Question to the Department of Health and Social Care:

To ask Her Majesty’s Government why NHS England has not published a choice and competition framework.

There is no requirement under the Health and Social Care Act 2012 for NHS England to publish a choice and competition framework. Monitor published statutory guidance, Substantive guidance on the Procurement, Patient Choice and Competition Regulations, in December 2013 to help commissioners understand how to apply the regulations when procuring clinical services. NHS England and Monitor have also run a series of joint workshops for commissioners and continue to provide advice and support to clinical commissioners in individual cases, where appropriate.
