Question to the Department for Environment, Food and Rural Affairs:

To ask the Secretary of State for Environment, Food and Rural Affairs, whether he has plans for Regulation (EC) No 401/2009 to form part of the common rule book envisaged in the White Paper entitled The Future Relationship Between the United Kingdom and the European Union, published in July 2018, Cm 9593.

Once the implementation period ends, the European Environment Agency (EEA) Agreement will no longer apply to the UK. The nature of our relationship with the EEA during the implementation period and beyond is a matter for negotiations.

Whether Regulation (EC) No 401/2009 will form part of the common rule book will be subject to these negotiations.
