Clause 23 and Schedule 3 of the EU (Withdrawal Agreement) Act 2020 provide for certain changes to the Northern Ireland Act 1998 that will confer new statutory powers on the Northern Ireland Human Rights Commission and the Equality Commission for Northern Ireland. Those new powers will allow the Commissions to monitor, report on and enforce the Government’s commitment, as set out in Article 2(1) of the Northern Ireland/Ireland Protocol to the Withdrawal Agreement, that no diminution of certain rights, safeguards and equality of opportunity set out in the Belfast (‘Good Friday’) Agreement results from the UK’s withdrawal from the EU.
