Representation of the People (Variation of Election Expenses and Exclusions) Regulations 2024

These Regulations increase the maximum amount of election expenses which may be incurred by candidates at Greater London Authority and local authority mayoral elections in England to take account of inflation. This is an 81.05% increase (rounded to 2 decimal places) in the figures for Greater London Authority elections and 29.09% (rounded to 2 decimal places) in the figures for local authority mayoral elections. The calculated figures have been rounded down to the nearest ÂŁ10. The extent of the increases also reflects the passage of time since the figures were set. The new maximum amount for local authority mayoral elections aligns with the new maximum amount for combined authority mayoral elections and combined county authority mayoral elections set out in the Combined Authorities (Mayoral Elections) Order 2017 (Amendment) Regulations 2024.
Representation of the People (Overseas Electors etc.) (Amendment) (Northern Ireland) Regulations 2023

The Elections Act 2022 (c. 37) amended the Representation of the People Act 1985 (“the 1985 Act”) (c. 50) to expand the franchise for parliamentary elections in respect of British citizens overseas, removing the 15 year limit on voting for British citizens overseas and allowing registration based on both previous registration and previous residence in the United Kingdom.

These Regulations make provision related to the expansion of the franchise for parliamentary elections in respect of British citizens overseas by sections 1 to 1E of the Representation of the People Act 1985 (c. 50), as substituted by section 14 of the Elections Act 2022 (c. 37). These Regulations also make provision related to the change to be made to the franchise for local government electors in England by section 15 of the Elections Act 2022 (voting and candidacy rights of EU citizens) and provision related to absent voting arrangements at police and crime commissioner elections in Wales.

These Regulations make amendments to subordinate legislation in consequence of provisions contained in the Elections Act 2022 (c. 37) (“the Act”). The amendments made by these Regulations complement provisions in the Act relating to the handling of postal voting documents by political campaigners (section 4); handing in postal voting documents (section 5); the requirements relating to secrecy (section 7); and the simple majority system to be used in elections for certain offices (section 13).

These Regulations make provision related to the implementation of section 3 (restriction of period for which person can apply for a postal vote) and section 6 (limit on the number of electors for whom a proxy can vote) of the Elections Act 2022 (c. 37) (“EA 2022”), as well as amending provisions related to the processing of applications for electoral registration under section 10ZC of the Representation of the People Act 1983 (c. 2) (“the 1983 Act”).

Section 79 of the Police Reform and Social Responsibility Act 2011 (c. 13) requires the Secretary of State to issue a Policing Protocol. This Order replaces the Policing Protocol, issued under the Policing Protocol Order 2011 (S.I. 2011/2744), which it revokes, with the Policing Protocol 2023.
Police and Crime Commissioner Elections and Welsh Forms (Amendment) Order 2022

This Order amends the Police and Crime Commissioner Elections Order 2012 (S.I. 2012/1917) (“the 2012 Order”), in consequence of section 13 of the Elections Act 2022 (c. 37), which provides that the simple majority system is to be used in all elections for certain offices, including police and crime commissioners. This Order updates and replaces references in the 2012 Order to the supplementary vote system, which was previously used for elections for police and crime commissioners where there were three or more candidates.

Police and Crime Commissioner Elections (Amendment) Order 2022

This Order amends the Police and Crime Commissioner Elections Order 2012 (S.I. 2012/1917) (“the 2012 Order”). Its main purpose is to make equivalent amendments to candidate expenses provisions for Police and Crime Commissioners’ (“PCC”) elections as the amendments made in respect of other elections by sections 20 to 22 of the Elections Act 2022 (c. 37). The Order also updates the list of qualifying welfare benefits in relation to certain proxy voting applications for PCC elections.

This Order prescribes forms, and forms of wording, for use at a police and crime commissioner (“PCC”) election taking place in Wales. The Welsh versions of the forms of words prescribed by article 3, the Welsh versions of the forms prescribed by article 4, and the Welsh and English versions of the forms prescribed by article 5 are translations of corresponding English wording that is contained in the Police and Crime Commissioner Elections Order 2012 (S.I. 2012/1917). The Welsh versions are to be available for use in any election of police and crime commissioners which takes place in Wales.
