These Regulations amend the Housing Act 2004 (c. 34) and the Housing and Planning Act 2016 (c. 22) to increase the maximum penalty which may be imposed for certain housing offences and breach of banning orders under section 249A(1) of the Housing Act 2004 and section 23(1) of the Housing and Planning Act 2016.

These Regulations amend the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 (“the Principal Regulations”). They are, in part, enabled by amendments made by the Social Housing (Regulation) Act 2023 (c. 36) to the power in section 122 of the Housing and Planning Act 2016 (c. 22).

Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020

These Regulations impose duties on private landlords of residential premises in England in respect of electrical safety standards. The duties do not apply to landlords of social housing. The Regulations require local housing authorities to enforce the duties, and include a power to arrange remedial action.
Housing Administration (England and Wales) Rules 2018

These Rules set out the detailed procedures for the conduct of housing administration, as provided by Chapter 5 of Part 4 of the Housing and Planning Act 2016. Housing administration is a special administration regime which applies to private registered providers of social housing.

Town and Country Planning (Permission in Principle) (Amendment) Order 2017
SI explanatory text
This Order, which applies in England only, makes provisions in relation to permission in principle. In particular it amends the Town and Country Planning (Permission in Principle) Order 2017 (S.I. 2017/402)(“the 2017 Order”) to allow local planning authorities to grant permission in principle for development the main purpose of which is housing development on an application to the authority in accordance with provisions inserted into that Order by this instrument. Permission in principle and its effect are described in sections 58A, 59A and 70(2ZZA) to (2ZZC) of the Town and Country Planning Act 1990 (“the 1990 Act”) (those sections were inserted by section 150 of the Housing and Planning Act 2016 (c. 22)).
Housing and Planning Act 2016 (Banning Order Offences) Regulations 2017

These regulations make provision to reduce the amount of local authority influence over private registered providers (PRPs). PRPs are defined in Part 2 of the Housing and Regeneration Act 2008 (c.17).
