Vulnerable Adults: Data Protection

Question to the Department for Digital, Culture, Media & Sport:

To ask the Secretary of State for Digital, Culture, Media and Sport, what rights relatives have to access data that belongs to vulnerable adults.

Individuals' rights in regards to the processing of personal data is governed by the Data Protection Act (DPA) which is regulated by the Information Commissioner. The DPA recognises that in certain circumstances a third person may need to act on behalf of a friend or relative, in such circumstances the DPA will not prevent someone from accessing and updating information about another person, as long as they have permission to do so.

The Information Commissioner's Office (ICO) has published advice on its website on the rights of individuals who are acting on behalf of a vulnerable person or relative.
