Question to the Home Office:

To ask the Secretary of State for the Home Department, whether the Governments proposals for European Temporary Leave to Remain status will require primary legislation.

In the event that the United Kingdom leaves the European Union in a no deal scenario, we will seek to end free movement as soon as possible through the Immigration and Social Security Co-ordination (EU Withdrawal) Bill.

Once enacted, this will repeal the Immigration (European Economic Area) Regulations 2016, which currently implement free movement in UK law. EEA and Swiss citizens and their close family members then arriving in the UK who wish to stay longer than three months will need to apply for European Temporary Leave to Remain, for which, for a no deal scenario, provision will be made in the Immigration Rules in due course.
