Coronavirus Act 2020 (Delay in Expiry: Inquests, Courts and Tribunals, and Statutory Sick Pay) (England and Wales and Northern Ireland) Regulations 2022

These Regulations extend the period for which certain provisions of the Coronavirus Act 2020 (c. 7) continue in force. The provisions are continued in force for a further period of six months beginning with 25th March 2022.

These Regulations provide for the expiry of provisions in the Coronavirus Act 2020 (c. 7) (the “Act”). The Secretary of State has obtained the necessary consents in respect of provisions of these Regulations which provide for the expiry of provisions in the Act which are within devolved competence; consent of the Scottish Ministers has been given in relation to section 23, and consent from the relevant Northern Ireland departments in relation to section 58, Parts 1 and 5 of Schedule 21, Parts 1 and 5 of Schedule 22, and paragraphs 14 and 15 of Schedule 16.
Coronavirus Act 2020 (Residential Tenancies and Notices) (Amendment and Suspension) (England) Regulations 2021

These Regulations amend Schedule 29 to the Coronavirus Act 2020 (c. 7) (“Schedule 29”) and suspend various of its provisions. They also prescribe replacement notices: notice of seeking possession under section 8 Housing Act 1988, notice requiring possession under section 21(1) and (4) of the Housing Act 1988 (c. 50) and notice of seeking termination of a fixed term tenancy and recovery of possession under section 83 of the Housing Act 1985 (c. 68).

Section 82 of the Coronavirus Act provides that a right of re-entry or forfeiture, under a relevant business tenancy, for non-payment of rent may not be enforced, by action or otherwise, during the relevant period. “Relevant period” is defined in subsection (12) as the period starting with the day after Royal Assent and ending with 30th June 2020 (or such later date as may be specified in regulations).

There are seven devolved sections, sections 8, 9 and 25 to 29, for which the Secretary of State has obtained the necessary consent to expire on behalf of Wales, Scotland, and Northern Ireland.

These Regulations amend the Local Government and Police and Crime Commissioner (Coronavirus) (Postponement of Elections and Referendums) (England and Wales) Regulations 2020 (S.I. 2020/395) to remove the restriction on petitions for a referendum on a change of local authority governance being validly presented to a local authority during the period from 16th March 2020 to 5th May 2021 (inclusive).

Schedule 8 to the Act made certain modifications to the Mental Health Act 1983 (c. 20) in response to coronavirus. It has not been commenced in relation to England, although some provisions of Schedule 8 have been commenced in relation to Wales.

These Regulations provide for extension of the time limits that apply to the retention of certain fingerprints or DNA profiles. The Regulations apply in respect of fingerprints or DNA profiles that are retained under certain counter-terrorism provisions, or that may otherwise be relevant to the interests of national security.

Section 21(8) of the Housing Act 1988 (c. 50) gives the Secretary of State power to prescribe a form of a notice under section 21(1) or (4) given in relation to an assured shorthold tenancy of a dwelling-house in England. This is a notice of intention to seek possession of a property let on an assured shorthold tenancy.

These Regulations amend the Buckinghamshire (Structural Changes) Order 2019 (S.1. 2019/957) (”the Buckinghamshire Order”) and the Northamptonshire (Structural Changes) Order 2020 (S.1. 2020/156) (”the Northamptonshire Order”). The amendments are required due to the postponement of local elections in England, which were due to take place on 7th May 2020, and which have been postponed to 6th May 2021 by section 60 of the Coronavirus Act 2020 (c. 7).

They also amend the Statutory Sick Pay (General) Regulations (Northern Ireland) 1982 (“the 1982 Regulations”) to specify when a person is isolating by reason of coronavirus is deemed to be incapable of work.
