These Regulations amend the Social Security (Invalid Care Allowance) Regulations 1976 (S.I. 1976/409), the Social Security (Disability Living Allowance) Regulations 1991 (S.I. 1991/2890) and the Social Security (Personal Independence Payment) Regulations 2013 (S.I. 2013/377). They reflect that claimants, to whom a relevant EU regulation applied on 31st December 2020 (the date of the end of the transition period following the UK’s withdrawal from the EU), maintain their rights to carer’s allowance, the care component of disability living allowance and the daily living component of personal independence payment subject to certain conditions. The individual must have continuously received these benefits since 31st December 2020, and they must not have been habitually resident in the United Kingdom on or after that date. These regulations do not create a ground for new claims but provide a legislative basis to continue paying benefits already in payment.

These Regulations amend the Social Security (Invalid Care Allowance) Regulations 1976 (S.I. 1976/409), the Social Security (Attendance Allowance) Regulations 1991 (S.I. 1991/2740), the Social Security (Disability Living Allowance) Regulations 1991 (S.I. 1991/2890) and the Social Security (Personal Independence Payment) Regulations 2013 (S.I. 2013/377) to reflect that claimants to whom a relevant EU Regulation applies need only show a genuine and sufficient link to the United Kingdom and not the United Kingdom social security system.

Regulation 2 amends paragraph (6) of regulation 99 so that work search and work availability requirements may not be imposed where a claimant has monthly earnings from employment that are equal to, or more than, 18 hours per week at the national minimum wage rate as set out in regulation 4 of the National Minimum Wage Regulations 2015 (S.I. 2015/621) (“the national living wage”) or, where the claimant is a member of a couple, their combined earnings from employment are equal to, or more than, 29 hours per week at the national living wage rate, in both cases converted to a monthly amount by multiplying by 52 and dividing by 12. Regulation 3 revokes a previous version of these Regulations in order to alter the coming into force date.

Under section 83(1) of the Welfare Reform Act 2012 (“the Act”) a person is not entitled to the daily living or mobility component of Personal Independence Payment for any period after they reach the relevant age (defined in section 83(2) of the Act as pensionable age or, if higher, 65) (“the age restriction”). Regulation 27(1) of the Social Security (Personal Independence Payment) Regulations 2013 (2013 No. 377) (“the PIP Regulations”) provides that the age restriction does not apply where the person has reached the relevant age, is entitled to an award of either or both components pursuant to an exception in regulation 25 or 26 of the PIP Regulations, and that award falls to be revised or superseded. Regulation 27(2) of the PIP Regulations modifies regulation 27(1) such that entitlement to the mobility component is restricted, as set out in regulation 27(3), where the original award is superseded for a change of circumstance which occurred after the person reached the relevant age.

These Regulations amend various instruments that govern the entitlement of a claimant (“C”), who has reached state pension credit qualifying age (“the qualifying age”), to universal credit (“UC”), state pension credit (“SPC”) and housing benefit for pensioners (“HB”), so as to provide for a smooth transition between those benefits where a person reaches that age, becomes part of a mixed-age couple, or certain other changes of circumstance occur. See section 1(6) of the State Pension Credit Act 2002 (c. 16) for the definition of “the qualifying age”. “Mixed-age”, in relation to a couple or a marriage, means where one member has attained the qualifying age and the other has not (see regulation 2(2)(b) which amends regulation 5 of the State Pension Credit Regulations 2002 (S.I. 2002/1792) (“the 2002 Regulations”) to insert that definition).

These Regulations amend the Personal Independence Payment (Transitional Provisions) Regulations 2013 which transfer disability living allowance entitled persons to personal independence payment (“DLA transfer claimants”) by providing an exemption to personal independence payment (“PIP”) age restriction in section 83(1) of the Welfare Reform Act 2012 in cases where transfer claimants’ PIP awards are revised or superseded for a change of circumstances.

These Regulations amend the Universal Credit (Transitional Provisions) Regulations 2014 (S.I. 2014/1230) (“the 2014 Regulations”) and the Universal Credit Regulations 2013 (S.I. 2013/376) (“the 2013 Regulations”). They simplify and extend the transitional protection for children and qualifying young persons born before 6th April 2017, the date when limits in relation to the child element in universal credit came into force.

These Regulations provide for the moving of claimants on existing benefits to universal credit. They set out the process for moving those claimants, the circumstances in which transitional protection is given and the manner in which it is calculated. They also include provision in relation to certain claimants who are, or have been, in receipt of a severe disability premium, claimants who are self-employed and claimants who may be in hardship.

Articles 3 to 5 of this Order apply and amend legislation applying in Northern Ireland to allow for the recovery of the following amounts. They are amounts specified in notices given under section 29 of the Tax Credits Act 2002 (c.21) (“the 2002 Act”) (which specify amounts of overpayments of tax credits), the amounts of penalties imposed under section 31 or 32 of that Act (which are imposed respectively in connection with the making of incorrect statements and failing to comply with requirements in connection with claims for, and awards of, tax credits) and, when read with article 2(2), the amounts of interest carried on those amounts.

These Regulations provide that payments from the London Emergencies Trust (registered charity number 1172307 and company number 09928465) and the We Love Manchester Emergency Fund (registered charity number 1173260) (“the Charities”) are to be disregarded for certain social security purposes. The Charities will make payments to victims (and their dependants) of the terrorist attacks in London and Manchester in 2017.
