Question to the Home Office:

To ask the Secretary of State for the Home Department, what the residence rights of the EU family members of UK nationals who have derived those rights under Ruiz Zambrano case law are; and whether they are covered by the Phase 1 agreement with the EU.

Until the UK leaves the European Union (EU), EU family members of UK nationals who have derived those rights under Ruiz Zambrano case law continue to have the same rights and status, and are subject to the same residence requirements under EU law, as was the case before Article 50 was triggered

The Withdrawal Agreement between the EU and the UK will protect EU citizens who have been exercising free movement rights in the UK at the time of the UK’s withdrawal from the EU, on 29 March 2019. This includes those who derive a right of residence from other instruments of EU law.
