Regulations 2013 (S.I. 2013/1387).âArticles 16A to 16C of the 2011 Regulation set out the circumstances in which the provisions in the 2011 Regulation are treated as being satisfied by a CE marked construction product. Articles 59A and 59B make provision in relation to market surveillance where an economic operator is seeking to rely on provisions in Articles 16A, 16B or 16C.
Building (Registered Building Control Approvers etc.) (England) Regulations 2024

These Regulations revoke, in relation to England, the Building (Approved Inspectors etc.) Regulations 2010 (S.I. 2010/2215) (âthe AI Regulationsâ) with the amendments to those Regulations made by S.I. 2015/767, 2016/285, 2021/1391, 2021/1392, 2022/718 and 2023/906. They also revoke and include in this instrument provisions relating to the registration and review in regulations 3 to 5 of the Building (Approved Inspectors, Review of Decisions) (England) Regulations 2023 (S.I. 2023/906).
Higher-Risk Buildings (Keeping and Provision of Information etc.) (England) Regulations 2023

This instrument is part of a set of Regulations which implement Part 4 of the Building Safety Act 2022 (âthe 2022 Actâ). These Regulations make provision about what information and documents the principal accountable person (âPAPâ) and any other accountable person (âAPâ) for a higher-risk building must keep in relation to that higher-risk building. The term âhigher-risk buildingâ is defined in section 65(1) of the 2022 Act as a building in England that is at least 18 metres in height, or has at least 7 storeys, and contains at least 2 residential units. The definition is supplemented by the Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023 (S.I. 2023/275).
Building Safety (Regulator's Charges) Regulations 2023

This instrument is part of a number of Regulations which implement Part 3 of the Building Safety Act 2022. That Act inserts section 91ZA into the Building Act 1984. Section 91ZA, which is to have effect from 1st October 2023, provides for the regulator to be the building control authority in relation to any higher-risk building in England and any proposed higher-risk building. The Act also introduces a new regulatory regime for the building control profession under which approved inspectors will be replaced by registered building control approvers.
Building (Higher-Risk Buildings Procedures) (England) Regulations 2023

These Regulations, which apply to England only, make largely administrative provision in relation to the management of safety risks in higher-risk buildings. Higher-risk building is defined in sections 65 to 70 of the Building Safety Act 2022 (âthe 2022 Actâ).

Building Safety Act 2022 (Consequential Amendments etc.) Regulations 2023

These Regulations establish the Responsible Actors Scheme (âthe schemeâ) and the prohibitions under the Act. They identify certain developers who are eligible to become members of the scheme, and, as a condition of membership, require such developers to enter into and comply with a contract with the Secretary of State for Levelling Up, Housing and Communities under which they are to, among other things, remediate relevant residential buildings for which they are responsible at their own expense and reimburse to the government amounts paid out by government remediation funds to remediate buildings for which they are responsible.
Building Safety (Registration of Higher-Risk Buildings and Review of Decisions) (England) Regulations 2023

These Regulations make provision about the register of higher-risk buildings held by the building safety regulator (âthe regulatorâ). These Regulations make provision about making an application for registration of a higher-risk building including the associated fee and withdrawing that application. They also set out further provisions about decisions of the regulator that may be subject to a review under section 25 of the Building Safety Act 2022 (âthe 2022 Actâ).

Section 9(3) of the Building Safety Act 2022 (c. 30) abolishes the Building Regulations Advisory Committee for England. The Building Regulations Advisory Committee for Wales will remain. Regulations 2 and 3 of these Regulations consequentially remove references to the Building Regulations Advisory Committee for England.

These Regulations determine which buildings will be subject to the new more stringent safety regime established by the Building Safety Act 2022 (âthe 2022 Actâ). They do so by supplementing and completing the definitions of âhigher-risk buildingâ at section 120D of the Building Act 1984 (âthe 1984 Actâ) (inserted by section 31 of the 2022 Act) and section 65 of the 2022 Act. The 1984 Act makes provision about the design of, and building work carried out in respect of, âhigher-risk buildingsâ. The 2022 Act makes provision about safety management in occupied âhigher-risk buildingsâ.

Construction Products (Amendment) Regulations 2022

Regulation 2 of these Regulations amends regulations 2, 3, 5, 10 and 14 of the Construction Products Regulations 2013 to provide that the Secretary of State is an enforcement authority in relation to construction products in England and Wales, and in Scotland.
