I am grateful to the Minister for his introduction of the regulations. I hope that the Committee will allow me to ask a few questions on behalf of constituents of mine who are directly affected by the provisions in the Building Safety Act. Although I welcome those provisions—they represent a big step forward in protecting my constituents—I have real concerns about the detail of their implementation. I hope that the Minister will be able to reassure my constituents.

First, I have spoken on a number of occasions about landlords who are linked to the original developer. A network of companies can exist with common directors and shareholders, and such companies can move in and out of liquidation, passing freeholds among themselves in a sort of merry-go-round of ownership. There is no doubt in my mind of the connection between those landlords—some of which have, of course, gone into liquidation and no longer exist—and the original developer, so it would be useful if the Minister explained what he means by “linked”. If a link between landlords and the original developer is clearly there but cannot be shown, how might the costs be apportioned between them?

Secondly, in the case of landlords that have gone into liquidation and disappeared, the directors and shareholders of which are still known because they have moved into other companies that are now the landlords, how effective will it be to apportion the costs among anyone who has ever had a hand in owning or developing substandard buildings?

In cases in which the landlord is the director of, a shareholder in, or is connected to a company that is also a leaseholder, or indeed owns a number of leases in the block—as is the case for Aura Court in my constituency—will that landlord who is also a leaseholder be able to benefit in any way from the regulations? It would be absolutely invidious if a landlord’s costs could be capped simply by virtue of owning some leases in the building, when in fact that landlord directly or indirectly bears responsibility for the condition of the building.

Thirdly, may I ask about management companies? Again, those may be controlled—I fear that, in the building I am thinking of in my constituency, it will be controlled by one of the individuals who is, in my opinion, linked to the original developer and to other landlords.

Finally, I would like to raise the concerns of constituents who feel they have waited many months to see any remediation at all, and still have no real idea of when works might start so that they can get out of this terrible position of having properties that they feel are not safe and which they cannot sell. My constituents would welcome any update from the Minister on what progress is being made on carrying out remediation work.

I thank the hon. Member for Greenwich and Woolwich and other members of the Committee, who in many ways seem content to allow the regulations to pass. I will start by answering some of the questions raised by the hon. Member and the hon. Member for Stretford and Urmston. The hon. Lady mentioned landlords linked to the developer and the apportionment of costs. The regulations clearly set out a formula for how those costs will be apportioned. In cases where landlords or developers are no longer trading, as I am sure the hon. Member knows, there is a levy scheme where developers pay into that levy, so we can support those people who end up—through no fault of their own—in a situation where the people responsible are not likely to pay for the remediation.

The hon. Lady asked a question about enfranchised buildings and leaseholders, which I will come to when I respond to the hon. Member for Greenwich and Woolwich. The hon. Lady also mentioned management companies. The type of arrangements she was thinking about were those with non-resident owned management companies that are subject to tripartite leases and arrangements with the landlord and leaseholders. It is important and urgent to prepare these two sets of regulations in the way that we have, so that they enable the protections to take place. We are confident that the way the regulations have been drafted will be effective in ensuring that the qualifying leaseholders gets the right outcome for the type of arrangements the hon. Member has mentioned. We are absolutely clear that all types of management company should be covered by the regulations, and we will closely monitor the progress of cases. If it becomes apparent that changes are necessary, we will come back to Parliament with further proposals.

Perhaps I could write to the Minister to set out the specific circumstances that pertain to my constituency. The regulations were helpfully accompanied by some worked-through examples, so perhaps I could add another one that is being faced by my constituents at the moment and the Minister could respond in detail as to how they would be affected?

I would very much welcome that correspondence. I would be more than happy to receive the example that the hon. Lady is talking about and to come back to her with a response.

The hon. Member for Greenwich and Woolwich mentioned that the protections came into force on 28 June, which was two months after the Act received Royal Assent. The regulations, along with the Building Safety (Leaseholder Protections) (England) Regulations 2022, which were laid on 28 June, will provide the detail to operationalise the new leaseholder protection regime. Landlords are now only able to pass on costs where the Building Safety Act permits them to do so, and that includes pursuing unpaid bills for historical safety remediation issued prior to commencement. As of 28 June, landlords must not pursue bills for historical safety remediation that are not in accordance with the Act. As the hon. Gentleman said, doing so would be illegal and I will come back to him on his point about the operation of that.

Leaseholders should seek to complete the leaseholder deed of certificate that is outlined in the regulations as soon as possible, so they can demonstrate to their landlord whether they qualify for the protections.

In an enfranchised building, the freehold is owned by some or all of the leaseholders. Capping leaseholder liability in a fully enfranchised or commonhold building would not have the effect of reducing or limiting leaseholders’ liability as leaseholders are the freeholder. The other complication is that often not all the leaseholders own part of the freehold, which is why my right hon. Friend the Member for Pudsey (Stuart Andrew) committed to bringing forward a consultation and a call for evidence on this important issue, which will be released shortly. It is important that we try to help clarify matters for people in that position.

On the report by the Joint Committee on Statutory Instruments, the Committee will know that the underlying statutory provisions for leaseholder protections were added to what is now the Building Safety Act 2022 about half way through its passage through Parliament, in recognition of the unfair and intolerable position that many leaseholders were in. They faced bills, as has been acknowledged across the House, running into thousands of pounds to fix problems that they had no part in creating. In many senses, as the hon. Member for Greenwich and Woolwich said, those people were put into significant financial distress as a result.

The leaseholder sections were devised and drafted at pace, drawing on expertise in a number of fields, including proposals put forward by Members of both Houses. I record my thanks for their time and engagement on that. The Act received Royal Assent at the end of April and the protections came into force two months later. It was therefore both important and urgent to prepare the two sets of regulations that will enable the protections to take practical effect. The urgency meant that we were not in a position to share the regulations in draft with the Committee, as is the usual practice. That meant, however, that the Committee and its staff had limited time to get to grips with both the regulations and the underlying primary legislation in what is in many ways a groundbreaking piece of law.

None the less, we engaged in two rounds of correspondence with the Joint Committee, culminating in the memorandum and response set out in Appendix 1 to the Committee’s report. Some Members will have read that report in full—I am sure the hon. Gentleman will have—and we have seen the detail of the Committee’s concern and the Government’s response.

To summarise, the Joint Committee raised a number of technical and legal issues with the draft instrument in respect of its drafting and of its vires. The Government have considered those issues carefully, including by working closely with the first tier tribunal about the way in which it will deal with appeals. The Government are satisfied that, notwithstanding the Committee’s concerns, there are no issues with the regulations that will prevent the process from operating successfully.

As I have described, the Government consider it imperative that the regulations come into force before the summer recess to alleviate the issues facing leaseholders in defective blocks. We will of course monitor closely the progress of cases. If it becomes apparent that changes are necessary, we will come back to Parliament with proposals. Therefore, as I said before, I ask colleagues to show some forbearance. I am glad that that seems to be the case, but that hon. Members will still feed in their particular cases.

On the final point made by the hon. Member for Greenwich and Woolwich on the memorandum from the Law Officers about confirmation of the retrospection on the 28th due date, if he will forgive me, I will take that away and come back to him with a fuller response. On that basis, and given that we have considered the draft regulations, I hope that the Committee will approve them.

Again, I find myself agreeing with the hon. Gentleman. The Minister for Refugees, to his credit, also met me about the case that I raised at Prime Minister’s questions and was fully briefed on the case, which impressed me, so I thank him. But again, I agree with the hon. Gentleman that the delay was unacceptable, and I hope that it will very soon be rectified officially.

I am cautiously optimistic after hearing reports this week that the Home Office is considering changing the visa rules to allow unaccompanied Ukrainian children and teenagers to come to the UK. That would end an unjust policy that has seen siblings separated and children abandoned in the most dangerous of situations. I would like the Minister here today to confirm whether those reports are true and tell us officially if the policy has changed, and explain why it took so long, despite so much suffering, for the Government to acknowledge that it is unacceptable to bar unaccompanied children from refuge in our country.

The Times has reported that the Home Office estimates that at least 500 children have been stuck in limbo in Ukraine for two months or more because of the unaccompanied child policy. I hope that this Minister, who I know cares, will be able to tell us today how many children his Department estimates have been prevented from accessing the Homes for Ukraine scheme because of this particular policy, and how those children’s applications for asylum would be considered under any new rules that the Government are considering.

My hon. Friend is making a very important speech. Does she agree that if, as we hope, provisions are to be put in place to welcome unaccompanied children to this country, it would be useful to hear from the Minister what special support will be put in place for those incredibly traumatised children and the families acting as their hosts?

That is something that I will talk about. It is all very well to welcome people to this country, but we need to think about the lives that they go on to lead. I will refer to that shortly and I thank my hon. Friend for the intervention.

Putting aside for one moment the unaccompanied child policy, I think it is important also to highlight the broader failings in the Homes for Ukraine scheme for child refugees. I believe that, even under the existing rules on unaccompanied children, my constituent, Mark, and his wife should have been able to welcome Mariia into their home. After the Home Office had refused to approve her application, Mariia’s parents provided a notarised statement, in Ukrainian and English, giving their consent for Mariia’s 18-year-old sister, Nataliia, to act on behalf of her younger sibling, but that note was deemed insufficient by the Home Office. Mariia’s parents still did not give up, because they were so desperate to send their two daughters to safety in the UK. Eventually they were able to obtain from the local authority a legal guardianship document that confirmed that Nataliia could act as the legal guardian for Mariia, but that still did not bring Mariia to the UK. As a result, and despite repeated representations to the Home Office by my office and my caseworker, Julia, and my constituent, the two sisters were stuck in a dangerous temporary hostel in Montenegro for weeks.

Only after I raised this topic at Prime Minister’s questions a couple of weeks ago was the Home Office finally forced to review the case, but not every MP will be as lucky as me and get in at Prime Minister’s questions at a very timely moment to raise a case. That is something that the House needs to consider. I got a call from the Home Office and the Minister because I raised the case with the Prime Minister, but there are so many cases with Members across the House that need special attention. I am of course grateful to the Home Secretary for her assistance, but there are potentially more Mariias out there, trapped in war-torn Ukraine or countries where they have no family or network of support. I ask this Minister to look into that. I am concerned that even under the existing rules, these cases are not being dealt with properly or urgently, so I want reassurance from the Minister. What are the Government doing to take the necessary steps to address these failings in the refugee system generally?

Sadly, even now, Mariia has not been able to enter the UK, but I hope that that will not be the case for too much longer. It is important to recognise that when Mariia and other children like her do come to the UK, they will need more than just a safe home when they enter these shores. These children, as my hon. Friend the Member for Stretford and Urmston (Kate Green) mentioned, have experienced serious trauma. They require specialist support to ensure that they successfully integrate into their new community. People arriving under Homes for Ukraine receive a visa for three years, but currently the integration funding is available only for the first year. I hope that the Minister can confirm today whether further funding will be provided to local authorities so that they can support people for the full three years.

May I ask my hon. Friend to note the position of pregnant women and new mums and their babies, and the support for them, not just through local authorities but through the health service? Does she agree that that will need to be sustained, particularly for women who will be without a partner at that time, increasing their sense of isolation and trauma?

My hon. Friend is right to raise the plight of vulnerable women and children. The Refugee Council has warned of a growing number of people arriving under the Ukraine schemes ending up homeless, potentially including young children and pregnant women. Government data show that 480 Ukrainian families and 180 single adults have had to apply to a local authority for support with homelessness. I am particularly concerned that 145 placements under Homes for Ukraine have already ended in homelessness: 90 because the relationship broke down and 55 that never started, because the accommodation was deemed unsuitable before the refugees moved in.

I understand the Government have now established a mechanism through which those who have to leave a placement can be rematched with another Homes for Ukraine host. So far, that has proved unsuccessful: only 20 placements have been rematched. Will the Minister explain the steps his Department is taking to ensure that people arriving under the Ukraine Family scheme are able to access accommodation provided under the Homes for Ukraine scheme, should they find themselves homeless after arrival in the UK?

I will finish by saying that I am proud of my constituents. Hampstead and Kilburn is a constituency with a long history of welcoming people from all over the world, including migrants from Ireland and Jewish people fleeing Nazi Germany. The Government should work with my constituents, not against them, in their efforts to help child refugees from Ukraine. That is why I hope the Minister will give my constituent, Mark, and others like him across the UK the respect they deserve, by setting out how the Government will address the serious failings in the Homes for Ukraine scheme and wider child refugee system.

I was interested to read about the national youth guarantee. A total of £500 million was announced by the Government in 2019 for the youth investment fund, but the first £10 million of capital funding was opened to bids only just a few weeks ago. Will the Secretary of State kindly urge his colleagues to turbo-charge the delivery of that funding so that our young people do not have to wait until 2025 to enjoy better opportunities and facilities?

My right hon. Friend, as so often, is absolutely right that it is an uphill struggle for leaseholders to get together to begin legal action of this kind. He also raises the highly pertinent point that there is nothing in the Bill that prevents freeholders today from passing on costs to those blameless victims of the crisis.

Does my hon. Friend agree that there is a real opportunity here for the Department to link up with the companies registrar and companies law, and to use the options that exist there to take action early against directors who repeatedly set up these special purpose vehicles, repeatedly carry out substandard developments, and repeatedly liquidate those companies, leaving no assets for leaseholders to act against, and who it appears are in no way acted against, either proactively or reactively, under companies law or by Companies House?

My hon. Friend makes a very good point, which she has made in other debates in this place with regard to unscrupulous developers operating in her constituency. Changes to company law certainly warrant further consideration in that respect.

And new clause 23, but let me comment briefly on two other new clauses. New clause 17, which was tabled by the hon. Member for Blackpool North and Cleveleys (Paul Maynard), is about safety on stairs and ensuring that stairs built in new properties conform to British standards. He is absolutely right and I have put my name to the new clause. Each year, 300,000 people are admitted to A&E because of falls on stairs. That is a staggering figure and anything that we can do to reduce that has to be considered. This proposal is not a difficult one; as he said, it should be easy to implement and cost-free because it would be in new properties. Making sure that the stairs are wide enough and have proper handrails is not rocket science, and I hope that the Minister might indicate agreement on that in future, even if he cannot agree to the new clause today.

I just want to make it clear that nothing I am saying here is meant to try to improve harmony in the Conservative party—that is not something I want to be associated with, as the hon. Member for Blackpool North and Cleveleys indicated. However, I am more than happy to have harmony with him in promoting new clause 17.

My hon. Friend the Member for Hammersmith (Andy Slaughter) is right that there should be similar standards for social tenants in social rented properties. The Select Committee on Levelling Up, Housing and Communities has an ongoing inquiry into the regulation of social housing, and if he could drop a note to the Committee as evidence so that we can take account of his proposals, that would be useful.

I turn to new clause 23 and amendment 73 in my name, which reflect what the Select Committee has looked at. Building control has come up as an issue as a result of the Hackitt review. Dame Judith Hackitt made it clear that two of her concerns about the construction industry were: the whole culture of the industry with its race to the bottom; and—this goes alongside that—conflicts of interest.

In the previous debate, I mentioned conflicts of interest on approvals for products in the industry, with suppliers hawking products around until they found someone—a friendly approver—who would approve them. Building control is the same—it is about the developer finding someone less likely to give them difficult scrutiny. The Government have addressed that for the highest-risk buildings, for which in future building control will be appointed by the regulator. However, for all other properties the developer can say, “Yes, I’ll have you to do my building control” or, “I won’t have you, because you gave me a difficult time with the last property I built.” That is not acceptable.

We need someone to approve a building who is independent of the developer. The Committee has gone on record on that several times, and we recommended it when we scrutinised the draft Bill. So far, the Minister has come back with, “The Government don’t agree.” I hope that at some point the Government will reconsider, because that seems to be a fundamental principle and something that will make all buildings safer in future. It would provide security for the owners, occupiers and tenants that their buildings have been approved by someone independent of the developer.

This is exactly the point. My constituents are deeply concerned as a result of some developers’ unscrupulous behaviour in appointing inspectors and building control approvers who they know will give them an easy ride. My hon. Friend may be familiar with the case of New Lawrence House in the constituency of my hon. Friend the Member for Manchester Central (Lucy Powell), which has the same developer that turns up often in my constituency. The issue was not that there was a definite intent to collude with the developer but that it was easier to turn a bit of a blind eye. Leaseholders in my constituency are worried about that real issue, so I strongly support his amendments.

I am not aware of the particular scheme that my hon. Friend mentions, but unfortunately it is all too common that concerns are raised after the event about the quality of building control. It can sometimes be that an independent building control inspector approved a development, but all too often it is someone appointed by the developer, and that is not right. I am sure that the Minister will not have a conversion when he responds to the debate, but I hope that he might consider that this needs addressing in the future.

Let me turn to amendment 74, which is about the buildings in scope for the new regulatory regime. The Select Committee has been on the record as welcoming the Government’s approach to stronger regulation with the new Building Safety Regulator under the umbrella of the Health and Safety Executive. We supported all that, with one or two questions and reservations in our response on the draft Bill, but we said that the scope of that regulation should eventually be expanded to include other buildings. I think that the Government accept that in principle but do not want to lay down on the face of the Bill the other factors that might be taken into account to expand that scope of regulation at a future date.

My hon. Friend makes a very important point and his campaigning has been a significant factor in helping us to get to the right, or certainly to a better, position. We want insurers to be part of the solution, as we want everyone to be, and Lord Greenhalgh is doing great work with them. I am sure that there will be an opportunity before too long for me to explain in greater detail, with Lord Greenhalgh, to my hon. Friend and others the progress that we are making, but he is absolutely on the button in pointing out some of the mistakes that have been made that need to be addressed by the insurance sector.

I note that the Secretary of State said he would extend the right of leaseholders to challenge those who cause defects retrospectively for 30 years, but he will be aware that unscrupulous developers such as Mr Jason Alexander in my constituency exploit loopholes in company law with the result that there is no corporate entity to go after because it has been wound up, struck off or stripped of assets. Can he say what work he is doing with the Department for Business, Energy and Industrial Strategy to ensure that those loopholes in company law are closed? Can he also tell us whether the obligations that developers will now face as a result of his statement today will take precedence over their other financial obligations?

The hon. Lady makes two important points. On the first point, yes, this has been a feature. I was not fully aware, until I took on this responsibility, of how some within the development industry play fast and loose with the rules and set up special purpose vehicles, shell companies and so on to evade their responsibilities. They exhibit the unacceptable face of capitalism, I am afraid, and she is right to say that work requires to be done to bring them appropriately to account. I will be working with colleagues across Government to do just that.

A happy new year to you, Mr Betts, and to all colleagues.

I start by thanking the hon. Member for Wantage (David Johnston) for securing this debate. In my constituency, we desperately need new homes for young families to buy or rent, but I absolutely echo the comments made by colleagues this morning about the way in which the dice are stacked against homebuyers and, indeed, local authorities.

I recognise the progress over the past two or three years, with measures such as the introduction of the new homes ombudsman and the Building Safety Bill, which is going through Parliament. However, the Bill will be of limited use in my constituency, where few buildings are over 18 metres high, and where we are still waiting for cladding to be removed and replaced on some that are, as it should be. I will just take this opportunity to ask the Minister whether he can update us on assistance with the cost of replacing defective cladding on buildings that are less than 18 metres high. That is an issue in my constituency and, along with all the other problems that we have heard leaseholders are experiencing, it is a very live one.

Today I will talk about some of the issues that homebuyers in my constituency have experienced in relation to defects in their new homes, which is a problem that has been alluded to by other hon. Members. I have spoken before in the House about Aura Court in Old Trafford and the risks faced by residents from unsafe cladding, staircases and walkways, which led to the Greater Manchester Fire and Rescue Service placing a prohibition notice on the block. Two years on, many of the issues that I raised are unresolved. Meanwhile, a few yards away at another development in East Union Street, residents await the completion of a sprinkler system and remediation of several other defects. Both those developments were undertaken by the same developer, Mr Jason Alexander, through his network of companies. I have spoken about him before in the House, too. He is notorious in the north-west for substandard developments and a failure to rectify defects once residents have moved in. Similar issues have been experienced in Renton Road in my constituency, where the developer is Mr Selcuk Pinarbasi, whom I have also spoken about before.

Those homes have now been sold on to private buyers and, as was mentioned by my hon. Friend the Member for Ellesmere Port and Neston (Justin Madders), the council has therefore been advised that it needs to take enforcement action not against the developer but against those homeowners—the very parties aggrieved by failures in the system. It seems that developers can repeatedly take advantage of a planning and building control regime that creates conflicts of interest; that gives precedence to the interests of builders and warranty companies over building quality and safety; and that leaves leaseholders and often, as my hon. Friend pointed out, the local authority powerless to act.

That will continue even after the changes made by the Building Safety Bill, which does not mandate people undertaking building work to do so in accordance with plans that have been either submitted to and approved by a local authority or issued with a plans certificate by an approved inspector. The Bill provides a power to make future regulations in that regard, but we have not yet had a commitment from Ministers to bringing those forward. I urge the Minister to do so, given the widespread support for such a measure in response to the Government’s consultation. Meanwhile, if a registered building control approver appointed by the developer wrongly approves, gives a plans certificate or issues an initial notice or a final certificate, the local authority is effectively locked out of enforcement action. I recognise that the Bill creates new compliance and stop notice powers for local authorities in some circumstances, but they are hedged about with limitations.

Company law could be a useful tool in acting against unscrupulous developers and repeat offenders, but it repeatedly falls short. For example, Mr Alexander again and again sets up a new company for each development, which he then either liquidates, strips of its assets or allows to be struck off for non-compliance with registration and other requirements, leaving buyers with no body against which to pursue further action. It is pleasing to note the Bill’s inclusion of tougher provisions so that when an offence is committed by a corporate body with the connivance of a director, that director will commit the offence. However, we also need a more energetic approach to company law.

I would be grateful if the Minister supported me by using his good offices to press Ministers in the Department for Business, Energy and Industrial Strategy, as I have been doing, for a less dilatory response from the companies registrar to enforcement action, and indeed for a toughening up of company law, which I am aware Ministers in BEIS are considering to ensure that those who breach the obligations that we rightly expect of directors cannot continue to behave in this way.

I very much echo the comments on managing agents. Residents of Eden Square in Urmston have been battling their management company, Residential Management Group, for years for essential work to be undertaken, and have faced what look like excessive costs when anything is actually done. They are not alone. The Minister may have seen the report in The Sunday Times on 5 December relating to the mismanagement and greed of that organisation. Meanwhile, Mr Jason Alexander retains control of the management company for East Union Street and is trying to regain control of the management company for Aura Court, despite his long track record of failing to act.

I support the concerns raised about the weakness of the regulatory regime in relation to developers and management agents. I very much hope that the Minister will work with colleagues in the House and in this debate on how we can continue to enhance and improve protections for homeowners.

On a point of order, Madam Deputy Speaker. All Members must be as accurate as possible when they speak in the House, and none more so than Cabinet Ministers. Today, in response to my questions following his statement, the Education Secretary twice made statements that were incorrect. First, he said that

“we have made £100 million available for universities…to ensure that youngsters have digital access”.

That was not accurate. The £100 million funding is for devices for schools and some further education providers, not for universities. The Secretary of State was wrong in what he said. He also said that individual students could seek additional maintenance support from the Student Loans Company, and as far as I can tell that is not right either.

When I asked the Secretary of State about digital access this afternoon, he said that he was sorry I had missed the announcement. Well, I am sorry that he is apparently wrong about the detail of his portfolio. Have you had any indication, Madam Deputy Speaker, that he will return to the House to correct the record on these matters?

I appreciate the point that the hon. Lady is making, but it is not a point of order for the Chair; it is rather a continuation of the debate that took place this afternoon. But she has taken the opportunity to make the point that she wishes to draw to the attention of the House, and no doubt to Ministers, and she has succeeding in so doing.

I beg to move,

That this House has considered Greater Manchester spatial framework and the green belt.

I am here on behalf of all my constituents in Bury, Ramsbottom and Tottington who believe that we should do everything possible to protect the green belt. The Greater Manchester spatial framework is described as GM’s

“Plan for Homes, Jobs, and the Environment…to deliver the homes people need up until 2037.”

The Greater Manchester Combined Authority website comments:

“This plan is about providing the right homes, in the right places, for people across our city region. It’s about creating jobs and improving infrastructure to ensure the future prosperity of Greater Manchester.”

In my view, however, talking specifically about my home town of Bury, the GMSF does not deliver that. Instead, it is a charter to build unaffordable homes in the wrong place, without ensuring that the necessary infrastructure will be in place to support such large-scale construction. Furthermore, the plan ensures the destruction of large areas of green belt unnecessarily and the devastation of important wildlife habitats. It is also a guarantee of congestion on our roads, which will increase along with air pollution.

This debate presents an opportunity for Members, specifically from Greater Manchester, to tell the Mayor and the leaders of the 10 metropolitan authorities that the draft GMSF is unacceptable. More must be done to ensure that the green belt is protected within the framework of the plans recently announced by my right hon. Friend the Secretary of State for Housing, Communities and Local Government to bring Britain’s planning system into the 21st century.

Next month, the Government will launch a register of brownfield sites that will map out unused land, as part of plans to encourage councils to make the most of such land first, backed by £400 million to bring mostly unused land back into use. Developers will be able to demolish vacant commercial, industrial and residential buildings, and replace them with well-designed homes, without the delay of a lengthy planning process. Crucially, £12 billion of investment is to be ploughed into building more affordable homes.

I congratulate the hon. Gentleman on securing this debate, which is of great importance to all our constituents. I apologise; I will have to leave early for another meeting at 3.30 pm. His point about brownfield sites is vital at New Carrington in my constituency. It is a massively contaminated site, but one with great potential. We will need very substantial investment to undertake the necessary remediation.

Will the hon. Gentleman join me in urging the Government to ensure that all the funds we need to remediate those brownfield sites are made available to Greater Manchester? Otherwise, it will be difficult for us to build the houses we need in the places where they could be constructed.

I am sure the Minister will comment on the hon. Lady’s intervention when rounding up.

Given the drive to regenerate our town centres—through building beautiful, affordable homes more densely, in part—it is clear that the green belt in towns such as Bury is being sacrificed unnecessarily. The local environment of the residents of Tottington and Walshaw, and in the vicinity of Elton reservoir, is being decimated because the local council is a signatory of a planning document that is not fit for purpose. It has no plan to take advantage of the funding opportunities provided by this Government to reclaim and build truly affordable houses on brownfield sites.

There are three questions in the hon. Gentleman’s intervention. I have already commented on the funding that the Government are making available to assist local authorities in remediating brownfield sites—that will be very important. The question comes down to housing need. It is the easiest thing in the world simply to say, “We need to build more houses,” but we need a robust formula that allows each local authority to build the number of houses that they need and where they need them over the course of a local plan. I am making the point that using the most up-to-date population projections reduces the need to build on the green belt, and in my borough—I am sorry, I cannot comment in respect of the borough of the hon. Member for Stalybridge and Hyde (Jonathan Reynolds)—that would allow properties to be built on brownfield sites.

The question, though, is the “brownfield first” policy. “Brownfield first”, again, is a statement, but there is nothing within the GMSF to force councils to build on the brownfield first. If the GMSF was in place, the green belt would undoubtedly be concreted over and no developer would be interested in building truly affordable homes on brownfield sites.

Coming back to the point, we have to build homes for people who need them, at a price that is affordable, in the right place. In the GMSF in respect of Bury, there was virtually no comment regarding building affordable flats in the town centres within my borough. That is one of many reasons why I believe the document is not fit for purpose.

Will the hon. Gentleman join me in asking the Minister—this is slightly tangential to the GMSF, but none the less pertinent—to look again at permission in principle? That is also being used in my constituency by developers as a means to try to build on green belt where the planning and obligations that the developers are required to meet are much less rigorous, and both the public and the planning committee have really no say in stopping such applications. Will he join me in asking the Minister to look again at that particular regime and what it might mean for building on the green belt?

Again, I thank the hon. Lady; that it is a very strong point, and I am sure the Minister will address it in his closing remarks.

As you can probably tell, Ms Noakes, I could talk on this subject at great length, but a number of other hon. Members wish to speak. I have been contacted by numerous constituents, so in bringing my contribution to an end I ask the Minister to comment on the following points, which they raised.

First, does the Minister agree that housing occupancy rates should be used to calculate how many houses we require in Bury and elsewhere? The average occupancy rate, I believe, is 2.35 persons per home in Bury, against the national average of 2.4. For example, that would mean 5,733 new homes needed within the metropolitan borough of Bury, rather than the 9,500 currently indicated in the GMSF. That is taking into account the 2,000 current offset, and it would be the case even using 2014 figures.

Secondly, returning to a point that has already been raised, will the “brownfield first” policy be made a legal requirement, which it has to be if it is to have any teeth? How can local authorities access national funding to assist in clearing toxic sites and making them financially viable for development, which they have to be? Those sites are the ones where we can develop truly affordable homes. We must be aiming to build homes that are innovative and green, but that are truly affordable for £40,000, £50,000 or £60,000. We must have a real vision for ensuring that we have the houses our populations need.

Thirdly, what measures are the Government taking to ensure that developers contribute to local public transport and infrastructure requirements? Fourthly, what measures are the Government taking to ensure that there are no further impacts from flooding as a direct consequence of the construction of roads and housing? In my seat, it is proposed to build on fields within Walshaw. Those are areas that flood, and have flooded in recent times. If we build there, that is only going to get worse.

Finally, the Government are committed to protecting, restoring and expanding natural habitats. How can sites in GM gain access to the Nature4Climate fund to ensure the preservation of local mosslands and woodlands?

The one thing that all our areas have is vociferous, committed and passionate community groups, who have been at the forefront of the fight to protect the green belt. I finish off by paying tribute to the Bury folk, numbering in the thousands, who are passionate and determined to protect their environment, to protect their community and to do what they feel is best to ensure that we all have a positive future.

My right hon. Friend is heavily involved in the Building Better, Building Beautiful Commission, and I commend its superb report to anyone interested in these issues. One point it raises, which we will now be taking forward, is the need to mitigate against the urban sprawl and the damage to the countryside we have seen over the past 50 or 60 years and more.

The answer to that is gentle density in urban areas, building upwards where appropriate—perhaps where there are existing clusters of high-rise buildings—and, building gently where building upwards is not appropriate. There are plenty of examples in the report of where that can be done in an attractive way that local communities could support. We need to ensure more homes are built in our town centres and around our high streets. The high streets and town centres fund that we have created through the £3.6 billion towns fund provides funding to many parts of the country to do exactly that.

I look forward to the forthcoming building safety Bill. As the Secretary of State knows, homebuyers in my constituency have had some very poor experiences of safety issues in their new homes, but can he explain how the Bill will bring about not just tighter regulation but culture change in the industry, upskilling of the workforce and adequate resources for enforcement and local authorities?

All those things need to happen. We are undergoing the greatest change in our building safety regime in most of our lifetimes. That will take time and will require a significant change in the culture of the industry. The new regime, which is now being established in shadow form and will be legislated for later this year, will place new duties on those involved in the construction industry and on those responsible for looking after buildings once they have been built.

An individual or entity will be criminally responsible for safety, from the moment construction begins, throughout a building’s occupation, many years into the future. That will be managed through our building safety regulator, which will sit within the Health and Safety Executive. The HSE has a lot of experience in this field and has seen significant changes and improvements in safety in other fields, such as oil and gas, in our lifetime.

I congratulate the hon. Member on the debate. Does he agree that it would be good for the Government to look again at permission in principle, which means that councils have even less grip on strategic planning control and residents have absolutely no means of complaining, raising objections or having their concerns taken into account?

I certainly agree that it would be desirable to get rid of outline planning permission, which many developers use to get a foot in the door and then have councils over a barrel. However, if we are going to give councils the power to have a proper plan-led system, we need to ensure that we have a better system for development to pay its own way.

Part of the opposition to new housing comes from the fact that too often it comes without the necessary infrastructure. Without new schools or roads, the GP’s surgery and everything around the new housing becomes more congested and, of course, people object to that. People see developers making humungous profits while the infrastructure is either not provided at all or the cost is dumped on the taxpayer.

Section 106, the way in which councils currently get developer contributions, is totally dysfunctional. Councils cannot use it to fund recurrent expenditure or anything that meets an existing need in the community. It can only fund a new need that is tied to the new development. Contributions are tied to specific purposes, so if what the community wants changes in five years’ time, that is tough luck.

Given that collection is fragmented among lots of authorities—fire, police, health, county and district councils—developers sometimes get away without paying. They can hold off making payments by staying below certain trigger thresholds, and if they are able to hold off for long enough, the opportunity to build a new village hall, for example, is often lost. If a community has only rolled up enough contributions within a specific time period to pay for half a new school, for example, then it gets nothing and the money goes back to the developers. In 2014, the BBC found that councils had returned to developers £1.5 billion that had been intended for the community. When my constituents read that, they are outraged.
