SI explanatory text This Order amends the Charities Act 1992 (c. 41) (“the 1992 Act”), the Charities Act 2011 (c. 25) (“the 2011 Act”) and the Charities Act 2011 (Group Accounts) Regulations 2015 (S.I. 2015/322) by substituting the sums specified in the Order. The effect of the Order is to increase the financial thresholds which trigger some of the regulatory requirements applying to charities.

SI explanatory text These Regulations amend the Charitable Incorporated Organisations (Notification Requirements: Social Housing) Regulations 2023 (S.I. 2023/1311) (“the principal Regulations”) which make provision related to certain constitutional and other business changes of private registered providers of social housing that are charitable incorporated organisations (“CIOs”), that wish to become CIOs, or that enter into transactions that involve CIOs. They are made to clarify the drafting of two provisions in regulation 4 of the principal Regulations.

SI explanatory text These Regulations make provision related to certain constitutional and other business changes of private registered providers of social housing (“PRPs”) that are charitable incorporated organisations (“CIOs”) or involve CIOs. They require PRPs to notify the Regulator of Social Housing (“the Regulator”) of such changes. They also impose requirements on PRPs that are CIOs (“relevant CIOs”) and others to notify the Charity Commission for England and Wales (“the Commission”) that the RSH has been so notified, and make related provision.

Charities (Exception from Registration) (Amendment) Regulations 2021

SI explanatory text These Regulations amend the Charities (Exception from Registration) Regulations 1996. They extend the temporary exception granted to certain religious charities from the requirement to be registered under the Charities Act 2011. The 1996 Regulations were made under the Charities Act 1993, which is consolidated in the Charities Act 2011. The exception was originally due to expire on 1st March 2001 but was extended by successive statutory instruments until 31st March 2021. These Regulations further extend the temporary exception until 31st March 2031.

SI explanatory text This Order amends Schedule 6 to the Charities Act 2011 (“the Act”), which makes provision in respect of the circumstances in which an appeal might be brought to the First-tier or Upper Tribunal. This change is consequential to the coming into force of the Charitable Incorporated Organisations (Conversion) Regulations 2017 which make provision for the conversion of a community interest company into a charitable incorporated organisation (“CIO”) and the CIO’s registration as a charity by virtue of section 234 of the Act.
