To ask the Secretary of State for the Home Department, whether he has made a recent estimate of the total amount of money that has been returned to victims of gambling-related crimes by (a) the gambling industry, (b) Proceeds of Crime Act proceedings and (c) any other means in the 2023-24 financial year.

Neither the Government nor the Gambling Commission hold information on how many crimes related to harmful gambling were committed in the last 12 months and there has been no recent estimate as to the total amount of money that has been returned to victims of gambling-related crimes.

The Office for Health Improvement and Disparities (OHID) in Department of Health and Social Care have undertaken an evidence review which provides estimates of the economic costs of harmful gambling, which includes a section on criminal activity (chapter 6).The economic cost of gambling-related harm in England: evidence update 2023 (publishing.service.gov.uk)

The Gambling Act 2005 sets out the following licensing objectives:

  • preventing gambling from being a source of crime or disorder, being associated with crime or disorder or being used to support crime.
  • ensuring that gambling is conducted in a fair and open way
  • protecting children and other vulnerable people from being harmed or exploited by gambling.

As the statutory regulator, the Gambling Commission is responsible for making sure all licensing applications meet these objectives. The Commission has published a statement of principles for licensing and regulation which sets out how it governs what it does and how they help to meet the Act's licensing objectives.

To ask the Secretary of State for Culture, Media and Sport, if she will make an assessment of the potential merits of establishing an independent ombudsman to enforce gambling operators’ duty of care.

Following the Government’s review of the Gambling Act 2005, and the Gambling White Paper, published in April 2023, we are introducing a package of measures to further prevent gambling-related harm, including a commitment to establish a non-statutory ombudsman to strengthen protections for customers where things go wrong. The body will adjudicate complaints, including those relating to social responsibility or gambling harm, where an operator is not able to.

We are working at pace with industry and all stakeholders in the sector, including the Ombudsman Association, to ensure customers have access to an ombudsman that is fully operationally independent in line with Ombudsman Association standards, and is fully credible in the eyes of customers. As set out in the white paper, it is important that the body adjudicates fairly and transparently all complaints regarding social responsibility or gambling harm issues where an operator is not able to resolve these.

We remain clear that if this approach does not deliver as we expect, or shortcomings emerge regarding the ombudsman’s remit, powers or relationship with industry, the government will actively explore the full range of options to legislate to create a statutory ombudsman.

We have struck a balanced and evidence-led approach to gambling advertising which tackles aggressive advertising which is most likely to appeal to children, while recognising that advertising is an entirely legitimate commercial practice for responsible firms.

Last year, HM Government published a White Paper on gambling which outlined a comprehensive package of reforms to make gambling safer. This followed an exhaustive assessment of the evidence, including on gambling advertising. We concluded that further action on advertising was needed, which is why we and the Gambling Commission are introducing measures to tackle the most aggressive and harmful advertising practices by preventing bonuses being constructed and targeted in harmful ways, giving customers more control over the marketing they receive, and introducing messaging about the risks associated with gambling.

This supplements the already robust rules in place to ensure that gambling advertising is socially responsible and that it cannot be targeted at or strongly appeal to children. This includes specific licence conditions for operators, including the requirement to abide by the UK Advertising Codes, which further regulate how gambling operators advertise. The UK Advertising Codes were strengthened in 2022, with new protections for children and vulnerable adults.

In our approach to gambling advertising, we have struck a balanced and evidence-led approach which tackles aggressive advertising that is most likely to appeal to children, while recognising that advertising is an entirely legitimate commercial practice for responsible gambling firms.

There are robust rules in place to ensure that gambling advertising is socially responsible and that it cannot be targeted at or strongly appeal to children. This includes specific licence conditions for operators, including the requirement to abide by the UK Advertising Codes, which further regulate how gambling operators advertise. The UK Advertising Codes were strengthened in 2022, with new protections for children and vulnerable adults.

Voluntary measures on advertising implemented through the IGRG Code (now in its 7th edition) include a watershed ban on gambling adverts and ensuring operators’ advertising on social media platforms is targeted away from anyone below the age of 25.

We also welcomed the voluntary whistle-to-whistle ban on TV betting ads during live sports programmes, which was agreed by industry. According to figures from the Betting and Gaming Council, the ban reduced gambling advertisement views by children (age 4-17) by 70% over the full duration of live sporting programmes. We also welcomed the Premier League’s announcement that it will ban gambling sponsors from the front of shirts by the end of the 2025/26 season, and are working with a wider group of sports governing bodies to introduce a Code of Conduct on responsible gambling sponsorship.

His Majesty’s Government recognises that while millions of people gamble without experiencing problems, for some it becomes an addiction with serious consequences.

The Secretary of State and I recently met with the Betting and Gaming Council (BGC) and other industry representatives to discuss industry-led safer gambling measures and implementation of the gambling white paper. We welcome industry-led initiatives such as Safer Gambling Week. Figures from the BGC indicate that in 2022 Safer Gambling Week messaging made nearly 30 million impressions on social media, and that around 200,000 accounts set deposit limits during that month, with 61 percent of those players setting a limit for the first time. Such limits can be an important measure in preventing harm. We understand safer gambling week has no impact on the volume of marketing (although its content is likely to be different) or game speed.

However, as outlined in the gambling white paper, we are working with the industry, Gambling Commission and others to implement a wide range of proportionate measures to protect customers from practices and products which can drive harm.
